it is the last wednesday of 2011, if you can believe it. good morning. thanks for being with us. it's 5:00. i'm marla tellez in for laura garcia-cannon. >> blows my mind. 2012 is already here? i'm jon kelley. let's check in with christina to tell us what kind of weather we'll have. >> interesting weather. i think we'll get a little rain before we hit 2012 which is good news. this morning, pretty mild start. temperatures below freezing, not on this map anyway. we might see gilroy dip to the freezing mark as we head to the next couple hours. upper 30s and 40s even in the north bay. 40 degrees in santa rosa, 40 in novato and 45 in san mateo. i think the greater bay area will get a little something. of course, we'll take you to 2012 with your extended forecast. first we'll check your drive with mike inouye. >> the tarp cleared from 680.

but we still have the construction crews. northbound 680 at sycamore, a tad bit of slowing as you pass that exit. likely another lane or two blocked for another hour. likely clearing before 6:00. a smooth drive off the dublin interchange. smooth drive for the south bay as well. i'll give you other key spots coming up. >> mike, thank you very much. it is 5:02. oakland has been without an occupy encampment for more than five weeks, this morning, the new encampment is located in a vacant lot on peralta street near mandela parkway. it's being called the cypress triangle. christie smith is live in oakland with more on this new camp. christie, good morning. >> reporter: good morning. it was hard for us to find. this is much less visible than the encampment at frank ogawa plaza at oakland city hall.

they're on the fireside of this fence. more than a dozen we counted yesterday. it popped up yesterday. seems like very few people even know it's here. according to one occupy website it's called the cypress triangle on mandela parkway. it's tied to the larger occupy movement over financial inequality. it was mid november when oakland police cleared out the big encampment at ogawa plaza. handful of smaller encampments popped up over various parts of the city. according to another occupy website, they'll be meeting this evening at ogawa plaza, 5:00 as they've done in the past. one option they're exploring is taking over a building as a social center for occupy oakland next month, january 28th, for things like communities, activities and sleeping space, is what they're saying. after a lot of bang and forth with the city and police about what would be allowed at ogawa

plaza, they ultimately came up with what they said, assemblying was fine. reporting live in oakland, i'm christie smith, jon and marla, back to you. >> christie, we'll check in with you in another half hour. governor jerry brown taking time to weigh in on the recent port shutdowns by occupy protesters. he says he believes mayor jean quan is aware of how important that port is to the economy and he plans to give whatever help is needed. just last week quan said attempting to prevent a closure would cost $1.5 million. brown stopped short of saying he'd send in the national guard say that is reserved for extreme emergencies. a 9-year-old boy is safe at home this morning after he escaped a kidnapping attempt in

oakland. police say a strange man approached the boy monday afternoon on arrowhead drive near northwest redwood regional park. the man allegedly offered the boy candy. the boy ran off and told his parents what happened. oakland's crime stoppers is offering a reward up to $2500 for information leading to an arrest and conviction in that case. oakland police are also looking for a man who sexually assaulted a woman early monday morning near the intersection of holly street and 90th avenue. the alleged victim says the man pinned her against a gate at knife point, took her money and sexually assaulted her before running away. if you have any information, you're asked to call oakland police. two people in the hospital this morning, recovering after their small plane crashed in concord. the pilot radioed he was having mechanical problems just after takeoff yesterday afternoon from buchanan field. he attempted to return to the airport but was forced to land

on a gravel area on airport property. the plane was destroyed. the two men right now recovering at john mere medical center. 5:05. sheriff's deputies shot and killed a loose pit bull that charged to attack them at a golf course. the deputies were at bethel island golf course searching for a man harassing drivers at a nearby gas station. it turns out the dog belonged to the man they were looking for. they eventually found the man and took him into custody on suspicion of resisting arrest. you may love the warm fire on a cold morning. beware that comfort may cost you some cold hard cash. "today in the bay's" marianne favro live in los gatos with a closer look. good morning, marianne. >> reporter: good morning, jon. even the yul tide log is not exempt. it turns out a lot of people lit a nice warm fire on christmas morning. that was illegal. now those people will get a belated christmas gift.

