>> good morning. thanks for joining us on this monday morning, 4:59, seconds away from 5:00. i'm laura garcia-cannon. >> good morning everybody. i'm jon kelley. let's check in with meteorologist christina loren. it feels like we hit the power lotto on this weather. gorgeous sunshine. >> and winter. hard to believe we're in the heart of winter right now. we're going to see another spring-like day. we do have fog developing, you'll notice visibility dropping off along the golden gate bridge and other bodies of water. temperatures are nice and mild because we have a blanket of clouds. we're going to see a nice afternoon because we're starting out so warm. and our rain chances, yeah, dwindling quickly. we've got a big weekend coming up so we'll talk about that. first let's get to the drive with mike inouye. >> not as big as we wished for. the approach to the city with northbound 280 at 101, reports of a disabled vehicle there and we don't see major slowing on the maps but we'll continue to check that as well as the nice

smooth flow heading up through the area as well. looking at the san mateo bridge as we cross over the bay, no problems up the peninsula, a smooth drive for 92. there's the map showing you where the earlier incident was approaching the san francisco area. no major problem. i'll talk about the bay bridge coming up in the next report. >> thanks. >> it is 5:01. no new taxes and no more regulations, the mayor of san jose wants to let the city's pot clubs operate in peace. damian trujillo live at the medmar healing center which has been vocal against the proposed restrictions. good morning. >> reporter: good morning, jon. medmar gives the city thousands of dollars in pot tax every month. there was one proposed rule that bothered the operators here. the city wanted all of dispensaries to grow their pot on site. medmar told nbc bay area in the past that requirement would not be cost effective since it would

run up their electric bill. the pot clubs use extensive electricity to help the plants grow. and it made a huge security risk fearing break-ins and robberies might occur. the city wanted to raise the pot tax from 7% to 10%. but club owners fought back and gathered 31,000 signatures to repeal the city's rules. that couple with potential changes in the pot rules out of sacramento and the mayor told the "mercury news" he's backing off. at wednesday's rules committee meeting the mayor will ask to put the matter on the february 14th city council agenda. all of these dispensaries, more than 100 of them, some of them are not zoned correctly so that needs to be addressed but they all have to pay the 7% tax. that's huge for the coffers of san jose, generating hundreds of thousands of dollars in pot tax every month. live in san jose.

damian trujillo, "today in the bay." >> thank you. it's 5:02. a retrial in the murder of a former nfl player's daughter resumes this morning. the prosecution will continue to present its evidence against the man accused of killing tracy, the dart of retired oakland player. the conviction was thrown out, he admitted to strangling her during an argument. he is expected to take the stand during the retrial. and in san mateo county the trial resumes for a suspect accused of shooting two people for partying too loudly. jesse david wilson is accused of shooting two men back in july 2010. the victims were laughing and talking loudly while canoeing in a lagoon. wilson claims he told them to be quiet, then shot them when they charged at him. the defense says that wilson was beaten by one of the victims before police arrived. >> a man wanted on domestic

violence charges under arrest after one of his wife's relatives hit him with a car. it happened in the santa rosa marketplace yesterday afternoon. while police were on the way the relative struck jose with his car so he wouldn't get away. police found the 25-year-old on the ground with broken bones. he was taken to a hospital for treatment and is expected to be okay. >> oakland city hall getting ready to reopen for business after this weekend's break-in and attempted takeover by occupy oakland protesters. bob joins us live outside frank ogawa plaza. >> reporter: the city says city hall will be reopened this morning. they say that the vandalism wasn't significant to force a shutdown. right now and the days ahead what the city wants to do is figure out how to reconsider security so that something like this doesn't happen again. what i'm talking about is

saturday occupy oakland protesters crow barred their way in and started vandalizing. the mayor showed us a broken window, damage to children's art and a model of the city, and protesters stole and burned an american flag. both sides are blaming each other for violence over the weekend. protesters complain that police were over aggressive, officers argue they were responding to all of the objects being thrown at them. the clashes started saturday when demonstrators tried to break into and occupy the empty kaiser convention center. then the ymca and eventually city hall. three officers and at least two protesters were hurt. police say they arrested about 400 people for those arrested more than once during the recent occupy oakland protests, the city is trying to obtain legal orders to get them to stay away. bob redell, "today in the bay." >> thank you.

