right now on "today in the bay," people all around the world welcome in the new year during spectacular fireworks displays. also, a monkey stolen from the san francisco zoo is back home this morning. now the question is, are the police closer to finding who stole him in the first place? and a 5-year-old boy was shot and killed this weekend. this is "today in the bay." and look at this pretty picture of the golden gate

bridge. a little more traffic than we're used to on a sunday morning. folks probably heading home from a nice evening out. >> that would be a long night. >> it was a long night. thanks for joining us this morning. i'm kris sanchez along with meteorologist rob mayeda. happy new year. >> happy new year to you too. new year, old forecast. notice the numbers around santa rosa, fairfield, 30s. you also see 50s this morning around san francisco and sunnyvale. higher up, about 500 feet up toward the foothills, we have a strong offshore breeze today. that will do interesting things to our temperatures. starteding off cooler for fairfield and concord, where it's a bit of a fog machine this morning. notice by noon 60s around san jose. down towards morgan hill and gilroy, may get close to 70. that would be a record-breaking start to the new year in terms of temperatures. 60s elsewhere. quite dry. quite mild despite the chilly

start. we'll let you know if it will stick around for the first full week of 2012. >> thank you, rob. new this morning, at least four people are out of their home forced out by a three-alarm fire that destroyed their victorian style house in san jose. the home erupted in flames just before 1:00 this morning in the 400 block of north 5th street, which is east of highway 87, north of julian street. 55 firefighters fought that blaze for about an hour and a half before putting it out. no other buildings were damaged, and no one was hurt. now investigators are trying to pinpoint the cause of the fire. now to banana sam. that monkey that was nabbed from the san francisco zoo a few days ago is finally back at home at the zoo this morning. someone stole the two-pound, 17-year-old squirrel monkey from his exhibit thursday night or friday morning. then last night police got a call about a monkey in stern

grove at golden gate park not far from the san francisco zoo. the caller told officers he recognized banana sam from news reports. >> according to the bystander, he was walking in stern grove. he noticed a monkey appeared from out of the bushes. he then was able to coax the banana into the backpack he had. he notified us. we then transported the monkey over to the san francisco zoo. >> zoo keepers say sam was thirsty, hungry, and shivering, but otherwise okay. there was a $5,000 reward offered for his safe return. in oakland, police are searching for the man who shot and killed a 5-year-old boy. the boy was standing with his father at the family's taco truck when shots rang out friday night. kim berber truck when shots rang out friday night. kim berbly terry talked about wh his family. >> i had to call my dad.

he said they shot my brother. >> reporter: 5-year-old gabriel martinez, jr. was shot friday night parked on the corner of international and 55th. gabriel was just a few feet from his father, helping unload supplies for the taco truck. that's when police say a man who had either just ordered or was waiting to pulled out a gun and opened fire. >> i don't know. he hears gunshots. my dad's like, don't get scared. when he checked, it was a little boy. >> reporter: after the shooting, police say the gunman got into a car with a woman and took off. gabriel was pronounced dead less than a half hour later. >> i don't know if they're drunk or just plain dumb or they don't care about people's lives. people like that don't even care about themselves, i believe. >> this has to stop. >> reporter: gabriel is the

third child to be killed from gunfire in oakland in five months. in august, a stray bull fret a drive-by shooting killed a 3-year-old. earlier this month, a 1-year-old was taken off life support after he and six other people were shot in west oakland. in oakland, a service was held for the 110 people whose lives were lost to violence in 2011. the mayor and police chief spoke to the crowd vowing to make oakland a safer place but also calling on the community to help. the police chief says he visited gabriel's parents and says it was the toughest 15 minutes in his 24 years in law enforcement. >> it is very, very painful to sit with someone who has just lost a loved one. it's extremely painful when the loved one is a 5-year-old kid. as a parent, that is something

that i could not imagine having to go through. >> that was kimberly terry reporting. so san jose now where a woman who claimed she was attacked along with another woman is now booked on is suspicious of murder. san jose police say the 41-year-old called 911 claiming an intruder was attacking her and the other woman with a machete in a home in san jose's willow glen neighborhood. when police arrived, they found one woman dead. later, the suspect was arrested and booked into the santa clara county jail. police say they won't release more details until the family is properly notified. in los angeles, police and firefighters are on the hunt for an arsonist or arsonists who continue to torch cars, putting entire neighborhoods on edge. just last night, four more fires broke out and fire officials say at least one of them fits the pattern that started days ago.