it's right up there with coal, a big hefty fine. because of poor air quality on christmas eve and christmas day in the bay area, it was illegal this year to light wood fires. it turns out regulators from the bay area air quality management district were taking note. yes, even on christmas morning. and they apparently got a lot of help. regulators say more than 400 people ratted out their wood-burning neighbors. authorities say they haven't issued any fines just yet, but they are going through 77 cases of potential violations after they went and investigated all those complaints. if you were caught burning wood in your home and it's your first offense, you'll get a warning. if it's your second offense, you could face a $400 fine and consider yourself warned about the new year's day weekend because even though it's nice to sit by the fire and watch the rose parade or catchall the good football games, it's likely to

be a spare-the-air day. so consider yourself warned or you could face big fines. live in los gatos, marianne favro, "today in the bay." 5:07 this holiday season. something is not looking right in lake tahoe. people on vacation who are looking to enjoy the winter weather there, well, they're finding only just a few inches of snow. this is more than 95% below the average snow depth at this time last year. there is a chance for a weak storm today. the forecast is not looking good. resorts are using snow making machines to get by. a lot of man-made snow out there. >> trying to keep it's see cold. let's get the official forecast from meteorologist christina loren. >> good morning to you. we have action happening in the north bay. napa county, the extreme north end of napa county getting a little shower activity. the good news about the showers rolling through, although it's not much. we need the rain. it's going to clear out our air quality substantially. take a look at this. a stray shower developed over

san francisco as well. watch out as you head throughout the morning hours, if you're trying to get to work, make sure you travel cautiously. you may find slick conditions. we're expecting fog to develop through the next few hours. right now looking mostly clear from san jose to the golden gate bridge. as we head throughout the afternoon, the clouds will slide to the south. your forecast calls for a lot of cloud cover today, limited sunshine for the second half of your day. you can see the showers right now slowly but surely evaporating before they get into sonoma county. as we head throughout the day today we'll see some pretty good cloud cover, not expecting much in terms of rain. it's the clouds keeping us nice and mild. temperatures running about five degrees warmer in some cities than we were yesterday. we were even mild then. take it through your futurecast, by 7:00 a.m., late fog settling in through san jose and through san francisco. and then that front slides south. we'll see mostly cloudy conditions by 4:00 p.m. today, holding on to the 60s in most

sparkling shot to show you at 5:14. waves as high as 16 1/2 feet battling and beating up part of thailand's coast this morning. for three day it is monster waves have been causing damage along the gulf of thailand. thousands evacuated as a precaution. people living in the area say the waves are thighest they've seen in decades. several homes and other structures near that coast have been damaged or completely destroyed. a much calmer scene here in northern california. >> thank goodness. >> let's check the forecast with meteorologist christina loren. >> that's one of the reasons we pay the big bucks to live here in the bay area. traditionally december is a wet month for us here in the bay area. as of right now, this very moment, it's the third driest december we've ever had here in the bay area. that could change as we head through the next couple days. we have showers on the way. right now seeing a little

activity through napa county, santa rosa staying dry. right now we've got mostly cloudy conditions in santa rosa. that's keeping temperatures in the 40s to what a difference up there, a little stray shower developing over the bay bridge and one cell just to the north of san jose. i think you can safely leave the umbrella at home. you may want to bring a hoodie with you. you might be dodging showers from time to time if you're waking up north of the golden gate bridge. most of the action not sliding to the south. we have a better chance to see that as we head through your friday. right now let's talk about what you can expect later today. a little cooler. but i think most of that impact will be up in the north bay. we'll stay just about as warm in the south bay. 61 in san jose, 61 in gilroy. 64 in livermore yesterday, about 61 today. staying mild with more low cloud cover as well developing as we head into the mid morning hours. this is what we're expecting as

