wednesday, december 28th. this is "today in the bay." very good morning everyone. thank you very much for joining us. the time right now is 6:00 on the nose. i'm jon kelley. >> i'm marla tellez in for laura garcia-cannon. let's get straight to that forecast with meteorologist christina loren. >> good morning, guys. it's wednesday, two more days before we have yet another holiday weekend. we have showers coming through. we have major changes actually on the way. as of today, we're not talking about frost this morning. we are talking about fog, not yet so much of a factor when it comes to your visibility on the actual highway. but i think that will become a factor during your mid morning hours. you can see showers developing in the north bay. i think that's where they'll stay. by noon, 55 degrees inland. up to 57 degrees as you make your way home from work. i'll tell you through that forecast. i think the greater bay area will see some shower activity. i'll tell you when coming up.

we want to cheng the drive with mike. >> in that case your reports always queue mine. looking at the roadways, a queue of how busy it is, the bay bridge toll plaza, shows a mild backup at the bottom of your screen. those are cash lanes. 6:00 tends to have more folks coming on shift. we'll see if this lightening up. i do see some slowing where we didn't yesterday. i'll show that to you guys coming up in the next report. >> everybody back to work. well, a winter time tradition could affect your all-important health and along with that your pocketbooks. "today in the bay's" marianne favro joins us with a look at the crackdown on homeowners who light up the fireplaces with real logs. >> reporter: even the yule log is not exempt. a lot of people decided to light fires in their fireplaces on christmas day which happened to be a spare-the-air day. now they're looking at a belated christmas gift that's right up there with coal in your

stocking, a big hefty fine. because of poor air quality on christmas eve and christmas day in the bay area, it was illegal to light wood fires. it turns out regulators from the air quality management district were taking note, yes, even on christmas morning. and they apparently got a lot of help. regulators say more than 400 people ratted out their wood-burning neighbors. authorities say they haven't issued any fines just yet, but they are going through 77 cases of potential violations after they went and investigated all those complaints. if you were caught burning wood in your home, and it's your first offense, you will get a warning. if it's your second offense, get this, you could face a $400 fine. so consider yourself warned about this upcoming new year's day week end because it looks like it will be another spare-the-air day, and once again, you could face big fines. reporting live in los gatos, marianne favro, back to you.

>> yes, marianne, i guess that $400 would add a little extra to the romance for new year's. 6:02 right now. a 9-year-old boy is safe at home this morning after he escaped a kidnapping attempt in oakland. police say a strange man approached the boy monday afternoon on arrowwood drive near northwest redwood leej nall park. the man allegedly offered the boy candy. oakland's crime stoppers are is offering a reward up to $2500 for information leading to an arrest and conviction in this case. oakland police also searching for a suspect after a woman says she was sexually assaulted and robbed near holly street and 90th avenue. the alleged victim told investigators she was attacked at knife point early monday morning. the man ran away. if you have any information about this attack, you're asked to call oakland police. speaking of oakland, the city has been without an occupy

encampment for more than five weeks now. the last camp was cleared out by police back on november 22nd. this morning, occupy oakland has a brand new camp. the encampment is located in a vacant lot on peralta street near mandela parkway. it's being called the cypress triangle. "today in the bay's" christie smith has more. >> reporter: good morning, jon. i have to say this is a harden campment to find even if you know exactly where this intersection is. they're set up behind the fence that you see there across the street in a vacant lot. set up way down on the far side. i just took a look inside. kind of like 13 or 14 tents set up this morning. this is being called the cypress triangle on mandela parkway in west oakland. the big occupy encampment at frank ogawa plaza in front of city hall, that was raided november 14th.

since then smaller encampments have popped up. those were quickly dismantled. i spoke with a man named john this morning who says he's the medic here. he thinks it has potential. >> have something worth saying and didn't say it well, you need a place to do that and a way to do it. and they're strength -- they believe it's a global movement, probably the first one ever. >> has anyone bothered you or asked you to leave? >> no, but this is only two days. but this is a good spot. >> reporter: he says it's been really quiet out here. no one officially asking them to go. but the question is whether anyone even knows they're here. they say that they're trying to figure out who really owns this land, but for now they say they're staying put. that's the latest from here, reporting live in west oakland, i'm christie smith, jon and marla, back to you. >> kind of out of the way. a strange place to make an

