look at the map, looking at the 280 northbound by sand hill road. around that area between sand hill and edge wood reports after car that hydroplaned. water across the roads. the chopper headed out to the area, they don't see much but they aren't on scene yet. hopefully in a few minutes with something to show. >> we'll check back. thank you. 6:01. san jose police are investigating an overnight homicide. it happened on blackford avenue near saratoga. that is where a man was found show. bob redell joins us live with the latest. good morning, bob. >> reporter: good morning, laura. shot and killed making him the third person to be murdered in the city of san jose this year. a lieutenant wants to reassure people who live around here this does not appear to be a random shooting. in other words, not releasing details it does seem that these people knew each other and for whatever reason had some sort of

disagreement which ended up with one of them dead. happened around 10:15 in an apartment complex on blackford avenue not far from the intersection with saratoga. police are trying to identify the suspect or suspects, there might have been more than one person responsible. the man who was shot, at least once, was 21 yearses old, found in the the parking lot located in the back of the apartment complex. >> we got reports of a person down. we responded and found a person laying on the ground suffering from life threatening injuries. the person was taken to the hospital and died there shortly there after. >> reporter: police know who this person is, who the victim is but they aren't releasing his name until they notify his family. he did not live in this apartment complex. they say they will release more information about what happened here later today. reporting live in san jose, bob redell, "today in the bay." >> thank you, bob. more violence to report, another man is dead and a person of interest in custody.

after an overnight shooting in oakland. christie smith live at the scene right now. she has all of the latest developments. good morning. >> reporter: good morning to you, jon. oakland mess are wrapping up this investigation. they took down the crime scene tape and moved a police cruiser. they seem to be focusing a little down the street there. after a 40-year-old man was shot, taken to eden medical center, telling us he has now died. when they arrived they found him down on the sidewalk on 83rd avenue, shot in the stomach area. this was about 1:30 this morning. they started immediately looking for the shooter with their guns out. and they focused on a house with a man inside after about 30 minutes a man came out with his hands up talking on a cell phone and smoking a cigarette. police saying that person only a person of interest, not a suspect yet because they are trying to sort out exactly what may have set this off.

it's been a busy and hectic time. they have had several shootings in oakland in the past 24 hours. reporting live, back to you. >> thank you, christie. 6:03 now. walnut creek bar owners meet today on how to deal with late night drunken violence. they are working to make the streets safer on the weekend. they want regulation giving them more authority over how businesses deal with rowdy and unruly customers. last month police arrested nine people and three police officers were injured during a series of separate fights. >> students at a san francisco school are finally heading back to class after a norovirus outbreak shut down the campus. saint ig nash yous closed down on wednesday when 20% came down with norovirus. classes will resume in about 90 minutes. the school was closed wednesday to allow crews to disinfect the campus. the administrators also wanting

to give about 350 students and staff members a chance to get well before they finally went back to school. >> occupy oakland protesters plan to hit city streets, they are holding another day of action or rally set for 9:00 this morning inside wily court house. then at noon at frank ogawa plaza and then will march to the courthouse where some arrested will be in court. oakland neighbors and merchants plan to stage their own counter protest today. they say they are angry over the loss of business over the violent protests. >> supporters of a millionaire's tax will be out working to get your support for their campaign. gathering signatures and posting banners at several locations. you may see them in san francisco, at interstate 80 and vermont street and 29th avenue in oakland. the proposal for the november ballot asking californians who

earn $1 million or more to pay an extra 3% in income tax and those that earn $2 million or more an extra 5%. >> political perk that's -- that would pass by a few. free game tickets. >> tony found few san francisco leaders are apologizing. >> reporter: a total of 76 free tickets for every game. >> the citizens of san francisco looking at this will say this is not proper. >> reporter: privileges like parking passes and playoff tickets t mayor controls 12 tickets to his luxury box t city's 11 supervisors all get two per game. a fringe benefit that seven accepted this past season. >> the championship game the other day, i gave to my mother-in-law. >> reporter: when they attend or give the tickets to family and friends they must serve a public

