and this weather mother nature is in the groove. >> yeah, she's got her groove thing going. we're looking good for today. temperatures are going to end up in the 70s. and it's not too cold out there right now. the micro climates are kicking in. 53 in san francisco. and just about everywhere talking about temperatures 10 degrees above average for this time of year. still winter and we stay warm, almost all week long. we'll take you through the forecast. let's check your drive with mike inouye. >> back out to the san mateo bridge. we'll show you the map, we have the eastbound direction, reports of an accident. it's tough to make out the icon there. we do have no slowing approaching off of that high rise through the flat section. on the flat section we were looking from our camera which is unavailable right now bt but maybe we can bring it up. there you go. on the left, some dim lights there, still looks like a

disabled vehicle. watch it as you approach. looks like a disabled vehicle blocking the shoulder area. >> mike, thanks. it is 5:01 now. new this morning a new twist to a gruesome san juan county search. a convicted serial killer revealed the location of a third burial site. wesley shermantine has been leading police to victims of his 15-year crime spree with partner loren herzog. more than 1,000 bones have been recovered from an abandoned well in linden. investigators were searching for a second site identified by shermantine when he revealed a third site sunday. he says herzog dumped another body there, not far from the other sites. no word on when or if investigators will search for it. >> in hayward police now searching for a domestic violence suspect who was accidentally released after a psychiatric evaluation. jose hernandez was arrested at

his ex-girlfriend's home saturday night. during a confrontation with police he slit his own throat, then stabbed himself. he was taken to the hospital for a psychiatric evaluation, but he was released by accident there. hernandez is about 5'8", 150 pounds and has lots of bandages and a suture around his neck. if you see him you are asked to call police. >> students at one high school will return from a long weekend but one classroom will be closed. it became the target of vandals who covered it with hateful and obscene messages, so offensive we can't show many of them. bob redell is live at mount pleasant high where crews worked to cover up the graffiti. good morning. >> reporter: good morning. yes, it's our understanding that graffiti has been wiped off and painted over, but mount pleasant high is still trying to find out who was responsible for tagging one of its classrooms with hate messages.

you can see in this video from inside the room that someone used a black marker to scrawl several swastikas, references to hitler and racial slurs on the door and walls. the schools have allowed students to write good-bye messages on the wall. but they never meant for it to be taken this far. >> our community for how we uphold the dignity of every culture and every person, so all of this vandalism, we washed it away almost immediately. >> reporter: this took place on friday. the district says that if a student was behind this he or she could be suspended or expelled. a non-student will have to deal with sjpd. bob redell, "today in the bay." >> tonight the oakland city council considering the high price of keeping the police department from falling under federal control. the department has been under the watch of federal monitors since 2003, part of a settlement in a high profile police abuse

case. now the work load has increased for the monitors after a judge ruled the department has not implemented required reforms and threatened a federal takeover. the council will vote on a $100,000 pay raise for the monitoring team f. approved it would bring their two-year contract to $1.8 million. >> the search continues for a robbery suspect in oakland who managed to get away when his alleged accomplice was shot by officers. just before midnight sunday police stopped a car on 62nd avenue as part after robbery investigation. the passenger allegedly ran and one of the officers shot him saying he saw a gun. the other suspect got away. the officer is now on administrative leave pending an investigation. >> 5:05 now. the mother of a berkeley man accused of beating a 67-year-old man to death says her son is the product of a broken mental

health care system. the mother of daniel jordan dewitt claims he suffers from paranoia, schizophrenia and wasn't properly treated in a hospital. saturday night say dewitt attacked a homeowner. the police response time is also being questioned since officers weren't immediately dispatched to the call of an intruder at the house because they were delayed with the occupy protesters. >> investigators say they do not think alcohol played a part in a deadly accident on highway 101 in san jose. this is an update to breaking news yesterday. the chp says the driver was going too fast when his suv rolled on the capitol expressway off ramp. the pavement was wet from rain. the man who died was ejected from the vehicle. police say neither he nor any of the eight people in the suv yesterday were wearing seat belts. two other passengers suffered

major injuries. >> gas prices accelerating quickly now. it's going too cost more than $4 a gallon on average. christie smith live in oakland now. she has the answer of why we won't see the price tag come down soon. good morning. >> reporter: good morning. it's not the $4 a gallon that has people upset. that's upsetting them but it's also how fast the prices have shot up. this is a popular station because it's under 4 bucks a gallon. but around the corner at the shell station it's 4:05. it's in line with bay area gas prices for oakland, san jose and san francisco. between 4.03 and 4.08. energy experts have a couple of reasons. political issues in the middle east, refineries closing down and demand is going up. one commuter said he keeps tabs

on his spending and his jaw is dropping. >> well, a little bit crazy. i mean i just locked in my gas now, two weeks ago was paying 24 cents less. right now it's not even a holiday -- it's past the holiday weekend. it's like i mean, just crazy. >> reporter: this should make you feel good about what you're paying. check this out. it's posed by one of my facebook friends talking about getting a second job to pay for all of the gas. experts think that it will keep going up but probably won't hit five bucks a gallon. california is on the high end. on the low end, wyoming where it's $3 a gallon. reporting live in oakland, christie smith. >> the palo alto council is expected to approve a plan to share police dispatch services. palo alto, mountain view and the

police departments will purchase a dispatch system and share it along with record management systems. the city leaders say it should cut cost and improve response times. the council approved the plan last month. >> a simple solution or just too much power? these palo alto city council expected to appoint police chief ron davis as interim city manager. he served as chief of police for seven years. he hasn't said if he plans to resign and apply for the job. he is the current city mager is retiring the beginning of march. >> good morning to you. we want to check in with christina. >> at this time yesterday we were tracking those showers, dense fog. we have a little bit of fog in the north bay and the east bay. but overall starting out mostly