october pay statement. thank you very much. keeping with that occupy theme, governor jerry brown says he'll do what he can to help keep the oakland port open. he was responding to mayor quan's comments that keeping the port open could be too costly if demonstrators again disrupt operations. brown, who served as mayor says quan could always call for mutual aid though he stopped short of saying he would send in the national guard. two people in the hospital after their small plane crashed in concord. the pilot radioed he was having mechanical problems at buchanan field. he attempted to return the plane to the runway but ended up having to crashland on a gravel airport property road. the plane was badly damaged but both of the people aboard were able to get out. they are now recovering at john mere medical center. this holiday season something is not looking quite

right in lake tahoe. people on vacation looking to enjoy the winter weather are finding only a few inches of snow. this is more than 95% below the average snow depth at this time last year. there's a chance for a weak storm today. but the forecast not looking so good. for now, resorts are using snow making machines to get by. >> got to do what you've got to do. 6:07, let's check in with meteorologist christina loren to see if they'll get any snow in tahoe. >> i think friday we have a good chance of getting some of that snowfall in tahoe, not a lot. we'll take anything we can get because it's been so bone dry. right now at this very moment it's still the third driest december on record for the bay area. the moisture coming through the north bay right now definitely appreciated. as you can see from this live picture of the golden gate bridge, i think fog will be more of a factor. we'll get to the futurecast in a moment. we'll start with your temperatures, rather mild compared to last week where we saw the 20s. 21 degrees at one point in napa

last week. so a far cry from that. you're at 37 this morning, 37 in novato and 47 in san francisco. as we transition into the next hour, that's typically the coldest point of the day. then we'll see limited sunshine. because we're starting out so mild, we'll see enough breaks within the cloud cover for us to warm up to the 60s in some cities. as you can see right here from your radar, we had a little moisture pass through healdsburg, situated over care stowing ga. cluds south of the golden gate bridge. nice and clear in san jose. when will the clouds make it to your city. let's talk about that. we stop the clock for you at 10:00 a.m. today. you can see the showers starting to push down along the peninsula. they'll move south of 92 between 10:00 and 1:00. then the showers will continue to push into the south bay. san jose mostly cloudy by 4:00 p.m. today. the sunshine that comes through before 4:00 p.m. will make for warm conditions. 60 in san jose, 61 in gilroy and

welcome back. we give you a shot of nearby sfo overlooking the beautiful city by the bay. that is san francisco on an early wednesday. it's 6:13. san jose city leaders respond to one group's criticism of a new law. beginning sunday police will no longer respond to business alarms unless someone on scene confirms a break-in. city leaders say 98% of the alarms are false and with fewer cops on the beat, this will ensure they focus on high priority calls. the california alarm association is asking mayor chuck reed to put the law on hold and explore other options. >> there's tremendous risk here, especially when you're advertising to the public in the normal circumstances the police are not going to respond.

that just doesn't make any sense. city council member pete constance say it is law will take effect sunday as planned he says it costs the city $600,000 a year to respond to false alarms and police need to focus on the high-priority calls. police in gilroy looking for a man accused of robbing a walmart start. we have a look at the surveillance video. that is the image of the man taken prior to the robbery on the night of december 23rd. if you recognize this guy, call gilroy police. the suspect is wearing a giants ball cap and a black and white reeboks jacket. police say he simply walked up to the cashier and demanded money and did not show a weapon. he was threatening enough, the employee gave the man some cash before the man took off. funeral ceremonies for north korean leader kim jong il are under way this morning. experts around the world are paying close attention looking for signs of any shifts in power as the country transitions to

kim's son kim jong-un. an expert in korean universe ti tells "the new york times," if anything, the funeral indicates who kim jong-un's closest aides will be. funeral ceremonies will continue into tomorrow. 6:14 right now. the gop presidential candidates back into full campaign mode. iowa's caucuses less than a week away. ron paul, he's the latest to jump up in the top as the front-runner. things getting very personal between mitt romney and newt gingrich. romney mocked gingrich for not even qualifying on virginia's primary ballot. that happens to be gingrich's home state. >> more like lucille ball at the chocolate factory. you got to get it organized. >> our campaign is going to stay positive. >> romney's message appears to be falling flat in iowa, but he is still running strong in new hampshire where the nation's first primary is just 13 days

away from right now. we need the rain. meteorologist christina loren, any in sight? >> we're picking up showers right now in the north bay. i've been showing those to you. let's talk about what your temperatures are doing right now. pretty mild start out there. 37 in novato. 39 in santa rosa. the clouds overhead, a little shower activity as well. it's going to keep things nice and mild in terms of your low temperatures as we transition into the next hour, i think you'll only be able to drop off by a couple more degrees which means for the first time in about a week you're going to be above that freezing mark, especially napa where it's been bone chilling cold. 37 right now up there. 45 in san mateo. here is what's happening. activate the radar. we have a little cell located just over calistoga, that will continue to fall apart. cloudy conditions all the way from the north bay down through the golden gate bridge. the showers starting to push down along the peninsula. still nice and clear here in san jose, not for long.

