area. you really want to travel cautiously. give yourself ample time to reach your destination. that fog will likely slow you you down at least until 9:00 a.m. we are still headed to a gorgeous afternoon. this is the clearest we have seen the view. schools are back in session. and we're seeing the commute ticking in full force this morning. so there's the backup at the toll pla s. we'll show you more coming up. it's 6:01 now. the suspect in the brutal machete murder in san jose remains jailed. but we're learning more about the victim. marla tellez is live in san jose

with the latest information. good morning, marla. >> reporter: laura, good morning. i just put in a call to san jose police to see if they have uncovered a motive. at this point it's not clear why 65-year-old yvonne kirk was killed. the main suspect in her death is her daughter's partner, who is being held right here at santa clara county's main jail. now police say 40-year-old sagal sadig was found covered in blood, standing outside the willow glen home she shared with her partner. neighbors say they haven't seen kirk for weeks. and investigators don't know why her mother was there. >> spoke to her for a while. seemed very nice. said she had a partner that

lived with her. >> her facebook page says she works at goodwill of silicon valley. ooich reached out to her for comment through facebook and good will. the murder happened friday before the new year, so it marked san jose's 39th homicide of 2011. she's set to make her first court appearance on thursday. cal tran dealing with the first death on the tracks of the new year. a woman was struck and killed at 7:30 last night. the train was headed south of stran down through san jose. as we say it marks the first death of the year. last year there was a total of 15 fatalities. officers are reviewing school

security systems after someone broke into petaluma high school at 7:30 p.m. on new year's day. the person who broke the window to the staff lounge. no word on what, if anything was stolen. if you saw anyone in the area at the time, call petaluma police. it's 6:04 now. the fan who claimed she was attacked at a recent sharks game said she doesn't want free playoff tickets. she wants an apology. she told the san jose mercury news she's been offered personal gifts and tickets for fans but has yet to hear an "im sorry" from the woman she was whacked on her head by. she's a brain cancer survivor and suffered a partial concussion from the blow. she said she hit her by accident while celebrating a goal. they're investigating but not saying how many people saw what happened.

>> it is 6:04 right now. the man hunt is over. police say they have found the body of the iraq war veteran at mount ranier national park. 24-year-old benjamin barnes was able to elude police but couldn't survive the snow. he was found wearing jeans and a t-shirt and likely died of exposure. he's accused of shooting four people at a party on sunday and then killing park ranger margaret anderson during a routine traffic stop. the project was launched almost two years ago with a promise to create jobs and to cut travel time to the airport. christie smith is live in oakland where bart came up short. did morning, christi. >> reporter: good morning, jon. this has been an on and off project for years. now the support columns are finally going in here. i'm going to try to show it to

you. but it's awfully foggy out here. we shot new video this morning. an elevated the three car train will take riders down over to the oakland airport. and this will replace the current air bart bus system. it downside like an easy upgrade that most people might like. there's a redebate going on. supporters say it will be quicker, create 2500 jobs and spark growth in the area. but you also have critics who feel the price tag is way too high and the jobs promised probably won't come. bart is defending the cost that start at $130 million that say that early projections aren't right, but they weren't the one who is made them. the 3.2 mile connector should be up and running within in next two years. live in oakland, jon and laura,

back to you. >> okay, christi. thank you very much. new red light cameras will be online at dangerous intersections in san francisco. the city plans to activate a camera later this month. fines for red light runners can run more than $500. 6:07 now. it started out as a cold, foggy day but meteorologist christina loren says it should get nicer as we go on. >> it's going to be a really nice afternoon. we have to wait for the sun to breakthrough the clouds. especially by the water. right now visibilities are dropping. and they'll get even lower. very interesting what's happening here. over the last 15 or 20 minutes, down to a quarter mile in concord. below a mile everywhere on the reporting map except for livermore and san jose.

we're expecting the cities to drop off through the next couple of hours. take a look at what happens between 6:00 and 7:00, the fog is more widespread. really thick pockets of fog down to the central valley. take it i ze along i-5. we stop the clock at 11:00 a.m. still low clouds hanging out over san francisco along the peninsula. but we get a nice break with clearing in the south bay. we'll easily make our way. limited sun early, a comfortable afternoon today. tomorrow, the warmest day of the week, i'll let you know how warm it will be in your city. try 70 degrees in san jose for a hint. by thursday staying dry, increasing clouds, though, maybe, just maybe an isolated shower in the north bay. >> we're look at a slower drive.

