lights westbound, across the section, no incidents so i'm going to call this closed. still watch that bridge. highway 13, the warren freeway, we still have an overturned vehicle blocking a lane. >> thank you, mike. it's 5:01 now. san jose fire crews on the scene at an assisted living center. marla tellez joins us with word of several injuries. good morning. >> reporter: good morning. you can see the devastation for yourself here at the mayfair golden manor apartments. the three-alarm fire is now out, that's the good news. now it's the cleanup and investigation into the cause. this is an eight-unit building that as you said, houses seniors. fortunately, the claims were contained to four of those units. you could see they are gutted this morning.

the captain tells me 16 seniors were safely evacuated but it was no easy task. >> there was a lot of panic, then we had some language barriers as well so it was a challenge to make sure everybody was accounted for. there were multiple occupants in each unit as well. that was our concern to make sure we had everybody and we did of course do an aggressive search to make sure there were no victims in the fire. >> reporter: five of those suffered some sort of injuries, none of those said to be critical. the injured are being treated. all of them are getting assistance from the red cross. this fire was called in this morning, it took about 50 firefighters to knock it down, about an hour later. though it did quickly escalate to three alarms. the cause is still under investigation. the captain on scene tells me it

appears to be accidental. it appears to have started on the roof. again, that has not been confirmed. live in east san jose, marla tellez. >> a lot of people needing a new place to stay. >> 5:03. the case involving a 1999 killing of former raider. a jury convicting ali of murder after he admitted strangling her during an argument. in 2009 an appellate court threw out the conviction saying prosecutors manipulated the jury pool. during the redril the attorney will argue that the killing was manslaughter, not murder. >> it's 5:03. oakland police are calling the death of a woman found in an oakland home suspicious. the body was discovered at a home on lyman drood in the oak more neighborhood early saturday morning. she was unresponsive when

paramedics arrived and was pronounced dead at the scene. investigators are looking for the cause of death. >> a party at walnut creek bar ended sunday with a huge fight and long list of arrests. it happened just after 1:00. christie smith is live in walnut creek where the fights are becoming a bit more common on the weekend. good morning, christie. >> reporter: good morning. at least 15 people were involved in this street fight. an offer was punched in the help when he was trying to break up what was going on. another man stunned with a razor. it happened near this buzz here. it happened here just steps away from the police department which is that brick building there right across the street. according to america it was an officer who came across the brawl early sunday. it was so big that all available walnut creek offers and the

deputies to try and help out. when an offer tried to stop a fight at he was punched. the crowd tried to help the suspect by pushing police officers away. this apparently started earlier in the evening as an album release party, several people arrested in all of this. controlling crowds and bars and alcohol has been an issue here, attacked -- a task force was formed but some worry not even to being done to control that. i do have calls tine walnut creek police. investigators believe the whole thing started when a man who was attending the party had his gold chain stolen. reporting live, christie smith. back to you. >> thanks for the update, christie. 5:05 now. five years later a discrimination lawsuit against richmond police chief is going to trial. the suit involves seven high

ranking african-american officers. they have accused richmond's police chief shown here and his former top deputy of discriminating. also he told racist jokes. officers are asking for promotions they say they should have. >> supporters are not going down without a fight. the market street cooperative will shut its doors tonight at 7:00. back in november california's u.s. attorney ordered clubbed close targeting the landlord. at 11:00 medical marijuana supporters are set to gather to protest the closure. >> crews will make an attempt capture an injured bird. it was first spotted friday with a fishing lure in its beak. they hoped it would shake loose

toot. westbound with with the pail lights, i was wondering what was going on. there is a disabled vehicle, just reported in from chp it's blocking the slow lanes. we saw the truck should have it cleared with no major delays. the map slows you slowing approaching that area of the flat section. keep that in mind as you travel west toward the foster city side. highway 13 northbound has the overturned vehicle. the last lane is blocked. better news, no injuries reported and no one was injured as a result but it the car has to be removed. despied the temperature, there no problem for that with the north bay. >> san francisco, it's the star of the new travel shanl show. ebony will take people on a quick tour of the city. dropping by places like china town and delores park.

it's still winter out there. i can tell you right now with confidence that as we head toward the end of the week, late saturday to sunday, monday and tuesday, we're talking about the pineapple express. we're talking about at least 10% to 20% chance for rain, starting on saturday, lasting through the midsection of the week so that's an indication that the jet stream will start to drop to the south and we need to the drop to the south. you can see it's taking all of that moisture into the pacific northwest, bypassing the bay area. well, as we head through the end of the weekend it looks like we're going to see the pineapple express shape up. we're not expecting a lot of rain, not at first but hey, saturday, sunday, might get something and that gets better through next week so it's on the way. and that's the good news. we even have some on the way for tomorrow. this morning it's comfortable in some cities, downright chilly in others. at 51 degrees in san francisco. that means you'll hit about 63

degrees at noon today, though, temperatures are going to be comfortable. take a look at some of the noon readings. 62 in san jose. 61 in santa rosa. 61 in sunnyvale. at 60 so these are our average highs. and we're going to see those at noon. a couple of 70s on this map. 68 in san jose. 70 in gilroy. 70 for fairfield. about 63 in the city by the bay. talk about shower, we've got this cutoff low it's going to try to sneak on shore tomorrow. as we see the showers theest about time will be about 1:00 p.m. and 5:00 p.m. i think most of the action will stay along the marin county coastline and maybe that system will sidle down the peninsula. san francisco to daly city, probably moisture as well. 62 by wednesday, patchy fog thursday. and then more cloud cover, saturday, sunday, that's when we're looking for our pattern to significantly change. we'll talk about that all morning. we want to check your drive with mike inouye. >> most of the east bay, that