i think later today we'll see mostly cloudy conditions. here is what's happening. let me show you the wider view. we have this area of low pressure slowly moving closer to the california shoreline. as we head throughout the day today, we'll see a few renegade showers break off and pass through the north bay. we don't have fair game for showers through the south bay today. i think you'll actually see quite a bit of sunshine down there, warming you up into the 60s. 62 degrees in los gatos as it will turn cloudy by about 4:00 p.m. through the south bay. that limited sunshine is going to keep you up to the 50s in santa rosa. let's talk about the rainfall i'm forecasting across, yes, the greater bay area. 6:00 a.m. friday, we continue the futurecast, stop it at 1:00 p.m. showers come through the north bay. by 1:00 we're getting a good amount of shower activity from redwood city through fairfield. a little moisture in san jose by 3:00 p.m. the good news about the moisture passing through is it will clear

out our air quality. that's great news. we really need the rain as it does tend to flush out all that particulate matter. cool and cloudy for saturday, the first day of 2012, looking good. not as hazy unlessout went hard the night before, right, mike? >> yes, cheese burgers are good on new year's day. we're looking at the nice flow of traffic to the bay bridge toll plaza. i'll point out two things for oakland. the first one, the live shot at the coliseum, northbound traffic, you notice we cannot get off at high street. the high street off-ramp has been closed as well as one lane approaching high street because of emergency repair work. that will go on for a couple of hours. you see that traffic is condensed now to one less lane making a little bit of a slower drive just past the coliseum in the northbound direction. not a major concern, but it is different than we expect at this time on a holiday week. the bay bridge toll plaza, let's get a look out there as well. these cars are in the cash lanes

with the backup. it hasn't spread across the freeway. maybe one of these lanes is still closed. can't get confirmation on that. that typically is what happens with the mat attorney like that. no drama as you approach the toll plaza. in the south bay, we have construction and a delay eastbound 237 to northbound 880 coming into milpitas. that's the latest extension. crews working on the toll lane. we loop back around on calaveras. shouldn't be a major problem. the rest of the south bay shows a nice easy drive. a little slowdown 101 around highway 87. that's a pretty typical slow pattern. we didn't expect that today. we'll track that. so far the south bay looking pretty smooth, guys. we'll send it back to you. >> okay, mike. thanks. new this morning, a southwest jet was towed from a sacramento airport runway just minutes ago. it was left disabled after blowing two tires during takeoff last night on a flight bound for

welcome back. a new report out this morning says the a's plans to move to san jose don't seem to be a priority for baseball's leaders. you're looking at pictures of the proposed stadium in san jose. reports out over the weekend said major league baseball was expected to approve the move soon, but the giants own the territorial rights to santa clara county and the team, it's not letting go without a fight. "the chronicle" reports this morning the deal is not on the agenda for an owners' meeting in just two weeks. the 49ers on a roll as a team also individually with a toll id contingent getting invitsz to the pro bowl in hawaii. eight members of the team will head to oh wa hugh, the most out

drive with mike. >> let's take you for a live look with our oakland coliseum camera. caltrans notified us of an emergency lane closure. i looked at the details. it says the southbound side where the traffic seems to be flowing fine. the northbound side is where we see the crew moving folks over to the left. one lane appears to be closed. we're sorting out the details. northbound restricted by one lane as well as at the high street off-ramp, the park street off-ramp is your next available. we'll sort the details. hopefully i'll have them for you by the next report. 6:31. with all the chilly weather outside, you might be tempted to light your fair place today. you better think twice or face the possibility of paying a large fine. list of locations over the past months this morning, occupy oakland set up a new encampment in west oakland. this new camp is located in a vacant lot on peralta street near mandela parkway. it's being called the cypress triangle. "today in the bay's" christie smith is live in oakland where occupiers have set up more than a dozen tents. christie, they're out of plain sight. >> reporter: it seemed like occupy oakland has been pretty quiet for the past couple weeks. all of a sudden tents popped up here in west oakland. i smoke with some october priors, and they say no one has bothered them or asked them to leave. i'm not sure if anyone even knows they're here. they're set up behind the tall fence in a vacant lot in west oakland. we have new video we took as we looked inside. there are about 13 or 14 tents set up and a table with some dishes and some food. it's pretty quiet and orderly, tucked away here on mandela parkway and peralta, just a