we head throughout the day today. temperatures will be on the mild side. the clouds will increase. then here is when we are expecting showers. 6:00 a.m. friday. you see those light cells start to make their way through the north bay. we'll continue to run your futurecast, stop the clock at 4:00 p.m. not expecting a whole lot of activity. nothing measurable in terms of accumulation, but enough moisture coming through the bay area to clean out our air quality. we'll take whatever we can get. i'd like to be wrong in this case because the more moisture we pick up, the better it is for our overall snowpack. rainfall to replenish our water. of course, i will talk about that snowpack, what we're expecting, not much. maybe three to six inches in the sierra. i'll show you where, it's going to be very isolated. let's talk to mike about your drive. >> the drive is better than we usually expect at this time. a lighter volume of traffic. a holiday week for a lot of companies and schools especially.

dozens of stores is not helping the markets. for the rest of the news before the bell, we turn to julia boorstin live at cnbc headquarters. good morning, julia. >> reporter: good morning to you. it looks like futures are pointing to a higher open. the dow up about 23 points, this after markets closed near the flat line on tuesday which was the lightest trading day of the year with just 2 billion shares changing hands. a positive report on consumer confidence was overshadowed by a bigger than expected drop in u.s. home prices. as you mentioned, news that sears holdings is closing 120 sears and kmart stores after a poor start to the holiday season also weighed on market sentiment. europe is in focus this week as italy sells billion in government bonds. asia fell overnight, but europe is positive. the dow slipped two points yesterday to 12,291. the nasdaq rising six points to

2,625. morgan stanley is cutting 580 jobs from its four offices in new york city. that's more than a third of the 1600 cuts the bank announced earlier this month. morgan stanley saying rolling lay-offs began december 15th. the company sites economic reasons for the cuts amid the sharp drop in investment banking and trading revenues across wall street. people just can't seem to get enough of the lambeau leap and those foam cheese head hats. the green bay backers are releasing 30,000 more shares of stock in the team after seeing incredible demand for an initial offering three weeks ago. that allotment of 250,000 shares the nearly gone, even though the shares cost $250 each and they have virtually no resale value. i'd say those packer fans really love their team. guys, back over to you. >> okay. thanks, julia. some sad news to report. the bay area lost a devoted citizen watch dog, a man who had been keeping an eye on city officials long before their were

blogs or even the internet. >> i counted 18 uniform officers. i have somebody counting the cars outside and all those sorts of things. the important thing is that that sends a message. >> san gee hond had been a fixture at oakland city hall for more than 20 years. he sadly died yesterday at 55 engineers young. he published an opinionated newsletter featuring city government gossip and' haven't. he will be missed at city hall where he attended just anti each and every meeting. >> in the middle of his dialogue, the public has a right to know. he's right. the public has a right to know. and i just -- i don't know -- i don't know how this place -- i think the city is going to really feel his absence. >> he attended not only city council meetings but just about every commission and committee meeting since back in 1991. an autopsy still pending on the cause of death.

5:21. local businesses and people around the bay stepped up this holiday season to help the south bay blue star moms who lost their savings in a scam. the group of local mothers sends care packages to those serving in war zones overseas. this month they were among hundreds of people whose credit accounts were hacked by skimmers placed at some bay area lucky supermarket self checkout lanes. help poured in. the group received roughly $11,000 in donations including a refund from comerica bank and a contribution from lucky supermarkets. it is 5:22 right now. coming up, psycho doughnuts releasing a brand new doughnut in honor of a very popular broadway musical. us possiossible new wrinkle in the plan to bring the a's to san jose. well, it is the christmas present that a lot of people in the south bay have been waiting for, reports the a's are rolling down to san jose, but this morning the giants are saying not so fast. these are pictures of the proposed stadium in san jose. the giants, of course, they own the territorial rights to santa clara county, and the team is not letting go without a fight. the buzz over the a's move south started over the weekend when a reporter tweeted the deal is in fact a go. the deal is not on the agenda for the owners meeting in scottsdale that takes place in two weeks. a pair of unlikely south bay businesses teaming up this morning. psycho doughnuts and broadway san jose. and we do have a look at the product of the partnership. it's called the kitty litter doughnut. the businesses are celebrating the opening of "cats" which runs through new year's day, one of the two signature cats

