into the north bay. isolated spotty activity. you see that in santa rosa. the north end getting rain. look at what's headed our way throughout the second half of the day. i'll tell you when the showers arrive at your door step. then we've got two more potent systems on the heels of this one. a lot of rain headed our way, possibly breaking records. we'll talk about that, help you plan around it as well. first want to check your drive with mike. >> i know not to bet a wlaed the new weather center behind her. we'll look at the roadways, 880 fine northbound. southbound, around embarcadero, crews should be clearing. there should be minor slowing as the crew clears the scene. 880 at the limit. good stuff. >> thank you very much, mike. >> 5:01. san leandro police are looking for a man who shot at an undercover officer following a suspicious driver near anza way around 9:30 last night. the driver made a u-turn, then

fired several shots. the car is described as a dark colored acura last seen going eastbound on 580 in oakland. >> san francisco sheriff ross mirkarimi street make his first court appearance on charges of domestic violence. christie smith live with a story that seems to get more dramatic. >> reporter: good morning to you, jon. san francisco sheriff ross mirkarimi has denied these charges and said he will fight it. his alleged victim in this is his wife who is now saying that it's her husband who is somewhat of a victim of dirty politics in her opinion. in this case it seems to have new and contradictory information daily stemming from a new year's eve incident. according to the chronicle a videotape taken by a neighbor seems to show his wife eliana crying and pointing to a bruise on her arm and indicating that this type of incident happened

before with her husband. this is coming from an arrest warrant affidavit. lopez has been taken to the air waves with a venzian radio station saying the charges are political persecution and what she said at the time of the alleged incident was taken completely out of context. the san francisco sheriff is facing domestic violence charges, battery and dissuading a witness. he will be arraigned in san francisco at 2:30 this afternoon. reporting live in san francisco, i'm christie smith. >> thanks. union city high school teacher is due in court to enter a plea on multiple charges of having section with a student. 36-year-old peter faces 21 felony charges for having a sexual relationship with a 16-year-old. investigators say that the james logan high school teacher began the relationship last march. they are looking for additional

victims. >> killed in an instant. the driver at a light never saw this couple. he was in the wrong place at the wrong time and it cost him his life. robbery suspects smashed into oohis car going 80 miles an hou. this happened on mowry avenue. the two-car collision flipped the suspect's car. two ran but they were later caught. moments before the accident police were chasing the suspects from a robbery scene. officers say they backed off before the crash occurred. >> an east bay city could begin using a controversial method to combat gang violence. the hayward city counsels sl talking about a gang injunction. opponents say it's an infringement and too expensive. proponents say it will make the city safer. some think the injunction is unnecessary. >> new this morning the iowa

republican party issues new results from the presidential caucuses. the results are surprising. the des moines register is calling it a split decision between mitt romney and rick santorum. the register says missing data from eight precincts makes it impossible to say who won. romney has been declared the winner by just eight votes. coming up later we'll get a live report from washington on how these new results may affect the race. >> 5:05 now. six days after a cruise ship ran aground in italy hope fading to find more survivors. a live look of the ship where a storm could halt the recovery efforts going on. rescuers have blasted four more holes into the "costa concordia's" hull to try to look for 21 people that are still missing. crews say they cannot begin to pump oil out until the search efforts are completed. >> the captain of the ship remains under house arrest. he says no, he didn't abandon

ship, but he accidentally fell into one of life boats as it was launching. the official number killed in the accident remains at 11. >> the san francisco 49ers' success in the playoffs could be just the thing to secure crucial funding for a new stadium. but some are still looking to derail their plans. bob redell joins us live at the 49ers team headquarters. good morning, bob. >> reporter: good morning. the team's success this season is expected to be a huge boost in the effort to build its new stadium across from its training facility here in santa clara. season ticket sales are going up which would help bay for the project. the city of santa clara is expected to be in a more favorable position as it auctions off naming rights and the nfl is about to vote on putting $200 million toward the new digs. yes votes now more likely. on the flip side, opposition to

the venue claimed a small victory. a group of citizens opposed to using taxpayer money for private entities like an nfl team says it is collected enough signatures to put the city's $850 million loan that would go toward paying for the stadium, they have enough to naught on the ballot. the city attorney says that the loan is not subject to a referendum. the city clerk is checking on the validity of all of the more than 5,000 signatures submitted. tickets to yesterday's game did sell out. once they went on sale on ticket master. you can buy them through secondary markets. you will be paying a lot, up to $1500 for sunday's game against the new york giants. kickoff at 3:30. reporting live, bob redell, nbc bay area news. >> we'll be tuned in. call this one chalk it up as a hit to embattled oakland mayor