fraction of the huge encampment that was at occupy oakland at ogawa plaza in front of city hall that police raided more than once, finally ending it on november 14th. since then a handful of other encampments have popped up. they've pretty much been dismantled this morning. they're trying to figure out whose land this really is. >> i don't know how long it's been like this. i want to take a look and see who owns it and what the status is because there's lots of places available to be. making that statement, it's crucial. it has to be valid and worthwhile. >> reporter: he says they're staying put for now and believes this is a good location to set up. occupy is still meeting at ogawa plaza. there's a meeting according to one website, a meeting here

tonight at 5:00. it's saying they're planning to take a building next month and use it as a social center. reporting live in oakland. i'm christie smith. jon and marla, back to you. >> christie, thanks. 6:35 right now. local businesses and people all over the bay area showing the love, stepping up this holiday season to help out the south bay blue star moms who lost their savings in a big-time scam. the group of local mothers sends care packages to those serving in war zones overseas. this month they were among hundreds of people whose credit accounts were hacked by skimmers that were placed in some bay area lucky supermarket self checkout lanes. help was pouring in from all over. the group receiving roughly $11,000 in donations. that is so cool, including a refund from a comerica bank and a contribution from lucky supermarkets. this morning the family who lost everything in a house fire days bfrs christmas is getting some help from good samaritans.

cloud cover slowly but surely sliding the the south bay. most of the cloud cover north of redwood city. as you can see, 15, 20 minutes, mostly cloudy conditions through here. we have a little rainfall coming down in marla's neck of the woods. a little shower activity in santa rosa. right now that cell is sliding south of san francisco. watch out for maybe a little shower activity along the bay bridge over the course of the next ten minutes. low pressure slowly but surely trekking closeer and closer to the coast here. the actual area of low pressure has not yet moved onshore. what's going to happen is the storm track is going to take it way to our north. we might see a few stray showers pass through today. as we head through friday, that storm track comes deeper into the bay area. 37 in napa, 37 in livermore and everybody this morning is above freezing. 60 today in concord, about 61 in livermore, turning cloudy throughout the day. we'll see enough breaks to warm

up to the 60s. another benefit of the showers coming through, better air quality. in fact, good air quality. we might just get enough rain on friday for better air quality as we head into this weekend. 6:38 right now. we want to talk about your drive with mike. >> we want to talk about that slowing we saw, 880, just got confirmation from caltrans. he said, yes, indeed it is in northbound side. we're glad they watch nbc bay area as well. this is just as you're passing the coliseum to high street where the off-ramp is closed, one lane is closed until 8:00 a.m. we or already seeing slowdown. we should see this until 8:00 this morning. that's unexpected for this holiday light week. that's the reason for slowing into downtown oakland. back to the maps, you see it's not very significant. no need to use 580 as anality flat. meanwhile, getting into the city, 280 northbound approaching

pressure that kept things nice and clear. we'll take you first outside. beautiful, butte. sunrise over the city of san jose. the good news is, san jose, we have onshore flow that strengthened enough to start to clear out that air quality. all the haze has been suspended in our atmosphere. i think we'll see a lot of improvement as of tomorrow. hard to tell from this picture we actually have showers coming down in parts of the bay right now. you, too, will turn mostly cloudy in san jose for the second half of the day. let's take you right to the radar. all the way from novato through san francisco. take a look at. this you can see the clouds are starting to break apart to the north of novato. that will be the case throughout the day today. we'll see passing clouds and enough sunshine to warm us up into the 60s. starting nice and clear right now in san jose, but the clouds are moving closer to you. you'll see partly cloudy skies by about 11:00 a.m. today and mostly cloudy by 4:00 p.m. as we head throughout the day, we'll see the renegade showers. take a look at how quickly

they've vap ate as the moist air mass combines with the dry air mass we've had overhead for the past few weeks. don't think a lot of the showers will be able to sneak past the golden gate bridge as we head throughout the morning hours. that means you'll stay nice and dry. oakland 41 degrees. you don't need the umbrella today. keep the umbrella handy in santa rosa. temperatures in the south bay with enough sunshine coming in early, we'll warm to the 60s, 62 in los gatos. 60 in san jose and 61 degrees in gilroy. all right. if you've been waiting for the rain, we've got it for you. we also have aa little bit of sierra snowfall. the front will slide to the south as we head through 6:00 a.m. friday, the jet stream will dip far enough to the south for us to see some moisture. you see the light showers push into the north bay. by 1:00 p.m., a good amount of rainfall from fairfield south redwood city. we continue the futurecast, stop it at 3:00 p.m., even san jose

