forecast. >> it is a little bit of a wet wednesday to start but we'll clear out as we head throughout the day today. we've got some pretty heavy low clouds starting to develop throughout the east bay valleys. your interior valleys starting to get soft. showers are racing into tahoe and the central valley. i'll let you know how much fresh powder we'll get out of this system. 5:01. let's check your drive with mike. >> if you're going to the sierra, bring chains and snow tires. those are required. locally the wind is the issue for interstate 80 across the bay bridge. you might get caught with a gust or two. chp warning folks about higher rise bridges like the bay bridge. another live look outther there past the coliseum no major issues but the camera is shaking here, gusts especially through the east bay hills, hold on tight, folks. 5:01 right now.

antioch city leaders say something has to be done in the wake of recent deadly violence. the mayor's calling for an urgent town hall meeting next week to talk about the problem and hope to find solutions. his comments came just a day after a homeowner shot and killed a robber during a home invasion monday night. police say an intruder rang the doorbell and when no one answered kicked in the door armed with a dwun. the home o gun. the homeowner wrestled the gun away and eventually shot the intruder several times. police arrested a woman outside the home and are looking for a third suspect. mayor says beefing up neighborhood watch programs and putting more police on the streets are ideas that need discussion. we're following a developing story out of honduras this morning. a fire ripped through a prison leaving hundreds dead. "today in the bay" marla tellez is in the newsroom with all the latest. >> reporter: good morning. the death toll first came in as dozens and now we're well into the hundreds. the associated press is reported almost 300 inmates are dead

after a fire ripped through a prison in honduras. this is about 90 miles north of the cap it will. fire officials described the scene as hellish. as for the cause, some reports point to rioting prisoners. others say it was an electrical short-circuit problem that sparked the flames. again, almost 300 inmates are confirmed debt in a honduras prison fire this morning. in syria now new video into our newsroom shows thick, dark smoke filling the sky in homs. it is a burning oil pipeline shell that's part of president ba slar shar al assad's crackdo the uprising. this morning he's calling for a referendum that could bring a new constitution. in iran, president mahmoud ahmadinejad is flexing his nuclear muscle. officials say today the country has inserted the first iranian-made nuclear fuel rod into its research reactor near tehran. iranian state tv reports this is

proof of that country's skill, expertise and nuclear development. tehran has long said its nuclear program is for peaceful purposes only. thank you. a little girl is in stable condition this morning and her grandmother is fighting for her life after getting caught in the cross fire of a shoot-out at tina's nail salon in vallejo monday night. police say the intended target was a 27-year-old target inside the salon. one person is in custody but police are still looking for two others. the chief probation officer in alameda county on administrative leave this morning amid sexual assault allegations. he's been accused by a deputy probation office. the accused says the allegations are false and outrageous and he will be cooperating with the investigation. 5:04 right now. opening day for the 49ers new stadium in the south bay could

come sooner than originally expected. "today in the bay's" bob redell joins us live from santa clara this morning with an update on the construction. good morning. >> reporter: good morning. the 49ers can just have only two more seasons at the stick. the city of santa clara has just approved a contract with construction company to have the team's new stadium built here behind me next to great america in just 30 months. that is much sooner than expected. it would be in time for the start of the 2014 football season. in a 5-1 vote the council agreed to an $878 million contract with turner deb con conv. the city has negotiated stiff penalties into the contract that include daily fines for every day the product is past due. >> the $20 million, if they are delayed. $6 million for each game. it is a rather substantial

incentive to get this thing done on time because we want to be playing football in santa clara in 2014. >> reporter: the decision to approve this contract was not unanimous. one councilman voted against this because he is waiting on a court decision. a judge is supposed to rule on the legality of the referendum that initially approved this deal. some voters have challenged it arguing that the city misled voters as to how much taxpayers would be on the hook for this roughly billion dollar project. live here in santa clara, bob redell, "today in the bay." they were asking for it and now are getting it -- much needed relief for east bay students. administrators at mount diablo high school in concord have unlocked all of the bathrooms on their campus. the "contra costa county times" broke the story and after the national attention it received the principal relented. all but two girls' rest rooms and two boys' rest rooms were kept locked during the day because of problems, vandalism and graffiti. that's far fewer than what's