here's more. >> reporter: he said it was his wife who woke him to say a neighbor's car was on fire. logic and fear drove him to take action until the real firefighters arrived. >> we just ran over. i got a hose and started putting it out. she called the police. luckily it was just the car. >> reporter: there's been luck so far in what fire officials say is clearly an arson rampage. none of the fires have started in a house filled with sleeping occupants. instead, just about every one began with a vehicle enflamed. >> we lost four cars. it could have easily been a life. thank god that didn't happen. just so close to that. >> reporter: if it's all a play for attention, it's working. local fire and police teams have now been joined by federal firearms investigators in the search for evidence and suspects. so far, none of the latter. >> we're pulling all of our resources together to make sure we track down and arrest that suspect. >> reporter: suspect or

suspects, and maybe even a copy cat at work too. that's because one of the worst arson rampages in l.a. history has occurred in short bursts of time. 21 overnight fires set through friday morning. at least 13 more by daybreak saturday. ten of those in north hollywood. investigators are studying inconclusive home video they've obtained, but they need more help. >> if you see anything, hear anything, please report it immediately. ten miles northwest of l.a., the final touches are being made on the floats appearing in the 123rd annual tournament of roses parade in pasadena. millions of roses are going on that float that will wow spectators during the parade on monday. volunteers and designers have been working on those floats for months. the tournament of roses parade kicks off tomorrow. you can see the entire thing

right here on nbc bay area starting at 11:00 in the morning. and here are some of the new year's celebrations from across the country last night. more than a million people rang in the new year together in new york city's times square. the enormous crowd counted down to midnight all together. mild temperatures made it a bigger turnout than usual. in mobile, alabama, a giant moon pie dropped 317 feet at the stroke of midnight much to the delight of the crowd. the giant moon pie weighs 350 pounds and is 12 feet tall. in case you didn't know, moon pies are a popular cookie in the south. music city celebrated the new year in style. we're talking about nashville, of course. people withere welcomed in 2012y dropping a music note.

and the las vegas strip was lit up with fireworks in celebration of the new year as well. seven different casinos put on shows to ring in 2012. in all, more than 56,000 fireworks were launched during the show, which lasted eight and a half minutes. in seattle, fireworks were shot off at the space needle to create an out-of-this-world light display. it took more than 1700 different firing cues to put on that spectacular show. and we still have more ahead on "today in the bay." doctors at ucsf are using cutting edge technology to help people who are paralyzed walk again. and a 6.8-magnitude earthquake jolts japan. details coming up. and a new year means new laws going into effect.

good morning to you. looking live at ferry building. a lot calmer than it probably was last night. hope you are feeling rested this morning. new year, new laws, including a plastic bag ban in the bay area's biggest city. if you buy something in san jose, the retailer can no longer sack it in plastic. retailers will be able to use paper bags, but they are required to charge ten cents for each bag. this ban is aimed at creating a cleaner environment, but opponents stay will hurt small businesses and also inconvenience shoppers. san jose is urging people to remember to carry those reusable bags with them for purchases. jo jody hernandez has more on the other laws taking effect. >> we don't go anywhere without having seat belts on. >> reporter: these children know the drill. a trip in the mini van means strapping into their car seats

for safety. >> if you don't put on your seat belt, then you'll get hurt, and then you'll end up in a hospital and that's no fun. then when you end up in a hospital, then you can't play. that's no fun. >> reporter: now thanks to a new law, these children will be buckling up in booster seats a few years longer. children will be required to ride in a backseat booster until they're 8 instead of 6. >> i think it's important because the kids need to be safe when they're in the car. if they get in a crash, the seat belts will harm them if they're not tall enough. >> reporter: that's just one of hundreds of new laws that will hit the books come new year's day. if you enjoy shark fin soup, eat up now, because restaurants will no longer be able to stock up. shoppers won't be allowed to buy liquor through the self-serve checkout line. and openly carrying an unloaded

gun will also be illegal. expect tougher penalties for driving drunk. if you're under 18, don't make plans to tan. the state's pulling the plug on that too. 16-year-old genevieve isn't happy about it. she tans weekly but not for long. >> i like tanning beds because they're fast. you just get in there. you put your lotion on. you tan for seven minutes or however many minutes you want. you come out, and you're tan. >> at this point, we have to make sure we're checking every single person that doesn't look 30 years old. it's going to be the same as cigarettes and alcohol. >> reporter: while change isn't always easy, the new laws are designed with your well-being in mind. this 5.5-year-old says he doesn't mind the booster seat at all. >> i want to keep it for a long time. >> reporter: jody hernandez, nbc bay area news. new year, maybe new money.