you have to lower the speeds because of that 13 registering at the l-street sensor. southbound through concord we see a great deal of slowing there. speeds hovering around 20s and 30s at times partly due to the volume of traffic we'll look at more travel times throughout the east bay. we're looking okay as far as 680 out of walnut creek. 580 is slow into livermore. speeds slowing into the 40s and 50s into livermore itself. 880 is slow through oakland because of the fog. you can't see part of it. fog advisory for most of the bay area bridges. just be careful, folks. back to you. >> good advice. san rafael will welcome the first ever female police chief. diana bishop will be sworn in as the city's 16th police chief,

welcome back, everyone, the goal is in site for the san jose earthquakes looking to move into a brand new home. let's say good morning to bob redell live at the proposed sit site. is there anything in particular to throw a wrench into the plans? >> that is the appeal. today is the last day they can appeal for the stadium at 880 and coleman across normanetta international. assuming no one raises a challenge, they could start construction on the $60 million, 18,000 seat stadium. there are some people who live nearby who are worried about the noise in the neighborhood. they have said they are considering an appeal. time is running out. we spoke with a team this morning. they have met with residents to

try to address the concerns and will continue to meet with them if the stadium plan goes through. the team says they're hopeful they'll receive the final approval. the stadium would take 9 to 12 months to build with the dream of having it open in time for the 2013 soccer season. they would make the ground breaking a big event open to the public and fans. jon, laura? >> all right, bob. thank you for the update on that. >> it's 6:14 right now. 127-degree temperatures, and still snow managed to fall. this is what it looked like in clooefl yesterday. the bank thermometer malfunctioned. 127-degrees on the temperature side. >> i don't think that's accurate. i was mistaken. >> really, that temperature was closer to the 20s. the snowstorm has closed schools and canceled flights in the area.

upper 50s, not too bad at the coast. by wednesday, mostly clear start. offshore flow will kick into high gear. so not as much fog tomorrow morning. should be nice and clear to start you out. also the warmest of the week. up wards of 70 in some cities. i'm forecasting 70 in concord, livermore and san jose. so we'll stay nice and dry for thursday with increasing clouds and maybe an isolated shower. up to 50 degrees by noon in san jose. really comfortable conditions once we get through the clouds. seven-day outlook shows you we have a slight chance of rain. but we have to wait for it probably monday into tuesday. so we'll talk about that and a

what that means if for sierra. >> you're talking about the patchy fog. keep thatted in mind. a lot of schools are back in session throughout the area. and closer to the school start time. 7:30, 8:00, you'll get dense fog in patches as well. no major slowing. 101 moves nicely past tully where we typically see the first slowing. we'll track the volume. it's heavier this morning than in past weeks. we're looking at the lower bay shore as well. a smooth drive for 101 past the dumbarton bridge. you can see down in 50 to 100 feet at spots, that's really tough. the toll plaza where the backup is starting to form, they may have just turned the metering lights on. a dense fog advisory has been issued for this span. and hearing reports of a truck

with flames underneath it towards the san francisco side. i was tracking that. no one is injured. but we'll end with this shot and a warning you may find slowing into the city. >> thanks a lot. in an effort to practice safe driving new laws trying to crack down on distracted drivers. the new law affecting 4 million commercial drivers. the law allows emergency responders and tow truck drivers to use their cell phones while behind the wheel of a car. new year making rearview cameras a requirement on all new cars. seven california hospitals collected information about injuries and fatalities from january of 2005 to june of 2007. that data revealed 46 kids were

killed and 100 injured. to help prevent accidents. they want rearview cameras to be required on all cars. some worry a camera will give them a false sense of security. one mother says it's a good idea. >> she would love that. as you see with her little one running around and doesn't want to stay in one place. kids are curious. >> kids and cars is starting the new year off by stepping up pressure to require backup cameras in new cars starting in 2014. it's 6:19. andrew luck is leaving stanford on a down we are a loss at the fiesta bowl. >> it's never about who should have won the game, who should have won the game. to reconcile it, it's hard to reconcile. a loss the last game of the year. butly say i'm so proud to be able to represent stanford.

across the board in terms of visibility. but we still have six miles in livermore, 4 miles in san jose. throughout the morning, you will probably be slowed down by the thick pockets of fog out there. it's very, very dangerous. one of the days where it's even worse than usual around here. we don't be get that many days with visibility at 50 feet. any delays on the roadway because of this, mike? >> i'm going to say you want to slow it down. you're going to have to. there's backup. the metering lights are on. the fog advisory and the number of issues involving trucks crossing the bridge. the latest is a disabled tanker truck approaching the s-curve. should be cleared to treasure island quickly. we're checking it out.

