good morning, everyone. the time is 4:30. i'm jon kelly. >> i'm laura garcia canon. lots to get to this morning. >> good morning. it is so cold out there this morning. you want to layer up. we are going to see temperatures dipping into record lows this morning. only to rebound into record highs. so we will talk all about that this morning. watch out for patchy frost especially up to the north bay. the drive is early but you're already tracking a couple of things. >> it is a low to high thing. folks will go down into the road surface, a pothole, then back up, westbound 80. you're down to one lane in the area. one lane affected by this pothole. road work continues now willow of off of cummings skyway, no major slowing past the scene but hopefully road crews will take care of this pothole.

new this morning, san jose police at the scene of overnight violence at a popular night spot. >> several people were injured early this morning at creek sidebar and grill on alma street. >> reporter: good morning, laura and jon. police have been here at the scene since just before 2:00 this morning. looks like they're loading up a car into a tow truck. those are the lights that you see hyped me here. violence erupted just before 2:00 this morning here at the creek sidebar and grill. police say one person was shot and two others stabbed here at creek side. they were taken to a local hospital in a private vehicle. they are being treated for unknown injuries. bystander flagged down a patrol car in the area saying someone had been shot in front of the restaurant. police at this point have not identified a suspect but it is early on in the investigation and investigators still need to talk to the victims and other witnesses. >> officers heard gunshots at

the creek side inn. they responded to the scene and when they arrived there was two people that were injured. later on approximately half-an-hour later we had another person walk in with additional injuries. >> police are still withholding the gender and identity of the victims. at least six police cars have remained at the scene while they gather evidence and try to determine what led to the violence here at the karaoke bar. again, it seems like they're ready to pull a car out of the parking lot and perhaps gather some evidence. we don't know at this time if there is a manhunt under way. we'll have the latest for you this morning at 5:00. live in san jose, "today in the bay." a san jose man arrested in a deadly september crime spree answering to those charges today. paul castillo is expected in court to enter his plea, accused of carjacking and killing 60-year-old a popular radio talk show host.

castillo is a three strikes candidate who could be facing the death penalty if convicted. in san francisco, the man accused in a string of violent rapes will be arraigned some time today. frederick dozier suspected in three violent attacks last year. dozier was arrested last year on attempted murder, robbery and sexual assault charges. he faces a possible life sentence there if convicted. a san jose elementary schoolteacher has been arrested for sexual assault and police are trying to determine if there are other victims. 35-year-old craig chandler is accused of sexually assaulting a child last year. he taught a combination class of second and third graders in south san jose. chandler worked at the school for nine years. police are asking other victims or anyone with information to call the sexual assault unit. a car thief is on the run this morning in richmond after stealing, then ditching, a car with a 5-year-old girl inside. police say a father left his car

in front of his home on fleet wood drive last night. his 5-year-old daughter was asleep still in the back seat. that's when a family member went back out to check on the child. the car though was gone. it was found a half-hour later near 3400 grasswood drive. the girl fortunately was unharmed. the suspect still on the loose. an airport passenger at sacramento international took the stress of traveling to whole new heights. sheriff's deputies had to use a taser on him after they said he refused to go through a security screen. the 26-year-old edwin barton allegedly became violent at the checkpoint, then just ran off with his bags. a deputy chased him down and tasered him three times. barton was check out at a hospital before being booked into jail on misdemeanor charges. 4:35 right now. investigators are trying to figure out what caused a large apartment fire in san francisco near 11th and folsom street quickly burned through the

building. no injuries were reported and at this point no word on the extent of the damage. the search for a serial arsonist is intensifying. a $15,000 reward is being offered this morning for information leading to an arrest. someone set 56 fires in 36 hours. all the fires have been small but close enough to nearby homes that locals are worried. so far no one's been hurt. investigators are reviewing evidence and looking at surveillance pictures. it is 4:36 right now. with the new hampshire primaries now in the books, republican candidates on their way to south carolina this morning. mitt romney finishing with a decisive win in new hampshire taking 39% of the vote. ron paul and jon huntsman finished second and third, more than 15 points behind. now that they're taking their message to the more conservative south, romney going after president obama. >> we're asking the good people of south carolina to join the citizens of new hampshire and

