>> we've got to get through this cold start but we'll see a gorgeous afternoon shape up with temperatures in the 70s in some cities. grab that jacket. the heaviest you've got because it is cold out there. 28 degrees in napa. 31 in gilroy and we have two additional hours of cooling before we hit our lows this morning. also it is very cold out there but it is illegal to burn. spare the air day. mike already has a problem in oakland. >> we do. a new accident just popped up in the last few minutes. this is your on ramp, park boulevard on ramp to westbound 588 as you are getting out of oakland heading toward the maze. we do have an accident, reports of injuries and an ambulance has been called. there may be someone trapped in the car right now. sounds very dramatic. i'll get details right now. no slowing at the scene so far. also probably a dramatic night last night as new this morning police investigate an overnight shooting and stabbing at a south bay restaurant during a karaoke night. it happened at the creekside inn

on west alma avenue in san jose. damian joins us with the very latest. >> reporter: looks like police have just cleared the scene just about five minutes ago. they also towed away a silver car from the parking lot, presumably to process that car for evidence. they had only put up the crime scene tape here at about 3:30 this morning when when drove up. we do know just about 2:00 this morning a bystander flagged down a patrol car saying someone had been shot in front of the creeksidebar and grill here on alma street. officers determined one person had in fact been shot and two others stabbed. they have not identified a suspect in the violence. the restaurant has karaoke six nights a week here and early indications are that's where the confrontation may have begun. >> officers heard gunshots at creek side inn. they responded to the scene and when they arrived there was two

people that were injured. later on approximately half-an-hour later we had another person walk in with additional injuries. >> reporter: police say the victims were taken to a local hospital in a private vehicle. they are not releasing yet the extent of their injuries. i asked the public information officer if in fact there was a manhunt under way because they have not identified the suspect. he just texted me saying he wouldn't classify it as a manhunt, only that they are trying to identify the perpetrator so they are gathering evidence to see if they can identify that person. live in san jose, "today in the bay." also new this morning -- a small kitchen fire forcing the evacuation of a redwood city assisted living center. the flames broke out at the woodside terrace just before 1:00 this morning. one senior was evacuated because

of all the smoke but there are no injuries to report. fire crews also mopping up right now after flames damaged tesla motors battery testing facility in palo alto. the sprinkler system is also being credited for putting out a two-alarm fire at about 1:00 this morning. no reports of any injuries and investigators are still looking for the cause. oakland police are trying to find the person responsible for the city's second homicide of the year. a man was found shot in the 6100 block of foothill boulevard. looks like by seminary avenue around 9:00 last night. he was pronounced dead at the scene. there are no suspects at this time. a san francisco man accused of several rapes in the city will be in court today. frederick dozier is charged with 26 counts including attempted murder and seshxual assault. the 32-year-old was arrested last week after police tied him to three violent attacks from late last year.

if found guilty he faces 100 years to life in prison. 5:03. a san jose mom accused of tossing her child from a second story window also due in court this morning. a judge will be setting bail in and a preliminary hearing date for cortez. she barricaded herself, say police, and her 22-month-old boy in the bathroom on christmas day. when police arrived she allegedly dropped the boy out a window before jumping her selves. she faces multiple charges, including child endangerment. san francisco's newly sworn-in sheriff could soon face domestic violence charges. the "san francisco chronicle" reports prosecutors are convinced video of a bruise on his wife's arm and text messages discussing the violence justify the charges. the alleged incident happened on new year's eve. his wife has publicly said she has no complaint against her husband and the incident was taken out of context.

an unusual solution being considered to try and keep drugs out of some tri-valley high schools. christie smith is live where the school district is talking about bringing in drug sniffing dogs. >> reporter: good morning, jon. some students probably might not like the idea of dogs sniffing around their lockers but we're speaking with adults this morning who are out and about in pleasanton. they certainly do like this idea. the school district trustees are considering using drug sniffing dogs that are already with the city police department. according to the contra costa times, this would be around lockers and parking lots at the three high schools in the city but it wouldn't happen in front of students. we spoke with one man who sees the whole thing pretty black and white. >> if i ha child that was this school i guess i wouldn't have a problem with it. anything to stop them from ending up in a prison someplace i guess is a good thing. >> reporter: no final decision

has been made yet but the school district has seen an increase in alcohol related suspensions and, of course, parents are worried about that. again no final decision but the board could make a decision when they meet again on january 24th. live in pleasanton, i'm christie smith. mitt romney now has a commanding lead of the gop presidential race about almost all of the precincts in new hampshire reporting romney has won the state with 39% of the vote. his closest competition is ron paul with 23%. jon huntsman was third with 17%. all of the candidates now head to south carolina for the january 21st primary. we'll have a live report on the new hampshire primary results in the upcoming south carolina primary coming up a little later in this newscast. a local lawmaker getting ready to start a brand-new fight against sexual exploitation in california. congresswoman jackie spear and

