>> a live look outside for this tuesday, january 24th at the golden gate bridge. this is "today in the bay." good morning to you. a good tuesday morning. it's 5:00 right now. i'm laura garcia-cannon. >> good morning. i'm jon kelley. let's check in with meteorologist christina loren. a chilly start to the day. you say it's going to get nicer. >> yeah. we have a good looking day today and for the rest of the week. really comfortable conditions, lots of sunshine. this morning it's a little on the cool side. grab a jacket but leave that umbrella at home. we do have thick fog developing. i'll let you know when it will be at its worst and which cities are going to see the worst fog. the seven-day outlook ready to go. >> we're going to track the fog with you because it will affect your commute at times. right now 101, affecting the commute there.

if you are getting on or off at embarcadero for the northbound side or on the oregon expressway for the southbound side. switch the route you use. northbound use oregon. the crews clear about an hour from now. >> it's 5:00 now. richmond police are looking for a suspect in a shooting that left a 22-year-old college student dead. the contra costa times report as man and his sister were sitting in a car near the corner of nevin and 22nd street last night. they were about to head to class at a community college when a man ran past them firing at a car. the gunman then gave up and then fired at the student and his sister. the young man was killed. his sister is okay. >> what a tragic story that is. 5:01 now. budget cuts in an east bay city could cause dozens of popular events to be canceled. christie smith is live in concord where the city council will meet to discuss pulling the plug on more than 45 downtown

events. good morning. >> reporter: good morning to you. yeah, they have tough decisions to make when they meet this evening in concord. what the budget cuts mean is that events that people have gotten used to over the years could go by the wayside. we're talking about things like the fourth of july parade, also the music and market series according to the contra costa times. 45 events that easily bring 200,000 people downtown, this according to a report that the city council will consider tonight after the governor's cost cutting moves to slash redevelopment agencies. the deadline is february 1. so that's why cities are moving now. for concord it could mean that seven city workers will lose their job. oakland is also in the same boat. most of its cuts would come from programs that are used in lower income areas. but could also mean cuts to favorites like the oakland zoo

and children's fairyland. last week out of 3,000 city workers, about 2,500 got layoff notices. it looks like when they crunch number it will be closer to 105 workers. oakland, they are going to discuss it tomorrow. in concord they discuss it tonight. christie smith. back to you. >> thank you very much. 5:03. witness testimony will begin in the trial of the suspected gang member accused of a triple murder. edwin ramos is accused of killing tony bologna and his sons michael and matthew back in 2008 after mistaking them for rival gang members. a third son survived and is expected to testify. during opening statements the prosecution said that ramos had a history of gang violence. the defense says that ramos is innocent and another man actually shot the bolognas. >> an east bay school district

could decide to allow drug-sniffing dogs onto its campus. they will talk about using the dogs to patrol three high schools. the dogs would patrol during certain school hours but not in the presence of students. the district says a rise in drug and alcohol-related suspensions has led to the proposal. >> a possible norovirus outbreak, 73 people are suffering from flu-like symptoms at two aegis living centers in san rafael and corte madera. health officials say the first outbreak happened nearly two weeks ago. >> san jose council members will decide whether they should eliminate their own pension benefits. a committee headed by mayor chuck reed approved the proposal. the full council will take it up this afternoon. san jose tried to trim worker

pensions because costs are outpacing funding. the council is in the process of asking police and firefighters to change their pensions as well. >> it is 5:04. mitt romney's taxes took center stage in florida. marla tellez joins us with a look at newly released tax information. >> good morning. he has been under pressure to come clean especially after newt gingrich released his tax records. soon after the debate ended romney's camp began releasing his financials. we learned that the former governor earned $42.5 million over two years, this comes from profits, dividends or interest from investments. romney has confirmed he paid about $3 million in income tax in 2010 and expects to pay about $3.2 million to cover 2011. here's the point of contention for the average american. his tax rate is below that of

most wage earning americans simply because most of his income comes from as i mentioned, caltal gains on investments. this means he is taxed at 15% compared to 35 period. when brian williams asked him about his wealth romney had no remorse. >> i will not apologize for having been successful. i did not inherit what my wife and i have. nor did she. what we have, what i was able to build i built the old-fashioned way by earning it, working hard. i was proud we helped create businesses that grew that employed people. >> romney went on to say he helped create companies like staples and sports authority which employ middle class americans and that's something he says he is proud of. it should be also be noted in the two years he made the $40 million, documents show he and his wife contributed $7 million in charity and much of that went to his mormon church.

