>> san francisco considering possible restrictions on music festivals. >> we'll give you a live look outside t lights lighting up the sky. that is oakland right now. picturesque on a friday, february 10th, "today in the bay." >> you made it to friday morning. 5:00. good morning. it's early. thanks for joining us. i'm laura garcia-cannon. >> good morning everyone. i'm jon kelley. let's check in with meteorologist christina loren to find out about our friday night fever with the weather. >> the good news is for you partygoers we're going to hold off on the rain until later on in the weekend. we'll tell you when that's expected. this morning a little bit of fog, a little bit of drizzle in the north bay. overnl starting off relatively comfortable in the upper 40s and 50s, headed toward the 70s in some cities today and then the rain on the way. first let's get you out the

front door with mike inouye. >> good morning. take note. oakland, i made a mistake. i said 6:00, it's 5:00 when this construction that you see on the screen should be clearing. there is the flashing light. the high street on and off ramp getting set to clear. we saw the crews on high street moving out of the area. we'll track this. if they have to do a traffic break i'll let you know. golden gate bridge we had the crews moving across, they moved the cones for the morning commute and we're all set. bring it on. it's friday. >> thank you very much. >> nice work, mike. 5:01. we have an update on an early morning fire at a san rafael lumberyard. crews are on the scene trying to put out the hot spots. the lumberyard erupted in flames in the 900 block of anderson drive. that's where christie smith is joining us live from the scene. what's the latest with this? >> reporter: good morning to you. right now firefighters tell me they are doing overhaul and working with the owner of this

business trying to figure out what started this. i got an update from the fire chief. he tells me they had a chance to look around the building and feeling pretty good about what they see in terms of the damage. they say it really is not as bad as it could have been. when they arrived there were 40 to 50-foot flames coming out of the building and major concerns about about a lumber and building supply catching fire because there is so much material here that could burn and keep on burning. fortunately, they surrounded this fire quickly. it started about with 2:45. it's retail in the front, lumber and palates in the back. and in the back is where the worst damage is. not so much in the front building. the system seemed to have worked. >> working aggressively and stopped the fire from making forward progress in the building which was also aided by an

automatic fire sprinkler. >> 35 firefighters were out here fighting this fire. they tell me they had it knocked down in about an hour after it reached its second alarm. again, they are working on a cause and trying to come up with damage estimates. reporting live in san rafael. christie smith. jon and laura, back to you. >> 5:03. stanford police release add sketch of the man they say tried to assault a student. this man entered an unlocked room around 2:00 a.m. on sunday, climbing into a bed with a woman. she woke up when he tried to take off her clothes. the woman got away and the man ran off. it was the second assault on that campus that morning. 1:15 a woman was tackled by a man. a passerby scared that attacker away. police did not think the two incidents are related. >> today friends and family saying farewell to a well known junior college football coach. a public viewing will be held for coach doug boyett. the 52-year-old died in his

sleep a few weeks ago. he spent 30 years at foothills college. the last five as head coach. today's viewing will be at roller, happgoo and tinney. then tomorrow at 1:00 p.m. at the foothill college gym. >> 5:04. the man shot by police in castro valley apparently has a criminal history. 48-year-old steven moore is the target of a narcotics investigation. also on parole for drug and weapons violations. two berkeley officers were tailing moore. they tried to stop him and moore allegedly backed his car into one of the officers. the other officer opened fire, wounding moore. he is in critical condition. the officer is recovering at home. >> occupy cal protesters back on campus and so are their tents, six tents going up yesterday. this is video of the last encampment in that same spot. it was dismantled by police last

fall. this time police taking more hands off approach. police and the dean of students have asked protesters to take down the tents but so far they are not budging. oakland police showing they are serious about cracking down on violent occupy protesters. 30-year-old joseph was arrested wednesday for violating a stay away order. he was apparently found on the plaza even though he was told to stay 300 feet away. the order was issued after a january 28 protest. the man was arrested that night and charged with battery of a police officer and refusing to leave that scene. >> jerry sandusky is back in court focusing on jury selection and bail. marla tellez joins us with some overnight headlines. good morning. >> good morning. the question is will people who live near the former penn state assistant football coach be allowed to sit as jurors in his

upcoming child sex abuse trial? prosecutors, they don't want this so today they are going to try to convince a judge to fill the jury box with people from outside the state college area. today's hearing is also expected to address jerry sandusky's bail conditions. he wants contact with his grandchildren and others while he awaits trial. he is facing 52 criminal counts for alleged sexual misconductov involving boys over a 15-year period. he denies all charges. in los angeles, one of the teachers charged in that child sex abuse scandal at miramonte has been released on bond. martin springer was freed early this morning on $300,000 bail. he is one of two former teachers at miramonte charged with lewd acts upon a child or children. springer is wearing the court ordered ankle monitoring device. his preliminary hearing is scheduled for next week.