mark klass have said human traffic something a tragedy and takes place around the bay area as well. the act is aimed to keep sexual predators off some online sites. 5:07 right now. volunteers will be back out at the golden gate park this morning trying to catch an injured bird. it has a barbed fishing lure caught on its bill. it was first spotted last week. animal rescue is certainly concerned about the bird's health. four volunteers armed with nets will comb the park today looking for that gull. san jose's medical marijuana rules continue to be a work in progress. council members validating a referendum yesterday opposing the city's limit on medical marijuana collectives to ten. the council must decide by march 6th whether the repeal actually to repeal the referendum or put it on the june ballot. mayor chuck reed has said he

would consider increasing the number of collectives from 10 to 25. council members also delayed a decision on whether to raise the city's tax on collectives from 7% to 10%. the vote will happen january 31st. bundle up if you're headed out the door this morning but prepare for a warm-up. at least inland. want to check in with meteorologist christina loren. >> even in the city it is going to be warm, 63 degrees today. record lows making way for near record highs. in the north bay temperatures are below freezing. napa you're at 30. and fairfield. 30 gilroy. liver more o livermore one degree away from freezing. we're going to see some cities with a temperature spread of 40 degrees-plus today. you think about adjusting your thermostat in your home just by a couple degrees, it makes a big difference. gilroy for example, fairfield, some of the outlying cities will see quite a spread. 26 degrees. that's the forecasted low in napa. just two degrees away from a

less than an hour until crews clear. before 6:00 we should see no problems. we'll get a live look and see how things are shaping up. finally we see some cars on the golden gate bridge. we have a new incident in the north bay. that's coming up. a controversial issue could soon make its way on to a popular kid's show. parents are petitioning sesame street to take on the issue of breastfeeding. more than 4,000 people have signed the online petition. in the 1970s and '80s sesame street often did segments on breastfeeding. recent news event including a protest of breastfeeding moms in target last month have brought the issue back to the forefront. a california kid fighting for his life had a big smile on his face this past weekend after his dream came true. max got to blow up a building on sunday. the conagra building in ohio was all set for demolition so the make-a-wish foundation flew max out there to push the button.

a good wednesday morning to you. you made it through the week. looks like folks are coming and going near san francisco international airport this morning. bundle up if you're headed out the door. 5:14 right now. speaking of bundling up, a park in moscow has a cool new attraction this morning. they call it ice city. you know why? it is a town made entirely of ice an snow. more than 1,000 cubic meters of snow and over 500 blocks of ice used to make this town and it is all part of a youth architecture festival. laura's mesmerized by the fire dancing there. this has a festival features a wedding chapel, has a jail, hotel, bank and also a freezing

cold movie theater. couple of jumbo igloos on steroids out there. >> that's as close as we'll get to that much snow. but i know there is a little tease of a pineapple express next week. >> i'm willing to put money on this at this point. hardest part about this forecast coming up is the timing of the showers. a lot of the models now agree that we are going to get some rain over the greater bay area through san jose up through the north bay but just when will it arrive. it looks to me like wednesday into thursday is our best chance. 39 right now in san jose. we have another issue this morning and that's very, very cold weather out there. it is a spare the air today. our air quality is suffering as high pressure just keeps things nice and mild for us. very light winds yet again this morning. clear skies make way to a very cold start. 42 in san mateo. freezing in navato and videos.

high pressure is building back in to the south and for us we'll see offshore flow by the day's end keeping things nice and clear. cold start then turning breezy as offshore winds pump from land to sea. 60s today inland, a couple of isolated 70s. by tomorrow we'll see more of the frost. basically more of the same. 64 in oakland today. 67 in freemont. 68 degrees in san jose. as we head throughout the next couple of days, things really don't change. the quiet weather pattern continues but then, tuesday, wednesday and thursday of next week, looking very promising for showers. models agreeing that the jet stream will take a dip to the south and usher in some rain right here in the bay area. we'll talk more about that coming up and also talk about when we might get better air quality. first let's check your drive with mike inouye. >> oakland still sticking around with the accident on the psark boulevard off-ramp.