required by law on a campus of 1,400 students. 5:06 right now. a san mateo county-run nursing home that's served the community for nearly 50 years will soon shut its doors. it is an update to a story we told you about yesterday. burlingame long term care facility is home to more than 200 patients. despite tearful appeals, the county board of supervisors voted to close it saying the building needs too many expensive upgrades to remain open. the county will find new facilities for the tenants and hopefully new jobs for the staff before the closure is completely by the sum every next year. soon it will be harder to light up in another south bay city. mountain view last night banned to ban smoking within 25 feet of outdoor patios, windows and doorways and also made it illegal to light up in public parks. the new rules take effect in 90 days. a new scam circulating in the south bay. sunniville says it received a complaint after man calling and

saying he represents the sunnyvale computer department. sunnyvale says it doesn't even have a computer department. looks like no rocket's red glare this independence day for people in san ramon. the city has taken the first steps towards getting rid of the fireworks portion of its fourth of july celebration. the council voted last night to have staff plan this year's events without the pyrotechnics. the change is as you'd expect -- yeah, over money. san ramon says it just can't keep up with the cost of growing traffic and crowd control. the new scaled-back celebration will be reviewed february 28th. 5:08 right now. christina loren joins us in the nbc bay area weather center. >> good wednesday morning to you. we want to get you over the hump so you can enjoy the end of the work week and hopefully that weekend if you're someone who works monday through friday. we do have some showers that

could slow you down this morning. give yourself plenty of time. at this point they are now racing into the central valley and we have a little bit of activity pushing over nevada. most of the action is over tahoe, fresh powder above 6,500 feet. throughout the next couple of hours we'll continue to clear out. we will see a little bit of patchy fog especially through the interior valleys of the east bay and south bay. as we head throughout the day, breezy to windy conditions will help clear whatever fog does develop very quickly. it will be a little bit gusty over the hill tops. keep that in mind. we have more rain on the way. our next best chance arrives on sunday. of course that could be problematic for that planned construction of the bay bridge. this just depending on their criteria at this point. they have to make that decision today and a really tough decision with 20% chance of rain over the bay bridge on sunday. for today though we'll get a lot of sunshine. by noon, 55 degrees inland.

by the bay, same for you. rounding out the day with the mid 60s in many cities. i'll get to that forecast, also show you the rain chance on your seven-day in my next report but first let's check your drive with mike. weather wise looking at winds and wet roads as well. to the bay bridge, first a nice easy 18-minute drive off the carquinez bridge. no major issues approaching the bay bridge on those feeder roads through the maze but the wind advisory issued by chp is warning folks especially on the upper deck you may get caught with a gust or two as they have during the overnight hours. that's the issue for interstate 8037 wind across the bridge. a cyclone fence and a car in an accident over here at cummings skyway as you approach eastbound 80. that accident should be off the highway now, not affecting traveling to or from the car season bridge. there may be debris floating around on bay area roadways. the toll plaza of the carquinez bridge, we had trees at the

bottom of your screen. they were blowing around quite a bit over the last few minutes but stopped just in time to take this uninteresting live shot now. highway 84, trust me, there's wind. you just can't see it. an iconic san francisco bar is hoping the city will save it from having to serve its last round for the very last time. golden dust lounge supporters will make their case in front of the city's commission to try and stay open. they want the bar designated a is a historic landmark. the business's owner say if they can't get special status they may take it to court. 5:11. back in the bay area and still showing his love for san francisco. ♪ i come home to you ♪ san francisco >> love it. tony bennett performing "i left my heart in san francisco" at the fairmont hotel last night.

the winner is -- malachi. the 4-year-old pekingese was named best in show at the westminster kennel club last night. there he is. it is the sixth time a pekingese has actually taken the top honor but it is the first time since 1990. malachi beat out more than 2,000 dogs and 185 different breeds. malachi getting the big star treatment and will appear on the "today" show at 7:00. what's next -- the sexy calendar for the dog and perhaps a reality show, his whole line of dog food. that's what happens when you make the big time. >> that is a lot of fur. that is a lot of brushing. i guarantee that dog will blog as well. it is a little slick out there. if you stayed out late on a romantic dinner, give yourself plenty of time and make sure are you alert before you hit the

