that is quite a gift. i've got something big to talk about this morning. take a look at your radar. first i want you to look at ukiah. you see the weak trough passing through the northern most portion of the state. then you see the flash of green, that's snowfall coming down in the east bay. no longer is it coming down, but over the past hour if you look on the national weather service page you'll see light snow in places like concord. we're going to zoom in for you and talk about why this is happening. some more interesting changes on the way. we'll take you into 2012. we have a lot to talk about when it comes to the morning forecast. we'll get to that. >> if you got a gift card for christmas and you're looking to spend it today, you will not be alone. damien trujillo is live at one wal-mart where it's expected to be packed with shoppers. how you doing out there, damien? >> reporter: good morning, jon. it's good to have you back.

you're full of compliments this morning on the day after christmas. it's a busy, important time for retailers now. it's known as mega monday. they're expecting a lot of huge sales at malls and stores across the country. this is considered the third busiest shopping day of the year. it's when shoppers come to the store for exchanges and returns, and it's a day when gift cards should see their busiest time. shoppers will pull out those stocking stuffers and give retailers one last push before the new year. retailers are cautiously optimistic. sales are expect thod ed to be m last year. there are some shoppers who will never use the gift cards. about 5% of the cards go unused every year. and consumer advocates call that a gift worth billions of dollars from shoppers to the stores. in california most gift cards do not have an expiration date.

and if the balance on it is less than $10, the stores have to give you the balance back in cash. the steals are bringing out most shopper this is morning. >> i've been waiting for this. like black friday. another day where people are going to shop and people are going to go buy stuff. >> reporter: so stores are hoping for you didn't like the scarf you got yesterday that you'll drop by the store and exchange it and pick up something else along the way. not too many people, i must say, here at this wal-mart store. it's 5:00 when they started coming in. no long lines. nobody camping out overnight. just people excited they can whisk through pretty quickly here.

>> reporter: not sure if that's a new scarf, but you're looking very chic. we warn you to be ware of sites that take advantage of typos. internet security firm says 2,000 sites it calls typo swatters. they look like legitimate ones but they're spelled slightly different. apple, wal-mart and best buys are popular stores that scammers target. they can launch computer viruses and steal personal information. a shooting overnight sent a man to a hospital. someone shot a man in downtown oakland on webster and 13th. the victim drove himself to alameda where police found him and got him to an ambulance. police are upping the award for information leading to the arrest of an east bay bank robber who struck twice in three days. police say the robber wears

glasses. here's a picture of him with a dark frame with purple tinted lenses. one robbery was in oakland at the chase bank branch on international boulevard on december 13th. the second robbery on mountain boulevard. that was december 16th. the reward now stands at $2500. the damage from a five alarm fire now estimated at $8 million. high winds and low humidity helped fuel the flames that raced through four residential buildings on thursday. the fire started in an alley near a trash chute between golden gate and pierce street. three people were injured. the fire left more than three dozen people, including three children homeless. this morning six people are lucky to be alive after a fire in sa south san jose home on christmas day.

fire investigators say smoking products caused the blaze, but they're not sure what kind. the house did not burn down completely. so far it's unclear if the mother will be booked in jail over criminal charges or if she'll be placed under psychiatric care at the hospital. san jose police say a family call called after a 24-year-old locked herself and her son in a room on christmas day. she allegedly dropped the boy out of the window and then jumped herself. the toddler was only bruised, but cortez suffered broken bones. bart thinking of big plans on how to move people in the future. christie smith is live in oakland with details on bart's

vision for the future. good morning, christi. good morning to you, jon. the idea is that bart needs to dust off its playbook that move into san francisco every day. it's just not that way anymore. so bart is looking to the future. looking to develop a plan a plan. something called melt row concept. they're talking about things like express train and all night service. possible extensions to livermore, ocean beach. but als adding new stations on existing lines where there's a gap. >> coverage vos two things. not only extensions within the bart district. things like bart to livermore which is on the table and being studied but adding stations the between existing stations. for instance, between 24th and

mission and glenn park we might add a station. >> now bart is already ordering a different type of train, one with three doors to help people get on an off faster. late night or all night service can get tricky. that's when bart does maintenance on the train. none of these ideas are done deals yet. you'll have your chance to give your opinion. they'll have public comment. the study is expected to go on for at least eight months. >> unlicenses drivers will be getting their cars towed next week. that's one in state law that takes effect january 1st. it will stop police from impounding cars at sobriety check points for the only offense is not having license.

