golden gate bridge on this wednesday, february 22nd. this is today in the bay. good morning to you and thanks so much for joining us. 5:00 right now. i'm laura garcia-cannon. >> good morning, everyone. i'm jon kelley. we check in with meteorologist christina loren and find out on this day after fat tuesday, miss loren bearing gifts. she comes just making our day. >> yeah. it is not one of those days where you need the extra time due to weather to get to work because a lot of you did celebrate fat tuesday. you know what? we don't have any fog to report at this point. we are looking nice and clear all across the bay area courtesy of offshore flow. take a look at your temperature. 47 in san jose. 46 in oakland and 46 in concord as we head throughout the day today, easily hitting the mid 70s. i'm let you know how warm it will be in your city and when rain comes back into the mix.

with a look at the golden gate bridge camera shows you a very clear view of those lights across the bridge. also we cannot see those lights we had earlier. about a half-an-hour ago there was a lane being blocked northbound side. that right lane has cleared, smooth flow now northbound out of the city and up toward the marin side. another look at the other bridge getting into the city. the bay bridge, a smooth drive as well. no problems at the toll plaza. we are hearing about a transformer fire just off highway 101 in san francisco. i'll get more details on the location and let you know if that affects your drive. could be a big issue. 5:01 right now. another major stadium project could get the green light today in the south bay. the san jose earthquakes want to build it right near the airport. but "today in the bay's" bob redell is live with why some neighbors are saying, not so fast, quakes. good morning, bob. >> reporter: good morning to you, jon. you might recall that in december the san jose planning department gave the quakes permission to build a new stadium, a $60 million, 18,000-seat stadium right next to their training facility here

on coleman just across from the airport. well, then a resident who lives nearby appealed that decision saying the team has not adequately addressed neighbors' concerns about the bright stadium lights and the noise from the crowds. well, tonight the planning commission will consider this appeal. we've got san jose earthquakes' president here. good morning to you. >> morning. great to be here. >> reporter: what do you say in return to their concern about the bright lights and noise? >> we think we have a great plan for the stadium that addresses the community's concerns about noise and sound and also lights, while also giving our fans an ability to really cheer and root for the quakes. >> they wanted a dome. they also wanted you to do something else. you said it was financially prohibitive. what's the middle ground though to address their concerns if they live somewhere in that distance? >> some of the key things that we've done is we're not including concerts in the original permit and that was one of the few things in the environmental impact report that had a discernible impact. other thing is we banned

vuvuzelas, the loud noisemakers. we banned those at our current stadium and at the new stadium as well. >> staff has recommended you do get the permit. that means you would start work tomorrow -- not groundbreaking but moving ahead, 18,000 seats. do we have enough fans in the bay area to fill a stadium for socker? >> i think so. at that size, we had a gram last year at stanford, we had 41,000. i think 18,000 is a great size for us. >> best of luck to you. how you feeling about the season? >> feeling good. we'll have a great season. we open on march 10th and hopefully get our first win. >> thank you again. appreciate you getting up early. that meeting tonight with the san jose planning commission to decide the fate or future of the proposed stadium here is tonight at 6:30. live here in san jose, bob redell, "today in the bay." 5:04 right now. one of san francisco's main hospitals may miss a state dead tlin meet earthquake safety

standards. the san francisco examiner reports that's because of prolonged negotiations over the california pacific medical center's plans to build a new facility on cathedral hill. the hospital wants to move most of its beds from its four san francisco hospitals to the new hospitals so it can comply with a seismic safety mandate without retro fitting its four aging facility. the hospital must move the patients to the new building by january 2015. a reward is growing this morning to try and help catch the vandals who damaged a new school building in richmond. congress imagine george miller of martinez is adding $25,000 to the already $20,000 reward. it could take up to a half million dollars to make all the repairs needed. richmond police say if you happen to know anybody who was involved with this, please give them a call. 5:05. a south bay mom faces charges