got at least two members of the board of supervisors saying they would reconsider pulling the club on the program. a lot of controversy, phone calls in after oufr coverage last night over what's happening here. free tickets, a lot of money and a lot of the members of rec and park, $4,000 in a year worth of tickets. one $5,000. and they weren't talking about it. where do you think it's headed? >> one of the big arguments is that bottom line we've been doing it for a long time. and simply doing it for a long time as we heard from them is not making something right. it's something many in the area need to take a look at. especially in tough financial times. the free ticket program we brought to people's attention. >> there we go, one of the many things. welcome to the team. good to have you. and of course if you have something you want, the nbc bay

about 7:00 to 8:00 tonight. the storm is going to sidle down the coastline. not a lot of sierra snow. i'll exlane that coming up, 55 degrees, by the coast and the bay as you break for lunch, 65 degrees at 4:00 inland with 70s and isolated spots across the bay. gilroy, morgan hill, 70 degrees. let's talk to mike about the drive. >> talking about rain in the future, i'm talking about slippery roads in the present. 280 at sand hill road northbound. the chopper headed out over two 80. we're seeing crews on the side of the road. the side of 280 and this is not where the flooding was reported. they may have found a disabled vehicle. the initial report did talk about one car hydroplaning so watch it north bound.

>> it's a story that made headlines three years ago. a utah mother disappears from her home and her husband is a person of interest but never charged. this morning the powell family in the news again and again for all of the wrong reasons. "today in the bay's" marla tellez is live with this tragic story. >> jon, good morning. susan powell was never found and her husband josh powell and the couple's two boys are dead this morning after officials say powell set his home on fire right after a social worker dropped off the boys for a visit. this happened in washington where a makeshift memorial is growing this morning for charlie and braden powell. people coming together for a candlelight vigil at the boys' school. a judge denied josh powell's request to regain custody of his sons. their mother went missing in 2009. a lawyer for powell tells nbc

news he received a three-word e-mail from his client minutes before powell allegedly set the home on fire, it said "i'm sorry, good-bye." overseas we're learning more about the major earthquake that sent school children running for safety in the central philippines. the 6.9 quake killed at least 13 people, dozens more are feared trapped under rubble. just in, officials say the quake triggered a landslide and now rescuers are digging through collapsed buildings and debris hoping to find survivors. so far more than 40 aftershocks have been recorded. >> now to london where long live the queen, today marks queen elizabeth's 60-year milestone. buckingham palace released two new photos of the royal legacy. she is the second british monarch to reach this milestone. queen elizabeth is 85, which means she was crowned when she

was just 25. you do the math, that was in 1952. oh to be a queen. >> let them eat cake. let's check the forecast now with meteorologist christina loren. finally some rain coming our way. we're clear for today? >> for the most part today. i think later on this evening starting at with 7:00 or 8:00, if you are someone who gets off of work late you want to bring that umbrella with you. you'll see showers later on. but this morning forget about it. many of you are joining us now. you are the early risers and you get done with work at about 5:00 clock. temperatures are cold enough for a jacket but leave the umbrella home because the showers arrive later on tonight. we're expecting a lot of rain. most will come down over the course of tonight while you're sleeping. look at this system, a strong enough area of low pressure to break down that big ridge of high pressure that kept us high and dry.

up to 61 degrees by wednesday with sunshine returning for the second half of the day. we head into this weekend we get another round ever rain come sunday. a better chance for sierra snow with this system. we'll talk about that. first you get out the front door now, mike's here to help. >> good morning. look to the peninsula for folks southbound 101, oyster point is where the accident is. the chopper shot we showed, they had made their way over to 101. if we still have the shot available, there we go. this car, this white sedan went off of the road, reportedly into a tree. we don't see major activity as far as the ambulance goes. i haven't heard about major injuries. this is off the road but the flashing lights will be a little distraction south along the peninsula. back to the maps, you see how quiet the scene was and the traffic flow past there was. the headlights flashing, not a big deal. nice drive for 101 and 280 both along the peninsula. we'll look over further south,

and northbound on 280 as you come up to sand hill road, still have to get more detail tons flooding reported about 40 minutes ago at sand hill road. reports of water across the roadway and one reporting hydroplaning. we haven't had other issues over the last half hour. out of the south bay no problems and through the south bay, a smooth flow. we'll wend this map and show you the sensors looking nice. but the tropical is building for 101 approaching 680. back to you. >> thank you, mike. 6:19. 9ers fans have a choice. think about what could have been or be happy your team lost to the eventual champs. the new york giants will be honored guests at a ticker tape tomorrow. they celebrated the giants win over the patriots. the parade will move down broadway into lower manhattan. it's the giants' fourth super bowl win, the second over new england. >> just like that win back in