jean quan. her deputy mayor resigned effective january 1 citing health reasons. this all comes two months after oakland's other deputy mayor resigned. the mayor's office says cohen will not be replaced. >> a plan to temporarily ban chain stores in one city is put on hold. the press democrat reports that sonoma city leaders decided it new enact the ban. it would have kept out restaurant, retail stores and businesses that operated ten or more locations including the chain williams sonoma. some city leaders argue that temporary moratorium would protect the town's character. others called it anti-business. >> joe biden and his wife jill wrapping up their visit to the bay area. the vice president will attend a campaign event in the city before he hops on a plane to

throughout the day temperatures are going to remain on the mild side. we're starting out mild. right now let's check your drive. >> before that rain you get a break. after that, tough. here we had debris reported for 580. you are getting a break as far as the traffic flow but not if you are one of these two cars that reportedly hit whatever debris it was. the debris couldn't be found but chp is with the two vehicles. they hit something in the roadway. and we have a smooth flow past them but flashing lights right around north flynn. over to the dublin interchange, we're seeing a blip. i'll check on that. the north bay, travel times. travel is smooth from 12 down through novato in toward san rafael and the golden gate bridge. you're at the the limit down into the city via 101. a live look shows you across the bay over to 101 on 92, that's

>> welcome back everybody. we're giving you a long distance shot of san jose. we'll check the forecast with meteorologist christina loren. >> we can tell you parts of the northwest getting hammered with snow this morning. that massive winter storm dumping more than a foot of snow and brought heavy winds to the region yesterday. that caused a number of car crashes in washington state, but we're happy to report no serious injuries. the storm causing delays at the seattle airport and that had a ripple effect at sfo where of course we're monitoring the

travel boards. we'll let you know if anything happens again today. >> meteorologist christina loren joins us now on the set. we need that rain. that snow. a little bit. >> we'll take it all. >> we're going to get hammered. i don't like to use that term unless it's absolutely necessary. we're 2ing to get slammed with rain, friday night in particular, also sunday looking very, very wet. today the first of three storms starting to push on shore. for us this is going to be the milder of the three storms as we see the second one roll through that will be more intense, wait till you see what i'm forecasting on your futurecast. we have spotty showers developing in the north bay, a good batch of rain. you can see it right to the north of ukiah. throughout the hour i think we'll see a little bit more of that spotty activity ramp up, then 7:00, 8:00 a.m., we'll see more shower activity in the bay

area. this is what we're forecasting. today, a.m. showers, periods of rain throughout the second half of the day. by tomorrow a very potent storm moves on shore, mostly cloudy, you'll get a little dry break until mid morning. then the rain returns. by sunday, the coldest and most potent of the storms rolls in just in time for that nfc championship game. you want to bring your umbrella -- excuse me, your rain gear. you cannot bring umbrella. get a poncho or something to protect your head. as you can see we have moderate rain on the way. in the north bay we continue your futurecast in motion. a break the first part of friday. take a look at all that red, yellow, orange, that is heavy rain on the way to places like san francisco. we are expecting localized flooding because it's going to come in so quickly, all that rain coming in at once has nowhere to go. so watch for flooding as we head

through friday. then a dry break until about 3:00 p.m. saturday. saturday morning until the mid afternoon looking good. hey, if you are going to attend that game make sure you're ready. heavy periods of rain, wind at 10 to 20 miles per hour sustained. i think all of us will be enjoying that game from our homes are going to get to watch excing action. it will come into the factor when it comes to game play. throughout day conditions continue to stay on the mild side until about 2:00 p.m. when the rain starts in the south bay. heavy rain friday and we'll tell you more about the time line for that storm coming up. back to you guys. >> so this morning's commute you should be okay. like christina said this afternoon and evening you're going to get whit the rain. that could mean the oil rises to the top for the first rain 18 long period. some slick roads. 101 looking slick, north of highway 92 and 84. 84 itself, the construction crew clearing from the bridge overnight maintenance and that's likely causing the sensors to

cause this red. no incidents on the bridge other than that but i'll make sure that is the case. we're looking here, southbound side of 101, embarcadero on and off ramp, blocked by construction for another few. nothing blocking the freeways, all of these speed sensors showing aus great flow at the limit there. smooth drive for 680 and 880 down in the area. sunol, fremont. i told you about a little bit after blip here northbound 680. there is construction at al costa, likely some of the crews are moving. al costa and sycamore valley road. no major slowing for 680, a smooth drive for 580 through castro valley. a look out there to see the bay bridge. a few cars. back to you. >> thank you. 5:18. the bay area's google, intel and ibm all expected to report earnings today and that could affect how the markets close. for a look at that and the rest of the news before the bell we turn to brian shactman live at

cnbc world headquarters. good morning. >> good morning. stock futures on a busy day are slightly higher after pretty good gains on wednesday. there were fueled by golden sacks reported better than expected earnings, also positive outlook on the housing market. asia was higher, europe has turned positive, it was negative. we get data on unemployment, housing starts and building permits as well as consumer prices and as marla mentioned google, ibm, all report earnings. the dow rose 96 points to 12,578. the nasdaq up 41 to 2769. eastman kodak filed for chapter 11 bankruptcy protection capping a prolonged decline for one of america's iconic companies. it has secured a $950 million life line to keep operating. kodak hasn't turned a profit since 2007. it failed to quickly embrace modern technology.

