>> and i'm marla tellez. looks to be shaping up to be a nice monday. christina loren is back ready to give us the forecast. >> yeah, you know. this is the last week of fall. we're going to start to transition to winter. the solstice is 9:30 p.m. thursday night. it's starting to feel more like christmas around here. your afternoons are getting very chilly. temperatures only averaging 58 degrees even in san jose this time of year. as we head throughout the day today, that's what we're going to see on par with our seasonal averages. we have visibility issues out there this morning. that is due to fog from fairfield and napa. take it easy. we'll keep watching this for you all morning long. any problems due to fog on the roadways? >> none reported. but we will track that. we'll get a live look out there. there's no fog. but there's a disabled vehicle reported on the westbound direction, that's with the taillights somewhere along the

span. we'll see what chp turns up. hopefully nothing. that's always good news. it means it's being cleared. the bridge crew will give us an update in a few seconds. this morning the death of north korean leader kim jong il is sparking concern over who is in control of the country and the nuclear program. >> we're learning north korea launched a short range test missile off the country's east coast. north korean military leaders insist it's part of a routine drill. right now north korean state tv is referring that kim jong i'l' son as the great successor. he is his third son and in recent years has been groomed to take over the country from his father. the south korean president is holding emergency national security meetings to honor the situation. he's also asking people to continue with business as usual. the korean stock market did fall after the leader's death, but

not drastically. >> he reportedly died suddenly on saturday while traveling. allegedlied from a heart attack. his funeral will be next week. for two decades kim defied international leaders by increasing his country's nuclear ambitions and launching surprise attacks on south korea. a surprise ending to services for church goers leaving a late night service in hecules. a van crashed into it around 10:00 last night. a parked van sped off, slamming into an empty children's nursing area. luckily there were no reports of any injury ls. fir crews arrived and checked for building hazards. san francisco police will hold a community meeting over a recent fatal shooting. last wednesday police pulled over a driver during a traffic stop in a lower knob hill

neighborhood. the suspect ran away, then allegedly turned and fired a handgun. officers returned fire severely wounding the suspect. he died a short time later. the community meeting will be held at the northern police station on fillmore street. it begins at 4:00. a convicted sex offender who police say kidnapped and raped a woman in oakley earlier this month is behind bars this morning. 45-year-old steven clark, seen here, was taken into custody saturday after he was spotted at the intersection in san francisco. he's been booked into jail on kidnapping and rape charges. clark had been the focus of an intense man hunt sbins being spotted near san diego last week. 5:03. foster city police are looking for a suspect involved with a mysterious death. last friday police found the body of a man in a home. the death was initially called suspicious. but investigators later say he

was murdered. there are no details of a suspect or the cause of death. anyone with information on this case is asked to call the foster city police. this is the city's first murder since 2006. reports of a biker accused of killing a fellow hell's angel member was spotted back in town. they have credible information that 38-year-old steve ruiz was in san jose within the last couple of days. he's been on the run since the shooting of steve townsend during a funeral service on october 15th. he's considered armed and dangerous and has known ties to gilroy, campbell and fremont. san francisco mayor ed lee afrounsed annishishtive to provide housing for homeless.

he made a private donation of $1.5 million, which the city matched. it will pay for an estimated 200 homeless families. >> one of the bay area titans zf moving. facebook is leaving for the corporate headquarters a few miles away. damien trujillo joins us live outside the new offices. good morning. >> reporter: good morning. they moved a few miles down highway 101 to menlo road. they're overlooking the san francisco bay. we're at the west end of the dun baren bridge to give you an idea of where facebook headquarters are located. for several years they've been located in buildings scattered throughout palo alto. the company felt it was time to move into its own place.

beginning today, all employees will be driving onto willow road in menlo park. there are a lot of amenities for the employees so they don't have to go too far to get the gourmet coffees or lunch. if it's anything like google, the employees won't need to leave the campus at all. that's why there's criticism about how much economic impact the facebook headquarters will have on the local economy here in menlo park. the next big step for the social networking giant is going public. that's expected to happen toward the middle of next year. so a lot of things happening at facebook. what do you think? do you like the new status update for facebook? >> i'll have to go out in person and check it out. especially the gourmet coffee bar if you know what i mean.