880 no major slowing coming through the area but construction right around broadway. a short segment for that remaining crew on scene. you see taillights past high street with no slowing and good spacing between the cars. they are able to squeeze by one lane that's restricted as you come through downtown. back to the maps, we'll talk about the other side of the bay. moving to the peninsula, nice smooth flow of traffic across the dumbarton and san mateo bridges. slowing up through woodside and here the construction crew remains for the embarcadero. the south bay, no major issues. we do have construction south, 17 between bear creek and the summit but that's right on schedule to pick up before 6:00. back to you. >> mike, thank you. occupy oakland continued to stir up trouble this time with a local newspaper. the bay area news group has apparently sent a cease and desist letter to occupy

protesters over a new website called "occupy oakland tribune." the site publishes articles written by occupy protesters but the media group claiming it tarnishes the oakland tribune name. occupy oakland says it will defend its first amendments rights. santa clara has approved a deal to allow the great american parking lot on game days. opponents claimed there will be traffic headaches in the area. in exchange for sharing its lot, great america will give a smaller share of its profits to the city. 5:18 right now. coming up, why the morning commute could soon cost a lot more for some people. plus, what the new raiders owner mark davis has to say about the possibility of the team moving out of oakland. you'll start seeing ads on facebook. that and the latest from ces coming up.

during a press conference yesterday, mark davis introduced his team's new general manager and also addressed questions about the possibility of the raiders moving out of town. davis admits los angeles and sharing a stadium with the 49ers in santa clara both possibilities. the raiders ceo says oakland is still the team's number one choice. it is 5:22. expect to see ads soon in your facebook time line. scott mcgrew says he's been searching for them. >> facebook prefers the concept of featured entries instead of ads but they're ads. i haven't seen any in the time line yet. yeah, we've seen them over in the corner before but not in the news feed itself. facebook says though if one of your friends posts something about, say, the gym you both go to, the gym could pay to make sure that update actually showed up prominently on your time line. or if you post something about starbucks, starbucks could make sure all of your friend saw it

figure it out. i can tell you this much -- this is "today in the bay." good wednesday morning to you. thanks so much for joining us. 5:28 right now. i'm laura garcia-cannon. >> i'm jon kelley. let's check in with meteorologist christina loren to find out -- sounds like it is going to be another hot day. >> racking up the records likely later on this afternoon and possibly, quite possibly, this morning. i'm actually forecasting temperature records in places like videos and concord, hayward and napa both getting very close to a record. it is frigid out there but we're going to see a gorgeous, gorgeous afternoon with plenty of upper 60s and low 70s. we'll take you through that forecast, tell you what you can expect in your city first. if you're getting out that front door right now, mike has a couple things that might slow you down, an improvement out there. >> in the north bay where are you talking about record cold temperatures dramatically changing today, we have a look at the golden gate bridge where volume's starting to increase out of the north bay.

we had emergency road work but it's just been called off. good news, 101 no problems for the approach, things are starting to clear up as volume increases. s >> perfect timing. 5:29. san jose police still at the scene of overnight violence at a popular night spot. a long list of people were injured at the creek sidebar and grill on alma street. "today in the bay"'s damian trujilla is live at the scene. >> reporter: officers cleared the scene a short while ago but they were here for a good three hours at the creek sidebar and grill doing their investigation and about a half-hour ago they towed away a silver car from the parking lot here at the creek side, presumably to process it for evidence. a bystander flagged by a patrol car just before 2:00 this morning here at the creek side. he said someone had been shot. there were other victims that were apparently taken to the hospital in a private vehicle.

>> officers heard gunshots at the creek side inn. they responded to the scene and when they arrived there was two people that were injured. later on approximately half-an-hour later we had another person who walked in with additional injuries. >> reporter: the victims are all male and none has life threatening injuries. at this point police do not have a motive and they are still trying to identify the suspect or suspects in this case. live in san jose, damian trujillo, "today in the bay." 5:31. a san jose elementary schoolteacher is in jail this morning accused of sexually assaulting a child. police are now trying to determine if there are more victims. 35-year-old craig chandler is accused of assaulting that child last year. he taught a combination second and third grade class in san jose. chandler worked at the school there for nine years.