getting a little rain. so 4:00 p.m., the whole thing blows out of here. i think a lot of precipitation will come in the form of rain. lake tahoe, you see that little white blurb, that's all we're expecting, maybe one to twoin chs. the cascades can get up to six inches. like i said, it's just not all that cold of a system. so we won't see all that much of the white stuff. 62 degrees by friday. here is what's interesting, as we start 2012, we'll start out dry. the end of the first week of 2012 is looking quite a bit more active with rain chances, especially thursday into friday of next week. that's the good news, our pattern is changing and we're tracking it for you each and every day. he's always tracking the roads. what do we have, mike? >> one less lane past the coliseum still. that will go on past 8:00. the issue is at our coliseum camera there's a backup forming in the northbound side past the coliseum because of one lane

that is restricted at high street. we can get that live camera out there. we'll show you what we're talking about. the backup forms just before the coliseum extending out. the top of the screen, you see the flashing lights at the high street off-ramp. that's closed until 8:00. that will be an issue just for that one stretch of the nimitz in the northbound direction. you can stick it out. it's okay, just past that maybe quarter mile, half mile, of course. then you're okay getting up to the bay bridge toll plaza. some folks are held up in oakland, no problems in the berkeley area, off the carcinas bridge or approaching out of the caldecott tunnel. a light volume for most of the rest of the bay area. highway 4, antioch, we saw earlier slowing. that has cleared up. the only remaining slow spot, that one sensor at willow pass east, that's the one sticking around -- we'll check it again later. looking over here to livermore as well with a smooth drive.

no delays out of the altamont pass and the south bay looking good as well as in the south bay. the san mateo bridge, just got reports of a possible disability vehicle. i'll check that and give you an update before the show ends. in case you've been keeping track at home, it's been five weeks since occupy oakland packed up the last campsite. this morning they're back. the new encampment is located in a vacant lot on peralta street. parade. police and parade officials have been working for weeks to prevent disruptions. the city says it will have more police than usual at monday's parade. protesters plan to march with large banners an unveil their own float. 6:53. we're happy to report a 9-year-old boy is safe at home after escaping a kidnapping attempt in oakland. police say a man approached the boy on monday afternoon on arrowhead drive, he offered the boy some candy before trying to grab his arm. the boy was quick, he ran off and told his parents exactly what happened. oakland's crime stoppers is offering a reward up to $2500 for any kind of information leading to an an rest and conviction in this case. oakland police also looking for a suspect in a sexual assault. a woman tells police she was attacked early monday at holly street and 90th avenue. the alleged victim says the man pinned her against a gate at knife point, took her money and

then sexually assaulted her before running away. if you have any kind of information about this attack, you are asked to please call oakland police. 6:54. we have an update on the crackdown of homeowners lighting up their fireplaces in the bay area. marianne favro joins us live in los gatos with the latest. marianne, good morning. >> reporter: good morning. i got to tell you, marla, on a cold morning like this where you can see your own breath, a warm fire sounds really nice. it turns out that a lot of people did light fires in their fireplaces on christmas morning. but now those same people could be facing hefty fines. because of poor air quality on christmas eve and christmas day in the bay area, it was illegal this year to light wood fires. it turns out regulators from the bay area air quality management district were taking note. yes, even on christmas morning. and they apparently got a lot of help. regulators say more than 400

people ratted out their wood-burning neighbors. authorities say they haven't issued any fines just yet, but they are going through 77 cases of potential violations after they went and investigated all those complaints. if you're caught burning wood in your home and it's your first offense, you will get a warning. but if it's your second offense, you could face a $400 fine and consider yourself warned about this upcoming new year's day weekend. because it looks like it will be another spare-the-air day. be sure and check on that before you decide to burn, or you could face a $400 fine. reporting live in los gatos, marianne favro, "today in the bay." >> good information for us. thanks, marianne. today two people still in the hospital after a small plane crash landed in concord. it happened after takeoff yesterday afternoon at buchanan field. the pilot radioed in mechanical difficulty. he attempted to return to the

runway. instead he was forced to land on a gravel area around the airport property. the landing destroyed the plane completely. the two men inside were pulled from the wreckage and they are now recovering at john mere medical center. new this morning, a southwest jet was towed from a sacramento airport runway just about an hour ago. two tire blowouts disabled it on a flight trying to go to seattle. emergency crews were called in to hose down the plane as a precaution. fortunately nobody was hurt. investigators at this point still trying to determine exactly what caused the blowouts. just because there's no hollywood sign in hill con valley, it doesn't mean we don't have movie magic in san jose. a santa clara non-profit and san francisco film production company are teaming up to give students a chance to make a professional-looking movie. the kids range in age from fifth to 12th grade. they spent winter break onset at a few schools in san jose shooting the trailer for the futuristic fantasy film called