>> thank you very much. the president will deliver his state of the union address tonight. most predicting the speech will be heavy on economic theme. president obama expected to pitch new initiatives on jobs, housing and taxes and expected to serve as an opening argument for the president's re-election campaign. it will air here on nbc bay area starting at 6:00. we'll go live to washington for more details on what exactly the president will be talking about. >> the san francisco board of supervisors will tackle a possible road block to the americas cup. the sierra club filed an appeal to the environmental impact study. it's concerned about potential water pollution from a giant floating tv screen yet to be installed. the study was approved by the planning commission. today the supervisors will decide whether to uphold that. if the conclusions are rejected

livermore. it's chilly, san francisco at 53, 49 in sunnyvale and 43 degrees, good morning to you, in santa cruz. throughout the day high pressure continues to mover closer to us. it's eventually going to set up over the great basin. we'll see the off shore winds. as of tomorrow the warming trend kicks in. high pressure is going to make for a comfortable afternoon. temperatures climbing 5 to 8 degrees from yesterday's highs and it works out like this. as we head through the -- mild, fog each morning. 60s in the afternoon. i'm talking about the upper 60s. here is your day part forecast as you can see, about 57 degrees by the bay at noon, 60 degrees as you make your way home from work. inland, you'll hit about 60 degrees at news, 63 at 4:00 p.m. as you head home after a long day's work. you got to get there first. how do we look?

>> this is a live look outside from the south bay this morning. nice start to the day. you'll be surprised where the temperatures are inching. >> today's dry weather will give crew as chance to clean up that huge mess left by all of the recent rain. geologists will be out at this rock slide in san francisco today trying to come up with some kind of plan how to deal with it. the large boulders tumbled down telegraph hill yesterday, the rocks crushing a car at the complex on lombard street. three apartments still under evacuation orders because it's unsafe out there with all of that dirt moving and falling on stuff. not good. >> wow. we'll help that we're not going to see all of the rain we've been seeing. >> nothing substantial.

maybe an inside slider which is a cutoff low that breaks from the jet stream this weekend. but even that's not going to produce that much moisture. we're looking toward fog. that's going to be the weather story especially tomorrow and thursday. this morning already noticing that fog dropping off your visibility. you saw from the live picture of the golden gate bridge, no major visibility issues yet but that will likely become a factor. 53 in san francisco, at 41, good morning in santa rosa. in concord your visibilities are dropping, watch out even through livermore, deep pockets of fog. dense fog will be the factor, clearing by mid morning for most of your interior valleys. a lot of sunshine early. as a result temperatures are going to climb into the mid to upper 60s as of today. even warner for tomorrow and the dry trend lasts all the way through the end of the week. so let's talk about temperatures for today. morgan hill about 63 degrees for you.

outside county line we have an accident, a car went off roadway and there will be crews heading there. not a major commute issue. 680, 101 moving smoothly. top of the screen, on westbound 277 you have the metering lights which have been on. they are starting to cycle. that will happen starting at 6:00. we'll see if it affects the roadways through milpitas. likely only the surface streets. we have construction going on here, the on and off ramps are affected. getting on at oregon expressway, that's the issue there. the rest of your peninsula looks nice. between the city and 92, no major slowing. and no problems. getting across 92 t san mateo bridge moves, nice easy drive. we'll take you back out to the maps to finish with more valley. i see this blip.

