heater. it's cold. 26 degrees iti fairfield. your heater is working overtime this morning. you were able to give it a break at this time in the north bay. we had the 50s. we're 30 degrees cooler in some cities up there. and we have a freeze warning in place in the southeast and north bay until 9:00 a.m. after that we'll see a gorgeous day. i'll take you to the forecast. 6:01. now back to you guys and the top stories. being christmas eve eve, so many people are traveling on this busiest travel day of the year. pack the patience if you're headed anywhere. including the airport. it's the busiest day there. we have a live look at sf ork. we're joined by airport spokesperson michael mccarren. good morning. how are you. >> good morning. merry christmas. >> to you as well, mike. always good to see you. the crowds don't look too bad. i imagine it's going to pick up.

>> that's right. it's going to be a very good year for us. the last two weeks we're finishing with a strong flourish. about 2 million passengers. we expect 134, 135,000 traveling out it have gates. it's going to be busy. we have great weather right now. we should have no trouble getting people to their destination. >> always good. it's a good idea for folks to plan ahead, check ahead as well. we heard from you earlier in the last hour of the broadcast this morning that you may think you know you won't have any delays. but that plane is coming from somewhere else. >> right, it could be starting in new york or philadelphia. check with the air carrier before you leave the house. they'll have the most current information about the status of the flight. fortunately my weather briefing looks like most major airports are operating smoothly.

in the northeast, midwest, southeast can change rapidly this time of year. >> and across the nation, really, airplanes aren't seeing as much travel as we've seen an increase at sfo. they've been able to buck the trend by adding several new carriers to the roster. 5.5 more available seats. so you're running pretty good this time of year. >> we're very fortunate. we're having a terrific problem with having more passengers in most airports. a couple of weeks ago in port vallarta. other places in mexico city and places such as that. >> we'll check back with you. what's ironic is you probably never get to travel on this day.

>> i'm usually at the airport but not traveling throughout the day. >> an overnight shooting reported at an east bay parking lot. this shooting happened after 10:00 last night. new video overnight. officers say the victim of the shooting was well enough to drive himself to a nearby hospital. this is the same parking lot where a man was shot on black friday. the suspects in that case are now under arrest. and the victim is recovering from a leg injury. senatoring january 1st they will implement a new alarm policy. the police chief sent out this postcard, informing business owners if the alarm trips police will not respond unless someone calls to verify that business is being burglarized.

98% of all calls are false alarms. that's why policy changes had to be made to work with the department's limited resources. >> you expect me to walk in here with a shotgun? shoot at people? i don't want to go to jail for that in the end. it's not worth it. >> san jose isn't the only city with a policy in place. fremont has a similar policy in places like seattle and detroit. >> a devastating day for dozens of people in san francisco. . the flames raged for hours. hundreds tried to gain control. 60 people lost everything days before christmas. entire buildings gutted by the flames. residents escaped the blaze with the shirts on their back. they are grateful everyone made it out alive. >> we had one gentleman asleep in his apartment. he had to come down the fire

escape out of his unit. we're glad he's alive. >> spokes spent the night in hotels and at a nearby evacuation center. firefighters working through the night, checking for hot spots after this fire in vallejo. three alarms started near highway 37 yesterday afternoon. luckily no homes were damaged. nobody was injured. ballistics tests on the gun involved in a fatal murder lead to murder charges in a completely separate case. this was the scene when a san jose police officer shot and killed galindo in his home. the same gun was used to kill 29-year-old valerie casillas back in october. the alleged murder weapon finally in hand, police charged the husband.

23-year-old marcus casillas with murder yesterday. police believe galindo and casillas are connected. >> a 7-year-old boy who died after fallg from a ski lift has been identified. john henderson fell sunday from the mount lincoln express ski lift. they identify the parents as mark henderson. and helen chu leads the university's cancer center. >> what a tragic loss for them. a sfran is -- a san francisco man is facing felon charges. he stole the identity of a physician assistant and used it to operate the derma clinic on mission street. a daly city woman went to police

after a botched liposuction. she says he smoked a cigar during the procedure and asked her to hold her own iv bag. when he was done, he flushed six pounds of fat down the toilet. he is facing a slew of felon charges and 12 years in prison. 6:07. thou shall not steal. especially from nuns. a woman is charged with embezzling $165,000 from the nuns. she allegedly used a credit card belonging to the sisters of the holy name's convent. gomez had worked at the convent since 1987. the sunnyvale woman accused of buying products online and then returning the items to stores for up to $47,000 in cash. she's scheduled to appear in court on january 10th. tonight pg&e is coming clean and admitting for for one of the

