of a 14-year-old pleasanton girl 28 years ago is expected in court. steve carlson charged with the murder of tina fails. the case remained unsolved for 27 years. carlton was charged last summer when dna evidence linked him to the death. a judge deciding the 44-year-old carlson should be tried as an adult for the murder even though he was only 16 at the time of the crime. >> a former realtor caught on video rummaging through a 12-year-old girl's bedroom will be in a courtroom. police say douglas john was stealing items at an open house. 12-year-old haley caught him in the act using a webcam she set up to catch her sister in her room. the realtor is charged with first-degree burglary. >> today will not be an ordinary day. students and parents learned a

math teacher marie johnson is in jail. johnson is accused of having a 6-month-long relationship with a boy under the age of 15. the 40-year-old is facing 24 counts of sexual assault. parents and students are shocked. >> behavior -- she was like friendly with us like she was a cool teacher. i liked her. i never would have thought. >> i feel bad that if this is true, if this did happen, because nothing's been proved yet, that it could -- it tarnishes teachers in general. >> investigators say the relationship started with text messages, facebook communication and the game words with friends. johnson is on administrative leave. she is expected in court tomorrow. >> police in one bay area city are asking people to be on the lookout for suspicious activity. copper thieves are stealing valuable wiring from light

poles. the department of public works thinks the thieves are dressing up as utility workers to commit the crime. at least six thefts have occurred. >> here's good news. finding a job could get easier. a new survey shows more bay area businesses are planning to hire more people. bob redell is live in newark where one company will hold a jobs fair. how many positions are available? >> reporter: quite a number. good morning, jon. target in the east bay is planning a job fair that will start today and the hope to hire 300 people in the next three days. the job fair will be at the newark location we're at now. but this will be for positions at a new store opening in fremont. this is certainly an expression of confidence and the local economy and target's not alone in this. the bay area council just released a survey of 450 executives in the bay area, local companies, and they are also expressing confidence and

more saying they plan to hire more people in the next six months. over half saying everything is status quo and about 70% who plan on letting people go in that same amount of time. this is a slight increase, though, over the last survey that the bay area council released. so there you have. local companies expressing confidence, target putting their money where their mouth is by hiring, planning to hire 300 people. the job fair is starting at 8:00 this morning through 3:00 in the afternoon here at the new park mall location. today, tomorrow and saturday. jon, laura. >> bob, thank you. a mystery company coming to the central valley and could mean a big time boost to the local economy. the paterson city council is set to meet to discuss project x, now this is a deal with a mystery company planning to move into a massive 1 million square

foot facility and hire 2500 workers. some people speculate it could be amazon and possibly part of the company's promise to governor jerry brown to bring jobs to california and delay imposing an online tax. >> we know the possible cause of a fire in palo alto. yesterday morning's fire started after equipment was left on inside the test facility. the sprinkler system put the fire out. there was minor smoke and water damage in the building. no one was injured. >> pg&e customers wanting to get rid of their smart meters may soon have a way to do just that. the california public utilities commission will meet today to consider a proposal that would allow customers to opt out of the smart meter program. residents who take on the option would have to pay $270 up front and then $14 a month. some residents complain the meters pose a health risk. pg&e insisting the meters are

safe. >> hoping to get kids into kindergarten. registration opens for classes at a school, four classes with roughly 120 seats. but it's first come, first serve and it's all in demand for the spots. parents want to make sure their kids are not left out. it's similar to what actually happened there a couple of years ago where parents had to camp out over another classroom but it was all prompted by overenrollment. >> 4:37 now. another chilly start to the day. christina loren is here to tell us are we going to warm up? >> you know what, i've got both for you, jon kelley. i have both in my forecast. you have to wait for my next report. we'll talk about today. it's cold out there, 35 in concord, 36 in livermore. 30 in gilroy. we're in the 20s in novato. we're going to continue to drop off, over the next three hours

