the construction but at least good majority of those crews are clearing from the roadway. we may see slowing for 680 north of that dublin interchange but not a problem off of the walnut creek interchange so good stuff. we'll take the peninsula, there was a crew there too. >> thank you, mike. >> it is decision day for more than 200 senior sn citizens on the peninsula. today they learn whether they will be forced to pack up and leave the place that has been providing them long term care. bob redell is live in burlingame now where the san mateo board of supervisors meets in a few hours from now. good morning, bob. >> reporter: good morning to you, jon, to vote on whether or not to close the county-run burlingame long term care facility. if the board says yes that means that the 200 people who work here will lose their jobs and the 230 patients will have to be transferred, a move that could be very traumatic for them according to one patient advocacy group.

a consultant and civil grand jury have recommended this facility be shut down because the building is outdated and doesn't meet today's standards. the union fighting to save the jobs argues that the building is in decent shape and where would you move all of the residents. a spokesperson telling the bay city news service the county don't have the space elsewhere. a group fighting for patients rights says the move would be hard on the residents especially those with dementia. the county says that if it does go ahead with the shutdown it won't close the facility until all of the patients have safely found a new home. they also promise to help the workers who would be fired, help them find new jobs. reporting live, bob redell, "today in the bay." >> thank you, bob. it's 5:02. oakland police with a warning this morning. take extra care walking to and from your car. police have seen an increase whan they call rat pack robberies. they say four or five people will attack victims and rob them.

officers say watch for any one suspiciously loitering. call police if you are worried and try to provide details like a car description and clothing. officers say never fight back. >> it is 5:02. a plan to put drug sniffing dogs on some high school campuses is moving forward. the school district's board of trustees will talk about when and how dogs will be allowed on campus. last month they agreed to check gym lockers and cars for drugs. no students would be present. if the guidelines are accepted the board could vote to adopt it at its february 28th meeting. >> hayward police are trying to identify the man they found lying dead 18 driveway, this is an update to news yesterday morning. the body was found about 5:00 a.m. at the intersection of seventh and c streets after reports of shots fired. so far police have not made arrests and not released the suspect description. one neighbor told us he is not

surprised by the murder, blaming strange activity at the home where the body was discovered. >> richmond police saying this morning they are narrowing their search on some elementary school vandals. focusing now on disgruntled employees or someone with intimate knowledge of the school. vandals broke windows, flooded the floor of a new auditorium. there was a total of about $1 million in damage there. several clues were left behind. a $2,000 reward is offered for information leading to arrest. >> turning to international news, a celebration of sorts in north korea where that country's late leader is now cast in bronze. marla tellez joins us from our newsroom with that. good morning. >> good morning. kim jong-il would have turned 70 and today north korea is paying tribute with a bronze statue of him. the statue was unveiled today. top political and leaders were in attendance.

here is a note, kim's son and the new leader wasn't there. kim jong-il died in december. india, the crime scene tape is no longer up but the investigation continues into who was behind yesterday's attack on an israeli diplomat. he was riding in a car in new delhi when it exploded, injuring four people. the israeli prime minister is still blaming iran. >> here in the states are you registered to vote? it turns out about 24 million registrations are no longer valid. and get this, almost 2 million who are registered are dead this according to a new report released by the pew center. the study finds almost 3 million people are registered in two or more states. the study concludes our paper system is outdated and flawed and researchers say the fix is on line voter registration. >> good information.

thank you very much. the east palo alto council holding a special meeting tonight to address concerns over facebook's campus project in menlo park. the city concerned expansion could have a major impact on the neighborhood's traffic. facebook planning to have 6600 people at the campus but promised to limit the number of cars in the area. the city leaders also worried facebook employees looking to live near their work will push out current residents and drive up home prices. tonight's meeting starts at 7:30 at east palo alto city hall. >> palo alto is trying to root out illegal prostitution at massage parlors. city leaders will meet to talk about regulations for the businesses and would require therapists to have a city permit or state certification. in some cases workers would have to submit to background checks. some argue the rules are too harsh and will hurt small business. >> this is a fourth of july drag

a. bay area fireworks show could soon find itself all snuffed out. san ramon city council holding a meeting to talk about canceling this, the star-spangled spectacular held on july 4th. the city says it can't afford the cost as more people will pour in to watch from neighboring communities that have canceled their shows. the cost of traffic and crowd control also has tripled. to weigh in you can attend tonight's city council meeting at san ramon city hall starting at 7:00. >> two competing ballot measures that would change the election system will go before supervisors. the first would replace the city's current ranked choice voting system with nonpartisan primary in september. if no candidate receives 65% a run-off would be held between the top two. the second would keep ranked choice voting but consolidate city elections so they happen every four years. right now city attorney and city treasure are elected two years

