good morning to you. thanks so much for joining us this morning. 5:59. i'm laura garcia-cannon. >> good morning. i'm jon kelley. let's check in with meteorologist christina loren to find out the weather is going to be this week. >> we're looking pretty good right now. it looks pretty clear. visibility dropping off in the north bay. as we head throughout your morning hours, the sun is going the shine over places like san jose and san francisco right off the bat. we're expecting temperatures today upwards of 70 degrees in some cities. we'll tell you if that's yours and maybe a little rain at the end of my seven-day forecast, we'll talk about that. first let's talk to mike about your drive. >> better news than yesterday as far as visibility. your forecast talks about that as well. we don't have the problems with fog like we did. but we do have the commute building over the course of this week. we see a steady flow of cars at the toll plaza. know slowing approaching the site. we see cash lanes seeing a

backup. i'll show you where there's significant slowing. that commute is building. we're getting it back. sorry. >> everyone back to work. thank you. new this morning, it is the closest finish in the history of the iowa caucuses, the latest tally coming in overnight. it's mitt romney beating out rick santorum by just eight votes. combined the two candidates accounted for more than half of the 120,000 votes that were cast. an apparent glitch in reporting the local results held up the announcement of that final tally. early in the night romney actually congratulated sanitorium on the victory. here is a look at how all the candidates fared. ron paul finished third, following by newt gingrich, rick perry and michele bachmann. the caucuses do not award any delegates to the candidates. iowa republicans taking care of that coming this spring. this morning it was a tragedy that rocked the city of vallejo. now some homeowners say they're

still suffering from a police chase that led to the death of an officer. today in the bay's christie smith is live in vallejo where some residents are suing the city. good morning, christie. >> reporter: good morning, laura. this was a really intense search. vallejo police had an officer down. they had a suspect on the loose. they didn't know where he was. now some homeowners are saying that the damage tied to that search was just a little too much. three of them have filed claims against the city asking for nearly $11,000. it was last november when veteran vallejo police officer jim capoot was shot. officers were looking for that suspect who they also believed just robbed a bank. capoot died from his injuries. the homeowners say s.w.a.t. teams broke fences and tore down blinds. one repair estimate, about $450, another about $700. our sister station contacted police in the city, but they said they couldn't speak on it while it was under review. a former sheriff said the risk

outweighed the cost and the person already showed how dangerous they are. >> dealing with a time factor. you look at the need to capture the offender versus the cost, the inconvenience to somebody's fence. >> reporter: officers did arrest henry albert smith, junior. he's due back in court later this month. the city expected to decide in about the next two weeks how to proceed with all these claims. reporting live in vallejo, i'm christie smith. jon and laura, back to you. a san jose police officers remains hospitalized this morning recovering from injuries after a carjacking suspect rammed his patrol car. police arresting 27-year-old alejandro gonzalez after he rammed into another patrol car as they chased after him. a total of six officers were hurt during the pursuit. gonzalez allegedly stole a 68-year-old man's suv at a gas station. a mechanic working nearby saw it all. >> he put a key in and he run. we could not stop him anymore. he took off very fast.

>> that chase ended when police used their cars to trap gonzalez inside the suv. officers had to use tasers and a restraining wrap to try to get him under control. it is 6:04. the chp says they caught a man flying drunk. late yesterday chp pilots spotted a man flying as low as 50 feet within 100 feet of traffic on highway 37 in sonoma county. the plane was followed to petaluma municipal airport where officers talked to the pilot and detected the odor of alcohol. they gave the 62-year-old a field sobriety tests. based on the results he was arrested for flying under the influence. >> wow, that's wild. investigators blaming foggy conditions for san jose's first traffic death of the year. a 25-year-old woman died when two cars slammed into her car on curtner avenue during tuesday

morning's commute. police say she was coming off the dumbarton avenue when the accident happened. that intersection, for the record, does not have a traffic signal. nevada highway patrol say a walnut creek man is the victim of a deadly accident in lake tahoe. 21-year-old alex moore was hit by a highway patrol suv about 1:00 a.m. on new year's day. the officer said moore was walking on the highway and tried unsuccessfully to avoid hitting him. moore was thrown into another lane where a bus also hit him. he died at the scene. it is 6:05 right now. a funeral will be held friday for a 5-year-old boy shot and killed on friday standing outside his family's taco truck in oakland. gabriel martinez junior became the third child to die from random violence since august. friday's funeral starts at 11:00