it's 5:05. a bay area congresswoman calling on governor brown to replace the man charged with investigating pg&e for that deadly 2010 san bruno pipeline explosion. the palo alto weekly says that she challenged the commission president michael peavy's ability to be objective in this case. the cpuc was headed by peavy in 2010 when investigators found that agency partly at fault for the pipeline rupture. the explosion ultimately killing eight people and destroyed 38 homes. speaking of pg&e it has a new tool to try and prevent future disasters. later on this morning pg&e will demonstrate a gas leak detection system. it will be able to spot gas leaks within its thousands of miles of transmission and pipeline. pg&e has two of these devices in place, and is wrapping up tests to determine how they will

perform. >> health care workers for one of the biggest hospitals are getting ready to stage a one-day strike. thousands of kaiser permanente employees are expected to walk off the job tomorrow, the fourth since negotiations began in 2010. workers are striking over proposed cuts to health and retirement benefits. the hospital will remain open during the strike. >> less than 24 hours and it's become a two-man race for the republican presidential nomination. mitt romney has a double digit lead on newt gingrich, 15 points according to the latest nbc news poll. ron paul, rick santorum, they both scaled back their florida campaigns. whoever wins in florida gets all 50 of the state's delegates. the war of words between romney and gingrich, nbc brings us the latest on the campaign live from

washington, d.c. >> i want to check in with meteorologist christina loren. she's got a look at our forecast. we are in winter. >> we are. we're spoiled this winter. one thing that we need, though, is the rain. we don't have any significant rainfall in the seven-day forecast. maybe next week but over all trending dry as we head through the next 7 or eight days. it's mild, another gorgeous afternoon. a few more clouds than yesterday. we had the filtered sunshine. as we head throughout this afternoon we'll see more of those puffy clouds. 9:00 a.m. you can see pretty cloudy over the south end of the bay area. a little bit of a break, some sunshine over the north bay. mostly sunny conditions. as we head throughout the day because of that cloud cover, not as warm as yesterday. what a beautiful weekend overall. today works out like this. if you live by the bay temperatures climb to about 60 degrees, as of noon, 4:00 p.m.

with 61 degrees, comfortable. inland talking about the mid to upper 60s today. so a gorgeous day. things start to change a little as we head to the middle of the week, then we've got the weekend forecast looking like another good one. we'll talk about that coming up. let's check your drive at 5:09. >> i told folks about with the disabled vehicle northbound 280. it was blocking a lane. someone was repairing their tire. over the last few minutes the slowing develops that i'm circling right there. i circled it in my head. as you approach, the traffic break will cause the slowing. a live shot, we'll show you traffic flowing nicely. 101 approaching embarcadero coming up into palo alto. a light volume of traffic on the freeway and the frontage road. the bay bridge out of san francisco t lower deck has construction from treasure island to the observation land side.

>> welcome back on a monday morning. bright and early out there. not exactly bright because it's not come up in san francisco. you know what the good news is, let's the lights sparkle. >> you can be our brightness. >> i'm loving it. as you are. thank you. >> so far this year winter, rain and snow certainly has been low. december and january have been so dry meteorologists say it's unlikely the bay area will reach normal rainfall levels by the end of the season. but they say right now we still have enough water in the reservoirs from last year's record snowfall. they say as long as residents take normal steps to conserve water we all should be fine which is really a good practice, good habits to get into. >> 5:13. speaking of weather, meteorologist christina loren is