you won't be dodging showers all day like yesterday. we had a lot of moisture come through the south bay and more on the way as we meet back here tomorrow morning. enjoy the 60s we have today in places like morgan hill and gilroy, 61 in milpitas. about 57 in blackhawk, across the water we're forecasting about 58 degrees in san francisco. plenty of sunshine for the second half of the day. so, it's 5:09, still a lot of areas dealing with the aftermath of yesterday's showers, puddles out there ponding. what are we working with? >> all of that and yet no major issues as far as accidents because the traffic is light right now. we'll watch as things get more crowded, about 5:30, 6:00. the peninsula getting less populated as well. because the road crew just cleared from embarcadero road. the off ramp also getting to leave early this valentine's day for that crew on the bay shore. bottom of the screen, southbound around 85, we've seen both directions with little blips here and there as more folks

remainder of your week. 58 degrees at 3:00 p.m. about 52 degrees at 8 p.m. for a late night romantic dinner. temperatures today on the mild side. 57 degrees in san jose. about 60 in milpitas. and 60 degrees today in palo alto. 50s in places like walnut creek and san francisco. as we head throughout tomorrow showers arrive, mostly between 4:00 a.m. and 9:00 a.m. we'll get a punch of showers and then the whole thing will clear out. enough to get the roadways slick. just in time for the morning drive. have no fear, mike inouye and myself will be here to guide you through the showers just like we always do. as we head throughout this weekend, that's when things start to get tricky. another area of low pressure that will try to nudge its way in the bay area which could postpone that construction on the bay bridge. that's what we're watching for. word is we'll find out whether that will be the case on wednesday. let's check your drive with mike. >> good morning to you. talking about the leftovers from the rain we had.

and that might be an issue around the freeways, the transition ramps. okay on the speeds northbound coming up into san jose and santa clara. at the lawrence expressway there is a new accident just in the last few minutes. not a lot of detail but it's the lawrence expressway off ramp from 101. making the sharp curve. watch for that. i'll track that. we also have here the summit for mout. hamilton is closed. that happens when we get a dusting. we had a little so you cannot head up to see what little snow there was. they don't want anybody to get stuck there. looking north through the hills of sunol. we saw fog going on. no problems for 580 and the drive through livermore and toward the dublin interchange. a little slowing northbound 680 as the construction crews clear. that might be the reason. i'll track that. so far no major issues. a look at the approach, no major issues. you're at the speed limit, good stuff off of the carquinez.

back to you. >> thank you very much, mike. what happens in europe continues to impact the markets here in america. for that and the rest of our news before the bell rts turn to jackie deangelis. good morning, jackie. >> good morning, laura. let's do a recap of the numbers yesterday. the dow jumped 73 points on monday to close at 12,874, the nasdaq rose 27, an 11-year high, 2931. and the s&p 500 up 9 points to 1351. as you mentioned the futures are higher this morning after a strong italian bond auction. the headlines drive the market. moody's last night downgraded six nations an cut its outlook on the uk but the markets holding up. europe is a tornado watch higher this morning. we get data on small business sentiment, import prices and business inventories. a technical glitch shut down the cme electronic oil trading sending traders to place bets on

the new york merck exchange floor. it resumed at 3:15. it was said to be caused by technical issues. the u.s. and eu cleared google's acquisition of smart phone and tablet developer motorola holdings. google received antitrust clearing, however the regulators note they will monitor. back over to you. >> thank you, jackie. >> it is 5:19. a south bay city about to make it tougher, a lot tougher, for smokers. mountain view holding -- rules would ban smoking in outdoor dining and create a 25-foot buffer zone around doorways and windows. it will go into effect in 90 days. >> you could save someone's life by downloading a mobile app.

day. the city council considering a plan to alter parking tickets and rules at a meeting tonight. it would prohibit officers from writing tickets when the driver of that car is present. and drivers who actually manage to get there and show up as the cars are getting the tickets, well, they'd get a break which is good news. "san francisco chronicle" recording the new policy would have no negative effect on city revenue. >> a popular valentine's day gift could cause a hazard. use care when handling mylar balloons. if let loose they could fly into power lines and spark outages. the utility says nearly 300 balloons caused outages last year in northern and central california. they are the shiny ones. >>ed have strd means balloons, candies, flowers, what about pillow fights. hundreds expected to be in san francisco's justin herman plaza for a good old pillow fight. this is from last year's battle.

child's facebook posting. he does what a dad would do. sure. >> that was a first round. these are exploding hollow point rounds. >> if you had a dad like that you might be cautious about what you put up on facebook. reports say the daughter thought she sent home run update to private friends only but the family dog has a facebook. i'm not making this up, and she included the dog in the post. that's where the dad saw it because he was updating the dog's status. apparently everything is going to be okay. i have actual news for you. european and american regulators cleared the way for google to buy chicago's motorola mobility. $12.5 billion. more importantly it gets tens of thousands of motorola patents which should help google fend off lawsuits from apple. if you have thousands of them and the other guy does, neither one will dare to attack. >> all right. thank you very much.