napa county. san francisco, you can see the cell located over the bay bridge there. that little guy could make for slick conditions. watch out there as we head throughout the morning hours, we will continue to see these very, very light showers roll through the north bay. will they make their way into your neighborhood? i think so and i'll tell you when. first let's check the drive with mike. >> you have micro climates. i have a micro commute this week, very small. looking at an accident in the south bay. i have an updated location. southbound 17 off of the merge or off the blend for 880 or 280 getting on to southbound 217. chp says it's complete think off the roadway. no slowing at the scene. i'll track the rest of those. there's still construction out there. a lot of the folks working. >> including us. thank you very much. it is 5:30 right now. yes, it may be cold out there. we suggest you may want to think before you light up that fireplace. the fireplace ban is designed to help improve air quality which, of course, impacts all of us. it's especially important for people with conditions like asthma. there are a few exemptions. for example, let's say your furnace breaks down. then you are allowed to burn wood in your fireplace to keep warm. that's really pretty much the only exemption. there will be no exemption on new year's day when it's likely to be a spare-the-air day. i did check this morning and you can burn wood in your fireplace because it is not a spare-the-air day. reporting live from los gatos, marianne favro, back to you guys. >> all right, marianne, thank you very much. 5:32 right now. fremont police are looking for not one, but two drivers involved in a deadly hit-and-run. this happened monday night at ardenwood boulevard south of highway 84. police say a 56-year-old homeless man was crossing the bid difficult street when he was hit by a mid-sized suv. then a second car right behind

that suv also ran over the man. both cars kept going. police in gilroy right now looking for a man accused of robbing a walmart store. we have surveillance video of the man that was taken prior to the robbery on the night of december 23rd. the suspected robber is wearing a giants baseball cap, a black and white rebach jacket and goatee. you can see he walked up to the cashier and demanded money. he did not, however, show a weapon. the employee gave the man some cash and the man then took off. 5:33. after being kicked out of a long list of locations this past month, occupy oakland set up a new encampment in west oakland, located in a vacant lot near peralta street and mandela parkway. "today in the bay's" christie smith is live in oakland where occupiers have set up more than a dozen tents. christie, it was kind of hard for you guys to find this morning? >> yeah, good morning, marla. this is a much less visible

location than the one they had set up in front of city hall at frank ogawa plaza where they had more than 100 tents. in fact, we drove by this location this morning and had a hard time finding it. they're set up behind the fence there. i just went behind that fence and counted about 13 or 14 tents and spoke with one of the october priors who said he considers this a good location out of the way here in west oakland along mandela parkway at peralta and kind of a next step, he said, unused property, a vacant lot. in fact, he wasn't sure who the actual owner of this property is. after police broke up the main encampment at ogawa plaza november 14th, a handful of smaller encampments popped up but they were dismantled to. they found this location and set up quickly this week. >> once we find a place and then we talk and say let's go. a bunch of people go.

like an advanced -- they establish and say this is going to be. there have been several different, snow park and the one with -- there's been a couple. that's fine. that's part of an operation. >> reporter: according to one occupy website this morning, a group is going to be meeting tonight at 5:00 at frank ogawa plaza in front of city hall. what they're doing, apparently they're considering taking a building for social use, sleeping space and they're saying that that might happen next month, january 28th at ogawa plaza. you may recall there was a lot of back and forth with the city and the police department over that encampment, whether it would be allowed or not. it seemed that what they came up with was that assembling was fine but camping was not. i did call the police department to see if they are aware of this