in particular. but we're headed toward a nice afternoon. just as we thought it's a spare the air day, illegal to burn, but the good news is you were in the unhealthy range yesterday in the north bay, now in the moderate rain. the unhealthiest in the south bay. if you suffer from respiratory issues you probably want to limit outdoor activity. storm track well into alaska bypassing the pacific northwest. high pressure in control for us today. that's going to make for a warmer afternoon with a clear sky. hazy sunshine. temperatures are going to end up in the mid to upper 60s inland, a few 70s, and at the coast we're talking about the low to mid-60s. i'm forecasting about 65 degrees today in oakland. so, comfortable january weather continues. we'll show you when we get a major pattern change that's in the forecast. are you following that crash? >> i am following that crash but we have a new incident, a disabled vehicle for northbound 680, coming out of fremont, past

the truck scales into sunol. out of fremont we have a disabled vehicle reported in lanes. prepare for a slowdown as you get down into sunol. no problems as far as the sen says goes. watch the flashing lights. more north of the dublin interchange. al costa north and in the southbound side we have a lane or possibly two at times over the next 45 minutes, that moves closer to the 5:00 hour for 680. no major slowing either. following that accident, castro valley boulevard at marshall street off the freeway, it's a divided road. but no major slowing except for at that intersection. a look at oakland things are moving at the coliseum. a light volume of traffic. construction out of downtown to fruitvale. back to you. >> thanks so much. it's 4:39. intel announced a finalist.

leadership with bain capital. they are also going after his claims that he is a job creator. romney's campaign is reportedly preparing a counter attack of his critics. >> economic developments overseas could steer the mood on wall street today. for that and more news before the bell let's turn it over to bertha coombs live at cnbc world headquarters. good morning. >> good morning. we've got futures pointing higher, we've got some data that people have been waiting for that was positive. out of china. the inflation there eased to a 15-month low in december so that's pretty good news. positive government bond auctions in spain and italy. european markets are higher. looks like we'll be higher. we'll get retail sales, first time for unemployment and the all important crop report. the dow slipped about 13 points yesterday, it was a flat day.

so we'll start the day at 12,449 for the dow, 2710 for the nasdaq which was up 8 points. foreclosures activity fell 34% last year, hitting the lowest level in december since 2007. reeltty track which monitors says that's mostly a function of the huge backlog. the process slowed following the so-called robo signing that emerged in late 2010. twitter is proving to abfrustrating tool for many banks. a new report finds that customers like the speed and directness of sending a question or a complaint to their bank. the banks are responding with the need to protect the personal and financial information such as bank account numbers. most banks say they need twitter to listen to customers but then take issues off line to protect their privacy. yes, no kidding. were you going to give me your bank numbers or social security

numbers? i have a nigerian prince who would be interested and might send you a check. >> sure. any time. i'll e-mail it to you today. all right. appreciate that warning. thank you. >> want to give you warnings when it comes to the forecast. christina loren. >> warning, another beautiful day in the bay. we're going to see a gorgeous day. people need to know it's cold out there. bundle up the little ones. if they are waiting for the bus, it's cold. by noon you're peeling off several layers. in fact, temperatures at noon are going to exceed our average daytime highs this time of year. so we'll take to you the hour-by-hour forecast. we've got the rain. the pattern change on the way. right now the storm track is just going way to the north. in fact, alaska is getting hammered because that's where all of the rain is. the storm track just bull's eyeing alas california we're going to see changes next week. a dip in the jet stream, this ridge that kept us dry is going