along with her son in the stabbing of a 13-year-old boy. san jose police say this 42-year-old woman drove her 15-year-old son away from the scene near glenfirth and clear view drives. the stabbing followed an argumentyounger teens had. the mother and son both face attempted murder charges. today lawyers meeting for a pre-trial hearing for the sheriff who faces misdemeanor charges for bruising his wife's arm on new year's eve. this is his first court appearance since winning visitation rights with his son two weeks ago. new this morning, greece's financial future is uncertain yet again. less than a day after it gets its second bailout that's supposed to prevent it from defaulting on its debt. with a downgrade in the stock market. risk management company fitch ratings agency says it has downgraded its status to ccc to c. here's what this means -- the downgrade indicates greece likely won't be able to meet its financial obligations and even worse, the rating means default is highly likely in the near term. just yesterday the european union struck a $172 billion bailout deal to keep greece afloat and ultimately from filing bankruptcy. with this morning's downgrade, confidence among investors is sure to deflate and we'll have to see how it plays out on the stock market when the opening bell sounds a little bit later this morning. also new today, the shelling in syria has claimed the lives it would have western journalists. an american reporter from new york seen here, and a french photo journalist were killed in the city of homs today. the associated press is reporting the american reporter

was a veteran war correspondent. meanwhile, the attacks on civilians by the assad regime continue as the death toll climbs well into the hundreds in the past couple weeks alone. and more anti-american demonstrations in afghanistan today against the alleged burning of korans and other islamic religious materials. hundreds taking part in the protest today burning tires and throwing stones. this is all happening near kabul. yesterday the u.s. issued an apology for the reported burnings that took place at bagram airbase saying the military is investigating this incident. jon and laura? >> marla, thank you very much. the stars of a popular cable show returning to dublin today months after a monumental mistake sent a huge cannonball screaming right through the city. myth busters host adam savage, here wearing the black glasses, along with kerry byron will appear at dublin high school tonight, out promoting national engineers week. just two months ago the cast was in dublin apologizing to people in that neighbor after a stunt for the show just went haywire.

a cannonball flew past the target and plowed through several homes and through a minivan. amazingly, and very luckily, nobody was hurt. supporters of california's prop 8 will take their next legal step before the federal appeals court. not the u.s. supreme court. they will ask the full 9th circuit court of appeals to reconsider the arguments that led to a three-judge panel striking down the ban on same-sex marriage. the appeal's circuit could reject the request, which would likely mean the case will move to the u.s. supreme court. same-sex marriages will remain on hold until the legal challenges are exhausted. 5:08 right now. starting today an east bay food bank hopes local churches will help it feed the hungry during the season of lent. the alameda county food bank's annual lenten food drive starts today, ash wednesday, and ends on easter, april 5th. the food bank says while many christians do make the choice to adopt lent as a time of fasting and abstinence, some people

flow. 11th at mission as well as a little bit further over. valencia and may be affected as well. watch through that area. meanwhile, further south of there, san mateo looks smooth as well as across the bay for 880 and oakland area, construction through downtown has also cleared, guys. the america's cup sailing competition will be back before a san francisco supervisor's meeting today. the supervisor's budget and finance committee will consider approving several business plans with the race leaders. among them, development rights for piers along the city's water front. today's meeting will start at 1:00 at san francisco city hall. the race itself starts in san francisco bay next year. 5:12 right now. the federal government is looking into whether banks are hitting customers too hard with overdraft fees. we'll have details in a live report. plus, one of the men responsible for shaping sonoma

meteorologist christina loren joins us. we're not getting the rain but we're get temperatures off the charts. >> we are. we will see the return of winter as we head through the weekend and the start of next week. that's the good news but this morning, already starting out nice and mild. gorgeous shot here of the bay bridge. nice clear start. little choppy on the bay. as we head throughout the day today with some pretty strong winds out of the northeast. but it is those downsloping northerly winds that keep us nice and warm. so 46 degrees right now. that's your current temperature in places like san jose. a little bit of fog out there as we head throughout the day today, temperatures are going to be on the cool side to start but we will see the 70s later on. we do have some changes as we head towards this weekend. we are going to get some substantial cooling. high pressure's firmly in control in our weather pattern for today. that's going to keep us nice and mild as we head throughout the afternoon hours. so temperatures today warmest that we've had all year long. we have touched on the 70s quite a few times so far this winter, so that is saying something as

8. it was on relief over the greek bailout deal and on positive earnings from home depot. oil prices crossed above $106 a barr barrel. analysts are saying markets and the economy are better able to withstand higher oil prices now than they were a few years ago. we'll get one economic report this morning that's existing home sales. look for that. meantime the dow closed up 15 points to 12,965. the nasdaq slipping to 2,958. the s&p edging up to 1,362. meantime, government's new consumer financial watchdog is looking into overdraft fees banks are charging on check accounts. the agency says charges can inflict serious harm on consumers and it is going to begin collecting data to determine whether banks are gaming the system to inflate those fees and whether or not they're clearly spelling out how customers can incur those overdraft charges. americans are holding on to their cars longer than ever before. a study by a research firm r.l.

