gate bridge. you see how slick the roadways are out there. be careful on this tuesday morning, february 7th. this is "today in the bay." >> and good morning to you. thanks so much for joining us. 6:00 now. i'm laura garcia-cannon. >> good morning. i'm jon kelley. we check in with meteorologist christina loren. lots of rain out there. what's happening? >> well, it's slowing down commuters this morning. we'll get to mike's report in a moment. let's show you what the rain is coming down the heaviest at this point. take it right to our live real time doppler radar. you can see san jose getting a break now but we're going to fly you into the heaviest downpours, san ramon, hayward, even oakland getting hit. south san francisco, yeah, everywhere across the board. this morning our bob redell is live in fremont. we have gusty winds, heavy rain at times. you see this impacting commuters

behind you? >> not right here in fremont, but to echo what you were saying, good morning, christina loren, what your doppler was showing with regard to hayward, north from our location, say you get to 84 and north that's where you see the rain. we're south in fremont. our brake lights heading southbound, headlights northbound. you can see if you can from here the roads are dry. we've got rain, not much in the way of anything that would impede your drive in to work. it is windy, something you want to keep in mind especially if you have a high-profile vehicle. what we're going to do momentarily is back up and continue our trek southbound on 880, trying to get to san jose, mckeon, claire minute. where winds that knocked down a power line. >> that's right. conditions are such that the

gusts could cause debris in the roadway and ataekting your drive. we'll get you located. the rain as well in spots may cause folks to slow down. early slowing north of 680. clairemont at mckee road. that's a power outage. they are affecting the area. clairemont at mckee. mckee from what i understand is open, that's good news because that's a major roadway taking you past white road toward 680, that could be an issue. prepare for a small reroute. when he gets here we'll show it to you. >> we'll check back. >> 6:02. today is a big day for the same-sex marriage debate. a year and a half ago a federal judge struck down prop eight. a panel today will give its opinion. christie smith is live in san

francisco with the latest on this story. good morning. >> reporter: good morning, jon. you said this decision is 18 months in the making so a lot of interest on both sides. that's when a judge struck down proposition eight. opponents appealed and now it's before a three-panel judge with the ninth circuit court of appeal. which will decide whether the state es gay marriage is kofl or not. whatever the circuit decides the appeals are expected to continue all the way up to the united states supreme court. which could mean that marriages remain on told because of the appeal. the two same-sex couples, one from the east bay, and the panels go to including overturning on the grounds that

voters disapproval denied rights granted by the state supreme court six months earlier. normally the court doesn't amount when it's going to make a decision. the decision expected around 10:00 this morning. christie smith. back to you. >> appreciate the update. new this morning a fire caused a scare at a taco bell store. fewer screws say when they got to the scene there was heby knock from the back of the building. they were able to knock the fire down but there was extensive damage to the kitchen area. we're happy to report no injuries. >> 6:04. city leaders could block the port of oakland. occupy protesters stormed the port and shut down operations.

some longshore workers were told not to report to work and hundreds lost their day's pay. today coke land council members will discuss a proposal to propose any future port shutdown. it would use any legal means possible to cent one. >> searching for a suspect at a hurd. a man stabbed another in a soma facility. the 44-year-old victim died hater on the hospital. his attacker left the scene. >> police are looking for the suspect in a weekend murder. officers found 20-year-old ramon suffering from a gun shot yoont. he was behind. he died at a nearby hospital. police are trying to find a motive and a suspect. this is han jose's third homicide of the year. any one with information should contact police.

>> two more assaults on the stanford campus have students on edge this morning. the first happened around 1:45 a.m. when a man tackled a woman near kennedy grove. the passerby managed to scare that attacker and then a man enerred an unlacked room near a housing facility. he jumped into bed and tried to take her close off. she was able to get away. there have been similar attacks on women. >> a bar is fighting a plan to restrict late night drinking asking the grill to stop serving alcohol at 11:30 p.m. an hour earlier than usual. the owners will argue that cutting alcohol service will kill business. there were several incidents of drunken violence in walnut creek. the lounge made more than 50

calls for police service in 2011. >> a teacher facing charges of abusing young students. police say alexi is accused of physically abusing two 4-year-old boys over the past months. one mother, this is preschool, says the allegations are terrifying. experts say parents with autistic kids face a difficult situation. >> he would come home with bruises on his arm right here and we never imagined that was her fingers there. we thought she -- that he just bumped. >> this is what we fear that someone will hurt our children because they dan not talk they cannot tell us. the teacher hurt me today. >> right now the teacher is out