and has not yet heard back. live in oakland, christie smith, jon and marla, back to you. >> what seems to be interesting to me is it's not visible from the street. >> reporter: no, it's not at all. in fact, there are several tell strigs trucks out here and we were all circling this. we had the location but couldn't find it. they're basically behind this fence here. it's a vacant lot. there's a street that runs through it and they're on the far side, like i said, about 13 tents. they even have what looks like the beginnings of a small kitchen setting up. really hard to see from the street. some passengers aboard a southwest airlines flight had scary moments at sacramento international airport. the 737 departing for seattle last night when two tires blew out and the pilot had to abort that takeoff. one passenger described what it was like inside that plane. >> the front of the plane was starting the go up. and boom. and it started shaking really bad. you felt the plane go back down

and it stopped right there on the runway. it stopped right there on the runway with all the flashing lights. >> emergency crews were called to hose down the 737 as a precaution. fortunately nobody was hurt. investigators still trying to determine exactly the cause of the blowouts. san jose city leaders respond to one group's criticism of a new law. beginning sunday police will not respond to business alarms unless someone on scene confirms a break-in. city leaders say 98% of alarms are fall. with fewer cops on the beat and a growing population, this will ensure police focus on high-priority calls. the california alarm association is asking mayor chuck reed to put the law on hold and explore other options. >> with this environment of really constrained resources, we have to really deliver the best service we can. >> it puts you in a tough predicament. i'm going to be careful when i do leave town. >> city council member pete constance says the law will take

effect sunday. he says it costs the city $600,000 a year to respond to false alarms and police need to focus again on those high priority calls. it's 5:37 right now. a high priority for us, checking in with meteorologist christina loren. >> finally i have action happening in my department. we have rain showers coming down across the bay area. it's another mild start. 39 degrees in fairfield, at 48, almost 50 degrees in san francisco and 41 right here in san jose. as we head throughout your morning hours, we'll continue to see these very light showers pass through the north bay. healdsburg, you might find slick conditions up there as we head through the next half hour. as you can see here, the front is draped across the north bay right now. we're expecting it to slide to the south as we head through the afternoon. let's set your futurecast in motion. you can see between about 10:00 a.m. and 4:00 p.m., we'll see mostly cloudy conditions over the greater bay area.

limited sunshine. because we're starting so mild, 60 today. 61 in fremont and 60 in san francisco with increasing cloud cover throughout the day today and another benefit from these showers, even though today they're not going to make their way over the greater bay area. we already have a forecast for better air quality tomorrow right at the coast and the south central bay. moderate air quality everywhere else. today we're all in the moderate range. it's not a spare-the-air day. we'll track when everybody will get a little shower activity. that's coming up. first let's check your drive with mike. let's take you to the south bay. i have yet another update for this accident we've been following. southbound 17 just off of 280 was the last report. now the updated location, the accident is clear. that means not there. i don't have anything more detailed than that. you really don't care if you're driving through that interchange. it is just fine. eastbound 237, that construction is still there if you're transitions onto northbound 880.

anaheim's disney land has temporarily canceled the holiday fireworks show. park officials are blaming weather conditions and technical issues. one employee was treated for a noise-related injury the day the first show was canceled last week. so far five shows have been put on hold. >> that is sad. a trip to disney isn't the same without finishing with the fireworks out there. >> you're right about that. i bet the neighborhoods surrounding disney are quite pleased. can you imagine every night hearing the fireworks go off? they say weather is part of the reason. you see all the particulate matter that comes off the fireworks. it's probably an air quality issue there. we have air quality issues of our own right here in the bay area. but i'm looking towards much cleaner air, especially as we head through your friday. i think the great ert bay area gets a little rainfall everywhere. 38 in livermore, 41 in hayward, 45 in san mateo.

welcome back everyone. security is always tight at tanl rose bowl parade in pasadena. this year that threat of occupy protesters along the route has security tightened up more. pasadena police have been negotiating with protesters for weeks now. officers will let protesters march along the parade route after the official floats have