we're figuring out when the sun goes down it feels like christmas time. but christina loren is telling us it's going to get nice today. >> kind of a repeat of what we had over the past week. the temperatures are getting downright pleasant in the heat of the day. by 3:00 p.m. we're expecting the 50s. but we are going to see more clouds. last week we didn't see any low cloud cover all week. this morning something that is so cool. i love this time of year because we get interesting weather. you see this dry trough. as it made its way through the bay area it carried in enough moisture and temperatures are so cold we had a quick light snowfall in places like antioch and livermore. so take it easy. you're still at freezing. we've got more moisture pushing on shore. onshore flow has picked back up. whenever we talk about snow levels in the bay area.

they always coincide with the coldest point of the day. an hour before sunrise is the coldest point of the day. sunrise at 7:22 this morning. very interesting weather. and woe're watching for freezin fog. enough moisture for the fog to freeze on contact with your windshield. take it easy out there. livermore, you're dropping off to four miles. with all the the weather across the nation, the only airport reporting delays is sfo. check ahead with your carrier. only a 15-minute delay, but those will ripple down as people are trying to get back from the holidays. three mile visibility in napa. three quarters of a mile in santa rosa. once we get rid of the fog and the the sun comes out and starts to warm us up, we have a nice and mild day. 57 in san francisco. 60 today in san jose. we have more changes on the way. we're going to take you into your in new year's eve forecast. right now back to you guys.

back the day after christmas. that's highway 280 in san jose. a few cars trickling down the roadway. looking like a lot of people have the day off. the time is 6:13. the president and the gop candidates are taking a breather before hitting the campaign trails. the iowa caucuses are now just eight days away. kristen welker reports. >> a quiet christmas for the

first family as they mark the hol die together at a church near their vacation home in hawaii. on christmas eve the president called ten service members thanking them for the sacrifice. he's ending the year on a positive note with the economy showing signs of life and the payroll tax holiday extended. political gains that could be short lived. >> it scored him some points going in the new year, put him on top of an argue, but there's a long way to go as the campaign develops. >> the republican presidential candidates laid low this holiday. this week they'll blanket iowa, seeking last minute support in the caucuses. in new hampshire, the first primary state, a new boston globe poll of likely voters shows 39% support mitt romney. gingrich and paul are tied for second place with 17% each. paul has gained the most ground if new hampshire, up five points since last month.

gingrich's support has slowed. >> numbers continue to be good for mitt romney. he's ahead and he's far ahead. ron paul continues to get a chunk of the vote. that typically makes it hard r for the other candidates to break out of the pack. >> and more troubling signs for the former house speak. this weekend gingrich along with rick perry failed to qualify for the virginia primary. near candidate had the required 10,000 signatures, a blow to gingrich in his home state. they accused virginia of having a failed system and compared the setback to the attack on pearl har bok harbor. >> we have experienced an unexpected setback. but we will regroup and refocus with increased determination. >> it reflects a fundamental lack of organization. >> and analysts say that can only help mitt romney. in what has been a volatile

republican race. >> that was kristen welker reporting. 6:15 now. >> time to check back with ch s christina loren. >> we have very interesting weather finally. a little bit of rain in the forecast. nothing significant, but enough to clean out our air quality. it's been rather stagnant. we've had the big ridge of high pressure in control of the weather pattern just about every day up until now. now this morning we are seeing the thin layer flatten out a bit and as a result the onshore flow. the fog is back and it's thick this morning. sfo reporting delays now up to an hour. you want to check ahead if you're picking someone up from the airport or headed there yourself. we have four miles of vizability or better now. san jose is still looking good. watch out for pockets of fog out there. we're in the upper 20s.