the digital camera, it invented it. walmart has launched a contest to find the best new product offering any small business or individual inventor a chance to win a spot on store shelves. you can submit your video of the item at get on the shelf.com t the public will vote to determine the win here will get the space. walmart has pretty incredible customer base, $260 billion spent there last year. i've done stories. you get in a couple of walmart stores and it's big business. >> for sure. it just takes one bright idea. brian, thank you so much. >> uc students, it's a radical plan to try to get rid of tuition and the school system president says he's going to consider it. this is cool a. group of uc riverside students presenting the uc student investment proposal to the board of regents

last night. the proposal would eliminate college costs while students are in school. in exchange graduates pay 5% of their salary back to the uc system for 20 years. the students say under the plan the uc system could triple its revenue over the next 20 years. the system president says kind of likes it. he and his staff will study the group's proposal. >> supporters of a popular san francisco watering hole slated for closure hope for a second chance. the supporters will hold a news conference this afternoon at the gold dust lounge, hoping to bring the landlord back to resume talks. he was served with an eviction notice in december. the owners were told to be out by march. since then a grass roots effort has taken off in hopes of saving the bar. >> dr.ing looking adult beverages there. coming up a outsoftball group in

>> welcome back everyone. it's 5:24 right now. an east san jose softball league the latest victim of copper thieves. coaches and parents now trying to raise money after somebody stole the wiring for the lights at their ball field. the thieves hit the ocala middle school grabbing copper wire and equipment. that leave the league with no place to practice or play without the lights. the scheduled evening practices start in about two weeks. parents trying to raise thousands of dollars trying to get the lights fixed. >> the 49ers hold a news conference to talk about this

weekend's honorary captain. it will be their first super bowl win, that's former owner eddy debartelo. he was at the helm for all five of the team's super bowl victories. >> hope it will be one more after this year. at&t upping the price for all that data that you download. scott, not the first price hike. can you say probably not the last. >> people buy a smart phone for the first time and start downloading things they had not been downloading before. it's turning out to be a major crisis for cell phone service providers. at&t says it will raise the price of its data plans by $5 a month for new customers, it's also raising the cap on the amount of data you can use so more money but more data. this takes effect for new customers on sunday. google reports profits at the closing bell. watch for overall cost.

more than 30,000 people work for google these days and relatively new ceo larry page says he will continue to grow the company but at what cost. the other thing to watch is the bottom line. it is possible google will top $3 billion in revenues, never done that before. speaking of google, gookle and wikipedia, the companies that came out against sopa can declare victory. yesterday a number of lawmakers who originally loved the bill turned their back on the proposed law. look at this list of senators. these are senators who were actual co-sponsors of the protect ip bill. not just supporters but sponsors. all of them now oppose their own bill. california's two senators, they will support it but their phone lines were melted down yesterday marla and jon, busy signals. remember the busy signal?

you said it, twists and turns. sheriff ross mirkarimi will be in dhourt afternoon at 2:30 on domestic violence charges. his alleged victim is his wife who is also talking about the case. saying it may be her his who is the real victim and a key piece of evidence could be a videotape taken by a neighbor which seems to show his wife crying and showing a bruise on her arm saying this happened two times in 2011. in an interview with a radio station lopez defended him. here is a translated portion. >> this is a case of political persecution. there's people with a lot of money behind this political fight. the richest people in california are behind all this. they can't stand that a progressive with very little money won the campaign for

sheriff. >> reporter: later on lopez questioned why the nab here videotaped that earlier interview even went to police with the information suggesting she may have had an agenda of her own. mirkarimi insists he is going to stay in office while he fights these charges. reporting live in san francisco, i'm christie smith. back to you. >> thanks. 5:33. new this morning a fire ripped through a home in san jose. firefighters say flames sparked about 2:00 this morning through the roof of this vacant home. this is east of the san jose municipal golf course. firefighters put out the the flames within 30 minutes so. far no word on the cause. damage estimated to be from 125 to $200,000. >> jury selection continues in the trial of an alleged gang member accused of killing a father and his two sons. 24-year-old et win ramos shot tony and two of his boys to