thanks lot. >> a new milestone for the bay bridge construction project. this morning crews will install the first span for the eastern span. once completed it will become the world's longest suspension plan. it will take about two days to complete this portion of the job. construction of the new bay bridge is expected to end in 2013. 5:07 now. this morning the east bay's largest labor organization holding a press conference in support of oakland major jean quan. alameda labor council adopted a resolution opposing recall efforts against mayor quan. counselor says it would distraction attention from the crucial task of confronting the economic crisis in oakland and create an additional financial strain on the city. it will be held at 11:45 this morning. >> we're in for a nice monoto start off your workweek. time to check that forecast.

good morning. >> good morning. we are in for nice weather this week. we picked up the showers. that cleared out the air quality. we're not sparing the air. it is getting cold. fairfield and concord we have very cold air this morning and fog as well. so you want to take it easy out there. there's really thick fog until 10:00 a.m. this morning. so proceed with caution. as you can see right now. we can pick up a little bit of the nothing in napa and fairfield. the visibles have dropped off substantially. your down to a mile and a half now in both cities. eight miles in concord. expecting that to fall through the next hour or so. we stop the clock at 9:00 a.m. a lot of sunshine coming in will keep your temperatures on the mild side for today. a couple of 60s in the south bay. mostly the upper 50s with a building breeze. by tomorrow a little bit warmer. more sunshine early on. and your temperatures are not too bad. 60 in san jose.

welcome back, everybody. a live look at an empty golden gate toll plaza. looks to be a clear morning. time to check the forecast with meteorologist chris tie na loren. >> looking nice and clear. we are expecting the fog to develop between the hours of 8:00 and 10:00 in that region. overall we're looking good. whatever fog does develop will not hang around until noon. high pressure is the reason why. and high pressure is keeping the whole western united states nice and mild through the next few days. temperature wise we're going to hold onto the upper 50s and low 60s. we have no rain in the forecast. u till zroping off in airfeel and napa but looking good across the board.

we're still not in the quarter mile range just yet. we are expecting that throughout the next few hours. 45 in novato. you're at 43 in oakland. 47 in san mateo. you're olding onto the mid and upper 40s along the peninsula. even in the east bay. fairfield and concord starting to drop off. we'll be at 56 at 2:00 p.m. we'll round out the day. the highs at 4:00 p.m. 61 today in los pz gatos. this shows you what i was saying before. no major swings in your temperatures. no rain in the forecast. and nice and mild and dry through christmas. through next week, looking a little bit more active, but this is the last week of fall. it's going to stay nice and fall like around here. temperatures in the low 60s and a lot of sunshine. >> we have a lighter volume of

traffic. right now no delays as far as these northbound sensors go through the south bay. i'll zoom into an area where some expect the construction to go on over the last hour. it has cleared early. the connector off of southbound 880, westbound 237, that is all cleared heading over. they picked that up at 4:30 this morning, so it hasn't been a problem for a half hour, 45 minutes. we have had this accident a deadly accident that occurred overnight southbound 280 at farm hill boulevard. that exit was closed for a few hours. it reopened. there was a second property damage only to the car involved. separate accident there. that may still have activity on the scene. but the off ramp it has opened on the peninsula. we have a nice, easy drive on the southbound area as you're coming through. let's get off of this map and go to the san mateo bridge. we'll see how traffic is shaping up coming off the high-rise off 101 to hayward.

it looks like the bridge crew went across and didn't find anything of note. i'll continue to track this bridge. that's a clear view for the lights across the span. now problems into no the waldo tunnel. a smooth drive here as well as the rest of your bridges so far. >> thank you very much, mike. it's 5:16 now. app makers are scrambling to beat apple's holiday deadline. each year around christmas apple stops accepting app submissions and updating the store, this year the deadline is thursday, anyone who misses it will have to wait until after the holidays to get their apps into the apple store. christmas is the biggest day of the year for app sales. developers are cramming to get their latest apps finished in time. facebook is trading lawsuits with another mark zuckerberg. but this mark zuckerberg didn't go to harvard.