clear. a pretty steady breeze out of the northeast as high pressure has set up. throughout the day as a result your temperatures are going to climb quickly about about noon. talking about the 60s. so tuesday through thursday we continue this trend. 60s and 70s. sunny and breezy to windy throughout the east bay. and the northbound mountains so you want to keep that in mind. it will be a little on the gusty side all the way through thursday. for today at noon, 62 degrees inland. about 60 degrees in the city. and 59 in places like pacifica. still holding on to the mid-60s, temperatures are going to climb as we hit peak warmth at 3:00 p.m. most are at work but i'll let you know how warm and if you might be breaking a weather. let's check your drive with mike inouye. >> good morning. we'll take you out to the peninsula side south of san francisco out of the area,

southbound 280 at san jose avenue. reports of an accident. i showed you some slowing both directions showing slowing over the last 15 minutes. now directs clearing. the accident looks like all activity moving off to the shoulder and most off to the freeway. no slowing here. a live look outside. see how things are gaping up. the taillights pass, southbound with the headlights down to the san mateo bridge. further south, 880 crosses the middle of the screen the back bar approaches with the headlights. you see a steady flow but a light volume. to the south bay in another report, there is an issue might be is power lines. i'll give you that heads up coming up. >> thank you. the streets are filling up in new orleans, why, well t city is jumping into the final day of mardi gras season. the french warter gearing up for

>> we have a big time warm-up considering it's still the heart of winter. good morning. we're talking about the 70s, by tomorrow even warmer. and we just keep on climbing as we head into your work week. 5:15 now. you can see the fog trying to develop over the golden gate bridge. really not getting an opportunity to do so because we've got pretty strong winds, and the ingredients for fog formation, calm winds and clear skies. the wind is helping us out. we could pick up moisture. 44 degrees in oakland. 41 in livermore. and 50 in san jose. a big time warm-up as high pressure is over the great basin. bringing our temperatures into the low 70s inland and the mid-60s even right by the water. so, this is what we're expecting today. highs in the 70s. we're forecasting records in places like santa rosa, napa likely will touch on a record, even livermore throughout this afternoon.

hasn't seen since 2008. investors are breathing a sigh of relief as european leaders reached a deal on a second bailout after 13 hours of talk. the package may help greece for now. there is no economic data in the u.s. but we get reports on home sales and consumer sentiment. reactions to that have been mixed. the dow rose 45 points on friday to 12,949. microsoft is in talks with a major record company to create a new music service for the xbox and upcoming version of windows phone but it's unclear how much it would differ from the zoo music path. p. diddy is taking on mtv. it could launch this year.

>> welcome back. police on the hunt for graffiti vandals who struck several times over the weekend. officers found graffiti in 32 separate locations at kennel worth junior high and at a home and six homes on the east side. anybody with information is asked to call petaluma police. >> apology for an overcharge in a peninsula city. they plan to send letters to residents in san carlos. the trash hauler says it added 10% to the latest bill instead of the 5% that was recently approved by the city. the letter will explain the error and inform customers they will receive a credit on their next garbage bill. >> an exclusive, a tour of the controversial apple factories in china. scott mcgrew joins us. lots of reporters wanted into those plants. >> some chinese newspapers have gotten inside.

that's how we heard of the suicides. and chinese television got close after a plant exploded, killing three people. but this will be the first time a major tour of the plant will be conducted by an american news crew. abc will feature the show tonight on its nightline program. there is some fuss over this because abc is so closely related to apple. the ceo of disney, abc's owner, sits on apple's board. the ceo of -- steve jobs, the largest shareholder sat on the board as well. in a blog posting abc writes that there are one of four possibilities why he got chose tune go inside. one, he says, i said nice things about apple on air. two, abc's owned by disney and bob iger sits on the board. the steve jobs trust is disney's largest share holder or four t amle enjoys nightline.

it doesn't matter why abc was chosen because he will write the story the way he sees fit but it's history in the making. deadlines set by congress for the white house to hand over all of the solyndra documents expires today. the white house did turn over a number of documents over the weekend. some of the same politicians from the house committee have sent a letter to the federal trade commission asking it to launch an investigation into google's privacy practices. washington has been taking a strong interest after a series of missteps by several companies. it's like they are caring washington to crack down. >> thanks. 5:26. still ahead new details on the search for the freed freak killers. >> a building about to go up for sale. all the details up next. >> and we've got a nice warming trend before showers move back

details are still being worked out but eu leaders say they know greece needs the package to avoid a devastating default next month. business and tech reporter scott mcgrew is in the newsroom. why should americans care? >> saving greece at least temporarily saves europe and europe is america's largest trading partner. california alone, we sell europe five times as much stuff as we do to latin america. any one involved in making something in america should be relieved to see these pictures of european officials after they stayed up all night working out a deal. it's temporary, greece has major problems ahead but today's bail-out means degrees will make its latest debt payment and avoid default. wall street will get back to work. we're under 13,000 on the dow. and the good news could be enough to push the industrials

"today in the bay's" christie smith is live with the reasons why there is no end in sight. good morning. >> reporter: good morning. it's not even that easy to get into this gas station. hagenburger road is under construction, there are fences along the road but people are making their pay in. it's under $4 a gallon. around at the shell station the price is more in line with what you're likely to find. prices are up about 40 cents from a year ago. analysts are looking at a couple of things.