power outages. they say the first outage was caused by the failure of a slice on the the power line. the second was a malfunction of the stadium's blackout power system. crews will replace the switch ahead of the team's first home playoff game since 2002. they are modernizing operations as recommended by the ntsb. they are operating 1600 miles of pipeline at the maximum allowable pressure using an updated emergency response plan and implementing data management systems to keep track of records. the explosion in san bruno prompted all of those changes. 6:09 right now as we look across the country for flight delays. let's check in with christina loren. >> good morning. the good news is we are on time out of every major airport

across the nation. we'll continue to check on that every ten minutes for you. a lot of people hopping on a plane today. we have interesting things happening. we have a trough of low pressure trying to nudge the way through the bay area and falling apart as it does so. the high clouds are going to make for a phenomenal sunrise. if you're up right now, and you can hold onto another hour before you go back to sleep, i know a lot of you on vacation, we're going to see a pretty sunrise. from the south bay to the north way. we have to get rid of the frost. it's cold out there. and we are going to do so quickly. the sun will be out at 7:22. we'll warm up to the mid 50s by noon. until 9:00 a.m., temperatures below the freezing mark in the north bay, east bay, and south bay. 28 in napa. you're back to 23 degrees here. and as you can see, temperatures are running much cooler than the coldest days we had last week. so this is the coldest morning we've had in seven months.

washington, d.c. >> we're down to the wire here. just a couple motions left before congress can leave. they have to have unanimous consent. and the whole thing could be pushed into next week if one lawmaker objects. house republicans have surrendered in the fight over extending the payroll tax cut. i'll tell you what, i think our members waged a good night. >> facing immense pressure from the 160 million americans who faced a january 1st tax increase and for members of the own party who feared a costly backlash republicans decided to go along with a two-month extension passed by the senate. >> the amendment is agreed to. but a key provision, language that protects small businesses from nightmarish reporting requirements allows gop

welcome back, everyone. live look at golden gate bridge. it looks like traffic is picking up as we've been watching it the last hour and a half. certainly cold. 6:24. making a difference in time for the holidays, a holiday wish answered by our viewers. someone stole a santa clara woman's motorized wheelchair from outside her home. a sunnyvale couple has come to her rescue, donating a wheelchair they say they had in their garage. jornl kiriama has more on the

amazing curiosity. >> christmas was delivered by this chrysler mini van. inside, a power wheelchair that brought a smooile to kathy joe smith's face. >> now i'm going to have a nice chris christmas. >> but for a while it was depressing for kathy joe. a thief had stolen her $4,000 wheelchair outside of her apartment. her ability to move around and her freedom have been taken away. tracey and her husband were so moved by her story on nbc bay area they wanted to make a difference and help someone in need. >> i immediately realized that we had an extra wheelchair in the garage. when he got the wheelchair a few years ago we kept the other one. and so i immediately approached jim and said we found a home. >> he can relate. after suffering a stroke his wheelchair became his life.

we have near record lows across the board. 31 degrees. break out your radars. puffy coat in oakland. i have your full forecast. holiday forecast and rain in the seven day. >> we've been talking about the big holiday rush. we're live at sfo by michael mccarren where you'll see hordes of people go through there. about 2 million passengers, mike? >> about 2 million in the last two weeks of this month. it's typical for us. a little bit higher than last year. about 5%. we're doing well with 1345, 135,000 people passing through the gates. so it's going to be a busy day. >> is there anything you do at the airport as a whole. you see people coming and going all the time. anything you can do to to prepare for this? >> we just make sure everything is operational. make sure the roads are open.

make sure the bathrooms are clean. make sure the floors are clean. i came in early this morning. they were buffing the trial, the floors here at the airport. want to make sure the place is clean and people get if and out, into their gates with no trouble at all. >> a lot of major house keeping that you do there. exactly. and what's funny is i mentioned last time you don't get to travel on this day. you're always there. >> yeah, i'm here, i travel off season times. >> take a boat? . all right. it's always good to plan ahead as well. check your flights. so far not seeing any delays. >> right. last time i checked, everything looked very well. the weather is not impacting any airports. it's gorgeous here. it is cold as they were talking about in the low 40s. but it's crystal clear. we don't expect any delays because of the weather here. >> a lot of people, you know, they wrap these beautiful presents just in time for the holidays to go to the airport and say, no, you can't have them wrapped. but you have a gift wrap center

now underarrest. the victim recovering from a leg injury. >> it's 6:32 now. a press conference will be held to discuss the arrest of a suspected serila arsonist. he's accused of setting 50 fires in antioch and pittsburgh. >> 60 em have lost almost everything in a massive fire in san francisco. it started just before noon yesterday. entire building is now gutted by the flames. residents escaped the blaze with just the shirts on their backs, but they are grateful everyone made it out alive. >> we did have one gentleman who was asleep in the apartment.