he didn't found facebook. he's an israeli social media entrepreneur formally known as rodam who changed his name earlier this month and now facebook is suing the former guez, saying he violated terms of service tw the business he cofounded. that's the like store. it helps people in businesses increase their likes. the form, guez is suing back for shutting down his like store profile saying facebook had no right to do so. it is the last full trading week of 2011. for more on what to expect pfr the opening bell ring this is monday morning, let's turn to jackie deangeles live at cnbc headquarters.

>> wall street is coming off a down week as stocks snapped a two-week win streak. there's a fair amount of economic data as well. we'll get reports on housing, consumer sentiment and personal income as well as the final estimate of the third quarter gdp. the dow slipped two points to close at 11 rkz 866. the dow fell 2.6% last week. the nasdaq rising 14 points on friday to close at 2555. it fell 3.5 pk on the week. this thursday will be the busiest shipping day of the year with an estimated 26 million packages. ups is expecting to process 25 million pack jjages on ere day this is week. they credit online shopping for the big boost to the business. and groupon is thinking locally. they are offering a $10 credit to the first 150,000 people who buy a local groupon by christmas

eve. amazon is giving a $5 discount to find a lower price on the website. >> thank you very much, jackie. it's 5:18. we've seen a lot of economic woes. they will lose $980 million in trigger cuts. one of the programs that will see a lot of change will affect california's youth offenders christie smith is live in oakland with more on the story. good morning, christi. >> good morning to you. caring for the youth offenders is expensive. about $200,000 each according to state figures. that is to supervise them, house them, educate them, feed and clothe them until they're at least 25 years old. governor jerry brown is now proposing a major shift that might put more of the burden on counties to pay for them in state lockups. this according to the oakland tribune. right now alameda county pays $500 million a year for each of

them. brown wants at least $125,000, which would be about $6 million a year for alameda county. these possible trigger cuts were announced tuesday and follow a trend of responsibility shifting from the offenders. the chief here has a different plan. he's talking about putting them under local supervision and asking the state to give money to this the county to help to them to the tune of $150,000 each. now they're building a new camp to house serious and nonserious youth offenders. a judge would have to okay all of this. and the cuts at this point are still somewhat in limbo, at least how they would affect al me dpa county. i'll sends it back to you guys in san jose. thank you, christi. this morning plans for a

public memorial service are in the works to honor the life of a bay area billion philanthropist. it will be held on wednesday in san francisco. the 77-year-old died from complications linked to leukemia treatments. he made a fortune as an investor. he also started the annual hardly strictly bluegrass festival in san francisco. this morning a south bay donation center says every box of food and toys is now spoken for. they are ready to hand out a record number of food boxes and toys to families for christmas. look at the the people already hovered outside. ju to be in line to receive the first boxes. the nonprofit says more than 3,000 boxes of food and 16,000 toys will be handed out this week. every child should have a toy.

welcome back at 5:24. this morning parents have a new tool to make sure parents under the christmas tree are safe for the kids. all childrens products sold in the u.s. will have to go through independent third party testing. that doesn't happen until january 1st. before then parents can report

problems and get information from the website safety commission. that is saferproducts.gov. 5:24. a saudi arabian prince has a lot more. >> he went to college on the peninsu peninsula now he's a major investor in twitter. he paid $300 million for a portion of twitter. hard to say what percentage he owns. it's not clear how much twitter is worth. it's estimated about $8 billion. that would put his investment far less than 10%. not his first high-tech investment.

