"today in the bay." good morning to you. thanks so much for joining us on this wednesday morning. half-way through your work week. 6:01 right now. i'm laura garcia-cannon. >> good morning, everyone. i'm jon kelley. we start things off with meteorologist christina loren telling us about what looks like a dry now rest of our day? >> yeah, it is still a little slick in spots, especially construction zones this morning. south bay received the most moisture yesterday so that's where we're seeing the wettest conditions at this point. 45 in san jose. 43 in sunnyvale but, yes, that trend is drying. more rain on the way is your seven-day forecast and a holiday weekend just around the corner so we'll talk about that. first, let's get a check of your drive. >> still waiting word on the holiday closure for the bay bridge. right now it is open and we are

looking at a smooth flow of traffic on the lower deck but the upper deck, got word of a four-car accident somewhere around treasure island. it must be on the oakland side because from the san francisco side we see a clear flow of traffic. it doesn't like like the flow has been interrupted over the last few minutes but we'll hopefully hear lanes cleared. winds gusty at times over the bridges. hold on tight, guys. you might get caught. >> thank you very much, mike. the search for more human remains expected to resume some time this morning in the town of linden just outside of stockton. so far, here's the deal. investigators have unearthed hundreds of bone fragments believed to have belonged to the victims of the infamous speed freak killers. "today in the bay's" marla tellez has more on where investigators will focus the search today. >> good morning. san joaquin county investigators are bracing themselves for another dig that could yield hundreds more human bones and

fragments. today they are expected to turn their attention to a second well where officials believe more victims are buried. so far searchers have unconferred more than 1,000 bone fragments in a well at the mass grave near stockton. the site was revealed by one of the so-called speed freak killers, wesley shermantine, who is currently sitting on death row. he actually gave investigators a map of the area. the bounty hunter working on this case says there could be as many as 30 bodies buried here. >> i think the other well holds even more than that. it is going to be a situation where it is going to be big time. >> investigators say some of the remains belong to 16-year-old chevy wheeler who disappeared in 1985 and 25-year-old woman missing since 1998. the infamous duo managed a two decade long killing spree which ended with their arrest in 1999.

investigators have also been digging up clothes, shoes, even some jewelry. again, they will resume their dig at that second well today. they say they could be out there for weeks. >> thank you, marla. eight deaths, 35 homes destroyed. this morning pg&e says $70 million is enough to fix it all. pg&e is setting a cap on the amount it will pay to rebuild the area leveled by that exploding pipeline. good morning. >> reporter: good morning to you, laura. the signs of rebuilding are up and down the block after the neighborhood was completely devastated here in 201037 but how much is enough? the city of san bruno and pg&e have been in negotiations trying to figure out how much would be needed restitution to pay for it all. but now pg&e is putting a cap on how much it will pay for the physical construction. that cap being about $70 million and the trust fund so far we're

told has about $12 million. this is to go toward rebuilding san bruno after the natural gas pipeline explosion that killed eight people and leveled 38 homes and damaged dozens of others. san bruno's mayor is saying not so fast, that the utility in his opinion is no longer acting in good faith. this comes as the city of san francisco filed a lawsuit against a federal agency claiming that it failed to enforce safety standards for ten years before the explosion. city attorney dennis herrera said regulators were asleep at the switch or too cozy with the industry all together. the mayor is expected to speak on this at san bruno city hall at 11:00 this morning. live in san bruno, i'm christie smith, "today in the bay." san francisco is filing suit over pipeline safety standards.