you. antioch police say this started last night with a knock on the door and ended with a would-be burglar shot because the homeowner they say was able to wrestle the gun away from that man and open fire. this is near the golf course on wexler peak way, again, happened about 8:30 last night. right now the scene is clear. police say what happened is a man was home with his 7-year-old son when he heard a knock at the door. he didn't answer it right away. instead the man outside they say kicked the door in right off the door frame and pulled out a gun. the homeowner fought him off, grabbed the gun and fired it several times. the man died at the scene. why this home in particular is still unclear. a woman was also detained at the scene. neighbors say the violence is getting to be too much. >> for us to move away from the hood and away from all of the problems, all the killings and the violence, man, we're not with that.

we move away for a reason. it follows you. just like this, man. >> reporter: this is the sixth shooting in antioch in three days. police don't think they are related, but so far two of the shootings including this one have turned fatal. reporting live, christie smith. back to you. >> thank you very much. a prominent nightclub owner in the south bay denying charges he raped a young woman at his family home in los gatos. ray shafazand owns the myth and suborn light clubs. a woman says she was attacked while staying in the guest room of shafazand's home. he is facing charges of felony rape by force. his attorney says his client is innocent. he will be back in court on thursday. >> it is 5:32. police are on the hunt for as many as two armed men who opened fire at a vallejo nail salon. the battle happened about 7:15

last night on springs road near maple avenue east of highway 80. witnesses say the two men entered tina's nails and shot a female customer three times. a friend of the wounded woman returned fire which led to four more people being shot, including a toddler hit in the leg. detectives are trying to figure out the motive. >> at this point we don't have a motive. detectives are out here and working on this and trying to piece that together. we've got witnesses we're talking to. >> the gun fire left bullet holes in store fronts and a car in the street. >> it is official, the bay area now home to world's most valuable company. business and tech reporter scott mcgrew is in the news wroom all of the details. good morning. >> good morning. shares in apple cost about $500 for the first time on monday. if you take all of the outstanding shares around the world, multiply that by the share price you get company's worth or market capitalization. so apple shares closed at $502.60. there you see the number.

460 give or take billion dollars by comparison exxon-mobil is worth about 400 billion. there are a bunch of takeaways on this. first, this happened under tim cook, not steve jobs so the company continues to grow even if it lost its founder. apple shares have jumped in the last year, apple in the words of one analyst, added the value of facebook in the last 12 months. lastly, as scott budman points out ap sl a consumer company, a gadget company. it's more valuable than companies that make things that people need like oil. with great power comes great responsibility. apple yesterday started permitting independent inspectors into its factories to search for human rights abuses and worker mistreatment. apple doesn't own those factories in shenzhen but it's come under criticism for working conditions. we're talking huge factories, a

morning in napa and 36 degrees in santa rosa. good morning to you. by noon today, climbing into the mid-50s inland by the bay and right at the coast. and then we'll round out the day with a couple of 60s on the map as you make your way home from work at 4:00 p.m. about 59 degrees instand. tomorrow morning, more showers on the radar. starting at 1:00 a.m. wednesday. we'll let you know how much we're expecting, how long the showers will last and then another round of rain expected to move in for the weekend. a lot to talk about. 5:37. if you are leaving now mike is sure to get you out on a good note. >> we missed folks who left and gone highway 4. look at this slowdown. it's traffic tuesday. i was worried about a severe slowdown. we don't see it as focused as i thought we were going to but we still see that. 50s where it's yellow, spread out throughout antioch and heading over to pittsburgh and baypoint which has the speed limit showing up for the 61. there you go for highway 4. it's a smoother drive through concord and off the benicia bridge.

a good tuesday morning to you. taking a live look outside. hp pavilion for the sharks played the capitols last night. >> actually they played on the road and the sharks won. >> that's the good news, jon kelley. >> absolutely. they broke out of that skid they were in. good news for the boys on ice here in san jose. a search will resume for more human remains in what appears to be a mass grave in san joaquin county weather permitting. investigators took a break because of all of the rain but so far they have found some 300 bone fragments, searchers were led to the site by serial killer wesley shermantine who says he and partner that he was in jail with dumped bodies at the remote location. police say they have identified the remains of two women who went missing nearly two decades ago. there are some hopes that the remains of 9-year-old michaela garecht will be found. >> plans in the works for a

public funeral for whitney houston. her body was flown to her home state of new jersey last night. a funeral is expected later this week. nbc news has learned houston's family will likely have a public funeral for the pop superstar on friday. it would happen at the prudential center in newark which holds more than 18,000. seating would be at a first come first serve basis. the funeral is expected to include v.i.p.'s and may be televised. the cause of houston's death is under investigation. an autopsy was done on sunday buttoc. investigators will not say what meds were discovered. >> president obama and vice president biden sitting down with the future leader of china, the discussion, economy, threats and human rights. tracie potts is live in washington right now. we're hearing -- she's not ready for us?