to the north over san jose alodge 101 through here. san mateo up to san franciscosh that's when it starts to get on the dangerous side. we take you up to the north by clearing out in santa rosa and petalu petaluma. danville getting hit, same for livermore and brentwood. those showers will clean out. i'm going to say clearing by about 9:00 a.m. that is such an advantage of this rain coming through the bay area. temperatures aren't going to be that warm by noon. about 57 as you break for lunch inland. 4:00 p.m., still the 60s in san jose and livermore for the second half of your day. you'll be able to open up the windows and in my current

weather conditions report when our next ground moves in. first let's get you through with mike inouye. >> a lot of little incidents typical when we have rain and wind. scattering around the bay area happening and clearing. a disabled vehicle was reported then cleared from 280 south of the 101 interchange. look, 101 out of san francisco and into daly city, some early slowing cropping up. speeds around 50, that's early for that slowdown. we'll watch and see if that sticks around. on the bay ridge. the lower deck, a salt truck heading over there, on the move again. but we have a minor accident in the westbound upper deck in the showing heading into san francisco. we'll track that but no metering lights. let's get a live look and see how things are shaping up. this may have changed because even though chp said there were no metering lights we have the backup and this pattern shows it

assad regime to step down. >> now to the land down under. this is not a scene out of breaking bad. this is a real life drug bust in australia. this video here is from melbourne where we're talking more than $16 million of drugs primarily meth, money and guns being taken into custody today in a series of coordinated raids across that country. several arrests have been made. this operation alone is said to have brought down one of the country's largest meth labs. >> and the search for a missing workers in western japan caught in an underwater tunnel collapse is suspended. these images give you an idea of the tunnel's size. five workers are missing after the tunnel gave way and began filling up with water. the search for the workers had to be suspended because of poor visibility in the water. and no word on a cause.

>> thank you for the upday. i want to check in with meteorologist christina loren. she has a look at our radar. >> good morning to you. we are tracking moderate to heavy downpours right now. rolling through the city of san francisco. also watching the tri-valley getting hit pretty hard. san jose is getting a break. you won't see more showers in the south bay, just about everywhere as you head throughout the first part of your morning. by mid morning the clouds start to break apart. we'll see sunshine and a pretty nice second half of the day. let's zoom in and show you where the showers are the heaviest in san francisco. watch out for heavy rain. through the richmond district t sunset district, getting light to moderate downpours. across the bay bridge, you can see another heavy batch of rain extending from walnut creek through san ramon. you want to leave plenty of time to reach your destination safely. futurecast tells the story. you can see the showers starting

to break apart. a touch by 10:00 a.m. most of that moisture is confined south of the golden gate bridge. but we're getting pretty heavy rain from san jose up to san mateo. by 1:00 p.m. a little bit of activity over the south bay. then the whole thing blows out of here. temperaturewise, comfortable conditions, later on it's going to be chilly until about 2:00 p.m. 57 degrees, and 53 degrees in limited sunshine for the first part of the day. almost about 60 degrees in the warmer cities across the bay. so quite a contrast from what we experienced yesterday. a couple of 70s on the map. thursday into friday, we are expecting pretty thick fog each morning. we're going to get a nice first part of the weekend. saturday 65 inland and then a round of rain sunday into monday. 6:17, let's see what the showers and winds are doing to your drive. >> so far not a lot. again, the warning for folks, slick roads, lower the speed as

you travel in this morning. we have no problems northbound out of san jose. in through we had slowing that did show up. that's cleared to about 60 miles on average but the volume is building up to slowing here. this is not cleared. the wires down, clairemont at mckee. bob is heading out to get more. mckee is chosed to madeleine. this is not impacting freeway traffic but will impact you getting there or waking up perhaps. looking here toward the dumbarton wij, for 84, 92, what we're going to extend on my behalf. gusty conditions there as well. looking to the peninsula. an accident northbound 101. slowing in the southbound side.