a.m. at st. elizabeth's church in oakland's fruitvale district. it is 6:05. a piece of history will meet the wrecking ball this morning. the old san francisco jail number three in san bruno will be demolished today. just a few days before he retires, he'll oversee the beginning of the end that opened back in 1934. people who live near that jail, they say they're happy to see it go. >> it's a very cool building. when it was all lit up at night, very neat to look at. again, it's not safe anymore. >> we've actually been waiting many, many years for this to happen. >> a federal court ruling in 1997 forced the closure when a judge ruled that dilapidated conditions were cruel and unusual punishment. a new jail was opened on the same site in 2006. an update on breaking news

this morning. it all started with a routine traffic stop at about 1:00 this morning possibly for tinted windows. the suspect did not stop. he got out of his car and he ran away. dozens of deputies and police were at the scene this morning as they were looking for him. officers finally caught up with the man around 5:45 in a residence. fortunately nobody was hurt. it is 6:07. let's check in with meteorologist christina loren with a look at the forecast for today. it looks pretty good. >> a little mic action there. i thought you were supposed to hear that. i was asking for a live picture of san jose. nice and clear out there. eight miles of visibility in san jose. livermore dropping off a little bit. you can see for seven miles or better from san francisco through oakland, still looking good. about five miles of visibility in oakland. the only place below one mile is napa. looking all right so far. i think a little more fog will

develop through the next couple hours. overall, high pressure has regained control of our weather pattern. that's going to keep all that fog for the most part off the coastline pushing it back out to sea. you can see the clockwise rotation. the storm track way to our north. that's where it will stay through the weekend. as high pressure picks up today, it will be at its max strength by about 2:00 p.m. this afternoon. that's going to push all that cloud cover back out to sea. we'll see a building breeze, much warmer conditions, a clear coastline. if you want to hit the beach today, you can definitely do so, especially in santa cruz where i'm forecasting about 67 degrees. the mostly clear start will make way to the warmest day of the week. tomorrow, not quite as warm. taking your temperatures down by about three to five degrees. by this weekend, really comfortable, keeping the mid 60s and sunshine in the forecast. 67 degrees in santa cruz. i do have a slight chance of rain at the end of my seven-day forecast. i'll get to that in my next

report. right now a lot of people headed back to work. find out how your drive looks with mike inouye. >> so far the volume slowly building. we'll look at a new accident for sunnyvale, northbound 101. we have an accident involving two cars. they have moved off to the shoulder. no injuries reported and no slowing seen at this portion of your south bay. actually no slowing through san jose either. that's a nice south bay commute. the slowdown starts in the east bay. oakland, 880 with the volume of traffic past the coliseum, bumping up over the last 20 minutes. northbound with the taillights, southbound with the headlights. no slowing in either direction. we are seeing some slowdowns for livermore, 580 continues to slow with the travel time at 16 minutes now. look at the middle of your screen, speeds into the 50s around isabelle interchange that will continue to grow over the next 15 to 20 minutes. back to you. >> it is 6:09. still to come on today in the o bay.

welcome back everyone. a live look outside golden gate bridge. you can certainly see it across the span this morning. not a lot of fog, but more traffic than normal. things picking up out there. campbell city council rejecting a plan to turn an old bank into a brand new hot spot. a developer wanting to turn the

old growers national bank into a restaurant and lounge. the issue is the closing time. campbell says it recently renewed policies for all restaurants and bars to set closing time at midnight. the developer wants to stay open until 2:00 a.m. on thursday, friday and saturday nights. he can still file if he wants another appeal. changes may be in store for san jose's recently approved medical marijuana policy. in september the city voted to shrink the number of collectives in san jose from more than 100 to ten. but critics have collected enough signatures to repeal the new law in a ballot referendum. now mayor chuck reed says he'd rather negotiate the number of clubs in the city rather than put it to the voters. a san francisco charter school reopening this morning just weeks after that devastating fire. the creative arts charter school was damaged by a five-alarm fire back on december 22nd.

