thank you, mike. health care workers in several kaiser hospitals will walk out for a one-day strike. >> they are protesting a new contract and now other unions are joining their cause. christie smith is live with more. good morning. >> reporter: good morning. if you are going to be driving by these kaiser locations or coming by for care there is a good chance you're going to see one of these picket lines. the union says this is one of the biggest one-day strikes ever at kaiser permanente hospitals as thousands of workers are set to walk off the job. the union has 4,000 members but what makes this so big is two other unions including the california nurses association have agreed to strike in sympathy. all told, we're talking about maybe more than 20,000 workers involved in these unions. places like oakland, walnut creek, antioch, santa clara, san

francisco, these locations could all be affected with the picket lines, quite a long list. the union is saying the issues come with proposed cuts to health and retirement benefits and patient care. but the hospitals and offices will remain open throughout this. they are using nursing managers as well as hiring replacement nurses to come in during this one-day strike. starts at 7:00 a.m. and continues all the way until 7:00 tomorrow morning. live in oakland, christie smith. back to you guys. >> thank you, christie. it is 4:33 right now. a teenage boy accused of murdering his parents is scheduled to appear in an observe land courtroom today. the 15-year-old is suspected of killing the couple friday. the bodies of robert kamin and susan poff were found in their car. kamin's brother says the couple adopted the boy nearly ten years ago. he noticed a change when the teen started playing violent video games and hanging out at

occupy oakland camps. >> they got him when he was 6. he had been in foster homes. he escaped from his original parents like when he was about as young as 3 years old. >> the district attorney's office says the teen is to be arraigned as an adult. >> a teacher in a south bay elementary school will be in court today answering the charges of sexual assault on a child. craig chandler taught second and third grade in san jose. prosecutors say he sexually assaulted two students on school grounds between august and october of last year. chandler will be arraigned this morning. >> also today, the man accused of killing a vallejo police officer returns to court. henry albert smith jr. will be in court to have a preliminary hearing date set accused of killing an officer in a foot chase in november. smith has pleaded not guilty to several charges including murdering a police officer.

>> a south bay construction site is blocked off after worker was buried alive. the man was working on the foundation of a new home in the community in milpitas when the hillside collapsed. he died before rescuers could free him. the city issued a stop work notice last wednesday to the contractor, three days before the accident, citing unsafe working conditions in the trench. >> they ignored that stop work notice. >> police are investigating possible criminal charges. the victim's name has not been released. >> police may be forced to help bail out the city. at a meeting the pleasanton council will discuss having the officers association pay up to $2.4 million more in pension costs. that's almost $900 more per

month in pension payments. the city is asking for the give back to bridge its budget cap. >> in oakland, city leaders will vote how many jobs they have to cut as the city faces the loss of millions in redevelopment funds. oakland workers showed up to fight to keep their jobs. 2500 employees received layoff notices earlier this month, though less than 100 are expected to lose jobs. >> the city of berkeley is considering moving its money to protest big banks. leaders suggested canceling accounts with wells fargo in favor of smaller community banks, the move in reaction to wells fargo alleged roll in the mortgage crisis. the council will discuss whether to move the accounts at a meeting tonight. >> i know we both noticed a little drizzle on our windshield this morning coming in to work. let's check the forecast. good morning. >> good morning, ladies. we've got a nice day setting up

former sf weekly theater critic michael scott moore seen here was reportedly captured by pirates. he was traveling in central somalia to research a book. the "l.a. times" reports he was on the way to the airport when 15 men in two suvs kidnapped him. they threatened to kill him unless a ransom is paid. a specific amount was not specified. >> salvage crews are on the capsized "costa concordia." crews were on the ship yesterday but were pulled off because of weather. the rough seas also delayed the removal of some 500,000 gallons of fuel from the ship. crews will try again today. as many as 16 people are still missing. the 17 bodies have been found aboard the ship. >> the polls are open in florida as republican primary elections get under way. mitt romney has a solid double digit lead over newt gingrich in the latest nbc news poll. other polls show gingrich may be

