california so it's atop a high hill. we're seeing shaking across the camera as well. the headlights, steady into the city but slicker conditions in spots, we'll watch that and of course these dwufty winds. higher profile vehicles and trucks. the wind could mean a loss of traction. we'll watch as the commute builds. things are moving even through the north bay. we have wet roads out there and more to come, right? >> yeah. you know, we're not out of the woods. we have showers rolling through the east bay, heavy showers right now. right to the radar, you can see livermore getting hit pretty hard, san francisco a good watch of rain. rolled over the city by the bay. we'll pinpoint these, let you know when they are going to clear and when we might get another round all in the forecast. >> thank you, christine. police are still looking for clues 18 deadly weekend shooting.

officers found 20-year-old ramon suffering from a gunshot wound on sunday night. he was behind an apartment complex near saratoga and moore park avenue. police are trying to find a fortive and suspect. it's san jose's third homicide of the year. >> 5:02 now. no charges will be filed against a fan accused of hitting a teen in the head during a sharks game. maggie says she was harassed at the december 28th game and nearly knocked unconscious by a fan. however, the "mercury news" reporting that police did not find evidence that the woman hit her on purpose. the woman says it was unintentional and she was celebrating a goal. her mother says she are still dealing with $1300 in medical bills. >> it's decision day, much anticipated ruling of proposition 8 will be released by the ninth circuit court.

a panel of three justices will announce their opinion on whether the man on gay rights violates the constitution. coming up at 5:30 we'll take you live to san francisco for details on what both sides plan to do if the decision does not go their way. >> meteorologist christina loren has been forecasting the rain for some time now. it's here, coming down in a lot of areas. let's check in and how it looks, live to bob redell. bob, what's happening. >> good morning. most are welcoming this rain especially in the eair ras or in the bay area where that ground is packed hard. we're on oak wood drive and wild currant way. over two weeks ago a good chunk of the roadway slipped down the

hillside. this road is closed and it's our pung it will be closed indefinitely. fortunately, the rain is not so hard that it's going to have further impact since engineers shored up the hillside. as we heeded up from the south bay north on 880, in the south bay everything seemed ok. once you get into the hayward, that area that's when the rain started coming down as far as heby drizzle. things that-meteorologist christina loren and mike inouye, you do want to be careful. there has been wind gusts, we understand there are supposed to be in the foothills, not seeing them as much. i did see them this morning further east in hosni mubarak. so watch for the wind and the slick reports. reporting live in the oakland hills. bob redell.

>> reporter: this could go a number of ways. the court is expected to consider whether the ban is constitutional. whatever it decides most legal observers agree this isn't the end of it. it will likely find who the supreme court. toss the panel will issue it's ruling. a decision that is 18 mots in the making. in 2008 voters passed proposition 8. then in 2010, judgen von walker struck down proposition 8, now, two same-sex couples used including one from the east bay. in addition the court will rule on attempts to set aside judge walker's ruling because he did not disclose they was in a same

of course the major roadways across the bay area. 5:40. >> today is caucus day. brian mooar is live in washington. he has the latest in the race to become president. good morning. >> reporter: good morning. all eyes today on rick santorum, if this isn't judgment day for him it is certainly close. he's hoping to change the dynamics of this race today and emerged this evening as the conservative choice more so than it new nooxt rick santorum is hoping to pull off a win in minnesota but also in the primary in missouri which is a beauty contest, there are no delegates at stake. but more importantly mitt romney did not make the ballot so this is rick santorum's chance to make the argument we can compete toe to toe with romney, that he is the conservative anti-romney.

if conservatives are going to rally it should be him. gingrich and ron paul hope to collect as many delegates as they can to keep the nominating race running. mitt romney, he looks like he is in good shape in colorado for the caucuses there. it looks like the next couple of weeks as they slow down will be mitt romney's as front-runner. jon. >> extremely busy day on the gop side. what do you see the polls telling us? >> reporter: the polls are telling us that rick santorum is in very good shape in minnesota, in good shape in missouri. but does that help rick santorum and his message, maybe not so much as it hurts newt gingrich and helps mitt romney. >> brian, thank you for the update. >> a former california governor is backing mitt romney. he points to rom niece' business
