>> good morning everyone. it is moments before 4:31. i'm jon kelley. >> i'm laura garcia-cannon. lots to get to. let's check the forecast with meteorologist christina loren. good monday morning. >> good back to work monday to you. we do have a storm brewing that we will have to drive to work through tomorrow morning but this morning we're looking so comfortable. the last day of mid-60s and a couple of 70s so we're going to get a nice day. tomorrow the rain moves in. we'll tell you when it arrives, timing that storm out first. let's check your drive with mike inouye. >> good morning. i think that impending storm might be the reason why there is little construction this morning. we're looking at northbound 101 from capital up to story, there may be construction crews hanging out for a while longer. no slowing shows up. the entire south bay map shows a nice flow in the northbound direction. sensors are not a problem but it's monday morning. be prepared.

more in the next report. back to you. >> thank you. police on the scene of an overnight shooting in oakland. >> police do have a suspect in custody. christie smith is live at the scene. she joins us with the latest. >> reporter: good morning to you. oakland police are investigating a shooting that left a 40-year-old oakland man in critical condition. the scene is very active. i just spoke with police and they told me that the major crimes unit is coming out to 83rd and international where they have a person of interest in custody. that person inside of a house here for about 30 minutes while police did a search with their guns drawn. they are still piecing this together. what they tell me is about 1:00 this morning they got a call of gun fire on the street. when they arrived they found a man shot in the abdomen laid out in the middle of the sidewalk. what set this off they still don't know, but the victim was taken to eden medical center. he is in surgery right now,

again in critical condition. i'm going to speak with the investigator, try to, when he comes back up this way because they are just arriving. as soon as i have that i'll bring that information to you. live in oakland, christie smith. back to you guys in san jose. >> we'll check back with you. san jose police are investigating an overnight homicide on blackford avenue near saratoga. around 10:15 they found a 21-year-old man in the parking lot of an apartment complex with a gunshot wound. this is san jose's third homicide this year. at this point police have no information on a suspect or motive. >> the latest homicide shines a light on more uncertainty in the san jose police department. a new report released concludes the city could get by with far fewer officers. ibm was brought in to analyze the city's public safety department. the company said that based on san jose's crime rate the city could cut up to 400 more officers at a savings of $60

million. >> i just don't know how any one could think we could do this with 300 or 400 less police. we're down to below 1100 now, the lowest in two decades. >> this report identifies some ways we can be more effective in the way we deploy our officers, we can use this to help us further avoid further cuts in the department. >> san jose mayor chuck reed plans to ask the city manager and auditor to come up with their own recommendation. >> 4:34 now. a massive fire on mayor island smoldering after destroying a warehouse. the fire started around 10:00 a.m. yesterday and took more than 60 firefighters to put this out. a combination of wind and the many open windows and doors helped the flames spread quickly. fortunately, no one was injured. the cause of the fire is unknown. firefighters say the building was a haven for the homeless. >> two bay area women abducted

at gunpoint in egypt are speaking out about their kidnappers and how they describe them is unexpected. patty and norma were visiting historic sites with a christian tour group when several egyptian tribesmen armed with ak-47s stopped the bus. they were held captive for six hours but they say they were not afraid. >> they treated us. >> she says nothing like this has ever happened before. the women met with the minister of tourism in egypt this weekend trying to encourage him to increase security so others will not be afraid to visit. >> in case you happened to miss it super bowl xlvi is in the history books. for the second time in four years the new york giants pulling off a big time fourth quarter victory against the new england patriots. the game went down to the wire.

a touchdown in the fourth quarter put the giants up with less than a minute left to play. the patriots tried to answer with this hail mary at the end. nearly pulled it off. tom brady does not complete the pass. the giants complete the victory to win it by four for their fourth super bowl title in franchise history. >> a lot of disappointment for a group of fans in san mateo. patriots quarterback and san mateo native tom brady had strong support from friends back home. >> tom brady, the tommy i remember from 1995. >> everything he stands for, work ethic, overachieving, being a good human being, humble. what more do you want from a mentor. >> for the record, brady graduated from serra high school. even with the heartbreak the coach says brady is still their hometown hero. brady will be speaking at his

