>> good morning everyone. it is now moments before 4:30. i'm jon kelley. >> i'm laura garcia-cannon. lots to get to. let's check that foggy forecast with meteorologist christina loren in our weather center. >> i get to be the first person to say it. it's friday. you made it to the end of the week. we've got a gorgeous weekend shaping up. temperatures running mild. we have fog out there especially at the coast. it's comfortable. we're going to see gorgeous conditions as we head into saturday and sunday. let's check the drive with mike. >> happy oh, my goodness it's foggy. the benicia bridge t fog advisory issued over 680 across the water, likely for the carquinez bridge. a lot of bridges have the advisories. lower the speeds. you see the 70s here, you have

an issue. the golden gate bridge, we'll show you other shots. back to you guys. >> the convicted mastermind of a high profile murder for hire plot in the south bay is back in court today. stephanie chuang is live with the latest developments there. good morning, stephanie. >> reporter: good morning, jon. yes, paul garcia was convicted of first-degree murder last year, he was convicted of the first-degree murder charge on hiring a hit man apparently, in what appeared to be a love triangle situation in the south bay. garcia bought mountain charlie's saloon and the lounge, two popular spots from mark achilles. jeff rosen got the conviction on garcia by convincing a jury he had become obsessed with a bartender who worked for him. it was argued that he was in love with the previous owner

which outraged garcia. prosecutors revealed desperate, quote, desperate text messages from garcia to donnelly before the killing. $900 in withdrawals and records showing that garcia downloaded garcia's picture, the same photo found with the hit man who was also convicted along side the middle man. garcia's previous attorney argued he was framed but failed in convincing the jury. he has a new attorney arguing for a new trial saying the previous attorney did a poor job. we'll find out a lot today at the courthouse on wa could happen with this garcia case. stephanie chuang, nbc bay area news. >> thank you very much. 4:33 now. police are investigating berkeley's first homicide of the year. it happened last night on shattuck avenue. a man was taken to the hospital where he died. police do not think it was

random and they are talking to people asking for possible leads. no suspect description is available yet. >> police this morning asking for help finding the man they think is responsible for a rash of robberies in a south bay neighborhood. morgan hill police looking for 21-year-old jose torres. they think he is responsible for at least seven home burglaries between mid december and early january in the area of san ramon drive. witnesses say they saw torres in the area at the time of some of those crimes a fingerprint lifted from one of the scenes has been matched to torres. >> after a string of violence at bars it's time to crack down. during a special meeting the council talked about taking new measures. city is thinking about hiring two new police officers and creating an ordinance to give the city more control over downtown bars and restaurants. leaders say they may also place a moratorium on alcohol licenses until there is a resolution.

earlier this month police arrested seven people during a large bar brawl. >> it is 4:34 now. signs of rebuilding in san bruno this morning, 16 months after that explosion killing eight people and leveling more than three dozen homes. while progress is being made, most residents say they don't trust pg&e. at a community meeting residents joined leaders to discuss rebuilding the crestmore neighborhood where 38 homes were destroyed. 13 homes are under construction. >> it's going to be a better place to stay, to live, you know. like i say, they killed a neighborhood. it will never be the same but it will be home. >> residents point out they don't quite trust pg&e or the state public utilities commission. since that explosion pg&e has made a new commitment to pipe line safety. >> 4:35 now.

a memorial walk will be held this weekend to honor slain police officer james kapu. it will span 29 miles between vallejo and vacaville. funds raised will go to the family trust. registration starts at 7:00 at the home depot in vallejo. the killer is expected in court on tuesday. >> fired and fighting back. one of the largest employers in the bay area is accused of age discrimination. 130 former employees slapped lawrence livermore labs with a lawsuit. they believe they were fired in 2008 because of their age. after a battle the case is now going to trial. we spoke to an attorney for one of the plaintiffs who says the layoffs arclassic case of age discrimination. >> they laid off none of the

higher people. the only way to save, they had to threat long term workers go who were closer to retirement who cost more for medical and whose salaries are the highest and keep the younger workers. >> lab officials say age had nothing to do with layoff process. the case is going to trial next month. >> san francisco's municipal transit agency will talk about a proposed parking ban that would prevent rvs, trailers and others longer than seven feet to park. it is to prevent people from sleeping in vehicles overnight. they say it will keep the city cleaner and safer. opponents says it targets the poor and the disadvantaged. >> want to check the forecast with meteorologist christina loren. she's in our weather center. kind of foggy. >> yeah, right at the coast, but the biggest difference is we're oing to lose that fog by mid morning. we're looking towards a gorgeous

weekend for outdoor activities. on sunday last weekend, but this weekend sunshine, temperatures in the mid-60s so we're going to get nice weather for you to get outdoors. 49 degrees in oakland. throughout the day temperatures are going to be comfortable, warmer than yesterday because we will see clearing earlier. a little bit of a dry wind later on as offshore flow sets up, that means breeze tee windy through the east bay hills and the north bay mountains fair game for gusty winds. through the weekend staying nice and mild. a sunny start to saturday with clear conditions. right off the bat that sunshine is going to come through. saturday and sunday, so the fog we're dealing with we won't have to deal with over the weekend. as a result temperatures will be comfortable. for today let's take you through the forecast inland. about 62 degrees at noon with a fair amount of sunshine, 64 degrees as you make your way home. we do have changes on the way for next week, rain back in that forecast.