highways. we did have some showers roll through earlier. at this point they are clearing out as quickly as they came in. just a quick shot of rain but enough to get your highways slick this morning. mostly cloudy conditions to start but sunshine by noon. we'll see windy conditions throughout the day especially in the bay hills. we've got a couple 30s out there. livermore you're at 39 degrees and fog in the interior valley sections of east and south bays this morning. as we head through the next 24 hours, we'll see a lot of clearing by the second half of the day today and temperatures in the mid 60s. let's get a check of your drive from mike. we'll look over to the roadwa roadways. we have a nice smooth flow of traffic. 101 kicks in right here. construction crews are moving out of the roadways so embarcadero road is not a problem, can you get on and off from 101. also 280 not a problem. the dumbo has an unexpected wind

advisory from the chp through the next several hours but not really an issue. south bay, southbound 17 heading down towards 85, some slowing. the issue is right here, southbound 85 on the 17 either direction. the transition ramp has been closed for construction. emergency road work going on possibly until 7:00 a.m. we may see some slowing but this is non-commute and too early for that for the south bay so we'll track this. following 880 up through oakland, passing the coliseum, see that camera shake just a tad bit. from time to time we do see the camera really jolt around. some winds are catching it through the east bay hills and across bridges again for the bay bridge, wind advisory as well. hold on tight because there might be slick roads as well. 5:17 right now. europe continues to dictate what

happens in the u.s. markets. for details on that and the rest of our news before the bell we turn to cnbc world headquarters this morning. good morning. >> reporter: good morning. stocks finished flat on tuesday, the dow up four to 12,878. nasdaq up slightly. the s&p down one point. futures are higher this morning at the market continues to monitor headlines out of europe. today investors are waiting the release of the latest fed minutes at 2:00 p.m. to see what federal reserve members said about quantitative easing. some hoping the fed will carry out more easing. we saw the asian markets higher overnight. european markets are mixed this morning. a tentative deal has been reached to preserve a cut in the payroll tax which has provided additional $20 pr week in americans' paychecks. in addition congressional negotiators struck a broader deal to extend unemployment

benefits and prevent largers cuts to doctors who accept medicare. a vote will most likely happen by friday. warren buffett add exposure to media companies according to berkshire hathaway's latest regulatory filing. they've added new position in liberty media as well and made a near $1 billion investment in direct tv raising its stake nearly five-fold in that company. berkshire also picked up additional shares of general dynamics and took a new stake in die a dialysis provider. reducing its stakes in johnson & johnson and kraft foods. new details this morning about recent vandalism at a richmond elementary school. police say it is not the first time vandals broke in to the school and the two most recent incidents appear to be linked. the campus was first struck over the martin luther king jr. holiday and then again on sunday. in both instances the initial d.j. were tagged there. there is a $20,000 reward for

any information from this. 5:19 right now. a popular summer attraction in the tri-valley area may never open again. "contra kcosta times" reports some water slides need major repair work and will be shut down until fixed. they need to meet safety codes and provide handicap access. earlier costs were placed at $200,000, all money the park does not have. families have been visiting the attraction for more than 20 years. 5:20 right now. coming up, five u.s. senators jumping in to try to keep raiders games from being blacked out. details next. plus, san jose's new plans for the city's medical marijuana clubs. is apple working on a little miniipad? we'll take a look coming up.

welcome back, everyone. live look outside. can you see how clear it is. we will check the forecast. 5:23 right now. good news for silver and black fans. raider nation might finally get to watch every home game on tv without the fear of it actually being blacked out. several u.s. senators have stepped up and called on the fcc to end that nfl policy of blacking out games which are not sold out. they say the rule unfairly hurts fans because a lot of those fans help pay for stadiums through tax dollars. the nfl says only a small handful of games are really blacked out each and every season and the three decades-old rule should not be removed. a change of plans in san jose as leaders vote to rescind the controversial pot ordinance. it would have reduced the number of pot clubs in the city from

more than 100 to just ten and would have forced operators to grow marijuana in-house. council members voted to set it aside and wait for state regulations. until then, the city will focus on pot clubs it has received complaints about or are not paying city taxes. the latest rumor says apple is serious about a smaller ipad. scott mcgrew, this has a lot of deeper meaning. >> it does, jon. steve jobs would have hated the idea. we're hearing serious talk about a smaller ipad as a serious product. if that's the case, this will be the first time apple has taken a serious step off the path set forth by jobs before he died. everything else apple is doing or rumored to be doing from u ipads to apple tv are continuations of the jobs plan. jobs once made fun of smaller tablets as too hard to use, saying those sorts of tablets should come with "sandpaper" so that users can sand down their fingers to one-quarter of the present size. he sometimes through us a head fake.

