2011, "today in the bay." good morning, everyone. the time is 4:30. i'm jon kelley. >> and i'm marla tellez. we have a lot to get to. first we have to talk about the mist that's raining out. not good for the hair. >> not good for the hair. don't mess with it, ladies. i like to lead by example. we're looking good this morning. we have drizzle. and something that's a really big concern for me is we haven't had rainfall if quite some time. all the oil is just right there on the highway this morning. really slick conditions. you might not have help getting traction if you take off like a jack rabbit this morning. proceed with caution. and right now we're looking good. more rain on the way. make sure you give yourself plenty of time. the fog generating the mist everywhere across the bay area this morning. so no exception there.

give yourself extra time as we continue to track the weather for you all morning long. ringing in the new year also means new laws. a look at what these changes could mean for you and everybody out there. good morning, christie. there is something for everybody. booster seats for children. they like to get beer and other alcohol using the self serve checkout area that you see in the supermarkets. you have to go to the regular checkout in wait in line to get your party started like everyone else. people younger than 18 won't be able to buy people take them in

really high doses as some do to get high. and minors won't be able to jump in the tanning beds and get their tan on regardless of parental consent. doctors can prescribe it if necessary. these are a few. we're going down the list every half hour. the three that i mention, those go into effect this sunday. reporting live, i'm christie smith. back to you in san jose. >> thanks for the update. 4:33. police caught the man responsible for a brutal 1999 cold case murder. 40-year-old raymond wong was arraigned yesterday. prosecutors say the registered sex offender kidnapped 21-year-old alice sinn and shot her four times. he was an ex-boyfriend. her father says he's waited 12 years for this arrest. >> does it give you any sense of relief? >> a little bit.

he's a very cocky, somewhat arrogant individual. he believed for years he had gotten away from this. >> her body was found two months later in a nevada desert. it's a case of alleged fan violence and fears of yet another potentially devastating brain injury. it's been nearly a year since bryan stow was attacked at a dodgers game. now a 16-year-old bay area girl says she was shot. the 16-year-old who attends independence high school also suffers from a brain tumor she's had since she was 12.

she suffer ads concussion after a drunk sharks fan started harassing her and hit her in the back of the head. >> it was second period when they scored the second goal, and i just felt two hands come down on my head, and i just flew forward, and then my sister asked me if i was okay. the lady next to her asked me if i was okay. everything was blurry and foggy. i don't remember muff. >> her and her sister went to the game together. it was a christmas present from maya for her sister. police are investigating the attack. as of this morning nobody has been arrested. arena staff along with san jose police interviewed the person who made contact with the injured fan who stated that the contact was accidental during the celebration of a shark's goal. >> the man involved in a standoff in south san jose is in jail this morning. he faces multiple charges, including brandishing a deadly

weapon at an officer and assaulting the officer. yesterday he called police to say he was confrontational when asked to turn down his music. he refused to come out when police arrived and was armed with a machete. after a five-hour standoff he walked out with a bottle of alcohol and tried to lung at a police dog. the dog bit him. no officers were hurt. 12 people were arrested inside a foreclosed property on 10th street. the yesterday police went in, cleared them out, and then crews boarded up the door's home and windows. the chp says the annual holiday dui crackdown is already yielding results and it's not over yet. extra patrols will be out to keep an eye on new year's eve

partiers. police have arrested more than 1,000 people in the bay area. almost 500 were arrested in alameda county, some of them after the raiders/lions game on december 18th. dui checkpoints will be set up tonight and tomorrow. it's 4:36. a memorial service will be held for a devoted citizen watchdog who died at the very young age of 55. he dedicated his entire life to keeping oakland city officials for more than 20 years. he published an opinionated news letter called east bay news service. he attended each and every meeting at oakland city call including commission meetings. he was found dead in his home on tuesday. a bay area chapter of the boy scouts is the latest victim of metal thieves. the organization's famed symbol was recently stolen from the boy

scout building of the silverado council in pleasant hill. someone pried it with an eagle superimposed over it from the building. chopped pieces of the sign were recovered at a local recycler, but no arrests made. at&t park ready to host a bowl game this weekend, and the players for the kraft fights hunger bowl are ready to give back. this morning they'll serve lunches at a san francisco church. tomorrow they hit the field. ucla and illinois going head to head at 12:30. it's aimed at donating mills to 50 million americans in need. good morning. it's 4:38. it looks like it's raining. the roads look like they were rained on overnight. let's check the forecast with christina loren. >> we have interesting things happening this morning. the main storm tram track still