45 in san mateo this morning. one degree away from freezing in san jose and sunnyvale. as the sun comes out and the places that do see the sunshine the earliest, we'll be in the 50s by noon. you can see which cities will see the sun earlier. it's where you get the green. the blue contouring means fog will keep your temperatures on the cool side in oakland, san francisco and san mateo. at least until noon. you will be able to climb in the 50s with sunshine between noon and 3:00 p.m. enough to warm you up to 57 in san francisco. you'll hit 60 in oakland and 60 here in san jose. we have a bit of a warm up ge depending on the area of low pressure. this is what i think is going to happen. an area of low pressure just to the north drags in the tail end, and so that will be enough to

get showers in locations north of the golden gate bridge. i don't think we'll see much, if anything, south of the golden gate bridge in the east bay. we'll see the 50s, breezy, limited sunshine. we'll start out warm enough that morning to see temperatures in the mid-60s. we'll set your future cast in motion. you can see all the moisture stays to the north. all the way through wednesday. as we head through the next couple of days that track could shift. we'll be watching it for you. i'll watch it like a hawk, as a matter of fact, and let you know if anything changes. clearing by thursday. crisp sunshine on friday. new year's day looking great for outdoor activities. no rain in the forecast. dress warm. once temperatures go down it will be cold at midnight. back to you. whoo! >> she's still looking. >> you heard it. >> fellas, beware. a warning for travelers on american airlines. they're asking customers not to open suspicious e-mails that say they're from the company.

apparently they are fake and meant to trick passengers into giving up personal information. the so-called phishing scheme looks like the real thing, but the airline has tips to help you out. >> the best advice is not open anything. you can look at the e-mail but don't open their links. you have to be suspicious because there are a lot of unscrupulous folks out there trying to phish for personal information any way they can get it. >> american airlines is now posting ways to avoid becoming a victim. 6:19. you may have trouble getting a loan, but corporations don't. a snew report says corporatiole increased this year. that's the highest one-year sum since 2007. >> as expected, yeah, old saint nick, very, very popular this year. a lot of interest in santa. norad officials in colorado say

a live look at san jose on this monday morning after christmas. federal regulators want to crack down on all cell phone usage behind the wheel. now a new device called cell control can be used to block cell phone use in time the car is in motion. this is activated by software installed on cell phones. cell control also lets you choose who to block and notifies

parents when their children tamper with it. >> they surf. they play words with friends and angry birds and the whole bit while driving. that's dangerous. >> the system costs $25 for the device. right now it does not work with the iphone, but the company says that will be fixed in a few weeks. one east bay city trying to link its past with the world's biggest tech company. they are in talks to place apple's former site on the city's historical register. there are talks of placing it on the national register. this building was built back in 1984 to assemble the original macintosh commuters. today another tech company earpting the building. as you think about the new year, it's a good idea to think about april 15th. here's a few steps to save you a bundle come tax time. >> reporter: a sure fire way to reduce your income tax next

in gilroy. 37 in santa cruz. we'll warm up nicely. the clouds will keep your overnight lows slightry more mild. we'll talk about rain in the forecast. whether or not your city is fair game for that. now bart is looking to the future to see how it can radically change and improve service for the riders. christi, good morning. >> good morning to you, marla. hard to believe that bart's opening day for passengers was way back in 1982. this would really nil in the gaps in service. they're talking about maybe adding express trains, service out to places like livermore and

brentwood. crockett and ocean beach in the city. these are the changes that bart is eyeing in a study they're calling metro concept. the study is expected to last eight months. and this is to fine tune the existing system with how riders really use bart today. and it moves away from the old model that bart riders came in from the suburbs every day and road into the city for work. that's not always the case anymore. >> the key concepts are capacity, being able to carry more people. service being able to serve people better with more frequent service and coverage. being able to have stations where we don't now. >> they will make it ease yr for riders to getting on and off. another idea is -- the service.