religion. >> there is no automatic "i'm mormon, he is, too, check that box." >> harry reid is mormon, too. they have completely different political beliefs. so it is not an automatic. >> the mormon faith is expected to get more scrutiny in the coming weeks as primary states hold their primary elections. south carolina is one state with being evangelical christians. 4:38 right now. let's find out if we were getting that rain we were hoping for. >> yesterday we actually did get more moisture. no showers in the north bay but we did pick up some moisture. this morning those skies are now clear. we are going to see some very frigid conditions. it is already 33 degrees in videos. the record low up in videos is 28 degrees. we're going to go from near record lows to near record highs all in the same day. with temperatures climbing from the 20s to the 70s in some cities, for instance gilroy, that's what i'm forecasting for

today. first want to talk to mike about your drive. we will take to you where other folks are doing their overnight work. these cruise are clearing over the next hour but at 680 we are looking to the top of the screen, from bollinger canyon road. both directions of 680 have their overnight construction lane and sometimes two. for the next hour they should be clearing up though and crews are not causing any major slowdowns through this area. looking at eastbound 580 as you are heading away from castro valley and towards the dublin interchange. foothill boulevard is where you'll see more construction going on for again another 45 minutes to an hour in that direction, no slowing approaching the interchange from any approaches. a live look at the golden gate bridge. very light volume with you it is called in the north, watch for frost. 4:39. she was trying to catch her

welcome back, everyone. a live look outside from the east bay this morning. pretty busy so early on a wednesday morning. 4:42 right now. we'll check that commute. vigils being held today to mark the 10th anniversary of the first detainees at guantanamo bay prison. activists gathering at the fe federal building in san francisco this afternoon starting at 5:30. the names of 171 prisoners will also be read as part of their national day of action against guantanamo. the u.s. began prisoning combatants there after the start of the war in afghanistan. former mississippi governor haley barbour parrdoned some 20 people during his last days in office. a list of pardons has just been released and some of the victims of the offenders are outraged. barber, not commenting at this point. however, some have defended this action saying releasing inmates who live and work at the governor's mansion is just a tradition that dates back

decade. it is 4:43 right now. investors might be getting a little less anxious about europe's debt crisis. for more on that, bertha coombs is live at cnbc world headquarters. good morning, bertha. >> good morning. yeah, at least for now we seem to be taking negative headlines in stride this morning. we got a headline that germany's economic growth in the fourth quarter was actually negative which is usually something that makes people nervous. but markets this morning are flat. they're okay, kind of digesting the news after some pretty good gains on tuesday. overall we are watching the fact that asia was up overnight, europe is a touch higher. as far as its economic news, we've only got the fed's beige book that tracks conditions in all 12 of the federal reserve's districts. dow was up 69 points yesterday to 1,246. the nasdaq will start today at 2,702 having added 25 on the day.

fannie mae's ceo is stepping down once a replacement is find. michael williams took over in 2009 a few months after it and freddie mac were seized from the government. both have soaked up $170 billion in taxpayer money since being bailed out. along with the fha, fannie and freddie guarantee 90% of all new u.s. mortgages. google is making search more personal. it has launched a series of upgrades adding content from its social network google plus. the new feature is called search plus your world. it includes posts, photos, profiles an conversations that are public or shared privately with the person who is searching the web. twitter is already making a fuss about it saying the changes are going to make it that much harder for people to fine timely information from twitter on google. got to admit, they're going to have rivalries and google wants to make google plus the dominant feature these days. back to you guys. >> thank you very much, bertha, for the update. 4:45 right now.

