>> good monday morning to you. thanks for joining us. we're seconds away from 5:00. i'm laura garcia-cannon. >> good morning. i'm jon kelley. we check in with meteorologist christina loren to find out about that wet rain forecast. >> yeah, you know we're going to have to deal with it the first part of the day but not all day. we'll see the sun shine by about 11:00 a.m. over just about everywhere across the bay area. you can see over the past three hours a lot of rain pass through the bay area. you can see the nature of the showers starting to thin out substantially. we'll talk about how much we accumulated, since last friday. we've got a lot to talk about in the weather department. first let's talk to mike about your drive. >> it will be a tough one this morning for a lot of folks. rain might be happening right where you are. if not the effects are an issue. the san mateo bridge we see our camera shaking, high winds on bridge. watch the slick conditions, the wind blowing you around as you cross the water and the water being a factor on and off of the off ramps. a lot of spin-outs.

lower speeds. the water is still an issue. >> you need to. thank you. >> still 5:00 right now. our wet and wild weather making for sloppy commutes this morning. christie smith live on the bay bridge with a look at what you can expect on the roads. >> reporter: good morning. it is wet and windy out here. not pouring. it's a little bit of a drizzle but certainly enough to make you grab that steering wheel tighter as you head out and hold on. if you are crossing the bay bridge the wind advisory still in effect. travel not advised for campers and trailers. i wanted to show you what it was like this morning when i was caught behind a big rig on 80 westbound where traffic was at a standstill for about 25 minutes. drivers were forced to exit at gilman. that's clear now. but the storm has caused headaches since it started with a tree down in mill valley, knocked out power. that was on friday.

also, downtown same area, there was rain standing water across -- caused quite a mess. people forced to pull out the sandbags. back to the bridges, mike was mentioning san mateo bridge, high winds there. basically, you'll want to keep an eye on it as you head out over all of the bridges. when we started this report this is how the weather has been going. when we started i said it wasn't raining. in this last 30 seconds the rain picked up again so that's the kind of morning it is. i'll send it back to you. >> that's the morning you're going to have. 5:02. the heavy rain is making a mess at one neighborhood in the oakland hills side. crews have been clearing debris near the intersection of oakwood drive and wild currant way. 50 feet of road slid down the hillside. despite the mess people can drive through the area in spite of some of the detours set up. >> we have the rain while much of the south and midwest gripped

with severe weather. marla tellez joins us with how bad the southern states are getting hit. >> it is rare to have tornados in january but that's exactly what is facing a few states including arkansas and alabama as many as 16 tornados have been reported through central arkansas overnight and early this morning. the strong winds destroyed several homes in the town of fordice. the best news is so far no serious injuries or deaths have been reported and the people there are keeping positive. >> just going to be a clean up, going to take while. get cleaned up but we're going to make it. we'll be all right. >> now to alabama, a local nbc station has posted this photo on its facebook page. hard to make it out but you can see complete destruction, this photo snapped in center point, alabama, which is north of birmingham. we're getting word searchers in

birmingham are going house to house right now trying to rescue people trapped in homes but again, no reported deaths there. many parts of the south are under a tornado watch this morning. we'll keep an eye on it and continue to update you throughout the show. >> thank you very much, marla. in the meantime, police are searching for two men who shot at an east palo alto during a robbery attempt. police say the gun men demanded money from the man just after 1:30 on sunday morning. when the 53-year-old victim walked away he was shot in the lower back. he is expected to recover. the robbers got away. >> city police are searching for a driver who hit and killed a pedestrian. it happened around 6:00 yesterday morning near union square. the man died at the scene. they have no details of the driver or the car involved. if you have information please call union city police.

>> opening arguments start today for an alleged gang member accused of killing a father and his two sons. 25-year-old edwin ramos charged with shooting and killing the three back in 2008 as they drove home from a picnic. prosecutors say ramos mistook the family members for members of a rival gang. another son was in the car at the time of the shooting but did manage to survive. >> a union city teacher accused of sexually assaulting a student will be arraigned. peter faces 21 felony counts for having a sexual relationship with a 16-year-old. investigators say the teacher began the 9-month relationship in march. the 38-year-old could enter a plea during today's court session. >> police will answer questions about a deadly officer-involved shooting. police will explain what happened when an officer shot and killed kidnapper tre le on