good morning to you. looking live at downtown san jose. hoping your 2012 is off to a nice start. i thought it was a chilly start to the day. rob, you say it's going to be pretty warm by this afternoon. >> areas south of san jose, yeah, pretty warm. san jose, because we don't have wind, kind of chilly this morning. 45 in oakland. hazy skries across the bay. san jose, 40 degrees. southeast wind at 3 miles per hour. if you're tuning in with us, just before 7:00 this morning, you might have felt a bit of an earthquake. this just came in around 6:59 this morning. 2.5, seven miles northeast of downtown san jose. if you thought you felt something this morning, yes, the grounds was moving just a little bit. chilly where we're not seeing wind, like gilroy. 51 in san francisco. 52 in sunnyvale. napa, 14 degrees warmer than santa rosa right now because of those offshore winds. you can see some of that cooler

air also spilling into the delta, where we have thick fog, dense fog waiting for you. so breezy in the hills as that dry air drops down to sea level. that will be warming up our temperatures. 60s, maybe even near 70 degrees in a few spots. it's a spare of the air today. tomorrow will also be another spare of the air day around the bay area. we have some high clouds from time to time for the afternoon. storm track moving off to the north. really, no sign of any rain here. monday, we'll notice a bit of a push of the sea breeze. the rain can't quite reach the bay area. this looks to be the trend. the fog we're seeing around the central valley looks good. heading into tomorrow morning, sea breeze picks up, and we'll see a few extra clouds. a little cooler towards monday. then we warm up again for the middle part of the week. highs around the bay area today. coolest places will be fairfield and concord, will those will be

fog-cooled temperatures. as that dry air drops down from the east bay hills, san jose should climb into the 60s. maybe close to 70 around gilroy. 68 for santa cruz. san francisco and oakland not too bad. low 60s. you have your cool temperatures there in fairfield. warmest temperatures today should be around morgan hill and gilroy. a little breezy and dry across the north bay. the first week of 2012 looks quite dry. cooler tomorrow with extra clouds. thursday, though, even that chance of showers looks to stay north of santa rosa. we're carrying over that dry december. we really could use the rain, but really not showing up there. >> it's just shocking to see the difference between where we were last year and where we are this year. you know, 24%. >> unbelievable. this year, running about 30%. quite a change. >> thanks, rob. people in japan are starting the new year checking for damage after a 6.8 earthquake which rattled part of the country, but

did not trigger a tsunami. the quake struck 370 miles south of tokyo today, 230 miles below the sea. this is video of buildings that were shaking in tokyo during a few tense moments. the japanese have reason to feel anxious. today's tremor comes more than nine months after a devastating tsunami that crippled parts of the country and created a nuclear power disaster in fukushima. also in japan, a member of a cult who has been on the run for 16 years turned himself in. he had been wanted by authorities since 1995 in connection with the abduction and murder of a man trying to get a relative to leave the cult. he told police that he had been on the run long enough and also said that his only involvement was to drive the car in that kidnapping. the victim's son hopes to learn what happened to his father. an iranian navy commander

announced today its navy test fired a new anti-radar missile. that missile was fired during a ten-day naval drill that began last weekend. the iran-made missile is said to have long-range capabilities the drill coincides with increased tensions between iran and the west after western nations announced stronger sanctions over iran's nuclear program. at beginning of the drill, a naval commander threatened to close a major waterway where 1/6 of the world's oil supply passes through. new year's revelers are waking up with memories of their big night. let's take a look at how people celebrated around the world. in dubai, aerial footage shows spectacular scenes at the world's tallest building. the display lasted about ten minutes to the thrill of thousands of people who were

good morning. looking live at the bay bridge and all those pretty palm trees. not a bad way to start the day. it's an early start for those of us, you know, who stayed up a little late. we're cheerful, right? living in the heart of silicon valley, we're used to technology. now, doctors at ucsf are using that same technology to transform lives in an even more profound way. in some cases, they're using technology to help paralyze the people to walk again. here's tracy grant. >> even the simplest things we do that we take for granted every day, someone who's paralyzed loses that ability. >> reporter: a diagnosis of lou gehrig's disease or a car accident have seemed like a medical jail sentence for many people. their freedom and movements are severely restricted, but dr. edward chang says that doesn't have to be the case. >> what we're trying to do is fuse the neuroscience research

we're learning from human brain activity in the context of patients that actually have disease to come up with new devices to help patients who are paralyzed. >> reporter: chang and his colleagues are working on building a computer that can be placed inside your skull on top of your brain that will be able to help a paralyzed person use their limbs or robotic prostheses. the computer will be able to decode the information from the brain that controls complex movement. >> what we've developed is something the size of a postage stamp that would be slipped just on the brain's surface where it can read the activity directly from the brain. >> reporter: it's a complicated process, but it boils down to this, the brain thinks it, the computer reads it, the body does it. it could happen quickly. chang is hoping to start clinical trials on paralyzed patients within the next five