>> it's 6:# 2. an east bay community is ringing in the new year with the realty of the same old problems. some residents are vowing to take back their streets during a vigil for 5-year-old gabriel. he was shot and killed at a taco truck owned by his parents. his father explained what happened, choking back emotion. >> obviously we don't have the sound from the father. but he said a man he had never seen before had said something to him. he didn't understand him. he was with a tacoo truck that he owns with his wife when that gunman started shooting, leaving the little boy dead as he fell to the ground. police have very few leads in the murder and they're offering a $25,000 reward for information leading to an arrest.

the men who shaped the most memorable buildings in downtown san jose is now dead. the san jose mercury news reporting the mexican architect died on friday at the age of 80. he designed the children's discovery museum and tech museum of innovation. it's been ten years in the works, but two years after breaking ground, the promises that came with bart's oakland airport connector is coming up short. christie smith joins us live with a controversy surrounding the project. good morning, christi. >> good moorng to you, laura. it's hard to make this out in the really, really thick fog out here this morning. but the support columns are up. 3.2 miles for the coliseum bart station right down the road over to the airport. what it is is it's three-car train on an elevated track, right now, a bus moves riders on a system called air bart. it sounds simple enough, but it never really is. people are divided about this.

the rainfall helps to purify the air. we're not sparing the air. however, it's been forced to the surface by a big ridge of high pressure that will clear the sky and warm us up to 70 degrees tomorrowful that's what is happening this morning. even though your city may not record visibility below a mile, you're encounter thick pockets out there. once the sun comes up, it really gets bad. this is what we're forecasting for you. 7:00 a.m., widespread fog in the bay area. we continue to 11:00, we meet back for the 11:00 a.m. broadcast, we'll have a fair amount of cloud cover on the coastline and the central valley. clearing for the south bay and the tri valley. we continue to noon. that's when high pressure really starts to do the job and push the cloud cover out to sea. it will set up over the great basin later on today. that will make for really comfortable temperatures for the second half of your day. probably clearing the fog by noon. by tomorrow we should wake up with a completely clear start so

big time skier. she wants the snow fast. >> the number one question posed to me on facebook. when will it snow? when can i hit the fresh powder? not within the next six days. when we start out next week, we might be starting out with showers right here in the bay area and snow showers up in the sierra nevada. it's not looking that promising just yet. what i can tell you, though, is the jet stream is going to take a very substantial dip as we head toward the middle of this month. that's what it's looking like right now. and at that point we ramp up the rain chances and see the pineapple express shape up. now high pressure is building in. you saw the live shot of san jose. that's the only shot we can see at this point where you only have four miles of visibility elsewhere. so make sure to give yourself plenty of time to reach your

slowing speeds in the 40s. close to 60 for okay land. we have fog making it tough. typical spots with the 50s showing up now and the build is on for the commute. >> ground breaking for a brand new soccer stadium could be approved today barring any last-second appeal. bob redell is live at the proposed site. is there anything to slow this down? >> it would be a last-minute appeal. today is the last day that anyone could appeal the permit that the city of san jose issued for the new san jose earthquake stadium to be felt in the empty lot here near 880 and coleman across from noranetta international.

however, there are some people who live nearby here who are concerned about the noise the stadium would bring into the neighborhood. they have said they are considering an appeal. i've been exchanging e-mails with them this morning. they're trying to confirm whether or not an appeal would be going forward. we spoke with the team this morning also. they have met with residents to address their concerns and will continue to meet with them. the team is hopeful they'll receive a final approval. so much so they've already begun selling 1,001 square foot luxury suites that will be in the new stadium. the dreams of having it open in time for the 2013 soccer season. they would make the ground breaking a big event to be open to the public and their fans. jon, laura? >> thank you for the update. it's 6:50. an arrest in the arson spree in

los angeles. since early thursday morning there have been 52 fires in and around southern california. sunday night a dozen additional fires were set. early yesterday morning came a big break in the case. sheriff deputied dpe taned a 24-year-old man. the part time deputy says he resembled the man seen in surveillance video taken near hollywood after a fire in a parking structure. >> thank you to the two officer who is backed me up as soon as i put on my lights and initiated the traffic spot of the suspect vehicle. i had an lapd backup with me. >> the fire caused $3 million in damage. 6:51. bp is going on the offensive, suing a contractor after the devastating oil spill in the gulf of mexico.