>> breaking news coming in to the newsroom. newark police investigating a shooting where an officer may have been hit. we got off the phone with dispatch who are saying they are hearing reports of an officer shot. it happened near the intersection of menu's landing road. the suspect is still at large. they are looking for a white two-door car. we have a crew headed to the scene. we'll give you an update as soon as we can. >> from a super bowl to a super dish. scott mcgrew says you can buy your own. >> good morning to you. it's a giant dish for sale in carmel valley. the james bird earth station as it's known once owned by at&t

christina loren to find out a little drier now. the wind looks like it's whipping. >> some really gusty winds. you could get caught offguard so you want to take it easy in addition to the winds week got heavy downpours coming down. to the east bay we have pretty heavy rain from hayward up to san leandro, and you can see that line of showers on the yellow and orange on the way to 880. find out where the slow down is taking place. >> the good news is the fact that the freeways are moving relatively normal but we expect slower commutes through those spots where you show the rain and 680 corridor, a live look at the oakland coliseum camera and see see the camera chicagoing, more folks back the roads. i want to take to you the maps because we did talk about the

officer-involved shooting in newark. that is near fremont and that may be an issue if they have to get crews through the area. i would assume if this is a shooting, we'll give the warning, 880 around thorton you might see police activity. once bob gets on the scene. >> the suspect remains at large. accused of getting in a gun battle with an officer. bob is live in newark. what's the latest? >> to echo what mike was saying when we were heading north on 880 we did see an ambulance headed north on 880, perhaps to one of the local hospitals. it was being es carted by two police cars which suggests that maybe one of their own was in the mans and they were trying a get him a quicker right to.

this is a residential neighborhood. and what you can see is a fairly large response from newark pd, showed up their evidence technicians, they set up a white sent. it's hard to see but they have two -- hard to tell here. but that's suggesting that maybe that's an area they are trying to protect from the rain and perhaps that's an area where this crime took place. they are not giving us much information, not even whether it was one or more than one person september that they were in a two-door white car. we don't tho what the circumstances were except for initially they believed that one of their own officers had been shot. based on what we saw, that

seemed to confirm that. bob redell, "today in the bay." >> 6:32 now. today is also decision day though it's not expected to be the final word on gay marriage. in a few hours a three-panel judge in san francisco will issue their opinion on proposition eight. christie smith is live at the courthouse with some of the possible outcoming. >> reporter: the decision is whether california voters ban on gay marriage was constitutional. whatever happens today most agree this case is likely to end in the united states supreme court on appeal. it centers around proposition eight approved about by voters in 2008. two things, it's challenged a. judge said that vaughn walker struck down proposition eight

and gay marriage appealed. judge walker, the panel will roll on whether an issue raidsed, whether walker should be disqualified. he didn't disclose that he himself was in a relationship and could have been allowed to marry if gay marriage were legal. one of the outcomes could be that prop 8 is overturned. walker is retired and his successor ruled that he did not have to disclose anything about his personal life and there was no evidence of bias in his decision. that is expected to come down at tep clock this morning. christie myth. john and laura, thank you. >> will church and state collide forcing a mandade forcing church affiliated hospitals to provide contraceptives to employees free

>> the time is 6:46. and meteorologist christina loren tells us it look like we had a date with mother nature but it's passed for the moment. >> yes. some parts of the bay area getting a break from that rain. but we still do have heavy rain coming down in other areas. for instance, the east bay still getting hit. let's zoom in. i want to show you a wider view. showers starting to deteriorate slightly. you can see the yellow. getting moderate and heavy rain especially through the east bay. san jose dry this morning but that's not the case. 680, very slick all the way down to dublin and slick conditions along 880, all the way up to oakland this morning. really dangerous driving conditions. make sure you give yourself

ample time. you can see the pattern clearing up in the north bay. novato getting a break. from the showers that were relentless overnight. as a result you'll find slick conditions, areas of ponding, and there is more on the way. you can see still getting light showers over the greater bay area. between 8:00 and 11:00, starting to clear out especially north of the golden gate bridge. we'll see clearing in places in the south bay by about 1:00 p.m. the whole thing clears out by about 10:00 p.m. expecting rainfall totals upwards of 3/4 inch in the north bay. we need moisture. we will be able to add a few more drops in the bucket when it comes to accumulation. still running that deficit. 57 in san jose, 58 milpitas. 57 in palo alto and 54 on the cool side and cloudy through wall nut reek.

own. this started around 5:40. if you can see the white tents in front of a house on may hughes. neighbors woke to the sound of a man saying something to down on the ground. then several shots from 5 to 7 shots that were fired. when some of the neighbors came out they saw through they believed watts a suspect limping down the street walking in 0 you are direction, toward our camera direction. this person had a ball cap, was limping. the person mad it sound like that person had been shot. that person is still on the loose, still looking for the suspect. they believe that they took off in a two-door white car. again as i mentioned to you. an officer not with p.d. has been taken the hospital via police es cart.