>> folks spent the night at hotels and nearby evac1-800-center. >> investigators are determining what caused a commute crash to send seven people to the hospital. the driver suddenly lost control of the bus saying he couldn't get it to stop moving. he crashed through fence and began driving in circles before a quick thinking passenger pulled the keys out of the ignition. it was total chaos. >> like a bad movie. about 20 people on the bus were

on it when they crashed. most passengers were able to get off the bus. emergency crews needed to pull three people out. among the seven takened to the hospital with minor injuries. one was a child. she was caught with 29 pounds of shark fins. the woman was cited, her visa canceled. deported. that was the oceanic organization. shark soup is considered a delicacy. that can cast more than $2 million a pound. high winds whip over roads and increase the risk of wildfires.

9:00 a.m. this is why. take a look at where temperatures are. 26 in santa rosa. you're back up to a comfortable 23 in napa. so temperatures are going up and down. that's because we have winds that pick up and the winds die down. when you lose the winds the temperature really starts to fall. you're at 33, one degree away from freezing in san jose. and oakland below freezing. send us your frost pictures. we're all headed to a gorgeous afternoon. we have changes on the way. we have rain in the forecast. also we are looking towards a pretty comfortable christmas. i think you'll like that. we'll break that down for you city by city. tell you what to expect for your holiday sunday that's coming up in the next report. the payroll tax cut debate is pretty much over in washington. we'll is a live update next. and a live look from chopper this morning.

house republicans are giving up the fight. they are going along with the senate's compromise bill on the payroll tax cut. brian mooar joins us live from washington, d.c. how bruised is house speaker john boehner? >> he's probably had the worst week of his career. it's definitely rough. he took it from the left from president obama. from senate democrats, from house democrats. but he also took it from his own party. one describes it as being hit by a truck with kentucky license plate. that's a reference to senate majority leader mitch mcconnell who wrote him an open letter telling him to give it up.

to sign on with a two-month extension. just minutes ago the senate agreed to a unanimous consent motion. it's now up to the house. but there's a catch. if one lawmaker gets up and objects to us going forward. then everything will be pushed up to next week. within an hour we'll know what happens if no lawmakers object. if the house passes this consent motion, it's over. the bill goes to president obama for his signature. >> 6:42 right now. repairs start today on the source of at least one of the power outages at candlestick. you can see the front backing apart as it passes on the bay. you see the breaks in the clouds from space. it's a beautiful, chris tas clear morning yet again. the winds help to clear out the air quality. here it is. moving over the bay area making for a gorgeous sunrise. 17 degrees colder than this point yesterday. make sure to dress in layers. not quite as warm as it was. just about as warp, though, especially in the south bay, where we ended up in the mid-60s. i'm forecasting low 60s later on. once the sun comes u out because it's so clear, it will warm us up quickly. cold air mass overhead settled in. cold dense air settles to the surface with a lack of winds. like i said, when the sun comes

impacting people taking off for christmas. this is a live look at sfo where a busy day is just bin beginning. 2 million passengers expected to come through the airport this weekend. michael mccarren gave us a list of tips to help travelers on the busiest day of the year. >> they should check with the air carrier, make sure you know when the flights will be in here. we expect that for the next couple of days. the east coast, and midwest is very changeable. if you wrap them and have to go through security, you may have to wrap them all over again. you shouldn't have any trouble at all. >> there are slight delays at sfo. they're talking about a ten minute delays.

everything else is fine. philadelphia had delays for a little bit. but it's clear this morning. an overnight shooting at an east bay wal-mart parking lot. we have new video from overnight. this is happening just after 10:00 last night. officers say the victim of the shooting was well enough to drive him to a nearby hospital. this is the same parking lot where a monowas shot by suspected robbers on black friday. the victim from last night's shooting is recoverg from a leg injury. >> barry bonds is appealing his conviction. his attorneys asked him on wednesday. he was found guilty of obstruction of justice earlier this year. he was sentenced to 30 days of house arrest and probation.

the sentence is now delayed until the appeal is resolved. repairs start on a backup power switch at candle stick park. pg&e says the switch failed that caused the second blackout during the 49ers game. this espn video from monday night football shows one of the two blackouts. pg&e taking the blame for the first one, saying a faulty splice on the power line failed. repairs will be under way to make sure the same thing doesn't happen again they are also giving the public a report cards. they are modernizing operations as recommended by the ntsb. they are using an updated emergency response plan and implementing data management

systems to keep track of their record records. >> and 3,000 people are without power in evergreen. they don't be know why. but they're working on the problem. >> the ceo of new york times has decided to quit her job. she'll get $60 million. she walks out the door with no one to replace her. she has been on the job for seven years. but the road has been rocky at best during that time. the newspaper stocked dropped a whopping 80%. the size of her exit package is drawing criticism from the paper's reporters. "the times" will pay her $11 million in pension benefits she accrued. the long awaited nba season will make its debut on christmas day. there are plenty of games to choose from.