there are a number of foreign investors getting involved in american media. he also owns a big part of fox news channel and the wall street journal. this gives some of them pause as saudi arabia and russia from covering uprises and protests. in fact, he probably made a fair amount of money. but few others did. the share price fell in the first day of trading on friday. so we'll be watching that company very carefully. some companies will sell their stock at say ten, but then say it jumped to 30 on the first trade. they could have gotten the $30, but they got to stick with the ten. so many many ways it was perfect for zynga. not so much for investors. >> it was interesting to watch. thank you. >> 5:26 now.

accident for oakley. this is the highway 4 bypass around laurel road. this could be an issue as folks are heading over to tan tee i don't care, for example, where we're seeing early signs of that slowing. . police believe a hell's angel accused of killing another in october has resurfaced in the south bay. now officers are asking for your help to try to find him. bob redell joins us live with additional details. good morning, bob. >> good morning, laura. this is the man police are looking for. his name is steve ruiz. he's a 38-year-old member of the san jose chapter of the hell's angels. he was spotted in san jose, a siting over the past few days. officers aren't giving more specifics other than to say they do have, quote, credible evidence he was in town. not clear if he has since left.

at okay hill cemetery in san jose. he was shot and killed by a member of the biker gang. ruz has been at run ever since. had been driving a pewter covered gmc yukon and an older model toyota four runner. they do consider them arm and dangerous. not the type who is a threat to the general public. they believe this shooting was an isolated incident. they also believe ruiz has ties in fremont, campbell and gilroy. marla? >> okay, bob. thanks. 5:32 now. a surprise ending for church goers leaving a late night service in hecules. a van crashed into the side of if full gospel fellowship on willow avenue.

this happened at 10:00 last night. witnesses say the driver was speeding away when he slammed into an empty children's nursery area. it was a mess inside. toys and books were tossed around. many were destroyed. luckily no reports of any injuries. fire crews arrived a short time later and checked for any building hazards. police are still investigating this accident. this morning investigators are trying to figure out what caused a cessna plane to crash into a the airport. no word on any injuries. only three will be on the plaza as a symbolism of the movement. the city council earlier offered to drop charges against demonstrators if they didn't

pitch tents for the next two years. protesters say the latest move is a compromise. the world's largest social networking site is changing its address. damien trujillo joins us live with more on facebook's new headquarters. >> the new headquarters of facebook overlooking san francisco bay. the new headquarters is only a few miles away from the hold headquarters on the west end of the bridge. now beginning this morning more than 2,000 facebookers will file into the facility at menlo park. for seven years facebook has been located in buildings throughout palo alto. the company felt it was time to get its own digs. that workforce has expected to grow to more than 9,000 in just over two years. the offices are cubicle free. employees can swivel in their

and christmas day. right now we are watching for deep pockets of fog starting to drop off in places like concord and liver more. really up in napa only half a mile of visibility. expecting more of the same through the next two hour ls. once the sun comes out we don't have to deal with fog very long. i think between 9:00 and 11:00 it will clear out. 44 in santa rosa. 48 in san jose. 45 in gilroy. we have absolutely no problems, no storms on the way. that means if you're headed to the forcorners region for travel, you don't have to worry about storms following you. we'll see a little area of low pressure start to dig in after christmas. but nothing in the forecast in terms of showers. all the way through sunday. it works out like this for today. your temperatures will climb into the upper 50s and 60s. 60 in san jose. 60 in livermore.

57 in san francisco. the warmest spot will be up through the napa valley. 65 in santa rosa. warmer than average with a lot of sunshine coming in early. 57 in gilroy. >> we'll give you the update on the highway 4 bypass accident. it involves a motorcycle from what the report says. however, it's off to the shoulder. chp still has yet to get there. we'll dpet more details. we're looking at highway 4 itself. this is not going to clear. s the going to get worse. we've seen the kickoff wb from g-street to summerville and making its way back to hill crest. slower speeds into the 50s and now the 40s in some spots. bay point in pittsburgh is not a problem. over across the bay, we're looking at the venecia bridge and the carquinez.