police are asking other victims or anyone with information to come forward. the man accused of a deadly crime spree in the south bay will make an appearance in court this afternoon. a plea hearing will be held for paul ray castillo. the 33-year-old parolee is in custody right now after robbing a gas station in san jose last september. police say he shot a man during the robbery and then later carjacked and killed a popular radio show host. castillo is a three strikes candidate who could face the death penalty. the search for a serial arsonist is intensifying this morning. navato now offering a $15,000 reward to find the firebug. someone has set 56 fires since early sunday morning. all of the fires were small but close enough to homes that it has a lot of people worried. so far, no one has been hurt. new this morning, a small kitchen fire forcing the evacuation of a redwood city assisted living center. the flames broke out at the wood side terrace just before 1:00

this morning. crews say it started in the kitchen of one of the units and was quickly doused by the sprinkler system. one senior had to be evacuated because of smoke. but so far no reports of any injuries. crews right now are cleaning up after a two-alarm fire at a tesla factory in palo alto. flames broke out at a battery testing facility at around 1:00 this morning. firefighters say the damage could have been worse but the sprinkler system did its job. scott mcgrew continues our coverage. a fire in a battery facility could be the sign of a much bigger problem. >> we have reached out to tesla to get an exact understanding of the damage and the cause. a battery is a prime suspect. but we don't know at this point it wasn't the copy machine that caught fire. but why are batteries prime suspects? because batteries catch fire often. something called thermal run-away. we've seen it in a number of devices like music players. you recall there was an enormous problem with laptop batteries catching fire on airplanes a few years ago.

what's the difference between a tesla battery and a laptop battery? actually, not much. though again, we are still gathering information. so it could be somebody left the coffee pot on but certainly you hear battery facility and fire and that requires a lot more investigation and we are on it. laura? >> thank you very much, scott. 5:34 right now. one of the biggest tech companies in the bay area is opening up shop in the silicon valley. "today in the bay's" marla tellez has more on where oracle is making a move. good morning, marla. >> reporter: jon, good morning. the software giant is here. you can see oracle's name already posted right in front of this building behind me. now a small sign for a big building. this is on almaden boulevard right next to the convention center. a building that sat empty for most of its life, a victim of the recession. but things are looking up. oracle now takes up 3 of the 19 floors.

that's about 66,000 square feet. it is expected to eventually have more than 400 oracle employees that will call this office home. oracle is headquartered in redwood shores. larry ellison's company actually inherited this building in 2008 when it paid billions to buy san jose based bea systems. the building's main tenant though is pwc. that's pricewaterhousecoopers. that moved in just over a year ago. that company occupies more than half of the office space here with some 1,200 employees. now this means only 10% of this tower is now vacant and that is certainly great news for downtown san jose which is just rye behind me, blocks away. live in downtown san jose this morning, i'm marla tellez. >> thank you very much. also good to bundle up before you head out the door this morning. want to check in with meteorologist christina loren. >> you'll regret it if you don't, it is so cold out there this morning with plenty of low 30s and upper 20s on that

to oakland. folks, if you're using the park boulevard on-ramp, it should have just re-opened over the last few seconds as the incident just cleared from chp but that park boulevard accident involving a person originally trapped in the car, that person's been taken to the hospital with minor injuries we're told so everything should be flowing smoother out of oakland there. through oakland for 880 past the downtown exit. the northbound side had construction overnight. that's cleared but we saw the slowing on the map there. right here a live look at the coliseum right about where the slowing is reported. nothing. but i did see flashing lights two minutes ago northbound past high street. we may have an incident between the coliseum and downtown. see that cluster of traffic at the bottom of the screen? i will sort out details and bring them back to you. quick check crossing the bay, san mateo bridge moving smoothly as well but volume all increasing as the commute kicks in. 5:37. coming up, when an east palo alto official is saying about recent measures taken at a deadly intersection where a

mitt romney, the winner in new hampshire with ron paul and jon huntsman coming in second and third. "today in the bay's" tracie potts has all the details. good morning, tracie. >> reporter: good morning, everyone. in fact the polls were pretty accurate. perhaps even under a little bit because the top three mitt romney, ron paul and jon huntsman, each outperformed what the polls said they would do just a little bit. mitt romney of course taking this race and he becomes the first candidate ever other than a sitting president, an incumbent, to win both iowa an new hampshire. he won by 39%. puts him in a strong position now going into south carolina where this morning even he admitted it is going to be an uphill climb. it is those conservative voters that rick perry and rick santorum and newt gingrich are hoping more of them will go their way. but if you look at the breakdown of who voted here, the exit polls, we see that there were a lot of independents. they're not going to find as

many of those in the south. 6 out of 10 of them said the economy was their biggest issue. many said their focus was beating president obama and that they were fiscally conservative. so romney this morning is saying that if he could win conservatives in new hampshire, he can do it again in south carolina. >> tracie, it is the eternal measuring stick. what do those polls look like for south carolina. >> reporter: sure. well, the latest ones we've seen -- it really only makes sense to look at very recent polls looking at the ones in the last week or so. he's up on average by about ten points but those polls range anywhere from single digits to in one case 18 points. that was the cnn/"time" poll. so he does have an advantage there but again you've got a lot of conservatives there, unclear if they will be strongly for a more moderate candidate like romney as they were here in new england. but we will know that in seven days. >> all right, mitt romney trying to keep the momentum going. tracie potts, thank you very much. in fact, his win in new