friday. he forced his way into a home friday morning and kidnapped an 11-year-old girl. they found him that afternoon holed up in an apartment. le apparently began shooting and offered returned fire. he was killed at the scene. the young girl, we're happy to report, is back safely with her family. >> the city of fremont selecting a new mayor today after opening up applications to the public. the fremont city council will look over applicants and choose a new mayor. he or she will serve a 10-month term until the november election. the council is replacing bob wasserman who had been mayor since 2004. the 77-year-old died last month. >> 5:06. new this morning police say the nfc championship game was not without trouble. pepper spray was used on one fan after he hit a police officer and a woman in the crowd. an officer and a fan involved in that had to have their eyes flushed out. they are expected to be okay. police have not released

complete arrest numbers but say behavior was typical. a number of fans were arrested for public intoxication, battery and resisting arrest. after the game one fan suffered a minor injury when a car drove over his foot. >> no secret, 49er fans left yesterday's game with nothing but a heavy heart. after not turning over the ball all year long the niners had two turnovers when it counted most. both compliments of kyle williams who suffered what had to be the worst game of his life. despite the disappointment niners owner jed york stays optimistic. >> it's tough to end it this way but we know we've come a long way and still have a ways to go. we know we'll get there. >> coach jim harbaugh says the slaus tough to get over, the team will not be defeated as long as they believe and remain knowing there is hope.

>> a great run for his first year. >> absolutely. >> and the rain coming down. check the current conditions with meteorologist christina loren. >> they had to deal with strong winds as well and this morning it's still windy. we still have showers. let's pinpoint those for you. you can see right now pretty good batch of rain through livermore. we'll see more light spotty showers for the next few hours. but that's enough to get the roadways slick just before you head back to work on an already harder than normal monday. throughout the day today, the showers will come to a close by about 11:00 a.m. you can see we're headed toward pretty nice conditions. 53 degrees at the bay at about noon. so if you break the lunch temperatures, we'll have 60s on the map places like livermore, here in san jose i'm forecasting about 68 degrees at 3:00. but future cast shows you, we stopped the clock at 11:00,

sunshine up in santa rosa. because of all of that moisture and high pressure moving in to compress it we could see thick fog over the next couple of days. we've got the seven-day outlook ready to go in the next report. first let's get you out the the front door. >> the front door that's okay, after that yeah, the drive, it's going to be horrible at least for the conditions. we'll look at highway 4 where we had a number of things to report. just in the last few minutes. an earlier accident westbound at 4 around somersville may have quickly moved off of the roadway. that's good news, no injuries and no major slowing. eastbound, reports of flooding in the area. sounds like it's unrelated. another report of more flooding over to bay point but that cleared from highway 4 as well. highway 24 at orinda avenue off ramp a report of slowing or flooding for the off ramp. that report cleared but then in the last few minutes we've seen

this slowdown. it's advisable you lower speeds to what is manageable for the conditions. as fast as the conditions will allow. 680 at 580, the transition, a lot of water, not closing lanes but watch it. slowing both directions from dublin to castro valley. sloppy wet conditions, that's what your windshield will be as well. >> 5:10. thank you, mike. occupy protesters using a new tactic this week to get the attention of world leaders. they building igloos instead of pitching tents. they are to warn people to clean up their act or they will end up in the snow. >> 5:10 now. lunar new year celebration in full swing, the year of the

>> welcome back everyone. mike inouye letting everybody know you need to watch your driving out there because christina loren tells us there has been a lot of rain, 880 in oakland right now. the time now 5:14. >> finally snow in the sierra. this is what it looked like on interstate 80 near the summit yesterday. chains are required this morning on both 80 and highway 50. most resorts say they received about two feet of snow over the past couple of days. despite the storms sierra will need a lot more to get up to levels up to normal for this time of year. last year we were inundated with snow but you know, that's a good sign there, good start. >> exactly. a start to the day is about with rain. christina loren tells us that will taper off. >> yeah, then we get to enjoy good air quality. it's going to be really nice for the second half of the day. tomorrow looks good, a dry

stretch in the forecast for this week. i'll show you your seven-day in moments. your doppler radar shows you we've got showers on the way. places like dublin about to get wet. the same for san ramon. throughout the day today your temperatures on the mild side. on track with our averages, we have 50s this morning so we're starting out mild. 55 san mateo, 54 in the city this morning and 48 degrees in fairfield. weather headlines show you a wind advisory until 6:00 a.m. especially over the local bridges. you could get caught with a strong gust. so be careful. tractors, trailers, you could get knocked around. after that we'll see the winds drop off a little bit as the system continues to pull out of the area. rain at times until 8:00, nye 9:00, then clearing. and temperatures work out like this. 58 in milpitas. 57 in palo alto. you're going to hit 58 in concord once the sun comes out.