classrooms, an art studio, the library, cafeteria as well as school material and computers all impacted by the blaze. students were supposed to go back to school over the holiday break -- actually go yesterday, but the return was delayed by all the clean-up there. a special ceremony will be held this morning to thank the entire community for all its help. the latest snowpack survey reveals there isn't one. the pictures really tell the story. the department of water resources workers brought their tools to measure the depth of the snow in the sierra, but they found more dirt than snow. the reading was taken near echo summit where they found just seven inches of snow. water officials say it's the lowest sierra snowpack taken in month of january in years. you see that, having to make it at all the slopes up there. >> for all the hard core skiers up there. >> you do want to hit the slopes, they're trying to make it. we need a big fat storm. >> she's a borde border that his

hour-by-hour forecast. 42 degrees in san jose, 39 degrees in livermore. meanwhile we have some mid 30s in places like fairfield. fairfield is going tond up being one of the warmest cities as we head through the afternoon. at noon you can see you're up to 61 degrees there, up to 65 at noon in gilroy. hard to believe still the first week of january, 70 degrees in los gatos, and winter. 67 in santa cruz and 63 degrees in san francisco. now, everybody want to know on my facebook page is it going to rain and when are we going to get the snow in the sierra nevada. really want to know when they can wash the car. go ahead and wash the car. the rain won't do it for you. the end of the week and beginning of next week is not substantial, maybe a few showers in the north bay as the tail end of the system swings here. no storms bullseying the bay area until the 15th of this month. the pattern stays drive for now. let's check your drive with

mike. >> looking over here to the bay bridge, the approach, the maze, a nice easy drive. a look at the toll plaza where not so nice. starting to see the backup in these cash lanes. fast track lanes in the middle and more cash lanes over there. that's the build. we should see the metering lights turn on probably over the next five, maybe ten minutes. being a wednesday, a little later for that. we do have the wednesday build. the pattern from highway 4 through antioch, speeds into the tens over towards summersville and this zone into bay point and pittsburg, 50s and slowing towards concord. we should see slowing for 242 and 680. sudden slowing showing up northbound 680 as you come across the venetia bridge. should be a temporary blip. no incidents reported there. we'll jump to the south bay we have a smooth drive northbound. traditional slowing shows up about 101 and 87, an accident to

the shoulder at 101 and fair observation. no slowing past that scene. a long list of parking violators apparently owe san francisco more than $38 million in unpaid tickets. the "san francisco examiner" reporting the unpaid citations span 3 1/2 years between october 2006 and april 2010. the money includes fines and late fees tacked on to the original ticket. muni says while, yeah, 38 million sounds like a lot of money, it has collected more than 37 -- actually $374 million during that same period for a nearly 90% collection rate. >> it is 6:18 right now. alameda city leaders will be passing the baton for its animal shelter. the city is handing day-to-day operations to a non-profit group after several months of negotiation to keep it running in the face of monetary trouble. alameda will pay $300,000

it's slower throughout in many spots. we have developing news out of san jose where a manhunt is now over. police say they captured a man near saratoga and moore park a short time ago. they tell us it all started with a routine traffic stop at around 1:00 this morning for possibly tinted windows. the suspect did not stop, got out of the car and police say ran away. dozens of deputies and police were at the scene this morning looking for him. officers eventually caught that man around 5:45 in a shed. he will face charges of possessing stolen property and resisting arrest. he had reportedly minor scratches when deputies found him, so he was taken to the hospital for treatment. no neighbors were hurt. also new this morning, it is the closest finish in the history of the iowa caucuses. the latest tally keem in overnight. mitt romney beat rick santorum by just eight votes.