he once said ipods wouldn't have video and they did and he denied apple would rent movies and they do. meanwhile, san francisco-based zynga had its first profit report since becoming a public company. one thing missing was profits. for the first time the company lost money in the quarter. much of it was due to zynga making good on promises to employees. while the company didn't make any money a whole lot of bay area employees made money. zynga continues to try to find that next great game, laura and jon. you're only as good as the last good game and zynga is spending a lot of money trying to find the next one. >> when it hits, it hits big, too. still ahead -- an accused serial killer heads back to court. after the deadline pipeline explosion in san bruno comes word that pg&e is putting a cap on what it will pay. what does this mean for negotiations? i'm christie smith. i'll explain coming up. and we just finished up with

"today in the bay." good wednesday morning to you. thanks so much for joining us. 5:29 right now. i'm laura garcia-cannon. >> i'm jon kelley. let's start things off with meteorologist christina loren telling us what's going on outside with the weather. >> the rain we told you about yesterday? we're done with it already. temperatures are lore on the mild side as well looking toward a fantastic finish this wednesday. we've got more rain in the forecast. i'll show when you on your seven-day and we'll let you know what that means for the potential construction closure on the bay bridge. no major problems but like you said, weather and traffic go together. we'll get a live look out there at oakland. the coliseum camera was shaking. right on cue. it stopped again. it was shake being tremendously

over the last couple of minutes. san mateo bridge, live shot. traffic is moving smoothly. camera shakes here from time to time as well. an earlier wind advisory from chp. pg&e in that hot seat once again this morning. it says the $70 million is more than enough to rebuild the area in san bruno that their gas pipeline destroyed but the mayor and others are calling this one just a slap in the face to the victims of the deadly explosion. "today in the bay's" christie smith live in san bruno where the mayor will hold a press conference later this morning. >> reporter: good morning, jon. signs of construction and rebuilding are up and down the blocks here in san bruno.

pg&e is suggesting a real breakdown in negotiations between the city of san bruno and pg&e. the cap $170 million to the trust fund. san bruno's mayor is saying not so fast, that the utility is no longer acting in good faith with these negotiations. the natural gas explosion and fire in september of 2010 killed eight people and destroyed 38 homes. the mayor will speak on the restitution issue later this morning and a formal action between the city and the california public utilities commission. he's scheduled a press conference at city hall at 11:00 this morning. reporting live in san bruno, christie smith, "today in the bay." san francisco is filing suit over gas pipeline safety standards. the city attorney says the u.s. pipeline and hazardous material safety administration failed to

oversee a pipeline safety program for at least a decade. the suit cites three gas line explosions in california. san francisco wants the federal agency to better oversee the california public utilities commission. this is not a pretty picture. the number of human bones found in a property in san joaquin county now topping 1,000. searchers back today sifting through the dirt at an abandoned ranch near linden. they found another 700 bone fragments yesterday after digging up 300 over the weekend. investigators were led to the site by a death row inmate, 1 of 2 men known as the speed freak killers. he and one other are suspected in a series of killings back in the '80s and '90s. investigators have also tentatively identified the remains found in another location identify by him. they think one of the bodies is

a 25-year-old woman from clemens in san joaquin county. she disappeared in 1998. the other body appears to be a woman reported missing in 1985. we're learning more about the deal that persuaded him to reveal the location of those bodies. a bounty hunter leonard padilla telling the "contra costa times" saying he made a deal with the death row inmate for $33,000. $18,000 will go to the victims' families as resolution. the inmate wants the additional $15,000 to buy headstones for his parents' grave, a laptop computer, a television and spending money for the prison commissary. the state department of corrections has not commented on this deal. 5:33 right now. accused serial killer joseph naso is expected back in court today, asked to reenter a plea. he was accused of killing four northern california women between 1977 and 1994.