a nice second half of the day. 57 san rafael, and your seven-day outlook shows you i think we'll see dense fog on thursday and friday. saturday may be a little drizzle early, making way to 63 degrees. a beautiful afternoon. we've got a good looking weekend setting up. by monday, nice and mild. let's check the drive at 5:16 with mike inouye. >> out to the peninsula we have a newer accident reported here. northbound 101, as you head up through san mateo. reports are this car got into an issue with control, then went across the freeway across all lanes and slammed into the center divide. we have to get more from chp. one of the notes not necessarily for this case but where you get a loss of control it's harder to regain control so something smaller can turn to something bigger. >> we'll watch this and let you

know if lanes are blocked. the south bay, a smooth drive despite your usual suspects, 237 past fair oaks, no flooding reported about but watch that. we have 87 at 28, you see flooding there as well as mats into downtown. we had an accident around bear creek. having one of the two lanes blocked for about 20 minutes caused slowing through the area. another accident southbound 101 at bailey so no major issues from san jose. we'll look at the golden gate bridge. wet roads. back to you. >> the asian markets closed this morning because of lunar new year. that is showing things down in early trading. for a look at that and news before the bell we turn it over to jackie live at cnbc. good morning. >> good morning, jon.

the futures are slightly higher after a micked session on friday. but overall positive week for wall street with the dow, the nasdaq and the s&p 500 all closing up 2% or more. the cloud of europe's debt crisis is still hanging over the markets today. most of asia as you mentioned is closed for chinese new year. there is no major economic data on the calendar but investors will watch several events including a fed meeting. president obama's state of the union speech. the dow rose 96 to close at 12,720. the nasdaq at 2786. did you get an ipad or kindle for christmas? they were such popular gifts that the number of people who own one has nearly doubled. new data shows that 28 percent of americans earned the device, up from 19% in december. taco bell for breakfast?

launching a breakfast menu and plans to take the plan nation wide. the program is called first meal, a menu that features 11 items with scrambled eggs, sausage, bacon, tortillas and hash browns. it's re-entering the competitive market with an eye on those on the go young adults, age 18-28. john. >> thank you very much. >> an oakland woman who convinced the irs she could deduct the cost of care for her rescued cats heads to court. the chronicle reports that jan faces animal cruelty charges related to nearly 100 cats she kept. animal service staff say most had parasite infections and other illnesses. the 60-year-old woman plans to fight those charges.

>> welcome back. good monday morning to all of you. that is san jose, hp pavilion downtown. things looking fairly smooth out there. still very early. the time now 5:23. >> a bay area hospital will hold a bone marrow drive for one of their own. registered nurse kathy loogenville has helped patients more than 30 years s. she has a rare blood disorder. there will be two drives at alta based medical center in berkeley and another drive tomorrow. >> the post office unveiling a new stamp celebrating the lunar new year. take a close look. the forever stamp commemorates the year of the dragon. san francisco's mayor ed lee is expected to attend the stamp unveiling set for 10:30. this is the fifth of 12 stamps in the post of service's

celebration of new year's series. >> couple of canadians lost their job this morning. scott, why do we care? >> because they ran the company that makes blackberry as co-ceos. did they run it well, no, no, they did not. research in motion may be a canadian company. considering that the cell phone is central it's important to us. here they are. they have been called everything from clowns to worse. they are out. though they will still stay on as members of the board. the pair grew research in motion into canada's most valuable company but then let it back down the hill with disastrous products like this t blackberry tablet. canada's answer to the ipad. it didn't get corporate e-mail which is the most important thing a blackberry phone does but the tablet called playbook wouldn't do that. new research from utah valley university, this is home of the fighting wolverines, people can

reports of a car starting to swerve and then all the way across the freeway into the wall. that accident has cleared as well. we've got the wet roads as a result of all of that rain. what do we have for the commute? >> more rain coming down. especially in the east bay. right to your live doppler radar. you can see where the showers are coming down right as we speak from concord down through san ramon getting heavy rain, also fairfield, petaluma getting a good batch of rain. the next couple of hours the showers will dissipate. as the storm system pulls out, a lot of instability, the winds are picking up and it's dangerous for your morning drive. monday, back to work. christie smith, she's on the bay bridge. it's not only wet, you've got the winds. are people able to get out, people able to get traction? >> reporter: you know, that's a tough thing. i am looking forward to the clearing later this afternoon