topping international headline, syria's largest city is under attack this morning. two explosions targeted security compounds in the city. syrian state tv says at least 25 people have been killed, almost 200 hurt. the city is a business hub and historically loyal to embattled president bashar al assad so state tv is blaming terrorists for these latest attacks. jon. >> thank you. the bay area may soon have a new way of fighting west nile disease. the state says it will scale back pesticide regulations so counties can fog for mosquitoes. they could spray near some waterways already polluted with chemicals used by vector control. officials say it will help keep the adult mosquito population down and fight west nile virus. opponents worry spraying could

affect the drinking water. >> the city of oakland will be closed today to save money. city services won't be available including parks and city offices. emergency services will not be affected. the city offices will be closed monday in observance of lincoln's birthday. >> san francisco talking about possibly shutting down large festivals in golden gate park. the land use and economic development committee will hold a hearing monday about the impact of the festivals, specifically when it comes to traffic and noise. the hearing coming on the heels of a san francisco state university report that found outside lands a music festival held in golden gate spark good for the economy. the report found last day's three-day festival brought in $60.6 million in the san francisco area. >> a good weekend to get outside and let's check in with meteorologist christina loren. she joins us in the nbc bay area weather center. >> good morning to you. i think it's going to be better for you to get out on saturday than sunday with more clouds and a few showers rolling through

the bay area. good morning. 44 degrees in concord. you're at 50 in san mateo and 53 degrees in san francisco this morning. we actually have a little bit of shower activity on the radar. very, very light. and mostly up in the north bay at the coast. nonetheless you want to give yourself plenty of time to reach your destination safely. throughout the day today, by noon up in the 60s. 64 degrees inland as you break for lunch. about 60 degrees by the bay and at the coast, 59 at noon, another day of unseasonably warm temperatures and of course we've got a lot to talk b. valentine's day around the corner. i'll let you know what the pros will be playing in at pebble beach later on. first we want to check your drive with mike inouye. >> let's take you out to the peninsula. 101, construction at willow has cleared. willow avenue a nice flow of traffic. 101 through the area passing the dumbarton bridge we still do have a crew, however, both directions north and southbound 101 at oregon expressway, the

off ramps are closed, scheduled to clear by 6:00. being a friday sometimes they try to clear early. the south bay, no problems, an easy drive for the northbound sensors. look at that all close to the limit. the sharks play downtown but that's not for hours. that shouldn't be a problem until after you try to leave work. a live shot with the san mateo bridge. an easy flow across the bay. you can see the high rise where it says live so it's a clear view. a little bit of drizzle through the far north bay but nothing to worry about. >> what's a newscast without a little banana sam. after weeks the squirrel monkey will return to his exhibit tomorrow. banana sam made headlines when he was stolen. he was later found by a man who says he lured the monkey into

his back pack. police are investigating that story to decide if the man qualifies for a $5,000 reward. >> banana sam reunited and it feels so good. a bay area woman putting her body on the line to help out the san francisco spca. laura grech known to many as the ferral cat wrangler is letting a bidder choose her next tattoo. it closes at 10:52. here's what the winning bidder can choose. a selection of tattoos. they will not, however, get to choose exactly where that goes. the tattoo will happen tonight at the spca's cat cocktails a s voodoo party. >> we'll have details 18 live report.

clear by about 11:00 a.m. today. you can see from your future cast, by 1:00 p.m., mostly cloudy conditions over the greater bay area. a few isolated showers are possible later on. a little bit of precipitation but that's mostly in the north bay and that, too, will clear by about 5:00 p.m. mostly clear over the greater bay area. it worked out like this for the big at&t national pro am, all of the professionals out there at pebble beach. good looking day for the first part of the morning. highs will end up 50 to 54 degrees at pebble beach. it's on the water. we're going to see the winds shift out of the east to the northwest at 5 to 10 miles per hour so. that could come into play. tuesday we've got a big day shaping up here. valentine's day, and a good looking forecast for all of you lovers out there. through your tuesday, temperatures are going to be on the cool side. not too bad. a few showers early. they will clear by 3:00 p.m. and then by tuesday evening you

oakland, the earlier construction crew, getting ready to leave. we have the off ramp which reopened. no disturbance to the flow. back to you. >> mike, thank you. all of that financial trouble in greece continues to drag things down that could have investors worried. for that we turn it over to jackie live at cnbc world headquarters. good morning, jackie. >> good morning. the futures are lower as investors continue to monitor the daily ups and downs concerning greece. the greek government reached a deal for budget cuts but european leaders are imposing more conditions before they approve a new round of bailout money. the asian and european markets are lower. we'll get data in the u.s. on trade deficit and consumer sentiment. ben bernanke speaks at a home builders conference this afternoon. we saw the dow rise 6 points to close at 12,890, the nasdaq up 11 to close at 2927.