saying pipeline safety programs were not overseen for nearly a decade, including the one in san bruno. san francisco wants the federal agency to better oversee the california public utilities commission. the chief probation officer in alameda county is now on administrative leave this morning amid sexual assault and harassment allegations. the oakland tribute says david mohammed'sing investigated by the state attorney general's office. the accusations are coming from a deputy probation officer. mohammed says these allegations are outrageous and he will cooperate with the investigation. two fremont police officers now facing dui charges this morning. officer paul singleton was stopped two weeks ago for speeding and taken into custody after failing a field sobriety test. then this past weekend officer william johnson was also stopped for speeding and weaving in lanes. the mayor says the behavior is unacceptable. >> any episode of drunken driving is unacceptable by

anybody. it's even more unacceptable when it is our police officers who enforce the law. >> both dui cases have been forwarded to the alameda county district attorney's office for their review. a change of plans for san jose's controversial new pot club law. city council has voted to rescind the measure that reduces the number of pot clubs more than 100 to just ten. council members have decided to back off and wait for state regulations. until then, the city says it will focus on the pot clubs it has complaints against and has tax violations. 6:07 right now. groundbreaking for the 49ers. brand-new stadium is on the fast track and could happen in a few months. "today in the bay's" bob redell joins us live from santa clara with the latest on all the proposed construction. good morning, bob. >> reporter: good morning, jon. the 49ers could have just two more seasons, only two more seasons left, at the stick. the city of santa clara has just approved a contract with a construction company to have this team's new stadium built

here in this lot next to great america in just 30 months in time for the start of the 2014 football season. this is much sooner than what was expected. in a 5-1 vote the council agreed to the $878 million contract with turner construction to build a new 68,500 seat stadium to help ensure that turner meets the 2014 deadline, the city has negotiated stiff penalties under the contract that include daily fines for every day the project is past due. >> up to $20 million if they are delayed. $6 million for each game. it is a rather substantial incentive to get this thing done on time because we want to be playing football in santa clara in 2014. >> reporter: the decision was not unanimous. one councilman voted against because he's waiting on a decision from the court. some voters have challenged the

decision argue rg the city misled them how much taxpayers would be on the hook for this roughly $1 billion project. live here in santa clara, bob redell, "today in the bay." 6:08 right now. let's check in again with meteorologist christina loren. kind of dry right now but expect more rain to come. >> your highways are still slick this morning so give yourself plenty of time to reach your destination safely. but you can see from this live look, we are nice and dry right now. what's left of the weak disturbance now wasting into the sierra, nevada bringing a little dusting of snow to the higher elevations of mammoth but it is really falling apart, losing momentum. after that as high pressure builds back in, we've got some pretty strong wind gusts from time to time so i've seen these numbers creep up to about 30 miles per hour at times. you want to take it easy especially over your bridges this morning. if you drive a high-profile vehicle and of course through the higher elevation of the east bay.

as you can see by noon today we'll be in the mid 50s. not just inland but by the water as well. then at 4:00 p.m. we're talking 60s inland. 6 degrees there. 58 by the bay and at the coast, 58 degrees. we'll talk about when rain is expected to return, how much we're expecting, what that means for the sierra nevada. that's all in my next report. 6:10. first let's check the drive. this is an accident right in the heart of where things are startsing to slow already at this time, 6:10 in the morning. slowing traffic as we have an accident involving two vehicles but blocking a couple of lanes there. bad news for the livermore commute heading into dublin and pleasanton. already 20 minutes and further slowing coming up toward the 84 cut through in the isabelle exchange. slowing already out of the altamont pass compressing down towards vasco. lighter though through castro valley until that accident clears. upper neck as well we have an

welcome back, everyone. good wednesday morning to you. 6:13 right now. san mateo county nursing home that's served the community for nearly 50 years will shut its doors. it's an update to a story we told you about yesterday. the burlingame long-term care facility's home to more than 200 patients. in spite of tearful appeals, the county board of supervisors voted to close it saying the building needs too many expensive repairs and upgrades to remain open. the county will find new facilities for those tenants and hopefully new jobs for the staff before that closure is complete by the summer of next year. students at a concord high school finally getting a break. specifically, a bathroom break. the school principal has decided to re-open the lock bathrooms in mount diablo high school according to the "contra costa times." only two boys and two girls rest rooms were open during class times, far fewer than the state required for the number of