i feel like we're hitting the extremes on both sides of this. >> we really are. we'll see extreme cold this morning, record lows. videos just a few degrees away from a record there. and i am forecasting a record high in videos later on today. so it is frigid out there. double up on the layers this morning but take a look at where we're headed. 68 degrees later on today in videos. i'm forecasting 72 in gilroy. oakland, new record for you in the forecast -- 64. concord will likely hit 66 degrees. we're seriously going to see a very nice spread in terms of our temperatures. some cities are going to go from the 20s to the 70s later on today. our rain chance has dwindled. that area of low pressure now pushing to the south, high pressure moving in. heading through the next 48 hours, conditions stay nice an clear. hazy sunshine, illegal to burn firewood. likely we'll see one tomorrow with no real wind or any moisture coming off the pacific until we get to next week.

i'll talk about that in my heaven-day forecast. couple of isolated 70s today. by tomorrow little bit more frost to deal with. but you cannot beat these temperatures. if we are not getting the rain, at least we're getting gorgeous weather. 68 in san jose today. 72 in gilroy and fairfield. 68 in videos. you'll hit about 63 in san francisco. now next week it starts to get extremely interesting around here as temperatures continue to stay in the mid 60s over the course of the weekend, things start to change tuesday, wednesday the jet stream finally takes a dip. that could usher in really good rain chances tuesday, wednesday and thursday. i'm very reluctant to put that on the seven-day just yet because i've burned lately so we're going to continue to track that for you but looking very promising. i'd even put money on the fact greater bay area getting some rain next week. the best chance for that would be late tuesday, wednesday and thursday. we need it and we're looking out for it.

back to you guys. >> thank you very much. the raiders' new owner kind of hinting the franchise could be on the move. mark davis, the son of the late al davis, making several bold moves and announcements during his first speech at team headquarters in alameda. davis also said he hasn't seen an offer that would prompt him to move the team back to l.a. but the franchise does indeed need a new stadium. he says a joint deal with the 49ers in santa clara is still a possibility. how about this -- a 12-year-old girl who caught a burglar on camera going through her drawers. >> she says she set up the webcam in her room to keep her sisters from stealing her stuff. she had her laptop camera hidden behind some pillows to keep an eye on the room. she didn't know her parents scheduled a last-minute open house with the realtor. what she saw caught everyone by surprise. >> i saw my chair move. kind of fast forwarded back and i saw him come through our

hlway. he came through the room looking through my drawers. >> all of a sudden she comes down screaming, oh, my god, somebody ripped us off. we look at the video and it was really shocking. >> police say the man is a former real estate agent previously convicted in 2010 of stealing from open houses and selling those goods on ebay. the family turned the video over to a real estate agent who recognized him and called police. he's due in court tomorrow. >> what a strange individual. that's a weird one. 4:49 right now. the city of oakland may have to deal with the next occupy protests alone. why its neighboring cities may not want their officers providing mutual aid. plus, it is a holiday weekend. if you haven't made plans yet -- we've got a suggestion. >> okay. >> why national parks may be a good place to go. 580 is a great place to go as well as you are looking through oakland. i'll show you what's going on

had tell but that. a call for back-up may not be answered in oakland. late last night richmond was still wrestling with a resolution allowing its police chief to say no if oakland police ask for help during an occupy protest. richmond leaders are concerned about safety and liability when its officers take part in police actions where tear gas and bean bags are used. council members tom butts says while ends it is a concern, a no answer he says is a dangerous answer. >> if every city made decisions about who they're going to aid and who they're not going to aid based on the politics of it all, it could come back and bite you. >> if the council passes the resolution the police chief will also have final say on where his officers go. december did not worry california water monitors but january certainly does. the california department of water resources is talking the

dreaded "d" word -- drought. the department's chief high drol gist tells the "sacramento bee" while a dry december is not usual, a dry january is hard to come back from. the only positive news is we still have a lot of water in reserve from last year's very wet winter. the nation will get its annual highway safety record card some time today. advocates for highway and auto safety will release the ninth annual report on each state's performance in adopting basic highway safety laws. the report expected to focus on distracted driving and teen driving. according to the national highway traffic safety administration, roughly 20% of all drivers and 50% of drivers between 21 and 24 years of age admit to having texted while driving. speaking of the roads, let's check in with mike. early start to the day. >> the folks who started even earlier, the overnight construction crews, just finishing up their days. a pretty standard spot right