that's when bart says the maintenance on the trains and tracks. if you're interested you'll have a chance to be heard if you have an idea. get in on the town hall meeting. reporting live in oakland, i'm christie smith. jon and marla, back to you. >> christie, thanks. a 69-year-old man in police custody after he fought through a taser shot and broke the nose of a san jose police officer. it all happened before 10:30 yesterday morning on a house on 24th and san fernando. officers tracked pierce to the car and the house, the 6'2", 220 pound man punched the officer right in the face even after being shot with the taser.

he's facing multiple charges including felon battery of an officer. this morning the family of injured giants fan bryan stow is expressing hope for the new year. he had to have a feeding tube reinserted. he was eating mashed potatoes yesterday for christmas though. they decorated his room with a tree and ornaments made by stow's children. on new year's day california will be the state with the toughest restriction on teens trying to buy over the counter cough medicine. they have to check i.d.s so nobody under 18 years of age can buy medicinetaining dsm. this happens when people take too much cough syrup or pills to get high. it causes intoxication,

stores are hoping you -- if you didn't like that scarf you got yesterday. that you'll drop by the store and exchange. they begin to trickle in a little more briskly i would say as the sunrises. i'm damien trujillo. >> san francisco art groups scrambling to schedule performances to coincide with the upcoming america's cup sailing race. featured crowds leading the waterfront are expected to head downtown for plays, music and dance. the local arts group say the cities overlooked them, failing to fund the arts. a handful of theater and dance groups are raising money and rehearsing if shows to coincide with the race. the america's cup is slated to start in august of 2012. it will run through 2013.

>> time to check the forecast with christina loren. you said it was snowing in antioch. yeah, we have these returns on our radar this morning we did have a mix of rain and snow actually come down for a brief time. we picked it up on the radar. very, very cool. i'll show you that when we get to my main forecast. stay tuned. this is what is happening right now. we have really deep pockets of follow settling in across the bay area. especially up in san francisco. as a result you have one-hour flight delays now. 29 degrees in livermore. this map tells the story. you can see where the fog will settle in and hang around. we have the blue shaded areas and green. you'll end up in the 50s by noon. mid-50s even.

shoppers across the country are getting set to jam into stores today after christmas for the holiday sales and, of course, to return some of the unwoonted or wrong sized gifts. brian mooar is live if washington with a look ahead hat the second wave of holiday shopping. good morning, brian. >> reporter: jon, you know they

say it's the thought that counts, but sometimes you just got to ask yourself, what the heck were they thinking? and on a day like today, yeah, epic. there are a lot of people who are going to be going to return stuff. the national retail federation estimates that basically a dime on every dollar spent going right back to the store. if not today, in the next couple of days. eight in ten people use gift cards. for those who didn't and are sort of paying the price, so do speak, let's give you advice to make it through today. a survival guide. if your going to return something, know what the store's return policy is before you go. you may not get cash back. you may get a gift card. thank you for coming but no thank. save the receipt. if you have the receipt, if you get a gift receipt, that's important. have all the original packaging, all the plastic, the manuals all that fun stuff. if it's an online return, don't just box the thing up. check and see the proper method to do it, and finally give

we're all set stalking about warm degrees. just think about that. the power of the mind. never underestimate that. it is cold out there. especially for your agricultural outlying cities. let's talk about that. taking a live look at the sun coming up over the city of san ho sigh. you can already see the layer of haze overhead. 6:46 priright now. temperatures are cool. we'll see more and more cloud cover throughout the day. this morning we're watching for patchy fog and frost. and we have delays up to an hour and 15 minutes. watch out for that. staying mild today. plenty of sunshine. but we'll see a mix of sun and clouds.

and we need the rain. 34 degrees right now in oakland. 36 in hayward. 29 in livermore. when i talk about the outlying agricultural areas, look at the perimeter of your temperatures. 26 in gilroy. so we're not quite near the records. noz as close as we were last week when we hit 21 degrees in napa, but it's cold out there. grab a jacket. something else that's really cool that happened this morning, we had this trough come through, and it brings in moisture simultaneously with the temperatures. we saw a quick mix of rain and snow in the east bay. let me zoom in and show you that. something that almost never happens. when we talk about the snow levels coming down to sea level like we did last year in san francisco, the area of low pressure has to cross over the bay area at the coldest time of the day for that to happen.