to head off to the east so that's the good news. we have rain on the way next week. it's going to be different than what we've experienced this week. more of the same today. 36 in livermore, 35 in concord, 31 in santa rosa. take a look at the noon readings. temperatures are going to climb in the mid-60s in some cities. we're going to end up warmer than we did yesterday. even warmer than we were yesterday. 73 degrees in gilroy, 73 for fairfield. i bumped up the number to 69 in livermore. and 70 in santa rosa. so yet again near record lows will make way to near record warmth. the remainder of the week we're not going to see a lot of change. hazy days all the way through the holiday weekend. looking like a little more cloud cover will start to push through sunday and monday. for us that's good news. milder mornings. as we head through next week, the pattern changes. we've got rain on the way, starting on it looks like tuesday into wednesday. we'll see major changes. that's the good news. we'll talk about that coming up. back to you guys. >> thank you very much. kind of a mini spare the air day

at schools, smoking cigarettes will soon be banned on all ten university of california campuses. the ban will be rolled out in stages over two years to try and help people quit gradually. tobacco companies will not be allowed to advertise in buildings owned or rented by the university. nearly 600 college campuses nation wide banned smoking altogether. >> it's an unusual trend in the bay area, squatters are moving in on foreclosed homes and getting paid to move out. police call it cash for keys. people move in illegally, forcing banks to pay thousands to get them out. police in antioch say they have seen it happen a lot. just this week police raided a vacant home and arrested three people. one claimed to be renting the property, and showed a phony lease. neighbors say they will keep a close watch on vacant homes. >> still ahead a man risks his life to save his dog.

a live look outside bay bridge toll plaza approach, traffic pretty light right now. we're going to keep tabs on the morning commute for you. 4:51. >> it was a tough day for a menlo park man who says he fought off four pit bulls attacking his dog in his own back yard. he says the pit bulls had his dog by the neck. he used a rake to try to save his pet. he was able to get his dog in the house. animal control officers came out and able to get the pit bulls over to their property and the owner of the pit bulls has since apologized and says he is planning to give the dogs away. a new more secure fence has been put up. >> it's a case that gripped a community. a mother could face criminal charges in connection with a deadly crash. police say she purchased miners' alcohol that led to the collision. it happened in february but now investigators arrested

51-year-old amelia chin and 45-year-old abdul dujk. the underage women went in a store, purchased alcohol, from the store clerk with the help of chin. chin is a mother of one of the young women's friends. a few hours later the underage woman was killed in a crash. the driver of the car was arrested for drunk driving. >> testimony continues this morning in the preliminary hearing case of accused serial killer joseph naso. diary accounts of rapes and disturbing photos made up the testimony yesterday in marin county. nasocharged with killing four women between 1977 and 1994. yesterday a probation officer described a 2010 search of naso's home. that search turned up a diary detailing assaults of underage girls along side posed photographs of two suspected murder victims. also a list of ten women was

also found including four references that prosecutors believe refer to the murder victims. >> a watering hole in union square may have to close. the gold dust lounge was served with eviction notice. the landlord says the new tenant wants to use the space. supporters for the lounge have started a social media campaign to try to save the bar. it was once frequented by janice joplin and steve mcqueen. the city of oakland holds a community day of service to honer the legacy of dr. martin luther king. starting at 7:30, community groups and volunteers gather at more than 30 sites in oakland to provide service. some of the sites include residential home projects, youth center, schools and rec centers. volunteers will work until 2:00 this afternoon. >> let's check back in with mike inouye to find out what's happening on the roads. >> good morning. to the peninsula, first for 101

where we have construction. highway 101 in the northbound side at oregon expressway and embarcadero road. a couple of crews. that's nothing unusual. no major slowing. the embarcadero off ramp has opened early sounds like but the oregon expressway on and off ramps will still have construction. closer to 6:00 we'll see that clearing. we do have in the east bay an issue, the northbound side of 680 at the fremont truck scales reports of a disabled car that was in lanes. we took a look and we didn't see anything going on over on the northbound side. the southbound side, however, back over the hill into fremont side at washington reports of a disabled bus. may be a few and reports of a passenger transport so i'm trying to find out more on whether that affects the major transit lines and how many are affected. we'll try to get updates from chp but they are just arriving on scene. no injuries, just a disabled bus or two.