during today's hearing a judge is also expected to discuss whether he can continue to represent himself. two men accused of making illegal campaign contributions will be in court today, charged with illegally contributing to ed lee's campaign. the men allegedly told employees to each write a check for lee's campaign and they'd be reimbursed. about 23 employees reportedly contributed money and were then reimwith yourse reimbursed. lee's campaign returned the money after word of possible improprieties. that's because the contractor in charge of the new 49er stadium has very little time to waste. only has 30 minutes to complete team's new 68,500 seat state of the art stadium. just yesterday in a 5-1 vote the city council here in santa clara agreed to an $878 million contract to complete this project and they've said that we want to complete it in time for the start of the 2014 football season and to show the construction company how serious they are. they've negotiated stiff penalties into that contract that include daily fines for every day the project is past due up to $20 million. $6 million for each game that is missed. that's certainly quite an incentive. now the decision to approve this contract was not unanimous. one councilman voted against it because he is waiting on a decision from the court. a judge is supposed to rule on the legality of the referendum that initially approved this

no problems for 680 between those two markers and the southbound side completely clear this morning. we'll expect to see slowing off the wall maybe over the next hour or so because more cars are coming you this the area. we're seeing the 19 registering over l street slow from a to l and into the 20s, and into the 40s. a bay bridge toll plaza, just a few cars waiting in the cash lanes but the build is on the next 20 minutes we'll really see this change. then down to the south bay, 280 northbound through san jose approaching the 880-17 interchange. 5:38 right now. some good news for you here. will you not lose more money in your taxes on your next paycheck thanks to a new deal out of washington. details in a live report.

"today in the bay's" tracie potts is live in washington where lawmakers right now have struck a deal on how to pay for this year's payroll tax cut. good morning. >> reporter: good morning, everyone. looks like that extra 2% we got this month, last month and all of last year will continue through the end of this year at a cost of $100 billion. that was the sticking point here. republicans, conservative tea party republicans, wanted to make more cuts to pay for your payroll tax cut but in the end that did not happen. republican leaders here gave in and said they would add it to the debt as a result that money that you've been seeing that extra money that you've been seeing in your paycheck will remain. also part of this deal, unemployment benefits will continue but as republicans wanted, they're going to scale back a bit, not going as long as

99 weeks but 73 weeks. it's about half-way between what republicans and democrats wanted but they won't run out at the end of the month and neither will there be a cut in what doctors are paid for medicare. that's going to be prevented. it looks like the negotiators are ready to sign off on this possibly as early as today, john. maybe we'll see a vote by the end of the week. this has been a long drawn-out slugfest just to got it to this point. now that it is here, the question is what is president obama saying about this deal? >> he'll certainly sign it but he was a little skeptical yesterday when asked about it saying, you know how washington is, sort of indicating that things are fickle here on capitol hill and a deal negotiate behind closed doors with the negotiators may or may not hold up once it is voted on on the senate floor but he's certainly willing to sign it to see those benefits continue. >> i guess we shouldn't count on

anything until the signatures are actually dried on the paper. secretary of defense will get grilled by the house armed services committee today. leon panetta will be on capitol hill for another hearing on the president's proposed 2013 budget. he spoke to the senate yesterday. treasury secretary timothy geithner, homeland security secretary janet napolitano and transportation secretary ray lahood will also be on capitol hill to talk about the president's proposed budget. china's vice president is off to iowa this morning. it will not be his first visit to the farming community, he was there in 1985 to study american farming practices. today the chinese vice president will meet with his former host family and will have a little tea. that's with a we're being told. he's also expected to speak with chinese language students in that town. 5:44 right now. want to get a check of our forecast with meteorologist christina loren.

but was denied a loan from the guaranteed loan program. this caused such a controversy because of solyndra. more good news -- a recent report by treasury officials says that loan program probably cost about $3 billion total. that's far less than the $10 billion congress had set aside. now washington has driven a stake through new technology that would have brought you high-speed internet by satellite. the federal communications commission says the technology developed by life squared would have interfered with gps devices. this has been a debate for a while but this debate is effectively over and light squared loses. remember this guy? he's the former head of nbc universal. it was quite the reaction in the studio. the "wall street journal" says jeff zucker will be a candidate for a board position at yahoo!. this if one of yahoo!'s rebel investors gets his way. daniel lobe owns about 6% of yahoo! and that's enough for him to nominate several of his own men to the yahoo! board.