students there. the facility had been locked up because of repeated vandalism. 6:14 right now. an iconic san francisco bar is hoping the city will save it from having to serve its last round. gold dust lounge supporters will make its case today in front of the city commission to save the site. it's hoping the bar will be designated a historic landmark. the building's landlord is kicking the lounge out to make way for a new tenant. owners say if the historic appeal fails, they may take it to court. 6:15. we want to get the weather. >> we actually have weather to talk about this week and it doesn't just mean today. we actually have weather all the way throughout your holiday weekend. stay tuned for that seven-day forecast. let's start with what's happening out there as we speak. we have current conditions of winds, breezy to windy conditions out there right now. the oracle arena, this camera has a bit of a shake to it. this camera is actually poised in the higher elevations where you have less friction. that's why it is moving around so much.

even right at the surface this morning we are clocking some pretty significant wind gusts up to 30 miles per hour at times. as we head throughout the day today, right now fairfield has a 20-mile-per-hour wind gust. we'll see nice conditions, the sun will be out, a lot of clearing by mid morning. then this afternoon, staying nice and mild. it's actually nudged your temperatures up from yesterday's highs. yesterday was just gorgeous for valentine's day. 65 in san jose today. 60 in milpitas. east bay, 64 dublin, 57 in blackhawk. mild in places like san francisco and pacifica today with the upper 50s. things start to get a little dicey as we head into this weekend. our next best chance for rain will be sunday and it looks like areas north of the golden gate bridge have the best chance of seeing that action. now sunday into monday we get a stronger round of rain. whether or not it is enough to continue the construction closure on the bay bridge, hopefully we'll have an answer

by our 11:00 a.m. broadcast. >> still awaiting word from caltran. folks, in livermore we still have an accident, westbound 580 and airway. only one lane remains blocked now, the other three are cleared from the earlier injury accident. the fast lane is blocked but that's compressing all the traffic approaching. still 25 minutes. you catch a break anywhere west of airway heading towards 680. hopefully the last of those lanes should be cleared in the next 15 to 20 minutes. the south bay moving smoothly but we'll see slowing northbound 101 north of tully. bottom of your screen, southbound 85 to 17, the transition ramp is closed. possibly for another hour as they have emergency repair work that continued from yesterday. they had to reclose it this morning. that's opposite your main commute. winchester and the lark alternates. that's your way around it. no problems here this upper

grammys on sunday will perform at the fund-raiser. it will be the ninth visit the president has made to los angeles since winning office in 2008. after visiting l.a., the president will continue campaigning north to the bay area tomorrow. he is making a re-election campaign fund-raising swing through san francisco. mr. obama will hold an event at the nob hill masonic center. students say they rex sited about having a chance to shake the president's hand. some have real concerns to share. >> hopefully he says he'll fix our education system out here in california. because education system out here is -- is kind of screwed up. it's broke. >> try to help the homeless, provide them with more opportunities for them to try to get themselves together. >> tickets for the obama victory fund 2012 event range from $100 to $10,000. 6:19 right now. b.a.r.t. changing things up in

its police department. officers will now be assigned to focus on five patrol zones in the east bay, south bay and in san francisco. a team of officers will now provide 24/7 service to those specific zones. goal is for officers to develop relationships with the passengers instead of just responding to crimes. tension between b.a.r.t. police and riders has been high in recent years after two fatal shootings on b.a.r.t. platforms. it will soon be harder to light up in another south bay city. mountain view's city council last night voted to ban smoking within 25 feet of outdoor patios, windows an doorways. they also made it illegal to light up in public parks. those new rules will take effect in 90 days. the time now is 6:20. coming up, valentine's day gone wild. find out why one couple's celebration of the big day landed them in jail next. geez! >> i can't top that! i'll have some nebusiew nt ss and business news but i'll stick around for that.