here. that's the other side, this beautiful sunshine, but not the rain. >> you got to wash your own car, wash your own plants manually. it's been beautiful. we're going to get more of the same. short sleeves, tank tops later this week. today a touch cooler than yesterday but we're starting out mild in places like oakland and san francisco. 53 degrees along the peninsula. really comfortable conditions. weather headlines tell the story for today. a cloudy start, a few areas of drizzle but right now the radar is bone dry. this afternoon partial clearing, we see a nice day today. temperaturewise, comfortable. we stop the clock at 9:00 a.m. mostly clear conditions in the north bay. we continue that, stop it at noon when we all start to clear out and get the sunshine. the mostly cloudy start, 65 in morgan hill, 66 in milpitas and about 63 degrees in concord. take you across the water, 62 in san francisco, and we stay comfortable for the next three

days, temperatures starting to warm up wednesday into thursday, then saturday, sunday, super bowl sunday, we'll get comfortable weather. let's check your drive at 5:14. >> super bowl sunday. we're looking at a super commute for the south bay, easy drive, these speed sensors at the limit. a nice flow through san jose. at the fairmont i was hosting the school district fund-raiser. thank you. it was aloha night. for 101, along this area, 280 along the area as well. a smooth drive although look at this. sudden slowing eastbound highway 84, that's the dumbarton bridge. we have overnight although it didn't show up on the reports, there is slowing right about the time it clears, i'll check on that as well. we'll jump to the other side of the bay and the livermore, a smooth drive as you push through over to pleasanton and dublin. we'll see if that's an early

sign of the commute kicking in. oakland as we see past the coliseum, a nice drive, northbound with the taillights to the bay bridge toll plaza. we had an earlier closing that has reopened, a nice smooth. back to you. >> mike, thank you. that is beautiful. we can tell you europe's debt crisis weighing heavily on the markets as wall street starts off another week. for more on that let's turn it over to jackie deangelis. good morning. >> good morning to you. the futures are lower this morning as investors await the news from the eu summit in brussels. leaders are expected to announce a deal to restructure greece's debt and create a gigantic bailout fund. the european mark r markets are lower. it's busy for economic data. news on spending, consumer confidence, auto sales and home prices topped off by friday's jobs report which may show that

unemployment ticked up. the dow fell on friday to close at 12,660, the nasdaq adding 11 to close at 2816. that t-bone steak could cost you more. the usda saying beef prices may go up for the second straight year. there was only about 91 million head of cattle as of january 1, down 2%. the lowest since 1952. retail beef prices are forecast to rise 4% to 5% after jumping in 2011. there is less grass and water. and there has been strong demand for beef from overseas. this new bud's for you. anheuser-busch launching a brand called bud light platinum. it has a sweeter taste and higher alcohol content. the launch comes as u.s. beer sales fell 1% and budweiser lost its best selling beer absolute coors light.

back over to you. >> jackie, thank you. >> today marks 23 years since 13-year-old eileen misheloff disappeared as she walked home from school. her parents refuse to give up hope like on this day every year since 1989 t misheloffs will lead a candlelight vigil starting at 7:00 in dublin. from there a walk will proceed to st. raymond catholic church for a prayer vigil. every january 30th more than 100 join on the anniversary of the kidnapping. eileen misheloff would be 36 years old. >> this one is a very popular joint says california's largest skate park has been saved from closure. parents and neighbors coming together to raise money to keep the skate park open in san jose. the 68,000 square foot park was built in 2008, mostly with city

funds. this one attracts about 40,000 visitors each year. last summer's budget crisis left just enough money to keep the park open until september. parents raised enough to keep this open until the end of the year. >> while it's not a day off of work, today is a state holiday honoring an east bay man who stood up against prejudice. fred korematsu refused to report to an internment camp for japanese-americans in the second world war. he was arrested, jailed and black listed for being unamerican. he took his fight to the supreme court and was later exonerated and awarded the national medal of justice. fred korematsu day is every january 30th, which happens to be his birthday. >> coming up, an opportunity you don't see every day. how you can hang out with president obama. >> plus, new evidence shows the stranded cruise ship is starting