alma mater later this month. if you want tickets, try next year. the event is sold out. >> not surprising. local boy. 4:36 now. i want to check the forecast with meteorologist christina loren. see what we are in store for. >> we've got a nice day shaping up, guys. good morning to you. temperaturewise right now we're in the 30s and 40s, so it's cold out there. but the sun, oh, it's going to come out about 7:22 and warm us up nicely. good morning. hopefully you got outside this weekend. it was gorgeous out there. we get one more day of comfortable conditions and then things change. waiting for the rain, we've got it on the way. we'll talk about that. right now, though, grab a jacket. san mateo at 50 degrees and san francisco this morning at 53 degrees. as we head throughout noon, temperatures climbing into the mid to upper 50s. then we'll round out the day with plenty, plenty of mid-60s. even a couple of 70s. we'll talk about that and track that storm first let's see what your drive is shaping up like on a back-to-work monday with mike

inouye. >> we'll get back to highway 4 for a check. 59 is registering at the center. not a problem. 60s all the way through pittsburg and bay point in the westbound commute direction. eastbound we have a minor accident no. injuries and the cars should be off to the right shoulder but that's around the interchange between 680 off of the benicia bridge and 242. this is as you head through concord. again no slowing at the scene. we'll track that. the construction we often see through the san ramon valley is not there. not there in many spots. 14-minute drive out of the altamont pass to the dublin interchange, 680 and 580. we'll get a live look at oakland. 880 fast coliseum. look how light that traffic is. it's really light even for this time on a monday. we'll track the traffic. this is probably going to be a light load until folks can wake up after that super bowl and all of the commercials they have been watching. >> thanks. >> we'll talk about big time motivation. the new york giants, they owe

the super bowl victory in part to a teenager. >> you might remember this video of holland reynolds crawling across the finish line during a race more than a year ago. the cross country runner from san francisco's university high school had collapsed from dehydration and hypothermia a few feet from the finish line but you'll see managed to muster the strength to crawl to the finish. she says to honor her coach jim tracy who had been diagnosed with lou gerhig's disease. the giants coach used that to inspire his players. >> when the story went national, jim and i thought that was strange. but now we have other athletes looking towards me. >> the fact she had her goal and it's so deep inside her that it occurred to her right away what to do. i think this giants team, i think this professional team, they needed to think about what

>> welcome back everyone. a good monday morning to you. taking a live look outside from san francisco this morning. make out the bay bridge in the distance. 4:43 right now. >> police in washington say the husband of a missing utah woman deliberately blew up his home in washington, killing himself and two children. a makeshift memorial for the two boys is growing outside the elementary school. authorities say josh powell's sons had arrived for a visit when the home exploded in flames. the social worker dropping the boys off said she smelled gas when powell answered the door.

josh powell was under investigation but never charged in the disappearance of his wife susan more than three years ago. last week a judge again denied his request to regain custody of his sons. >> a second cruise ship returns to port in florida after an outbreak of norovirus. it pulled in on sunday. on saturday the crown princess also returned to port due to an outbreak. officials say in all nearly 500 people fell ill with the stomach bug while cruising the caribbean. executives say both ships have been disinfected. >> turning to politics, the focus of the gop presidential race is in three states, colorado, minnesota and missouri, all holding contests tomorrow. mitt romney mitt romney a big win. he lashed out at president obama's policies but the

president defended himself in a pre-super bowl interview. >> i deserve a second term but we're not done. we made progress and the key right now is make sure that we don't start turning in a new direction that could throw that progress off. >> at this point romney looking like the front-runner going into tomorrow's contest but his rivals insist the race is not over yet. >> a check of the markets for this monday morning we turn to courtney reagan live at cnbc headquarters with a preview. good morning. >> good morning to you. futures right now were lower as markets take a bit of a breather from last week's gains fueled by friday's better than expected jobs report. asia was up, europe is in the red as investors continue to wait for a deal to restructure greece's debtd. sounds like a broken record but we're waiting. there is no economic data but we'll get reports this week on consumer credit. the trade deficit and consumer sentiment. the dow closed up 156 on friday to 12,862.