mylar balloon is responsible for putting at least 15,000 people in the dark. in oregon, police say a couple took valentine's day way too far. it started when people at a grocery store spotted a woman naked, tied up with duct tape over her mouth in the back of a car. the driver of the car told them they were just having fun. they still called police and when officers caught up with the couple and freed the woman, she also told them it was all part of some valentine's day role playing. police arrested them for disorderly conduct. let's move on. the latest rumor says apple is serious about a smaller ipad. >> this has actual deep meaning. steve jobs would have hated this idea. yet we are hearing serious talk about a serious product, a smaller ipad. here's an approximatation of what it might look like. if a small ipad is real, this would be the first time that

apple's taken a serious step off the path set for it by steve jobs before he died. in fact, jobs dismissed smaller tablets as too hard to use saying those sorts of tablets should come with sandpaper so users can file down their fingers to around a quarter their present size. now steve jobs sometimes said one thing, then did another just to throw off the competition. he once said that ipods wouldn't have video. they do. he denied apple would rent movies and it does. sony says it's sorry for raising prices on whitney houston's "best of" album the day after she died. the company says it was a mistake. the price hike was the most visible in england where the price jumped by several pounds. sony says the price was raised at wholesale that set off automatic price increased on itunes. the dow industrials will go either up or down probably. there will be some trading of some sort and that's pretty much all i could think of.

had some showers roll through the bay area. you'll likely encounter slick conditions on your way out that front door. you saw from your live picture it is clear as a bell this morning at the coast. and cold. grab the jack but leave the umbrella at home. we'll dry out for friday, then more rain just in time for presidents' day weekend but i'll help you plan around those showers. it is not the slick roads that are causing most of the problem, it is the debris in the roadway left over after an earlier accident involving two weeks. tow trucks have to make their way through slow traffic at airway boulevard. debris across the roadway slowing traffic. 38 minutes out of the altamont pass. getting a break closer to the dublin interchange. live look at the bay bridge as well, the toll plaza has an early back-up because of an earlier accident on the upper deck. i'll give you the latest status coming up. eight people dead and dozens

of homes destroyed. this morning pg&e says it should only have to pay $70 million in compensation. "today in the bay's" christie smith is live in san bruno where few people agree with this. good morning, christie. >> reporter: good morning. there are signs of rebuilding all over the neighborhood but really this neighborhood was absolutely devastated by that natural gas line explosion. since then, the city of san bruno and pg&e have been negotiating a restitution settlement to help rebuild but now there are reports that pg&e is setting up a fund that would max out at about $70 million to help rebuild san bruno. the natural gas line explosion killed eight people and leveled 38 homes, damaged dozens of others in september of 2010. san bruno's mayor is expected to speak on this development of a cap today with a significant announcement on these negotiations. i just got off the phone with a representative from pg&e who told me that he would look into

it but he said he wasn't even aware of this development or the press conference that is set for 11:00 this morning at city hall here in san bruno. live in san bruno, christie smith, "today in the bay." the number of human bones found on a property in san joaquin county is now topping 1,000. searchers will be back today sifting through dirt at an abandoned ranch near linden. they found another 700 bone fragments yesterday after digging up some 300 over the weekend. investigators were led to the site by a death row inmate who was 1 of 2 men known as the speed freak killers. the two are suspected in a series of killings in the '80s an '90s. searchers have also tentatively identified remains in calaveras county. they think it is this woman. she disappeared back in 1998. the other body appeals to be

chevy wheeler reported missing in 1995. this salesman accused of killing four northern california women between 1977 and 1994. during today's hearing the judge will discuss whether he it continue to represent himself. details this morning about recent vandalism at a richmond elementary school. police say it's happened twice since martin luther king weekend. nystrom elementary has been damaged with the initials d.j. tagged there. opening day for the 49ers' new stadium in the south bay could come sooner than originally expected. parking lot next to great america right here me, laura. that's because the contractor had charge of the 49ers' new stadium has very little time to wait. only 30 minutes to complete the team's new 68,500 seat stadium. supposed to be finished in time for the start of the 2014 football season. it is much sooner than what was expected. in a 5-1 vote the city council just agreed to an $878 million contract with turner construction to build the new stadium and to help prod them along to make sure they meet that deadline, the city has negotiated stiff penalties into the contract, penalties that include daily fines for every day the project is past due up to $20 million, $6 million for each game that is missed. the decision to approve this contract, as you might have realized, was not unanimous. one councilman voted against it because he's waiting on a decision from the courts. a judge is supposed to rule on