>> welcome back everyone on a monday morning. that is highway 880 through oakland. actually looks thick for early 5:22. >> rough seas in italy making it tougher for salvage crews working on the capsized cruise ship. strong currents caused the "costa concordia" to slip an inch. the salvage team has been trying to move 500,000 gallons of fuel. the work has been halted until the weather improves. the ship capsized more than two

weeks ago, killing 17 people. 16 passengers and crew members remain missing. >> president barack obama planning to hang out in a live video chat room this afternoon. the president will answer questions about the state of the state of the union address he delivered on tuesday. google saysly is taking part in a 45-minute live video chat room known as a hangout. that's on the search engine's social networking site google plus. the white house says the president will answer questions submitted by americans via youtube. >> a big week for facebook. scott mcgrew joins us. closer to the ipf. >> one step but plenty after that so the most accurate thing to say might be facebook is getting ready to get ready to start beginning to file for its ipo. people could come as early as this week asking to file for the first offering of public shares, easily the most important ipo since google. actual trades wouldn't come for

months. the other thing happening right now, european leaders meeting for the 17th time about the crisis there. and i'm not being glib, this is the 17th meeting. germany pushing for other countries to make huge cuts in spending and you can see how that's turning over with the regular man on the street. this is a strike in brussels where the actual meeting is taking place, train stations, bus lines, shut down in a nationwide strike. federal prosecutors issued a letter warning that data collected on servers of mega upload could be deleted as soon as thursday. it shut down on piracy accusations and millions of dollars seized by washington. now the company can't pay to keep the servers running. technically no one is found guilty of anything. we don't expect anybody with sense would keep crucial files on mega upload. it's a tale about keeping data in the cloud. if you don't control the cloud you don't control your data.

long. gorgeous conditions. spring-like weather in the heart of winter. it's really mild out there. you probably don't need a jacket. there is a little fog so take caution, we find out if that's impacting your drive. >> so far no word on problems because of fog or visibility. that's good news. folks were easily able to see this disabled vehicle which was in lanes. we had a traffic break resulting, they cleared the car, still a little bit of slowing but then further north on the map, san francisco, right around civic center we have an overnight power outage that will affect signals, larkin and hyde. about 200 people are affected. we're tracking that but pg&e continues to make progress. maybe 8:30. >> 5:29. san jose may be changing course on medical marijuana. after fighting to restrict pot clubs in the city the mayor is doing an about face. damian trujillo is live at the medmar healing center which is

pretty vocal about the restrictions. good morning. >> reporter: medmar put pressure on the city to change course. they said the proposed new rules would cripple their business model. they are only paying 7% tax, pot tax it's called, to the city. the city wanted to raise that to 10%. san jose wanted the dispensaries to grow their own pot on site. club owners argued that would force their electric bills to sky rocket and they worried what it would do to security. the owners gathered 31,000 signatures to repeal the rules. couple that with the potential change to the rules from sacramento, and the mayor has decided to raise the white flag. he'll ask rules committee on wednesday to put the matter on the february 14th city council agenda. there he is expected to ask the council to hold off on those new

regulations. there are more than 100 pot clubs throughout the city of san jose. all of them have to pay the 7% tax. a lot of them are not zoned correctly so that issue has to be addressed first. again, the city is raising hundreds of thousands of dollars each month in pot tax. live in san jose. damian trujillo, "today in the bay." >> thank you. it's 5:31. police are searching for two people they say are responsible for stabbing four men following a weekend wedding. police say it happened in half moon bay in front of the ides hall on main street. the victims were leaving a reception when they were attacked. all suffered serious injury but expected to survive. police are looking for two men and a motive. >> oakland now cleaning up after one of the most chaotic occupy protests in months. the protesters broke into buildings including city hall. bob redell is live on the day after the weekend.