not a problem as far as the drivers are reporting just yet. that's that portion of the north bay. other portions is 101. let me pull up travel times. we see southbound. speeds so close to 60 and closer to the limit at 65 through san rafael and towards the golden gate bridge. crossing that bridge is no problem. the san mateo bridge is also looking good. a nice easy drive in both directions between 101 and 680. >> coming up, the death of kim jong il. is it the dawn of a new ere rar for north korea? or will more of the same still rain? we'll have a live report just ahead. >> also a woman is set on fire inside an elevator. why a man sprayed her with gas and then ignited it. today in the bay's tracie potts joins us live from washington, d.c. this morning with a look at reaction to the leader's sudden death. good morning, tracie. >> good morning. good morning, everyone. we got word this morning that north korea fired a short term, short range missile just before hi death was announced. that may have been part of a routine test. the military in south korea has yet to confirm what the news agency is reporting. the 69-year-old leader died of a heart attack while on a train trip on saturday. but the news came out late last

night. an autopsy has been performed, confirming his funeral will be held a week from wednesday. who will now take over? it looks like his son will take over. he is being called on state tv the great successor. it's not been made official. he's young. he's in his 20s. he's the third son. he's been groomed for the position. what about his nuclear program? what about security and stability in the region? president obama on the phone with south korea's president last night assuring him that 20,000 plus u.s. soldiers in the region in south korea will work to secure their stability. national security teams have been in touch. south korea's military is on high alert. laura? 5:47 this morning. a new stage in iraq's history. the last convoy of u.s. troops rumbled out of iraq and across the border into kuwait early

sunday, marking the end of the war. details of the last convoy's departure were kept secret to ensure the safety of the soldiers. at least 4,000 u.s. soldiers will remain in kuwait for several months, helping finalize the move out of iraq. the nearly nine-year war claimed the lives of close to 4,500 u.s. soldiers and 100,000 iraqis. it is 5:44. this morning new hope there may be more survivors after an oil rig sank in freezing waters off the coast. the owners say they were spotted in the area, but the government has not confirmed the report. 67 people were on the oil rig when it capsized in the storm yesterday. 14 people were rescued. dozens are still missing. four boats, a helicopter and airplane continue to search for survivors. the man accused of burning

to death a 73-year-old woman did it as pay back for a debt she believed owed them. it shows the man spraying the woman with a flammable liquid on saturday. and then backing out of the elevator as he set a rag in a bottle on fire and tossed it in. 47-year-old jerome isaac turned himself in. she owed him $2,000 for work he had done for her. >> the future of florida's a & m president is on the line. they will consider whether to defend him. the meeting comes after the state and medical examiner ruled robert champion's death a homicide. officials say the 26-year-old was beaten so severely that he bled internally and went into shock.

california's three strikes law what is the toughest in the nation may be scaled back. they want to place an initiative to scale back the state law. 23 other states have similar three strikes laws. only california allows a third strike to be any felon. the initiative would restrict the third strike to certain hardcore criminals. officials say the move will save taxpayer ls millions of dollars each year. this morning it appears the deficit is actually shrinking. just last week governor jerry brown announced a billion dollars in spending cuts to state programs which means the new projected deficit st $13 billion dlu the next fiscal year. much lower than a couple of years ago when the state's budget gap hovered at $42 billion. lawmakers and budget analysts say a combination of more cuts in the coming months along with the governor's tax plan could

lift the state out of the red. winter is quickly creeping up on us. christina loren joins us with that. >> fall is such a beautiful time in the bay area. all the the leaves are changing color. t going to be nice all the way throughout the week. we don't have storm systems slated to bring us rain if you have the kids home on christmas break and they need to get outdoors. they're going to get many options to do so all week long. we have really thick fog up in napa. elsewhere looking good. we have a half mile here of visibility elsewhere. above five miles. so we're looking pretty good. we're going to keep watching that for you throughout the morning hours. temperature wise right now, it is nice and mild. not too cold except for next to the delta. we have some cold air and fog drifting in through the sacramento valley this morning. as we head throughout the day, we'll see areas of fog and a building breeze, offshore winds will develop. that will push all the fog out