the legality of the referendum that initially approved this deal. some voters have challenged that the city misled them as to how much taxpayers would be on the hook for this deal, this project that is in the neighborhood of $1 billion. reporting live here in santa clara, bob redell, "today in the ba bay". good news for raider nation. fans may finally get to watch every home game on tv without the fear of the thing being blacked out. a long list of u.s. senators calling on the fcc to end the nfl policy of blacking out games which are not sold out. they say the rule unfairly hurts the same fans who actually help pay for stadiums through their taxes. the nfl says only a small handful of games are blacked out each season and the three decades-old rule should not be removed. 6:35 right now. time to check that forecast with meteorologist christina loren. we woke up to some rain. >> we did have some rain at this point. your radar is nice and dry. let's take you outside to this spectacular sunrise over the city by the bay.

"today in the bay's" tracie potts is live in washington to tell all. good morning, tracie. >> good morning, everyone. some cities in the bay area way up near the top, others not so much. we'll show you that in just a moment. first of all, cyber crime really involves millions of victims and billions of dollars every single year. money that you lose, money that companies lose as a result of online criminals ripping you off. the average victim loses $128 per incident and this tends to happen in the areas where there are more use of smartphones and wi-fi, more use, more cyber crime. the riskiest cities they found have high computer use, smartphone use an social media as well as wi-fi. now, in terms of security, what can you do? update your software and, by the way, i should mention that this report today, this new report, comes from norton, the folks who make the antivirus software. you also want to make sure you have complex passwords and use secure websites. now, in terms of where the bay

welcome back, everyone. it is 6:44 right now. there were some sprinkles very early this morning. roads very wet but locks like we're dry the rest of the day. we picked up the most moisture in the south bay so it is still a little slick from campbell, san jose, santa clara. but we are starting to dry out. take a look at this beautiful sunrise over the city by the bay. the sun is now out in full force and it's not only going to help to dry out those high waisz, it will warm up us quickly. a lot of sunshine. it is going to take a little while for this cold air to mix out, temperatures running on the cool side. by noon today we'll be in the mid 50s at the coast and inland so we're going to climb rapidly under full sunshine. as we head throughout the day today, temperatures will be on the mild side right at the coast but we'll be four or five degrees warmer than where we ended up yesterday.

we'll get clearing early. already clearing at the coast. still little patches of clouds over your inland cities. by this afternoon, a mostly sunny finish. we'll stay nice and mild. another gorgeous day for outdoor activities. you can open up the windows, let that clean air in. by noon today you will you's get a clear view of the san francisco marina. 55 degrees. bring a jacket but great viewing of all those sailboats out on the water for today. it will be a little bit choppy on the bay with some winds out there. that's the big factor when it comes to the weather department today. a little bit breezy to windy throughout the east bay hills, your higher elevations and over your local bridges. as we head throughout the east bay, temperatures climbing into the mid 60s in concord, 65. 62 in san rafael. 58 in san francisco. right on par with your seasonal average. as we head through friday we continue your warm-up. clouds increase saturday, we get a few showers sunday. i think we'll see more moisture come through the bay area on monday, presidents' day.

dublin interchange as well. over here as you make your merge on to southbound 880, this their is an accident just past the flyover. that may add to the congestion. you're okay for southbound 880 though heading down in towards fremont out of hayward and san leandro. northbound routes look okay in san jose. we have an accident northbound 87 that's just clearing from the alameda area so that should cause more slowing there as well. guys, back to you. 6:48 right now. eight people dead, dozens of homes destroyed. this morning pg&e says it should only have to pay $70 million in compensation. between pg&e and the city of san bruno over restitution that pg&e would be paying. well, now comes word that those negotiations have started after the natural gas pipeline explosion aren't going well at all. eight people were killed, 38 homes destroyed in september of 2010. there are reports that pg&e is setting a $70 million cap on what it will pay for the physical construction. mayor j the mayor has other plans though. he'll speak at a press conference at 11:00 this morning. i called pg&e where i spoke with a representative who said he didn't know anything about this press conference at all and would look into it and get back to you. live in san bruno, christie smith, "today in the bay." vallejo police this morning still searching for suspects in a shoot-out that sent five people, including a little girl, to the hospital. three gunmen opened fire inside tina's nail salon monday. that led to a shoot-out that wounded three customers. police suspect one of the customers, a 27-year-old woman, was actually the target there.