because it is just still wet and windy. it's not necessarily pouring. right now it's not raining at all. we're having a tough time deciding whether to put the hoods on or off because it is starting and stopping. enough to be annoying. and it is windy. if you are heading over some of the bridges it could knock you around. bay bridge and other bridges have a wind advisory in effect at least for another 30 minutes or so. i wanted to show you video a while ago at the bay bridge. getting here was quite tough with a major backup on westbound 80 near gilman. it was a parking lot for about 25 minutes as they worked to clear a big rig accident. since the storms started they caused problems, trees down in mill valley, fell on a power line. people trying to walk in it. lots of standing water. so much that in some areas people had to go for the

sandbags to keep the water out. as you head out, that standing water is still there even if it's not raining. winds 20 to 2 to miles an hour. if you have a high profile camp or trailer, travel not recommended. i checked the website. the dumbarton, richmond, san rafael and san mateo t wind advisory. caltrans has the electronic message boards and a couple weren't lit up sow might not know until you get closer how windy it is. but take it from me it's awe any windy. live near the bay bridge. back to you guys. >> thank you, christie. it's 5:32. police trying to find the gun men who opened fire at a birthday party. investigators say even though there were 80 people at the party, no one has come forward with information.

six people were shot on saturday night when three or four young men opened fire during an argument. the victims range from 13 to 21 years old. three have been released from the hospital. three others are in serious condition. >> san leandro police need help finding a woman suspected of at least eight armed robberies. we have a picture to show you. she is black, between 16 and 25 years old, 5'8", weighs about 130. she has dark hair which could have highlights and usually wears it pulled back or under a wrap. she approaches her victims on foot. after asking for the time she pulls out a gun and demands money. >> accused killer joseph nasowill wrap up this morning. nasois representing himself. a judge is trying to decide if he should stand trial for the murder of four women. during the two weeks of

testimony the prosecution presented images found in naso's home, posed in unnatural positions. prosecutors argue the women were drugged and subdued. nasosaid he used his charm to seduce the women and images were part of what he called americana, not evidence of criminal activity. >> san francisco sheriff ross mirkarimi returning to court to seat date for trial. facing three misdemeanor charges, related to an alleged case of domestic vie hence. last week he pleaded not guilty to the charges. the sheriff has been ordered to stay away from his wife and sun. the mayor is asking mirkarimi to consider whether he can continue on the job effectively with all of the legal issues he is facing. >> a popular dollar star illegally selling toys with too much lead has agreed to pay a

fine. a california subsidiary of daiso settle add lawsuit brought for alameda and santa clara counties t.d. a. accused the store of selling products containing lead. >> it was a heart breaker but some sports fans may take the loss, the playoff loss, a little too hard. bob joining us with more on the reaction. some who are getting blamed for the loss. good morning, bob. >> good morning, john. a lot of disappointment especially monday morning after what should have been a win yesterday over the giants. that wasn't the case. arguably no one is feeling that more than kyle williams. he is the backup punt returner for the 49ers, who fumbled two returns during last night's

game. once in overtime which put the giants in position for the game-winning field goal. his two mistakes has drawn the ire of fans. some issuing death threats on twitter against williams and his family. som of those have been removed. some remain. there are many more messages of support from fans. hear the reaction after the game. >> we'll move forward. it's one of those things you hate to be the last guy that had the ball and to give it up that way, to lose with you know a game of this magnitude. we're going to move forward as a team. >> we understand that his family and teammates were there after the game with williams in the locker room there to console him. he was clear i disappointed in his performance.

there is an image of him throwing his helmet down on the sideline. reporting live, bob redell, bay area news. >> thank you for the report. >> everybody was pretty excited. we're still wearing our 9er red. 5:37. time to check in with meteorologist christina loren. she's in the weather center. >> definitely a lot of rain coming down over the game yesterday. weather was certainly a factor and will likely be a factor on your morning drive. give yourself plenty of extra time. especially if you have to get the little ones out the door. some good rainfall pushing into the east bay. throughout the day today we'll continue to see showers especially on the each edge probably till about 11:00 a.m. overall we'll see nice weather as we head through the week. some of the totals over four inches in napa and santa rosa.

2 1/2 in san francisco, 1.5 in san jose and seven inches of rain over the course of the last four days. we've got a lot more on the way for this morning. i think by about with 11:00 a.m. we'll see a clearing. temperatures time climbing to the mid-50s. by 4:00 we'll round out the day with comfortable conditions especially when you consider we struggled to make it out of the mid-50s. 54 at noon. up to 60 later on. >> first let's check your drive with mike inouye. >> this report you're getting now if you're around for 10 minutes watch the next report because things are changing so quickly. we're looking at 580. a number of accidents for the east bound direction. the lightest was an accident 580 around red wood road.