>> welcome back. the time is 6:24. alameda cooking up a plan to end the turf war between food trucks and restaurants. the ordinance goes into effect today. operators of trucks must now obtain a local business license, pay taxes and comply with health and safety regulations. the ordinance it's restricts where the trucks can park. city leaders say the new rules should level the playing field between food trucks and brick and mortar restaurants. >> 6:24 now.

san francisco voters could get a chance to help reserve a land mark. the protect coy tower committee plans to deliver signatures to the department of elections for a june referendum. it would require the city to use revenue generated by coy tower to maintain. the group wants the money used to improve the site's park and restore its murals. >> last night scott mcgrew says tivo was watching. >> everybody gets all creeped out. tivo doesn't get much of a rise out of consumers. it took a look at who watched what during the super bowl, and says this ad for doritos where the dog buries the family cat was the moch watched ad sunday. the ads accounted for three of the top five ads. twitter set a record as well. 10,000 tweets per second toward the end of the game. crushing the last record set

first let's get you out the door with mike inouye. >> we're following this accident on the peninsula. our chopper took a look, it was southbound 101 at oyster point. traffic flow past the scene hasn't been a problem though the lights are on the car that crashed into a tree. no slowing there. our chopper is on the other side of the bay heading to oakland investigating what we reported a second ago, a building explosion, 1250 international. there may be slowing, we may have international boulevard closed. i'll follow this with a report as well and we've got more coming up. >> thank you very much, mike. 6:31. san jose police are searching for the person who shot and killed a young man overnight. it happened at an apartment complex on blackford avenue near saratoga. bob redell joins us live with an update. good morning. >> reporter: good morning to you, laura. police are still trying to figure out who did this, who shot a 21-year-old man leaving him to die in the parking lot in back of that apartment complex

on blackford avenue in san jose. when police arrived a little after 10:00 last night they found the man lying on the ground with at least one gunshot wound. he was rushed to valley med where doctors tried to save his life. he died shortly after arrival. police want to reassure people that this crime does not appear to be random. >> it's probably one of those deals where the residents aren't going to have to worry. it's something that was related to this person but we don't know for sure. >> reporter: police know who the victim is but aren't releasing his name. they do tell us he did not live at this complex. no word on why he was here. and they also say they will try to release more information later today. this unfortunately is the third homicide in the city of san jose for 2012. reporting live, bob redell,

"today in the bay." >> breaking news that we're following out of the east bay. reports of an officer down in oakland. we're understanding that police are at the intersection of 14th and jackson investigating. we have a crew headed to the scene. we'll bring you updates as soon as more information comes in. >> 6:33. more layoffs could be on the horse for san jose's police department. a study concluding based on crime rate the city could eliminate another 400 officers at a savings of $60 million. >> in right mind could think we could do this with 3 or 400 less police. we're down to below 1100 now which is the lows in over two decades. >> this report identifies some ways we can be more eeffective in the way we deploy officers, we can use this to help us further -- avoid further cuts in the department. >> the mayor is planning on asking the planner and auditor

to come up with their own recommendations. ibm did this study free of charge. >> we should learn more about recent hate crimes this morning. police will talk about this sketch and the suspect in an attack last november. they say a man of east indian decent was hit in the whed a liquor bottle while he sat in his car. the suspect is leaved to be latino. >> school said to be back in session after a prep school this morning, st. ignatious was closed wednesday when 350 students and staff got sick. a live look at school m morning where classes will resume in about an hour. norovirus suspected of causing this. crews disinfected the building and the health department has given it the all clear. marin county dealing with people sickened with norovirus. the journal says since january 20 there have been four outbreaks at schools and children centers and six more at long term care facilities.

