this is "today in the bay." >> good morning everyone. the time now is 4:30. i'm jon kelley. >> i'm laura garcia-cannon. lots to get to for this monday morning. let's check that forecast and say good morning to christina loren. >> good morning. what a gorgeous weekend we had. more of the same for today though we're going from near record lows in some cities to near record highs later on. 70s on the map again. we'll take through the forecast. rain on the way tomorrow as well. so, it's a good looking forecast. first your drive at 4:31. you have a problem. >> we do. a little less now that the icon changed from accident to accident cleared. this is southbound 680 at the mission boulevard off ramp. actually off the off ramp. there was a truck down the embankment about an hour and a half. looks like it may have cleared. flashing lights should be clearing. all lanes are open but we have a new incident now that i'm checking near the maze.

i'll tell you about highway 24 coming up. >> thank you very much, mike. >> new this morning a busy overnight for san jose firefighters battling a three-alarm fire. >> it happened at an assisted living center. there is word of at least one injury. marla tellez joins us with the latest. good morning, marla. >> reporter: good morning. plenty of activity here at the mayfair golden manor apartments. it's living for seniors. right away i want to bring in captain mike with san jose fire. what can you tell us at this time. it was called in as one alarm but escalated. >> correct. the initial report was an exterior fire. the first companies noticed fire on multiple floors. it's an eight-unit facility. four units heavily damaged. >> it's for seniors, the good news you got all of the folks out safely. >> exactly. it is a high risk situation when you have senior housing and

middle of the night fire and heavy fire so we were concerned that someone may have been severely injured. thankfully we did get everybody out. no fatalities. we had five people transported to local facilities for medical complaints and minor burns. >> in terms of injuries none critical. >> that is correct. there were 16 people displaced and we have five at local facilities. >> the state of these people? you mentioned nearly panic. >> initially middle of the night fire and woken up from a sleep. we were able to corral all of the people, account for all of them and assure there was nobody missing. >> in an hour you were able to contain. this any sign of a cause? >> the cause is under investigation. it does appear to be accidental and we are looking further into the initial presentation of the fire. we have arson on the scene investigating. >> reporter: thank you so much,

captain mike van elgort. as you heard five people taken to the hospital. none of those injuries said to be critical. that is the best news here. the flames under control at mayfair golden manor in east san jose. >> glad to know everyone's all right. thank you, marla. in the meantime police in novato are looking for someone who started as many as 20 small fires over the weekend. fires broke out over a six-hour period from about 9:00 saturday night to 3:00 sunday morning. most were brush fires. no structures were damaged, no injuries reported. arson investigation is under y way. >> six people now facing charges after a weekend occupy protest turns violent in oakland. the charges vary from vandalism to assaulting to possession of explosives. about 150 protesters marching to police headquarters saturday night. they yelled at officers and threw at least two bottles.

at one point another tv station's truck was vandalized. this is uploaded on u-stream. occupy oakland invited anarchists and any one against the police to take part. >> it is 4:35 now. ed lee has his first official dayton job as the newly elected mayor of san francisco. lee took the oath of office yesterday morning during a ceremony at city hall. becoming the city's first elected asian-american mayor. during his inaugural speech lee had laid out a vision for the city during the next four years, and he did something during his inaugural speech no mayor has done before. mayor lee took time to send out a tweet about jobs. >> there. how about that. that's a little disruption but shows how important i think

allegations. >> san francisco now considering new rules for its dog walkers this morning. the city's land use committee will look at legislation that would require dog walkers to get permits and licenses. to qualify a dog walker would have to complete training on things like dog park etiquette and pack management and have apprenticeship with an experienced dog walker. the discussion after a dog got into a park and chased one of the animals until it crashed and broke three ribs. the baby bison unfortunately later died that same day. dogs are not allowed off leash in the area and the dog walker was cited. >> it is 4:37. if you are headed out the door grab a coat or a jacket. i want to check in with christina. >> it is cold this morning. good morning to you. welcome to your monday. we've got a good looking week. we're waiting for the rain and we're going to see some as we

head through tomorrow. mostly at the coast, and we're not talking about sierra snowpack out of this. but any sort of rain we can get because we've had really no wind, no rain, our air mass is suffering. so air quality probably going to be an issue through the next couple of days. once we get the rain late tomorrow things are looking pretty good. high pressure is in control. clear sky this is morning and calm winds lead to cool conditions in the 20s in some cities, 27 in novato, 29 in napa. 36 degrees in concord, 44 in hayward and here in san jose going to drop to the upper 30s as we transition through the next couple of hours, the coldest point of the day. by noon, temperatures climbing into the mid to upper 50s, and we're going to round out the day with 70s on the map. this is the last day with near record warmth. once you see that area of low pressure tomorrow, it's going to be much cooler as a result. if you didn't get to get outside this weekend you'll want to get out today. 67 in redwood city. 70 in gilroy, i'll have your