hampshire makes him the solid front-runner for the race for the republican nomination for president. with south carolina's primary next, romney's mormon faith may surface as one of the big campaign issues. that is because the state has many evangelical christians. lee and peggy green hope voters will look beyond religion and focus on romney's character. like john kennedy in 1960, romney gave a faith-based peach when he ran for president in 2008. vowing he would not serve any any one religion or take his cues in the head of the mormon church. >> he's not going to do that. he's going to do what he thinks is best and act on his principles and he's not going to be taking orders from salt lake. >> while romney is expected to get the lion's share of the mormon vote, the greens believe the mormons will not vote for romney simply because he is mormon. they say he will be judged on his political record and current issues. 5:34 right now. the new investigation into the death of actress natalie wood

while sailing off santa catalina island in 1981 has turned up no new evidence. the l.a. county sheriff's department detectives say they found nothing to suggest the cause of wood's death was anything other than an accident. detectives have been working on the new investigation for two months now. it is not closed. however, they say it is highly unlikely any new ground will be broken on how the starlet actually died. we need the rain and snow. december did not worry california water monitors but january does. the california department of water resources is talking the dreaded "d" word -- drought. the department's chief hiydroloy hydrologyist says a dry january is hard to recover from. we still have a lot of water in reserve though from last year's very wet winter. but if the pineapple express could possibly come through, that could help out the situation, too. >> even if it arrives in spring, we're still going to get that

yesterday saying photos of nude and partially nude women were found in his reno home last year. he was charged with killing four women between 1977 and 1994. another probation officer is expected to testify today about finding a list of unnamed girls in geographic locations in his home. list is linked to areas where some of his alleged victims were found. east palo alto's city engineer says the city should see if flashing lights will fix a dangerous intersection that's been the subject of much debate ever since a 6-year-old girl was hit and killed in the crosswalk last fall. residents say the intersection needs a stop sign to make it safer but the city engineer tells the daily news group the city should try other safety measures before resorting to a stop sign. vigils are being held today across the country to mark the tenth anniversary of the first detainees at the guantanamo bay prison. activists gathered at the federal building in san francisco this afternoon starting at 5:30.

rummaging through her drawers is opening up about the bust. she said she set up the webcam in her room to keep her sisters from stealing her stuff. she had her lap tap camera hidden behind some pillows to keep an eye on her room. she didn't know her parents had scheduled a last-minute open house. what she saw on camera caught everyone by surprise. >> i saw my chair move and i was like, what was that. so i kind of fast forwarded back and i saw him come through our hallway and he came through my room looking through our drawers. >> all of a sudden she comes down the hall screaming oh, pie god, somebody ripped us off. we looked at the video and it was really shocking. >> it is a former real estate agent convicted in 2010 of stealing from open houses and selling good on ebay. they turned the video over to their real estate agent who turned it over to police. he is due in court tomorrow.

cheap airline fares might start looking more expensive soon. the federal government is forcing airlines to be more up front about what your flight will actually cost. starting in two weeks, airlines will be required to make sure advertised fares include all government taxes and fees. airlines will also be required to list fees for the dreaded checking of the bags. and they'll have to give customers 24 hours to change their reservations without paying a rebooking fee. 5:55 right now. a number of websites have threatened to shut down next week in protest of a controversial proposed law called sopa. scott mcgrew says they're really going to do it. >> we've heard they're thinking about it on january 18 -- facebook, google, twitter. this site read it and says they'll do it. reddit is the site. the administrators say they'll turn themselves off for 12 hours next week and instead show

information about the stop online piracy act or sopa. wikipedia also thinking about going dark for that one day. the founder of that organization asking users what they think of the idea. the problem is with a protest like this, companies that pride themselves on always being available wouldn't be. google, for instance, is something you depend on and they want you to feel that way and if you wanted more information about why tech companies don't like sopa, what would you do? you'd google it. as we first reported yesterday, congressman darrel issa has invited a number of tech experts to testify about this proposed bill in congress because congress needs to understand more about how the internet works if it is going to establish laws controlling it. not everybody thinks that's a good idea. one congressman from north carolina, democrat mel watt, once said he didn't really understand the internet because he wasn't a nerd, he said. but watt said he was sure that engineers from google and twitter were wrong to oppose