zero is wrong. heading to the walnut creek interchange a. footh drive approaching the bay bridge toll plaza. we're following this, the remnant of the highway 24 accident. the showing shows up that should clear up because the accident cleared from the chp report. also just clearing from the report t the disabled vehicle along the flat section though we see a little slowing traveling away from the toll plaza. a live look shows you what we're looking at. with taillights, i saw a little clustering earlier. looks like it's clearing, no more flashing lights on the bridge. an easy drive to the peninsula. travel time 101, no problems in either direction approaching san mateo. all the way down to the south bay, no problems for the northbound commute. the earlier christmas 3 on 85 has cleared. that's good news. back to you. >> thank you, mike. 5:17. investors hoping to continue the

2012 rally. for a look at how feature shaping up we turn to bertha coombs. good morning. >> good morning to you. the futures now are kind of flat, a little bit to the up side. they call it the january effect when you have a strong first week of the year, usually bodes well, sets the tone for the rest of the week. a mixed close on friday, though. we did see the dow close lower. we have a lot of meetings starting today with angela merkel and nicholas sarkozy. we call them merkozy because they are together so much with the debt crisis. we're going to get a lot of data this week including trade deficit, retail sales and consumer sentiment. this afternoon alcoa kicks off earning season reporting after the bell. the dow on friday down about 55 points but a pretty strong week,

we'll start out above 12,359 t nasdaq was up on friday at 2674. the white house will hold a jobs forum on wednesday highlighting companies that returned jobs to the u.s. president obama says the event called in sourcing american jobs is going to discuss ways to bring more jobs home. on friday the government reported companies added more than 200,000 jobs and unemployment fell to 8.5%. walmart wants to help you with that owner's job. your taxes. the giant is opening in-store kiosks offering prepreparation of simple 1040 ez forms. the service will be at about 3,000 walmart stores. if you are going to do the deductions, please try to bring those receipts in more neatly.

mid-60s in some cities. 62 inland. up to about 64 as you make your way home from work. enjoy it while it lasts. this is the last day of near record warmth changes. showers move in. we'll talk about that first 5:30. let's see if there are any problems on your drive. >> looks like they are taking care of one of those issues. chp there, northbound 101 aus approach 380. just past sfo. sfo is where they are starting the traffic break northbound as you head to the earlier accident. car into the center divide. the traffic break going on. the round robin, the vehicle going back and forth. should be moved to the shoulder in a few minutes. >> it's 5:31. san jose firefighters still on the scene where a three-alarm fire damaged an assisted living center located at madden avenue off the intersection of north capital and alum rock. marla has been on the scene all morning including reports we hear of injuries.

good morning. >> reporter: good morning. it was called in as a single alarm fire about 1:45, then it quickly escalated to a three-alarm as you just said. the flames are out the good news, but the results are heavy this morning. four units completely gutted. the captain says he considers it heavy damage though it new total loss. the mayfair golden apartments, most are in their 70s. we are just learning that 20 to 40 in all were evacuated. 16 have been displaced, all are accounted for. you can maj their plight. >> it's a high risk situation you have senior housing and middle of the night fire and heavy fire so we were concerned that someone may have been severely injured. >> wouldn't be more pleased with the work of our crews and the total outcome. it could have been much worse.

>> reporter: 16 are displaced, five taken to the hospital with stress-related injuries such as chest pain and hypertension. but the captain tells me the injuries are not critical. the red cross stepped in to find temporary housing. all in all it took about 15 firefighters, many still on season, you see the gentleman on the roof there housing down the units. the cause of the fire is still under investigation. the captain tells me it appears accidental. live in san jose, marla tellez. john and laura. >> thank you. >> it's 5:33 now. northbound police on the lookout for a serial arsonist. novato officers say someone set more than 15 small fires between 9:00 and 3:00.

seat for the stadium. similar seats 13 in this 00 to 1800 bucks for the season. in order to get a seat you have to buy it. we're talking 80,000, those are the seats marked in influence. the majority of the 9 thousand seats run 20 to 30,000. the niners say they expect high demand but these figures are upsetting plenty of fans. >> i don't think it's fair. i think it prices 0 but regular people and makes this available to rich people and businesses. you're not going to get a nice diversity of prouds. >> it's a good time they are doing well. it will probably surprised that they got some. >> reporter: the building is expected to dos $1 billion. these higher prices expected to help foot the bill. for the majority of the seats the cheaper ones, those will not be public until they go on sale this summer. this new stadium isn't expected

over the candidate in second place for now ron paul. however, his lead has slipped 10 points since iowa, since last week. it is what the candidates have been trying to do. we saw it yesterday in the nbc facebook debate. they have tried to cut into the commanding lead that mitt romney had here almost since the beginning. we've seen him go back and forth with newt gingrich, rick santorum. even with jon huntsman focused on new hampshire. in that poll i should note he's in third place. if hunts man is able to finish in this primary 18 third place it's a pretty good win for him. mitt romney is the candidate to beat. here's how this could play out. the question is whether he's going to win or have a decisive win and who is going to move in.