the nasdaq 45 points to start the trading day today at 2905. today is the deadline for states to sign on to the multi-billion-dollar land mark settlement with banks over mortgage abuses. "the new york times" reports the obama administration, california's returned to negotiations after a four-month absence. that could boost the amount of mortgage relief available for homeowners from 19 to $25 billion. amazon may go from click and mortar to brick and mortar. it will open testing to see if the strategy could be profitable. the stores would be small and stock higher end items like the kindle. we'll have to see what actually takes place. back to you both. >> thank you very much, courtney. >> 4:46. time to check that monday

forecast with meteorologist christina loren. it sounds like maybe precipitation if i can say that coming out. >> we have precipitation on the way. >> rain. >> rain on the way. something we haven't seen in about 13 days. yeah, we've got the return of the rain which is good news. you know, usually we talk about rain, it's not a great thing but a lot of people have been missing it so looks like we could pick up a quarter inch, maybe a half inch. and the rain moves in as we wake up taupe morning. so, for this morning mild and dry out there. 50 this morning in san mateo. and 49 degrees in napa. hope you had a great weekend. we'll hold on to that one more day. a cold start with increasing clouds. the system does mirror the california coastline. clouds increase, the breeze will pick up. tie down loose objects in your yard. the big changes arrive as we head through tomorrow. we're going to hold on to unseasonably warm temperatures for one more day and then

tomorrow we drop back in the 50s. 67 for today in los gatos. 65 in san francisco. and 55 in oakland. 66 degrees right here in san jose. breeze picks up for the second half of the day. showers early wednesday, then thursday, friday, saturday, dry conditions start to pick up in temperature a touch, and then sunday another area of low pressure moves back in. so, as you know, we've been talking about the deficit that we're running in terms of our average rainfall totals. we'll make up some of that moisture as we head through this week and at the end of the weekend. we'll talk more about that coming up what that means for the sierra nevada. i'm going to send it back to you. >> thank you very much. >> bay area high school student and his teacher taking a trip of a lifetime. >> sounds cool. on the way to meet the president and take part in the second annual white house science fair. eric bacon, a senior at san jose's bellamman prep.

so get ready, it's going to be baseball and hockey season you can focus on now. the time is 4:52. >> alameda has cooked up a plan to stop the turf war between food trucks. the food truck ordinance goes into effect. operators must pay a business license, pay taxes and comply with health and safety restrictions. the ordinance also designates where the trucks can park. leaders say the regulations will level the playing field between food trucks and restaurants. >> a los angeles elementary school has canceled classes for two days after two teachers were arrested for allegedly committing lewd acts on children. mark burns was charged with lewdness against 23 students, some as young as 6 years old. four days later another teacher was arrested on suspicion of touching two girls inappropriately. the school district says the superintendent will meet with parents tonight. classes at the school will be

canceled tomorrow and wednesday. >> the san francisco schools that closed its doors after a stomach flu outbreak is street reopen. we'll give you a look at st. ignatious. it closed three days after more than 300 students got sick with a stomach bug. the administration says the school has been thoroughly disinfected. norovirus is suspected of causing the outbreak. norovirus is an illness that causes nausea, vomiting, diarrhea and stomach cramps. officials say the best thing you can do is wash your hands and wear gloves and protective clothing while cleaning surfaces that a lot of people touch f. you contract norovirus, you have been told to stay home until your symptoms disappeared for at least 48 hours. >> not a lot of traffic to report but it's 4:54. how we looking? >> all right.

we have a smooth flow of traffic on the roadways looking to the maze, again like laura said, not a lot going on. not a lot of construction because likely they are worried about the impending storm coming in. and christina is tracking that. we did show you that highway 24 heading to the caldecott, we see that clearing up. we'll see blips off and on. no problems across the bay bridge. we're looking here to the san mateo area. a smooth flow of traffic. saw blips for 101, those cleared up. a look at the san mateo bridge. a smooth drive across the bay, looking at the westbound side with the taillights, there is the golden gate bridge. not a problem as you come south. you see the flashing lights, that's a crew that should be heading to the marin side moving the cones. nothing unusual here and a very clear view. maybe that's unusual, i guess a clear view. back to you guys. >> you can count the cars. >> with all of the sunshine, the