sits way north. we're seeing a front bring in moisture. this morning you'll have a steady mist. have your windshield wipers on all the way to your destination. as we head throughout the day, we have showers on the way. pretty good amount of rainfall headed to the north bay, the chances getting better and better every time i check. as we head throughout the day, a lot of clearing and better air quality as a result. today you really want to watch out for thick fog in the north bay. we have two and a half miles visibility in livermore. we expect the numbers to continuously fall throughout the morning. the temperatures this morning, nice and mild yet again. almost at 60 in san jose. 58 degrees. so this is a warm system. we're not going to see all that much cold air, and what that means is as this moisture makes its way over the sierra nevada,

it's probably going to fall down, precipitation in the form of rain. not so much snow expected because it's so warm. as we head throughout your friday, the jet stream starts to take a dip later on today. that's going to bring in more rain, probably north of the golden gate bridge is where we see most of the rain come down. breezy conditions with sunshine. quite a difference a day will make as we kick off saturday, new year's eve, looking good. and a really nice pattern shaping up for next week as well. >> christina, thank you very much. 4:40 now. the raiders are not just playing for a playoff spot, they're also playing for two possible nfl records. they're not the ones you want. the silver and black need just four more penalties and 11 more penalty yards to sur the existing record of most penalties in a season. both are currently held by the 1998 kansas city chiefs. the raiders play the final game of the season at home against

it's okay for sacramento to take away redwmt money. that could take money away tr the 49ers stadium. no one is sure if the money will make it to the project. woun council member is not worried. >> i'm not concerned about it. i believe it will move ahead regardless of what happened today. because the funds were skmited prior to this present legislation. >> gilmore says if the city can't provide the cash the 49ers are on the hook for it. meanwhile, the redevelopment ruling may mean the end to the oakland a's ballpark plan. city leaders want to build a new stadium to keep the team in town. many require redevelopment money. still city mayor jean quan is

remaining hopeful. even though most people are taking time off for the holiday, unfortunately the marble debt is not. the u.s. treasury department says at the end of the day the nation's debt will come within $100 billion of the total limit. it's a big deal. president obama will need to alert congress to get to work again on increasing the debt limit. right now the debt ceiling, if you're keeping track, $15.194 trillion. >> hard to wrap your mind around that. today is the final day of trading for 2011. for a look at that, we turn to jackie deangeles. good morning, jackie. >> the futures are flat on the final trading day of the year. stock rallied. the dow rose 135 points to close

at 12,287. and as for the year the s&p 500 is roughly flat in 2011. utilities were the top sec for. financials were the worst. they are reporting that apple is having two new ipad models for a january launch. the models would be aimed at the mid to high end market. they're going to feature dual l.e.d. light bars to increase brightness. apple hasn't appeared at mac world for years. over to you. >> thank you very much. 4:47. let's turn to the forecast. christina loren is tracking some mist. >> yeah, and it's so bizarre. you'll drive to work and probably keep your windshield wipers on the whole time.

it's a pretty steady mist. no rain to wash off the oil. hard to gain traction with conditions like this. throughout the day today we have more moisture on the way. but what's happening now is a little front is dropping in the bay area to increase the onshore flow. really thick fog. that's creating the mist. although we're not picking up returns, it's still wet out there. drizzle from san jose up to san francisco and up the marin county coastline. throughout the day we'll continue to see visibilities drop off. especially over the next few hours. when it comes to weather, we'll see rain. and we need the rain up in santa rosa from napa to novato. probably pick up one-tenth of an inch. all the rain starts to subside by late afternoon. it will come in quick, and we'll

a popular toy is being recalled. the build a bear workshop is recalling 3 # 0,000 colorful hearts teddy bear. the eyes can loosen and fall out posing as a choking hazard for kids. now if you have a colorful heart teddy bear, you can return it to a build a bear workshop and receive a coupon for any stuffed animal in the store. 4:55. the nationwide closure of sears and k-mart stores will not hit the bay area. they posted a list of 48 stores slated for closure. only three in california. two down in san diego. one in los angeles. sears expected to announce the closure of 41 more stores in the near future. >> al ka traz was famous for keeping prisoners locked up