seven-day outlook coming up. mike, are you following that problem out there? >> the one in fremont has cleared, that's 680 at mission. all lanes cleared there. but we have a new one here, highway 13, approaching 24. right at park boulevard sounds like there is an overturned vehicle blocking the fast lane approaching that interchange. this does not affect traffic out of the caldecott but does affect it to the caldecott. northbound 13 at park boulevard. we also have reports of well, an earlier accident at the san mateo bridge toll plaza. a live look, the westbound traffic a couple minutes ago i saw a tow truck heading away from the screen and making some calls to make sure there is nothing going on on the bridge. we'll look at a map again, the south bay, an even flow. northbound 17 approaching 85, this is the second one for the morning show, about the fourth for the week after christmas or new year's, christmas tree on

the roadway approaching the interchange. but that should be cleared in a few. >> mike, thank you. the team gears up for game against the saints, season ticket packages for the new 49ers stadium go on sale today. if you want a good seat you have to pay serious cash. the 49ers released ticket prices for premium seats at the stadium. the 9,000 club seats carry a builder's license which means you buy the southeast the prices, from $20,000 to $80,000. >> the most premium product in the building. no different than courtside or basketball or behind home plate for baseball. >> it's a good time that they are doing well. it will help getting some of those prices. >> for the record, those prices do not include the cost of the season tickets which in these seats runs 325 to $375 per game. the 49ers have not set the prices for the cheaper seats.

bertha coombs is live with a look at our business news. good morning, bertha. >> hey, good morning. we've got the futures right now flat, slight lly positive. the first trading week of the year, that bodes well for a positive year. we had mixed close on friday and europe is still very much on investors' minds, that debt crisis did not get resolved and there are more meetings, you have meetings to try to come together for some sort of progress. in terms of data, here at home we're going to get retail sales, the trade deficit and consumer sentiment and this afternoon earnings season, we get excited about that. alcoa as is tradition will kick it off after the closing bell this afternoon. on friday the dow ended the week at 12,359, down 55 points but again, pretty positive week and

start to the year. the nasdaq will start the day at 2674. on the eve of the consumer electronics show in las vegas, people aren't buying many new gadgets. holiday sales of the electronics fell nearly 6%. the reason is smart phones. a lot of folks don't need buy a stand alone camera, gps device because their phone does it all. pay pal assessing in-store payments at home depot. the the program is only run in five stores and involves a few paypal employees. so no access for the general public yet. the move is part paypal and parent company ebay strategy to move beyond the desk top to mobile devices and other parts of everyday life. in case you didn't know, five years ago today was only five years ago, they launched the iphone. which has unleashed all of this. >> so many people have them in the palm of their hands. thank you very much, bertha.

>> 4:47 now. we experience that fill chilly weather on the way to work. the question is what's the rest of the day like? >> near record warmth. we have a beautiful january day setting up for us. the temperatures in the 70s in some cities, so we are not done with this gorgeous trend. as we head through tomorrow we expect a change. area of low pressure is expected to drop off. looks like it's going to break off from the main jet stream. we call it a cut-off low. that could bring us pretty good showers at the coast if it stops along the coast. it could end up over the pacific. futurecast is bringing it in. all right. let's get to it this morning. grab your jacket. you want to wear short sleeves underneath especially inland. temperatures today are going to be in the upper 60s and low 70s yet again. 44 in hayward now, at 32 at freezing in santa rosa. 27 chilly degrees in novato, 29 in napa and oakland, you are

feeling the 30s. grab that jacket. look where we're headed at noon. at 12:00 p.m., 62 degrees at noon in san jose. you can see easily yet again another one for the record books. 67 degrees in redwood city. 68 in san jose. so, we need the rain, we're talking about chances for rain, anything that looks promising at this point is going to be well received. the rain shower forecast, at about 1:00 p.m. tomorrow looks like we'll see activity offshore as we head throughout the day, i think some of those showers will sneak on especially marin county, probably along the peninsula as well. maybe we could pick up to .1 inch of rain, which is not that much but enough to purify our air quality, wash out all of the debris in the atmosphere. the next couple of days temperatures drop but we hold onto the 60s. 63 on thursday, mild friday, and