"today in the bay's" marla tellez live at facebook headquarters in menlo park with exactly why they're looking the sue. good morning, marla. >> reporter: jon, good morning. we showed you facebook's new headquarters when employees moved in just over two weeks ago. this is it at the intersection of willow road and bayfront expressway. i can tell you from standing out here, it is a very busy intersection and no doubt facebook only adding traffic to this area, and that is, in fact, the issue here. facebook already has plans to expand to a vacant lot directly across the street on the other

side of bayfront, a little closer to east palo alto. this would be its west campus. it would house an additional almost 3,000 employees. that would mean a total of about 5,000 employees at this single intersection. east palo alto is concerned because its city limit is just about a half mile away. the mayor tells the palo alto daily news she's concerned about traffic gridlock and the potential to displace e.p.a. residents. the city may sue facebook if it does, in fact, go ahead with expansion plans. the east palo alto city council will talk about filing this potential lawsuit at a closed door meeting tomorrow. reporting live in menlo park, i'm march will tellez. jon and laura? >> thank you very much. first an officer killed in the line of duty, now more trouble in the wake of that tragedy. the city of vallejo is being sued for damage they say was caused by that crime. through the next week and maybe, maybe after that we'll start to see that pineapple express shape up. we're watching for that for you. 6:48. let's see what mike is watching. >> we have slowing in the south bay. even though you said no fog, you're right. the commute is from capital expressway up northbound 101 to the scene of this four-car accident. that's de la cruz on the northbound side of 101. the cause for the slowing you see approaching the area at 880 up to the scene where all the cars have moved off to the shoulder and no injuries. we should see the scene clear quickly. there are a lot of flashing lights. need two flatbed tow trucks and chp cruisers are on scene. 101, a smooth drive. 880 through oakland. the volume of traffic is building. speeds close to 60 through downtown and up to the toll

plaza where the metering lights are in. the bay bridge t backup continue to form back to west grand avenue for most of the lanes. suddenly these cash lanes have cleared, starting the fill in as quickly as that break happened. slowing through livermore as well. look at theality mont pass, it's not the problem. a financially strapped east bay city could soon be facing more money problems if several homeowners get their way. "today in the bay's" christie smith live in vallejo where the city right now is being sued over a recent police chase. good morning, christie. >> reporter: good morning to you. this was an intense time for the vallejo police department. they had an officer down. the shooter on the loose whod robbed a bank. now three neighbors have come forward saying that this search for suspect caused significant damage to their popity and the city owes them money. it was november of last year when veteran police officer jim capoot died when he was shot.

a s.w.a.t. team search for the suspect, neighbors say during all this their fences were broken, blinds were torn out. three claims have been filed totaling about $11,000. some of that for emotional damages. our sister station in sacramento tried to contact the police department and the city. they said they couldn't comment while this whole thing is under review. the city should decide in about two weeks how to handle the claims. live in vallejo, jon and laura, back to you. >> a san jose police officer is recovering in the hospital this morning after a carjacking suspect rammed his patrol car. police arrested 27-year-old alejandro gonzalez shortly after a chase that led to a crash with several police cruisers. a total of six officers were hurt. gonzalez allegedly stole an suv at a gas station near mckee and king. the chase ended when police used their cars to block that

suspect's escape. officers had to use tasers and a restraining wrap to get gonzalez under control. a piece of history meets the wrecking ball this morning. the old san francisco jail number three in san bruno will be demolished at 10:30. sheriff mike hennessey made a campaign prom 34is to close the jail more than 30 years ago. a few days before he retires, he will finally get it done seeing the beginning of the end of the billing that happened back in 1984. people who live near the jail say they're happy to see it go. >> it's a very cool building. when it's all lit up at night, it was neat to look at. it's not safe anymore. >> we've actually been waiting many, many years for this to happen. >> a federal court ruling in 1997 forced the closure when a judge ruled dilapidated conditions were cruel and unusual punishment. a new jail was opened on the very same site in 2006. put the emergency brakes on california's high-speed bullet train. that is the advice from a panel of transportation and financial

sitting well with that city. the expansion campus would sit on what's currently a vacant 22-acre lot. it would bring another 2800 employees, that means a whole lot more traffic in the area. we drove it. east palo alto city limit is just about a half mile away. the mayor there is concerned of gridlock and a general sense of invasion. if facebook does, in fact, expand, it would mean about 5,000 employees would work at this single intersection alone. the palo alto daily news was told the city is considering filing a lawsuit to stop this from happening. the city will talk about the potential suit at a closed session meeting tomorrow. facebook is hoping to move across the street by 2017. so it could all happen in the next five years. jon and laura? >> thank you very much, marla. 6:54 right now. three swiss bankers are facing charges in a tax fraud scheme involving dozens of american