showers and windy conditions at times. your daypart forecast, by noon up to 55 degrees at the coast and by way, breaking at 63 degrees inland. at 4:00 p.m., mostly cloudy conditions across the greater bay area. about 65 degrees inland. i'll track those showers. first, let's check your drive with mike inouye. >> we'll look at the approach to the bay bridge. we see slowing for the east shore freeway but nothing major. the metering lits, well, they have been turned on so that will add to the backup off the berkeley curve. we do have this issue which we talked about a couple minutes ago. going on in oakland. 13th avenue at international boulevard. that's the nearest intersection of express liquor from what i understand, no word on whether or not international boulevard is closed. i would avoid that. it's off of interstate 880 and

what a nail biter to the last second. three things people are talking about in indianapolis. first of all, the finish of this game. it was really one that the patriots thought they might be able to pull out but in the end it didn't work out that way. eli manning mvp yet again. bringing a third championship ring to his family. the other thing folks are talking about was the halftime show. madonna promised there would be no wardrobe malfunctions and that did not happen during the game. however, this was a side kick did create one not so nice hand gesture, turns out nbc was not able to catch that. but overall good reviews. finally, the city of indianapolis getting rave reviews for how they handled the crowds for this super bowl game. it was the first time they had ever done. this brand new stadium, they had a festival behind it and we are told we'll get the final numbers

tow trucks and the car into the tree, no major injuries. no lanes blocked but the distraction is enough to slow things a bit as you approach 380. south we have a smooth drive for 101. northbound 280 at sand hill road we had reports of flooding and hydroplaning. of course northbound route for 101, 87, and coming up past the airport we have slowing for the south bay as well. back to you. >> thank you. breaking news out of oakland, fire crews on the scene of a big time building explosion. police say it happened at express liquor near the intersection of international boulevard and 13th. the nbc bay area chopper right now is over the scene. we're not exactly sure what happened to cause the explosion. we'll update you on this as soon as we have new information coming into our newsroom. >> we also have an update on breaking news we told you about, reports of an officer down in oakland. we sent a crew to the intersection of 14th and jackson. they found nothing.

police not confirming or denying reports. and again we'll get you an update if anything changes on this story. >> san jose is investigating its third homicide of the year, it happened overnight on blackford avenue near saratoga. that is where a man was found shot. bob joins us live with the latest. >> reporter: good morning. shot and killed making him unfortunately the third person to be murdered in the city of san jose this year. a lieutenant who we spoke with does want ta reassure people that this does not appear to be a random shooting. no details but they believe that these people knew each other and had some sort of disagreement which ended up with one of them dead. it happened around 10:15 in an apartment on blackford avenue not far from the intersection of saratoga avenue. police are trying to identify the suspect or suspects. there might have been more than one person responsible for the shooting. the man who was shot was 21

years old, found in the parking lot located in the back of that complex. >> we got reports of a person down, we responded and found a person laying on the ground, suffering from life threatening injuries. the person was taken to the hospital and died there shortly thereafter. >> reporter: police are not releasing much information about the victim. they tell us he did not live here. they know who he is but not releasing his identity until his family has been notified. police say they will be releasing more information later today. reporting live in san jose, bob redell, "today in the bay." >> thank you, bob. it's 6:50. a man is dead, another in custody after a shooting in oakland overnight. it happened on international boulevard around 1:30 this morning. police responded to calls of gun fire in the area. and they found a 40-year-old man with a gunshot wound lying on the sidewalk. he was taken to the hospital but died a few hours later. police say they do have a person of interest in custody. they have not said if he is a

suspect but they say they are not looking for any one else. >> we are following breaking news this morning in syria where the u.s. made a move. marla tellez is live right now. she has the latest. >> good morning. the last few minutes we learned that the obama administration has decided to close the u.s. embassy in damascus, syria. the associated press is reporting all american personnel have in fact already left the country. by far this is the most dramatic move by the u.s. after 11 months of a violent crackdown by president assad's regime. today 30 people have been killed in the city of homs. the un says the crackdown killed more than 5400 people since march so. once again, the u.s. embassy in syria has been closed and top officials here have issued a travel alert, warning americans against travel to syria and those who are in the country, they are advised to leave