gaining ground. romney and his super pac have been bombarding florida with ads most pointing out gingrich's flaws. >> flailing around trying to go after me for one thing or the other. you watch and shake your head. it's been kind of painfully revealing. >> we're going to beat money power with people power. we are going to go all the way to the convention. >> americans still seem to think that romney has a better chance than gingrich in a race bens obama. one poll shows gingrich losing by 14 points. >> more big earnings reports today that is sure to influence trading. for more on that and news before the bell let's turn to jackie deangelis. good morning. >> good morning. the futures are higher this morning after wall street closed monday with minor losses, and well off their lows. tech and telecom stocks, offsetting early concerns about

europe and in particular portugal where bond yields have soared. the markets in asia and europe are higher. we're going to get data on labor costs, manufacturering and consumer confidence. when you mention the earnings we're talking about exxon-mobil, eli lilly and ups reporting some of them have reported already. the dow slipped 6 points yesterday to close at 12,653, the dow is still on pace for its best january since 1997. the nasdaq losing to close at 2811. there is another possible positive sign for the economy, a survey by the fed finds that banks are seeing more small businesses apply for loans and the highest level that we've seen since 2005. economists say that could signal the companies are more confident which could lead to expansion and more hiring. wendy's opens a new front in the burger wars looking to challenge mcdonald's. wendy's posted its best

quarterly sales numbers. the chain is remodeling stores and in fact research showing that customer who is dine inside tend to spend more. wendy's is launching a breakfast menu and coffee. >> everybody is doing breakfast these days. thank you very much. >> i wish we could do breakfast. >> nice. >> meteorologist christina loren is. >> you're enjoying your eggs and coffee, maybe cereal, the good news it's not too cold. you don't have to have the piping hot coffee. you could go with an ice coffee. temperatures are in the 50s. we're starting out mild, full deck of clouds overhead. you'll probably have to use the windshield wipers, a little mist out there. nothing heavy, not enough to get the roads slick. we'll let you know when that becomes a factor. temperatures really mild. we're usually in the 30s and low 40s at this time. so as we head throughout the day today we're looking good. a little chance for rain tomorrow morning. probably along the coast and the peninsula.

but for the most part we're going to see the whole thing clear out by 9:00 a.m. wednesday. that's our next best chance for rain. after that high pressure sets back up in the great basin and really warms us up. so for today, temperatures are looking comfortable. in the mid-60s. 65 in san jose. 66 in milpitas and 64 today in danville, take you across the bay, 61 in san rafael and 64 degrees in santa rosa. so temperatures are going to end up about where they did yesterday. but if you're looking for the warmth, boy, we've got it on your seven-day forecast. it works like this. we'll start warming up by thursday. 60 by the bay. then friday, saturday and sunday, that's when we really get to enjoy some gorgeous spring-like weather for the first weekend of february. 70 degrees in san jose. saturday looking fantastic for outdoor activities. 68 degrees on sunday. that means you can get your grill on super bowl sunday not having to worry about showers. then we stay mild as we kick off next week as well. so dry weather prevails.

"the new york times" reports administrator at clairemont's mckena college admitted to sending false s.a.t. scores to "u.s. news and world report"s that uses the data to rank the colleges and universities. the administrator resigned his

post. clairemont mckenna's president says the scores were inflated 10 to 20 points. the school is ranked as the ninth best liberal arts college in the country. >> lawmakers will take a shot at revising the three strikes law. if they fail to pass it the bill will die for the year. the bill would require defendants third strike for a serious violent felony. revising the law would reduce prison sentences and save money on corrections. opponents say it dilutes the intent of the law. right now third strike leads to 25 years to life in prison. >> another big step towards today toward hosting america's cup yacht race. mayor ed lee will break ground on the new cruise terminal at pier 27. the terminal will be an 88,000 square foot two-story facility. the 34th america's cup will be in 2012 and 2013, expected to

bring millions of people and more than $1 billion to the area. >> google's big buses that pick up workers have parents complaining they are unsafe for children headed to school. the commuter buses are picking up google employees in los gatos and taking them to the mountain view headquarters. parents say the buses stop in bike lanes, then workers fill up the sidewalks so kids on bicycles have to pull out onto the street to avoid this. traffic police say they are working to solve the problem by having google buses pull into a parking lot instead. >> san francisco's board of supervisors is taking issue with music's famous awards. the board will consider a resolution urging that reinstatement of 31 categories eliminated from the grammy awards. the sponsoring supervisor eric marr is a musician and is concerned eliminating the categories will have a negative impact on local artists. the resolution is nonbinding.