retailers will feel the love on valentine's day. the national retail nedder rags predicts consumers will spend $17.6 billion up 9% from 2011. people are going to likely spend an average of $126. mostly to spouses and significant others. jewelry is the biggest gift item, expected to hit $4.1 billion followed by a night out and flowers. men are the bigger spenders. $85 by women. you can have your own farmville action figure. hasbro is developing toys based on the games. the first item should be available this fall. the company may be trying to follow the success of rival mattel on those stuffed toys and board games. >> great. now i have valentine gift ideas. >> your lucky wife. >> 5:19. advertising firm thinks it has

found a way for b.a.r.t. to generate refuse knew, talking about putting billboards on the right-of-way property. along the highways and maintenance yards and transit stations. the agency says b.a.r.t. would make $10 million a year from the signs. but the plan may not be legal. current ordinances prevent billboards being put up on many of our properties. b.a.r.t.'s board will discuss the idea. >> the future of san ramon's fireworks show up in the air. this year's tab could nearly double up from $175,000 in 2011. now city leaders are asking the public whether to shell out the cash or cans tl display. the day-long event draws more people as nearby cities cancel their shows. as the crowd goes, so do the costs stretching resources to the limit. a public meeting will be tuesday at 7:00 taking place at city

between $1500 and $2000. >> it's 5:24. the fbi says steve jobs was the target of an extortionist in the 80s. one of the odd things found in jobs' fbi file. scott joins us. why did the fbi have a file on jobs? >> back in the early 90s, jobs had been considered for a position in washington during the administration of george herbert walker bush. and the background investigation found much of what any one knew about him we know. he was a bragger, insisted on his way, several called jobs dishonest. the report detailed a plot by an unidentified man who claimed to have placed bombs in silicon valley and demanded that steve jobs pay him $1 million to defuse them. jobs never paid. no bombs were discovered. to this day we don't know who the extortionist is. back here in modern day, apple shares are just under $500, giving apple an overall worth of

where in a week or so we're going to watch for construction there and rain delaying that. right now it's open for service and no problems at the toll plaza. we'll get a look in the east bay. oakland past the interchange with high street, that construction had it closed. it's reopened. now the southbound side a few more of those but not enough to cause slowing. the nimitz okay, good news. >> thank you very much. good news there. an early morning fire created a scare at a lumberyard. calls came in just before 3:00 this morning. by the time firefighters arrived at the building the flames were 50 feet high. the owner of the business says they got lucky. >> could have been a lot worse. could have been our dry shed or something like that. they wouldn't have been able to put that out quick. it's all dry timber in there. >> firefighters say an automatic springler system in the building helped douse the flames.

no word on a cause. >> san jose police now looking for answers this morning after the city's fourth homicide of the year. somebody dropped a man off outside of kaiser medical center suffering from stab wounds. he later died. officers still trying to figure out where the stabbing happened. >> accused killer joseph nasowill be back in court to re-enter his plea. nasois accused of killing four women between 1977 and 1994. during a pretrial hearing last month a judge decided there was enough evidence to try nasofor the murders. today that same judge will consider whether nasois competent and able to represent himself in the case. >> new developments in the case of a customs official shot outside his home. police say the suspect was infatuated with his victim's

wife. the suspect is expected back in tourt. good morning, stephanie. >> reporter: good morning. 61-year-old dennis bagwell may be here again to enter a plea. he was here yesterday afternoon for his arraignment charged with attempted murder and assault with a deadly weapon and assign add public defender. we're learning more about a possible motive behind this shooting. bagwell allegedly shot the customs officer, also 61, tuesday morning outside the officer's home. in court records police said that bagwell became obsessed with his victim's wife, 38-year-old irenea smith whom he had taught. that began a few months ago. smith said she rejected bagwell's advances and told she remained friendly with him, even texting him. but this was after he was spotted quote lurking in the

bushes outside their home. according to the "mercury news," bagwell and his wife live here in fremont and then filed for divorce in 2009. before losing their home to foreclosure in 2010. the owner of the school told us that despite all of the recent changes, bagwell never acted any differently. stephanie chuang. back to you guys. >> thank you very much. 5:34 now. oakland will go to court to try to shut down two popular hotels. the city attorney says the national lodge on international boulevard and the economy inn on east 12th street are havens for hookers. both have a history of prostitute activity. they were under a court order to clean up their act but the attorney says they are coming up short and she will seek the maximum penalty. >> an elementary school shaken up after eight more employees were placed on leave. the redwood city district says it's investigating whether

staffers followed proper procedure in the handling of abuse allegations. alexia is accused of kicking and slapping two of her students at roosevelt elementary. the alleged abuse happening back in december and january but an aid did not come toward until february 1. >> we'll find out why a south bay principal was placed on administrative leave and escorted off. they will send out a letter explaining why the principal was removed last week. it's about a block west of almaden expressway and north of fox worthy avenue. >> it's 5:35. yesterday was one of those dream days. soak up the sun. meteorologist christina loren is here to tell us about beautiful weather. still a good one.