a man who showed up later at the hospital with gunshot wounds remains in custody. but police are still searching for two others. a little girl right now remains in stable condition about her grandmother who was also wounded right now is fighting for her life. antioch city leaders say something just needs to be done, anything, in the wake of recent deadly violence. the mayor there calling for an urgent town hall meeting next week to try and talk about the problem and maybe figure out some solutions. his comments coming just a day after homeowners -- a homeowner shot and killed a burglar during a home invasion robbery attempt on monday. police say the intruder rang the doorbell and when no one answered kicked the door in armed with a gun. the homeowner happened to be inside and wrestled the gun away and shot the man several times. police also arrested a woman outside the home and are right now looking for a third suspect. the mayor says beefing up neighborhood watch programs and putting more police out on the streets are ideas that need to be discussed.

6:50. two men accused of making illegal campaign contributions will be in court today. jason perez and hanan khatami will be charged with illegally contributing to san francisco mayor ed lee's campaign. the men allegedly told company employees to write checks for $500 to lee's campaign. about 23 employees reportedly made those donations, and then were reimbursed. lee's campaign returned the money after it learned of the alleged improprieties. plans could build that 49ers new stadium are moving faster than expected. "today in the bay's" bob redell joins us live from santa clara with an update on all the upcoming construction. good morning, bob. >> reporter: good morning to you, jon. this means that the 49ers could have just only two more seasons at the stick. the city of santa clara just approved a contract with a construction company to build that new stadium for the team in this parking lot next to great america right behind me in just 30 months, in time for the 2014

football season. this is much sooner than was expected. in a 5-1 vote the council agreed to the $878 million contract with the construction company to build the new 68,500 seat stadium. to help ensure they meet the deadline, the city has negotiated stiff penalties into the contract that include daily fines for every day the project is past due. >> up to $20 million if they are delayed, $6 million for each game. it is a rather substantial incentive to get this thing done on time because we want to be playing football in santa clara in 2014. >> reporter: the decision to approve this contract was not unanimous. one councilman voted against it because he is waiting on a decision from the court. a judge is supposed to rule on the regalegality that originall

allowed the project. new this morning -- we're getting our first look at the scene of a massive fire that's left hundreds dead at a prison in honduras. "today in the bay's" marla tellez joins us with the latest. >> reporter: almost 300 inmates are dead and many are still missing. it all happened overnight at a prison about 90 miles north of the honduran capital. a fire ripped through the facility that housed about 800 inmates in all. the associated press just releasing these photos from the scene. an inmate here being rushed to the hospital. dozens more seen standing around in a courtyard. fire officials described the scene as hellish. as for the cause, some reports point at rioting prisoners. others say it was an electrical short-circuit that sparked the flames. in syria now, take a look at this oil pipeline explosion. this is new amateur video in to our newsroom out of homs -- actually, this is not the

correct video but i can tell you, thick black smoke was seen billowing into a nearby residential area in homs. it is a burning pipeline, shelled as part of braze shar al asad. this morning assad is calling for a new referendum that could bring a new constitution. in iran this morning, president mahmoud ahmadinejad is delivering on his promise to reveal new nuclear projects today. officials say the country has inserted the first iranian made nuclear fuel rod into its research reactor near tehran. rain yan state tv reports this is proof of that country's skill, expertise and nuclear development. meanwhile we are learning iran, upset about tough western sanctions, has just decided to cut oil exports to six european countries. laura and jon? >> marla, thank you. 6:54. the "today" show is coming up next. matt lauer is here to show us what they are working on this