cannot use gps devices on suspects without a search warrant. the decision could affect an appeal in the chauncey bailey murder trial. police hid a device on bay's car as part of a separate investigation. that device was on the car when bailey was killed. it shows bay's car outside of bailey's apartment hours before his murder. it also showed the car went by the crime scene less than an hour after the murder. under the ruling that information would not be admissible in court. >> the ruling could affect a lawsuit filed against the fbi by an arab college student who found the device on his car. he and his lawyers say the gps device violated his rights. he was accused of trafficking cocaine as a result of data from that device. >> 5:24 now. the giants said they didn't want

scene. still dark out there but details are coming in. it appears that police are staged in front of the union building on fisherman's wharf. we hear a woman was attacked by a man in the bushes just before 4:00 this morning. we have a crew on the scene. we'll update you as soon as we get it. >> a group of santa clara residents may have scored a minor victory. bob redell live near the proposed construction site and what's going oun. good morning. >> reporter: good morning, jon. there is a group of residents opposed to using taxpayer money to pay for a 49ers stadium that would be in this parking lot next to great america. the victory comes in this sense. they have now forced the santa clara council to take up this issue again tonight at its meeting. the registrar of voters confirmed that california played fair collected enough signatures to force a referendum on the

city's decision to line uf $850 million in bank loans to help finance the project. at the meeting one of three things could happen t city preels the loans, submits the issues to voters, unlikely, or ejects the referendum petitions which is most likely. the city's argue summit that the bank loans were never subject to referendum because that move to approve them was administrative in nature. in other words, they are just carrying out the will of the voters who approved the project in june. santa clara plays fair believes the voters were hoodwinked. the group says it does plan to go to court to fight this issue. reporting live, bob redell, "today in the bay." >> accused serial killer joseph nasowill be tried for the murders of four women, that is a

judge's ruling after a 2-week preliminary hearing. he is charged with killing four prostitutes from 1977 to 1994. during his closing arguments the 78-year-old marin man called prostitution a, quote, risky business, and any one could be responsible for the murders. nasowill be back in court february 3. >> a warning this morning for people living in san carlos, the san mateo sheriff's office asking residents to use caution when dealing with door-to-door salesmen. last sunday a man and woman posing as magazine solicitors were allowed in to use the bathroom and took a large amount of jewelry while they were in the home. the sheriff's office says it's never a good idea to let strangers in. a showdown may be imminent between ed lee and sheriff ross mirkarimi. hours after the sheriff appeared in court to set a trial date, the mayor said he wants to meet mirkarimi and may ask him to take a leave of absence. the mayor says the charges may

be just too much of a distraction for the sheriff to fulfill his duties. the sheriff right now facing three misdemeanor counts of domestic abuse for bruising his wife's arm during a new year's eve argument. a second woman has come forward claiming that mirkarimi injured her during ath violent argument when she dated mirkarimi in 2007. she just filed a police report yesterday. >> prior to releasing his taxes mitt romney mixed it up with newt gingrich in a feisty gop presidential debate. romney lost south carolina in that primary on saturday and he came out swinging last night. >> i think it's about leadership and the speaker was given an opportunity to be the leader of our party in 1994, and at the end of four years he had to resign in disgrace. >> romney went after gingrich's electability and working as a consultant for freddie mac. two hours before the debate gingrich released his contract with the mortgage giant showing he made $300,000 for consulting and related services.

then the fog creeping in, mostly impacting fairfield, concord and livermore. high pressure is the reason for the change in our pattern. you can see where the storm track is now. right now bull's eyeing the pacific northwest. up over the ridge of high pressure that is going to make for comfortable days. tomorrow looks like the warmest day of the week. so, it all works out like this. as high pressure gets closer it's not only going to compress p moisture, it's going to help keep things mild giving us a quiet stretch of weather that lasts into the weekend. 60 degrees, fog, rising temperatures for the next 48 hours. and we're talking about the 60s so temperatures coming up above the seasonal average. here is the day part forecast. you find out where you live, the coast bay, 45 at 8:00 inland. 60 by noon and rounding out the day at 63 degrees. we'll talk about when you're going to get the best skiing and i've got the seven-day outlook.

5:37. first let's get to you work on time with mike inouye. >> we'll take you to highway 4 where we've seen this, 5:30, boom, down from 50s to the 20s as far as the speeds go in the westbound direction through antioch. they had road work yesterday that was completed later than they thought but it was done and held up through the evening. looks okay now in toward bay point. in the 50s there as well. we'll watch for the volume to move toward concord. so far smooth drive to the bay bridge and the maze no. delays here. we'll look at the north bay times with a smooth drive down from highway 12. christina showed you this shot but we'll look at it again. there is a glow to the lights. no issues for visibility yet. >> starting next month you may see something you have never seen before at disneyland or disneyworld. disney will start to loosen things up and let cast members