so that's what happened here. it's so cold that the moisture that did come through came down in the form of mix of snow and rain. nothing that stick out there. you're not going to go out and find snow, but still cool weather is happening now. 61 in redwood city later on today. hard to believe we're going to hit the 60s. 60 today in san jose. if you want to getout doors an take down the christmas lights, wait till afternoon and it will be more comfortable. low pressure in the south as we head to tomorrow. that will increase the cloud cover to make for a more mild night. then the main event arrives. an area of low pressure crosses to the north. really tricky forecast. we'll see some showers in the north bay, not much, maybe a tenth. a maybe a quarter of an inch. that's all what all meet rom meteorologists are grop ling with. breezy conditions with limited sunshine. as we future cast in motion. the future cast agrees with me. 4:00 p.m. on wednesday.

and stores to return gifts they didn't like for christmas. they hope you pick up another product at the store. today is also when gift cards should see a lot of use. in the end retailers are expecting quite a spike in sales compared to last year. but some consumer advocates say the stores also make out on unused gift cards. they say consumers give stores nationwide $5 billion worth of unused gift cards. one shopper said his trip had nothing to do with christmas. >> you don't mind getting up this early? >> no. i've been up all night just waiting for this. >> little bit crazy, maybe? >> it's going to get crazy in there, you know. >> that shopper was here for the christmas holiday sale. here in california most cards have no expiration date. and if the balance in the cards is less than $10, then the store

branch on international boulevard that happened on december 13th and a second at the mont claire wells fargo branch on mount boulevard. both times the man approached the teller and demanded money before he ran away with the cash. new this morning, a man in the hospital after a shooting in oakland. police say somebody shot the man in downtown on webster street around 12:30 this morning. the victim drove himself to alameda. police got him to an ambulance, but police have not yet said if there are any suspects yet this morning. the five alarm fire that damaged four victorian apartment buildings in san francisco caused an estimated $8 million in damage. investigators say the fire began in an alley near a trash chute and quickly engulfed the wood framed structures on golden gate avenue and pierce street. three people were hurt.

the fire left more than three dozen people including three children homeless. six people are safe and sound this morning after fast moving fire ignited a san jose home yesterday on christmas. rescuers pulled three elderly wheelchair bound residents from the burning home on omera lane. fire investigators say smoking products caused the fire, but they're not sure what kind. the house did not burn down, but the garage is a complete loss. it's unclear this morning if a san jose mother accused of dropping a toddler from a second-story window is headed to jail or not. 24-year-old lupito cortez could be placed under psychiatric care at the hospital. she locked herself and her son in a room on christmas day. when officers arrived cortez tossed her 22-month-old son out the window and then jumped out after him. the toddler fortunately survived with bruises. cortez suffered broken bones.

6:53. bart planners are working on a new vision for the transit agency. it involves big changes for rider riders. >> good morning to you, marla. bart's original role was mainly to move computer frsz the suburbs into san francisco every day for work. that's changed quite a bit. now they're talking about adding services the places like livermore, brentwood and ocean beach in the city. even talking about express and possiblily overnight service. this is part of an eight-month study that trying to adjust service to how riders are using it today. doing things like adding new stations on existing lines where there was a gap in service and the population is growing. better ordered a new type of car you may see soon with three doors to allow riders to get on

flames erupted early yesterday morning at this connecticut home. this is in stanford. it's owned by an advertising executive. now police say madonna badger lost three daughters and her parents in the fire. now badger and a male acquaintance escaped the flames. the cause of that fire is still under investigation. >> it's 6:57. texas homicide investigators looking for a motive behind a christmas day shooting that left seven people dead. four men and three women between the ages of 18 and 60 were all found dead in an apartment in a suburb of ft. worth. police believe they were all related. the shooter is among the dead. a 911 call was made, but there was no one on the line when the dispatcher picked up the call. two handguns were found at the scene of the crime. a soldier may never walk again after getting shot in his homecoming party in san bernardino. this happened friday at 22-year-old christopher sullivan's welcome home party.
