distraction from flashing lights. we'll follow this on the peninsula and more coming up. this morning the death of north korean leader. right now they are referring to kim jong il's successor. his third son is in his 20s. in the meantime, the south korean president is holding emergency national security meetings to monitor the situation and asking people to continue with business as usual. kim jong il died suddenly while traveling from a heart attack. for two decades he defied leaders by launching surprise attacks on south korea.

a surprise ending to services for church goers leaving a late night service. a van crashed into the side of a full gospel fellowship around 10:00. witnesses say the van, the parked van sped off and slammed into an empty children's nursery area. toys and books tossed around. luckily no reports of injuries. fire crews erupted a short time later. police are still investigating the accident. investigators try to figure out what caused a small sesna plane to crash into an airport. no word on injuries. last wednesday police pulled over a driver during a traffic stop. the suspect fled, then turned around and fired a handgun.

he died a short time later. the community meeting starts at 4:00 this afternoon. a convictioned sex offender who kidnapped and raped a woman is mind bar this is morning. 45-year-old steven clark was taken into custody saturday after he was spotted at the intersection in san francisco. he's been booked into jail on kidnapping and rape charges. he was spotted in san diego last week. police say they have credible information that 38-year-old steve ruiz was in san jose within the past couple of days. ruiz has been on the run since the deadly shooting of hell's

angel member during a funeral service at oak hill cemetery on october 15th. he is considered armed and dangerous and has known ties to gilroy, campbell and fremont. california's three strikes law which some say is the toughest in the nation may be scaled back. an advocacy groups wants to place an initiative in next year's ballot to scale back the law. 28 other states have similar laws, but only california allows a third strike to be a felon. the initiative would restrict the third strike to certain hardcore criminals. it would save them millions of dollars each year on reduced prison population. this morning it appears the state's budget deficit is shrinking. last week governor jerry boun anonsed a million dollars in state spending cuts. that means the new projected deficit is $13 billion. much lower than a couple years ago when the state budget hovered at $42 billion.

of course, lawmakers and budget analysts say a combination of more cuts in the coming months along with the governor's tax plan could live the state out of the red in the next 12 months. now once completed on all sides of the bay bridge, it will become the world's longest suspension plang. it will take two days to complete the job. construction is expected to end in 2013. it is 4:36. the east bay's largest labor organization is holding a press conference in support of oakland mayor jean quan. they have adopted a resolution opposing measures against recalling quan. they say it would distraction against the crucial task of the constructing of finances. the press conference will be

good morning, everybody. rise and shine. here's a live look at the empty golden gate toll plaza. here comes the cars around the corner. it is 4:42 this morning. a new stage in iraq's history. the last convoy of u.s. troops rumbled across the border of iraq and into kuwait early sunday morning, marking the end of the war. details of the last convoy's departure were kept secret to ensure the safety of the soldiers. 4,000 soldiers will remain in kuwait, helping to finalize the move out of iraq. the nine-year war claimed the lives of close to 4,500 u.s. soldiers and 100,000 iraqis. this morning a key vote on capitol hill could undo the deal

when it comes to payroll taxes. for more on what you need to know about the deal and the other news before the bell, we turn to jackie deangeles live at cnbc world headquarters. good morning, jackie. >> good morning to you. the futures have turned higher this morning. bounces off of earlier losses in concert with the asian markets that fell on the news that uncertainty resultg from the death of korean leader kim jong il. they dropped as much as 5% overnight. wall street is coming off a down week as stocks stopped a two-week win streak. we get reports on housing, consumer sentiment, personal income and spend. and the final estimate of third quarter gdp as well. the dow slipped two points to close at 11,866. it fell 2.6%. the nasdaq closed at 2555. it fell 3.5% on the week. if the senate's bill to extend

all week long. a u lot of kids have this week off. they can go outside and play without worrying about the rain. 49 in hayward. it is mild. the reason why is because we have high and mid-level clouds overhead and fog developing as well. nothing below five miles of visible. we're looking good across the board. what we do accumulate in terms of low cloud cover is going to clear out by 10:00 a.m. then we'll see more fog roll back in. a high about 8:00 p.m. nothing too heavy. that building breeze that we see later on today will help the to clear all that cloud cover out. so we're not going to see too much of it. tomorrow looking pretty good. a little bit more sunshine in the afternoon will make for warmer conditions. 60 degrees in san jose. meanwhile, 57 in san francisco. really not too bad for this time of year. right on track with our seasonal averages. as we head through the next few days, no major changes or swings

welcome back to you. taking a live look outside. can you even make it out? that's the bay bridge approaching this morning. no one on the the roadways. it's still early. 4:52 now. this morning parents have a new tool to make sure tb presents under the christmas tree are safe for kids. the federal government is using tougher standards to check for led in toys and all children

products sold in the u.s. will have to go through independent third party testing. that testing process won't happen until after the holidays on january 1st. before then parents can report problems from products and get company responses from a new website from the consumer product safety commission. that website is saferproducts.gov. it is 4:53 now. it is the monday before christmas. that means plenty of people packing their bags for those holiday trips. this year aaa says nearly 92 million people will travel 50 or more miles from home. it's up 1.5% over the number of people traveling last year. holiday travel this year is expected to be the second highest in the past decade. >> most of those people probably warm in bed still.