>> we're looking pretty good. it's a little on the cold side. 50 degrees in san mateo, 44 in oakland. john is exactly right, though, more clouds than sun later on today. that spectacular sunshine, mid-70s not quite as warm as a result of all of those clouds but we're starting out mild so hitting the 70s again. we'll climb into the 60s by noon so. overall looking good. we have showers. very light and mostly in the north bay, falling apart as they move on shore. you want to give yourself time. especially if you're waking up near the coastline. 64 degrees at noon inland, at 60 degrees by the bay, and 59 degrees at the coast as you break for lunch. rounding out the day at 4:00 p.m. with really comfortable conditions. we've got this golf tournament happening, yes, pebble peach today. 50 to 54, winds will shift during the day today.

>> welcome back on this friday morning. mild temperatures outside. that's a look at the bay bridge toll plaza. not too bad. probably picking up in a bit. it's kind of early. 5:41. >> three or four republican candidates will be in washington this morning to address the conservative political action conference. today in the bay's brian mooar is live in washington. with rick santorum coming off a triple win may be a critical showdown between he and mitt romney. >> reporter: absolutely, laura. all eyes on this cpac conference. we'll pull off on a side street and talk about one of the hot topics at this conference, it is the obama administration's controversial contraceptive policy. we learned in the last minutes nbc news reporting that the white house will address the issue today, politico.com suggesting there could be a compromise in the works, so that

will be a subject that will be center stage. also center stage, mitt romney. it is his biggest chance to date to try to pave over his problems with conservatives, to try to win them over. but it's also a wonderful opportunity for rick santorum who just has three big primary season win this is week to make his case that he is the conservative candidate. newt gingrich is going to try to make his case as well today. noticeably absent ron paul, two-time winner of the cpac straw poll, the rules have changed, they do not favor his campaign and it's seen as an important test for santorum. laura. >> very interesting to watch. especially the news on what the white house is addressing. thank you very much for the update. >> that's a big break in that story. the pros and celebrities hitting the links for day two of that pebble beach national pro am. >> always fun to watch. bob redell live at pebble beach.

interstate 80 and napa. interstate 80 across the carquinez bridge. 18 minutes down to the bay bridge toll plaza. no problem for the flow of traffic heading over to the bay bridge. your commute direction and flow but picking up as far as the volume goes through the east bay. we'll look at the south bay. traffic northbound, that's your commute route as well through this area. we're looking at a smooth flow off 101, 85, and all the way past capital to tully where we'll see the signs of slowing. maybe 40 minutes being a friday. a little later start. so far a smooth drive heading up into the lower bayshore. construction crews still on the oregon expressway, north and southbound the off ramp blocked. we're looking north from the dumbarton bridge. and the san mateo bridge, 92 over the water nice with the headlights off the peninsula. look at that, the high rise, a clear view here and across the bay bridge.

a look at the golden gate. back to you. >> nice and smooth. thank you. searchers back near stockton where human remains were found thanks to a tip from a death row inmate. serial killer wesley shermantine drew a map of what he said were burial spots of victims. the map detailed areas on shermantine's family property in san andreas which is in rural calaveras county. searchers made a grisly discovery yesterday. >> the dog alerted. when investigators went over to e what the dog alerted on they found human remains, it was a skull. >> deputies say the remains could belong to cindy vanderheiden who went missing in 1998. shermantine began talking to authorities after his killing partner, loren herzog, committed suicide. he said that herzog was responsible for the abduction of michaela garecht.

>> marin county health officials investigating two cases of a rare brain disorder similar to mad cow disease. 59-year-old eileen shaw contracted what health officials believe is kruts felts disease. she died. her husband tells us once she got sick she deteriorated quickly. in a statement they ruled out the string of cjd linked to mad cow disease. this is based upon results that a national reference laboratory. furthermore, we have no evidence that suggests casual linkage between the suspect cases nor is there evidence to suggest a risk to food supply. >> 5:49. was it the state of the city or state of the city's retirement benefits, last night san jose mayor chuck reed spent a chunk of time talking about the city's retirement costs.