we'll tell you when, how much we expect. first let's check your drive with mike inouye. >> the fog is an issue and through some of that fog in fremont we have an accident northbound 880 right as you approach highway 84. we have a car that went off of the roadway. some fencing is reported there. not sure where it is except for up a hill, that might be part of the issue. some flashing lights. the good news is the ambulance has been called off from that scene. you see the slowing, we'll follow up on that. a live look north at the bay bridge shows you the toll plaza. we can barely make out the lanes close to us. there you go. the issue is dense fog for the bay bridge, and many of the other bay bridges, lower the speeds, and the mist will cause some slick roads. >> city of vallejo will honor a pro baseball player. it will name a field after alum

>> welcome back. the good news it is friday. the bad news for drivers on the golden gate bridge, tough to see. the fog thick and as christina loren likes to say, soupy. we'll fill you in on what to do and where it's going to be. >> san francisco sheriff ross mirkarimi will not be allowed to see his family soon. a judge has refused his request to lift a stay away order. during yesterday's hearing prosecutors presented two e-mails from mirkarimi's wife.

in them she accuses him of neglecting their child including one instance of leaving the boy in the car while he was vomiting. mirkarimi's attorney argues child services found no damage was caused to the child. mirkarimi's trial is set to start february 24. >> a stunning admission from a former san ramon police officer telling a judge yesterday how he stole money and other items while serving search warrants. he also admitted to possessing and selling drugs and using law enforcement money to buy illegal firearms. lombardi was in court to plead guilty nine felonies, part of a plea deal. he is expected to testify against others including private investigator christopher butler and narcotics team commander norman welsh. >> reports from chevron and ford, for details on that and the rest of the news we turn to bertha coombs. good morning.

>> hey, good morning. we've got the futures pointing to a higher open. about 45 minutes from now we get gdp. markets started higher yesterday but lost ground, stocks falling after a report showing a surprise drop in new home sales last month. we started earlier positive on the day after we had gotten good news on unemployment claims and a bigger than expected jump in orders for durable goods. asian markets were higher. europe is mixed this morning. we are going to get the gdp report for the fourth quarter growth and the economy. that comes out about 8:30. should show the economy picked up steam in fall. we'll get data on earnings from chevron, ford and procter & gamble. the dow finished off down 22 points yesterday at 12,734, the nasdaq lost 13 to 2805. mortgage rates rose, the first time in a month. freddie mac says the average rate on a 30-year fixed mortgage

rose to 3.98%. that's still historically low but up from a record of 3.88%. rates tend to track the yield on the 10-year note. that's what you should watch. this week the 10-year rate fell below 2%. and ben bernanke has time to moonlight. he is going to teach classes at george washington's business school. the classes will be live on the internet. bernanke has a history on campus, he is a well known professor, he taught grad school at stanford and chaired the economics department. his term as fed chairman ends in 2014 and it's possible that he could return to academia. that's it for now. not bad, getting the federal reserve chair to teach you thou fed works.

>> 4:46 now. it's a feel good friday. some fog and great weather. >> we do. we have great opportunities to get outdoors so saturday and sunday inland temperatures are going to be in the mid-60s. so, great weather for outdoor activity. you can take those kids out of the house if you didn't get a chance to do so last weekend because of the rain. 52 degrees atgilroy. we're starting out mild, 54 in livermore. san francisco's at 53 degrees. we're starting out so mild even with that fog, that will probably burn off before about 9:00 a.m. we'll see a comfortable afternoon. the jet stream is taking the storm track to the north. it will drop to the south. we'll get a little more activity as a result but high pressure moving into the great basin driving the winds offshore. clearing skies early so we'll see a lot of sunshine by mid morning. i'm forecasting clear skies by about 10:00 a.m. over the greater bay area. breezy throughout the day. you will notice the difference. breezy to windy across the bay

area so tie it down if it's loose in the yard. that way you won't lose it. mostly sunny and warm, by tomorrow staying mild with hazy sunshine. i think we'llbl pbaroy be sparing the air this weekend as we do have no rain in the forecast and really the winds are going to drop off through tomorrow night. 66 in sunnyvale batoday, 69 in morgan hill. 70 degrees in gilroy and 65 in fairfield. yet again rounding out the day with unseasonably warm temperatures. that's going to hold on throughout the next few days. clouds increase on sunday, then that rain chance tuesday, wednesday, thursday. the best chance for rain looks like wednesday into thursday. we have a good opportunity for that. we need the run, we're still running a deficit. i'll let you know how much we're expecting coming up. back to you guys. >> thank you very much. newt gingrich may have evened the playing field with the win in south carolina but it's starting to look like mitt romney's making a comeback.

>> amazing video out of rio de janeiro this morning. shot the moment three buildings collapsed. look at the security video shot on wednesday from the building across the street. you see it there, people running for their lives followed by that huge cloud of dust that eventually just will envelope the camera lens. at least six people were killed when three buildings collapsed. 16 people are missing. rescue workers are out searching for survivors. >> reminiscent of 9/11. closer to home a public viewing today for legend etta james. it will be in englewood near los angeles. james died after complications from leukemia. she is best known for her rendition of "at last." a private memorial service will be tomorrow. james was 73. >> the movie character ferris bueller has taken many days off since the pop culture hit was

cleared but you might have flashing lights as you get on from that major city street on southbound 101. further south, southbound 280, we got wind of a disabled vehicle that was on or affecting the geneva avenue off ramp. no lanes are blocked and chp hasn't filed an incident but it may be foggy through daly city. there may be an issue. a live look at the golden gate bridge. the map shows you the red. we did have fog over the last 15 or 20 minutes. now a clear patch but that will change. the fog, the clouds, all rolling through creating mist for the windshield and possibly slick roadways. be careful out there. >> thank you very much, mike. boy tan no and fleming joined skating champions last night for the opening ceremony of the u.s. figure skating championships.