death as they drove through san francisco in june 2008. a third son did survive. ramos telling investigators yes, he was driving the car but was not the gunman. police think they were sadly mistaken for rival gang members. >> the oakland teen anoused of sexually assaulting two people is set to make his court appearance. the 14-year-old turned himself in. he is charged with robbery, sexual assault and kidnapping. for the attacks earlier this month. right now he is charged as a juvenile but the district attorney plans to ask the judge to charge him as an adult. >> 5:34, the woman accused of killing her partner's mother with a machete expected to enter a plaext she is charged with murdering eion kirk. prosecutors say she attacked the woman with a machete type women,

then told police that a man came and attacked both of them. she lived with eion kirk's daughter. >> apple is ready to make an announcement that will interest students in the bay area and beyond. scott mcgrew is in the newsroom with what's happening. >> we expect appearing is going to announce something with text books, maybe on the ipad, special tools to create text books. maybe all of those. apple has been quietly trying to lower expectations on this announcement. it's 7:00 a.m. our time. a short time from now. apple in ways a victim of its own success. nearly always announces something really awesome so it's trying to have a low key meeting about section books. apple has a close relationship with education back since the apple 2, even steve jobs told

his biographer he wanted to crack the text book market so we expect it has something to do with text books in education. we'll know in what, an hour and a half from now. >> thank you, scott. >> the san francisco 49ers' push for the super bowl could not have come at a better time. live outside the team's south bay ed quarters where the 49ers are not the only ones benefiting. isn't that right, bob. >> yeah. good morning, jon. 49ers success is expected to be a huge boost in its effort to build a new stadium from santa clara. three things that would happen, one, season ticket sales go up which would help pay for the project. the city of santa clara is expected to be 18 more favorable position as it names off naming rights. the nfl is about to vote on

putting $200 million toward the new bigs. they are more likely given how hot the team is. on the flip side, you do have opposition to the 68,500 seat venue. a santa clara plays fair says it is collected enough signatures to put the loan for the stadium on the ballot for voter approval. the city attorney says that the loan is not subject to a refer ren come. the city sclerk checking on the more than 5,000 signatures that were submit. speaking of sunday's game, all tickets did tell out on ticket master. you can find them on the secondary market. looking at stub hub.com. tickets are available but they

in gilroy and 55 in oakland because we're starting out on the mild side. we have upper 20s only in gilroy. elsewhere the 40s and 30s. a far cry from the low 20s earlier in the week. here it comes, this is the first of three storms that will impact the bay area as we head through sunday. you can see it's not just impacting us, the pacific northwest getting slammed as well so this is the first storm. the second is on its way. it's packing moisture. when we stop the clock for totals at 8:00 saturday look how much rain we'll be dealing with. you see the orange and yellow. that's upwards of two inches. you think about how that translates to snow i'm still sitting with six feet of snow above 7,000 feet. we'll show you and what we expect from these three mean storms. first i want to check that drive. >> a quick note check the wipers

and chains if you are heading to the sierra. highway 4 westbound, the slowing right at 5:30 we saw these chicago lets turn to yellow, red. 40s at best. 57 just over to the left. some slowing as well. no problems. folks haven't made their way over there. about 19 minutes off of the carquinez bridge. we'll look at north bay times with a drive southbound 101 from highway 12 down through novato and across the golden gate bridge. you cross the bay into the city. crossing the bay in another spot, san mateo bridge moves well. no problems between them. >> let's keep it problem-free.

>> welcome back everyone. the podium's all set up as the republican presidential candidates get ready to square off for their final debate before the south carolina primary. this is as a new report out of iowa calls it a virtual tie. tracie potts is live on capitol hill. she has all of the details. >> jon, good morning so. the republican party in iowa calls it a tie, mitt romney in a statement this morning says it's a virtual tie. but here's the fact.

certified results now have rick santorum up by 34 votes instead of the 8-vote margin that declared mitt romney the winner. the bottom line, we knew there were over 100 precincts in question for possible issues with the vote. and now they have been able to chase down the official certification form and work out the issues for almost all of those precincts. but there are eight, eight precincts in iowa for which it appear there is was no certification form. no votes can be counted from those precincts. as a result of that, plus the others that have been adjusted, most likely santorum is technically the winner by 34 votes. what effect will this have, we don't know yet. mitt romney, saying santorum did well. but it is a tie. we're waiting to hear from the

santorum camp. he is now fourth in iowa with 14% of the vote. 20 points behind mitt romney. >> all right, tracie. thank you. >> 5:44. the eighth largest economy is on the mend. that's the message governor jerry brown is sending to californians. during yesterday's state of the state address the governor laid out his plans. he pushed his initiative to raise taxes calling it, quote, key to restoring california. he also urged lawmakers to support the high speed rail project and renewed the commitment to renewable energy and innovation. >> the u.s. getting a bailout, kind of, from a billionaire, warren buffett. he will write a check to help pay down the national check. the total, about $49,000. relatively small change for a billionaire but buffet says he