oakland. san jose, we have light winds, which is why it's so chilly around the south bay this morning. 45 in oakland right now. 30 in santa rosa. look at san jose. 40 degrees. kind of chilly. the winds are going to do some interesting things to our temperatures. first, the raiders forecast. early afternoon, 63 degrees. big game coming up as they take on the chargers here at home. of course, 49ers taking on the rams in st. louis. you can see our temperatures today. san jose to gilroy has a chance to get close to 70. that would be breaking records for january 1st. pretty warm for parts of the south bay. cooler around concord where the fog and northeast breeze is keeping things cooler. things will be warming up today. we'll let you know if it will stick around coming up. >> thank you very much. that monkey taken from the san francisco zoo is back at home where he belongs. someone stole banana sam, a two-pound, 17-year-old squirrel monkey from his exhibit thursday

night or friday morning. last night, police received a report of a monkey in stern grove at golden gate park not far from the zoo. the caller told officers that when he spotted banana sam, he recognized him from news reports. >> according to the bystander, he was walking in stern grove. he noticed a monkey appeared from out of the bushes. he then was able to coax the banana into his backpack he had. he notified us. we then transported the monkey over to the san francisco zoo. >> zookeepers say banana sam was thirsty, hungry, and shivering a bit but otherwise okay. a $5,000 reward had been offered for his safe return. in oakland, police are still searching for the man who shot and killed a 5-year-old boy in the evening on friday. the boy was standing with his father at the family's taco truck in east oakland when he was shot. he's the third child to be shot to death in oakland in 2011.

loved one is a 5-year-old kid. as a parent, that is something that i could not imagine having to go through. >> that was kimberly terry reporting in oakland. in san jose, the police department is investigating the city's 39th homicide of 2011. it is a case that started with a 911 call about an intruder. investigators say the machete-wielding intruder claimed he was being attacked by another woman. it was she who allegedly attacked the victim with a machete-type weapon. when police arrived at the scene, they found the victim dead while the suspect was injured with a non-life threatening injury. later, she was arrested and booked into the santa clara county jail on suspicious of murder. police have not released any information on the motive. dozens of high-end watches

that were stolen in san jose a few months ago have been found in san diego. the rolex watches were taken in this smash-and-grab robbery back in october. gunmen who used sledge hammers to break into cases stole thousands of dollars worth of jewelry. police displayed the merchandise from four jewelry stores. the watches are worth at least $1 million. back in november, police in san diego arrested 34-year-old ryan mcknight and 40-year-old robert chivera but just recently found the merchandise. >> he's been in custody for a couple months, hasn't paid the rent. the property management was going in to prepare for a new tenant and came upon what you see behind you. >> in the most daring robbery, police say the gunmen drove their car through a san diego mall dodging pedestrians. for the watches, we're told they'll be sent to each police agency before being redistributed to the stores or insurance companies.

happy new year. look at san jose right now. we're pretty close to 40 degrees. by the afternoon, maybe close to 70. yes, the calendars don't apply to the type of weather we're seeing today. no rain, but possibly record-breaking warm temperatures for part of the south bay. right now, i know that's hard to believe when you're waking up to 30s in the north bay. patchy frost in santa rosa. 52 in sunnyvale. nearby where the winds are lighter in san jose, 40 degrees. gilroy right now, 34. the wind direction northeast at 6 pumping in fog to concord and fairfield this morning. those two locations probably missing out on the warmup today. right now, oakland, 45. southeast wind at 12 miles per hour. there's the view from san bruno

mountain. 51 degrees in hsan jose for now. you may be able to add 25 to 30 to those numbers we're seeing in the afternoon. we had an earthquake this morning northeast of downtown san jose. about a 2.5. that's right on the threshold of being able to feel that. that was at 6:59 this morning. some of our weather headlines. breezy in the hills. patchy fog toward solano county. today looks like a lot of 60s. if these winds stay up long enough and mix down that warmer, drier air toward sea level or closer to downtown san jose, it is possible we may see 70s outside. not enough wind this morning to improve air quality around santa rosa. spare the air alert for unhealthy air quality levels there. looks like another one into monday. right now, not much in the way of clouds. we'll probably see high clouds for the afternoon. look at what's happening with this storm offshore. it's being pushed off to the

north. just the trailing edge of this will come through the far north bay for tomorrow. watch what happens here. not only do we have dry air on top of the bay area, but the outer fringe tries to hit. just like that, it's gone. it will pull up the sea breeze. it will give you more clouds into monday. there's the fog inland. sunshine for the afternoon. monday morning, here comes the sea breeze again. we'll see brief cooling. then temperatures will rebound again as high pressure builds in behind that system monday into tuesday. so i think if you're south of san jose towards morgan hill or around the coast around santa cruz even, it is possible. it really depends how long the winds stay up. we're going to call for at least mid 60s. these types of patterns, i've seen it happen before, we could get low to mid 70s. that will be interesting to watch. 3:00 and 4:00 this afternoon. for the north bay, low 60s. look at those tahoe temperatures. mid 50s. we should be talking about snow