>> welcome back everyone. good morning to you. 5:42 now. the gop presidential candidates fighting out for florida pounding the pavement hoping to hit the jackpot and the inner take all state. tracie potts joins us live from washington with the latest on their chances. good morning. >> good morning everyone. no question, florida is a battleground state and three out of the four republican candidates will compete, for ron paul, it's a winner take all state he decided not to campaign there. tonight at the debates be on the lookout for sharp attack from newt gingrich, mitt romney and rick santorum all hoping to gain

ground in the sunshine state. again, this is a winner take all state. they have got a primary just a week away. romney is coming out of south carolina having reversed a double digit lead there, ended up losing big to newt gingrich over the weekend. so gingrich walks in with the momentum though romney has been ahead in the latest polls in florida. now there is a poll new out today insider advantage that shows that newt gingrich is up by eight points. again, this would just be the beginning of the turning of the tide so we've got to watch over the next week or so and see what florida voters are thinking. rick santorum thinks he's got a pretty good shot in florida. this is his reasoning. the other two candidates have each won a state. newt gingrich and mitt romney. they were both essentially in their back yard. he won in iowa where he believes voters had more of an independent voice. so, he's hoping he'll be able to take that winner take all in florida a week from today or

tomorrow. but first, the debate tonight on nbc. >> of course. tracie, thank you. congresswoman gabrielle giffords stepping down this week in order to devote her energy to rehab. she release add video this weekend to make that announcement. >> i will step down this week. i'm getting better. every day. my spirit is high. i will return. >> so good to hear that and so great to see that smile. giffords will appear in tucson today. she will meet with some of the people at the event last year, then after that she'll be attending the state of the union address tomorrow in washington, likely her last act as a congresswoman. there will be a special election set up to fill her seat.

>> 5:44 now. the penn state campus is grieving the loss of legendary coach joe paterno. paterno died sunday, hours later thousands of people gathered on campus to pay their respects to the winningest coach in major college football history. paterno was fired last year after one of his assistant coaches was accused of child molestation. mourners preferred to remember the good times. >> try and be strong for him. but it's hard. he made me proud of this school. >> joe paterno taught us about success with honor and that it wasn't enough for him just to win football games but that he wanted to do it the right way. >> paterno died of lung cancer. no word on funeral plans. >> 5:45 now. actor tracy morgan is in the hospital after collapsing last night. sources say the "30 rock" star

this snow. if you are thinking of playing hooky and trying to come up and play, not today. get some traction with this snow. much more up near the sum michigan beware. out here on the interstate it's very wet snow so under the snow has been a slick sheen of that sierra cement we have seen an suv actually spinning on its side, wheels going around. the plow you saw, even with the chains on he was spinning his wheels because of how heavy this snow is to mover. the good news is, plenty of snow returning to the sierra, dramatically changing our situation. possibly enough to allow downhill for the first time all year. almost the end of january. despite the difficulties it may make for driving we've seen some accidents, everyone we talked to here says this is a sign from heaven, manna if you will.

bridge, some conditions we're dealing with. they have to run a wiper on the lens. high winds also across most of the bay area bridges. lower the speeds. flooding could be an issue. the latest was 280 in san francisco, the on ramp has cleared from the flooding but a note it is reported in many spots, a little through daly city and the bay bridge, the wind advisory continues. i'll talk about this accident coming up. >> 5:51. divers are back out at the capsized cruise ship in italy. 19 people from the "costa concordia" are still missing. ofrls are trying to decide if they will stop searching for the remaining and start pumping a half million gallons of fuel from the ship. they are worried if they wait too long the fuel spill will cause an environmental disaster. a decision is expected this afternoon. >> students of san jose state pushing the city to raise that minimum wage. the students part of a class at

>> welcome back. new rules for airlines go into effect this week that should make buying your plane tickets the next one less confusing. the newell rules are meant to make sure travelers are not surprised by hidden fees when they get to the airport. regulations include posting the total cost of a ticket including the cost of baggage, airlines are now required to let passengers know when a flight is canceled, diverted or delayed more than 30 minutes. and travelers now have a 24-hour window to hold or cancel a reservation at zero cost. experts say we could see more air fair hikes even with those new fee disclosure rules. >> mailing a letter will cost you a bit more this week. the postal service raised the price of a first class stamp a penny to 45 cents now. it's the first increase in more than two years. postage for post cards increased to 32 cents and letter to canada or mexico cost 85 cents. forever stamps are still valid