what's the latest? >> reporter: you know, 400 people arrested over the weekend. this is according to opd. they are trying to figure out the repeat offenders, the ones they keep arresting, how to get the legal authority to get them to stay away from the city of oakland. some of whom broke into city hall, behind me, this happened over the weekend. city hall will reopen because the vandalism wasn't significant enough to force a shutdown. the city is trying to figure out how do we prevent this from happening again as far as people breaking into city hall. protesters crow barred their way in, started vandalizing the mayor showed the damage. which included a broken window, damage to a children's art exhibit. protesters stole and burned an tern flag. both sides blame each other. they claim police were overaggressive in the use of

batons, and tear gas. officers say they were responding to all of the objects thrown at them. these clashes started saturday when demonstrators tried to block into a convention center tymca and city hall. police tell us that three officers and at least two protesters were hurt. reporting live in oakland, bob redell, "today in the bay." >> a small group of people who say they support the occupy movement rallied against the violence. >> violence should not be in oakland. if we're going to be occupying a boundary to help people we can't cross those boundaries and have violence and destruction of property and people's rights. dr. king marched for nonviolence. >> a handful of leaders gathered for what they called a peace and

economic justice rally, saying that occupy protesters need to stay focused on the core message of economic equality. they also say they will told nonviolence seminars. >> police at stanford university are asking female students to be on alert after reports of someone lurking in dorm shower areas. the peeping tom is targeting kru corothers hall. in the same bathroom on the first floor showers are open to the men and women. >> it was an issue of somebody putting their hand under the shower stall to take a picture. she screamed and ran away. >> it's not the only campus where safety is an issue. friday you may recall we told you police arrested a 21-year-old. they say he barged into unlocked dorm rooms and groped four

female students. >> we're still in january, right? >> crazy. >> spring-like weather out there right now. meteorologist christina loren has been working hard in the weather center. >> i saw blossoms on a free yesterday. >> in january. >> in january. amazing. the temperatures are so warm. i want to check in and look at the forecast. >> you know, i'm noticing those blossoms outside my door as well. so yeah, the plants are confused. you'll want to water them on your own and wash that car. we don't have any significant rain in the immediate forecast. maybe this morning and another chance tomorrow to get drizzle but i don't think we're going to insure any signature amounts. at least not for the next seven or eight days. staying comfortable, in the 40s and 50s this morning. good morning to you in san jose, 47. 53 in san francisco. as we head throughout the day it will be nice, we're going to see a mostly cloudy start though we

didn't have to deal with this. this morning mostly cloudy, sunny by this afternoon. by about noon the sun will be out warming us up. daypart forecast works like this. 62 degrees inland at noon. it's going to be cooler as per usual at the coast and by the bay. but not too bad ending up in the 60s at noon. we'll round out the day with plenty of mid to upper 60s. i'll get to the temperatures for today in my next forecast and we'll get to the 7-day as well. first, let's get you to work on time with mike inouye. >> well, sort of on schedule. we see slowing for highway 4, as you head through antioch, this westbound direction shows you that heading over to somersville. it's kicking in stronger for longer than we see. further south, 580 westbound out of the altamont pass. we don't see that much slowing so we have an 18-minute drive.

unusual is this stretch heading all the way to vasco. and slowing into pleasanton and the dublin interchange. this may be a sign of heavier monday commute kicking in right now. we'll show you how things are over the water. that's the san mateo bridge. either side looking standard. but again, the early slowing, heavier for antioch and livermore may indicate heavier flow into the bay. back to you. >> mike, appreciate it. the men's u.s. figure skating chance wrapped up with a familiar name. jeremy abbott winning his third national championship in the last four years. nailing a quadruple toe loop to open. word on the street that's extremely difficult. the 26-year-old held onto his lead from his short program on friday, and adam rippon by more

shows that he is definitely gaining momentum. 42% to newt gingrich's 27% right now. and in that poll shows everyone else is exactly that. rick santorum struggling with 16%. ron paul who isn't campaigning in florida has 11%. there are 4% undecided. with rick santorum out of florida taking care of his ailing daughter, heading out west to resume his campaign, it is essentially a two-man contest between gingrich and romney, and they are blasting away at each other. >> i believe the republican party will not nominate a pro aborti abortion, pro gun control, pro tax increase moderate from massachusetts. >> he is looking for some kind of excuse but i'm afraid the real reason he hasn't been successful connecting with the people of florida is because of his message and his failure to connect to the needs of the people in this state.