5:23. santa barbara assemblyman wants products like gad rate added to the list of beverages banned. the bill has already won endorsement of the ped cmedical community. they say the drinks may seem healthy but they're often loaded with high-fructose corn syrup and other sweeteners. the company behind popular games like farmville will not have to pay millions in taxes. the san francisco examiner says zynga saved $6 million through tax breaks thanks to a deal they cut with city leaders. san francisco agreed to provide breaks on stock compensation to prevent zynga from leaving town. thanks to this deal, zynga will pay less than $1 million in

will be about 20 degrees warmer if you do park in the direct sunlight. you might be turning on the ac later on today. this morning it is cold. rain is on the way but first let's get you out the front door with mike. we do have an accident to report highway 24 westbound your commute direction as you come through pleasant hill. reports that the left lane is currently block. reports are that this is a hit-and-run accident meaning the person who did the hitting took off. anybody who saw any activity over the last few minutes off that walnut creek interchange, call chp and let them know what you saw but no injuries are reported, though an ambulance was originally called. a look at the bay bridge toll plaza, getting a little more busy but not so crowded. but that will change. >> we'll just see exactly when. 5:31 right now. a young man with a history of mental illness will head to court today to face murder charges. the case is not only raising questions about the suspect's mental health but how it was handled by the system an also

how police handled the victim's call for help. "today in the bay's" christie smith joins us live in oakland where the suspect will head to court later today. good morning. >> reporter: good morning to you. that's right, the suspect is expected in court this afternoon here in oakland. as you said, this homicide not only stunned residents in berkeley, but had many residents and even some on the city council questioning the police response to the horrible beating death of 67-year-old man outside of his home in the berkeley hills saturday night. we are also getting a clearer picture of the suspect, daniel dewitt, a 23-year-old former alameda high school former football player. neighbors tell us they like him but it was no secret at all that he had documented mental health problems that may have been neglected, according to his family, by a broken system. >> we've lost a terrific community member. he was a wonderful man. then we have this young man who's suffering from mental illness and not apparently getting the help that he needs.

and that is also tragic. and now he's a murderer. >> reporter: she's one of many wanting to know more about how berkeley police responded. police also released a timeline about what they did saying that at 8:45 dispatch received a report of an unknown person hanging out near the home. but at that time patrol teams were monitoring a coming protest in berkeley. at 9:00 an officer offered to respond apparently but that offer was denied. exactly why is unclear. two hours later a report of an attack in pro-gregg gres. the suspect was arrested 15 minutes later. the b.a.r.t. police officer who shot an killed a knife wielding homeless man on a b.a.r.t. platform will not face charges. the san francisco district attorney says the transit officer acted lawfully and in self-defense when he shot charles hill in july of last year. hill's death triggered several

protests during rush hour xhooun commutes on b.a.r.t. a still case is still moving forward against the officer. the state is moving forward with a $3 million fine against pg&e for failing to come up with pipeline safety records by its deadline. some critics say $3 million too small. the state initially threatened to fine pg&e $1 million for each day the documents were late. ultimately pg&e admitted there were some documents that just couldn't be found. the president released a new corporate tax plan this morning. business and tech reporter scott mcgrew is in the newsroom with the leaked details. scott, this really beats the republicans to the punch. >> it really does, jon. what president obama is suggesting is that the corporate tax rate be reduced from 35% to 28%. political analysts say there's little chance of any of this getting accomplished, especially in a republican controlled congress, because that would mean the republicans would be

handing president obama a major victory just ahead of the presidential elections. now in addition to the tax cut, the president's plan would also reduce a great number of corporate tax loopholes. here you see mr. obama speaking at boeing last week. did boeing pay 35% corporate tax last year? no. boeing paid no corporate tax last year. corporations are able to avoid american taxes in two ways and the president's plan would get rid of both. first, if they make money overseas, they keep that money overseas. for instance, hewlett-packard. hp is an american company based here but a lot of its business is done in other countries. germany's hp selling to the french. that kind of thing. we see none of that in tax. that would change under the plan. the plan would also get rid of many loopholes that allowed boeing to avoid taxes through declared losses. one company to watch in all of this is facebook. last year facebook made about $1 billion in profit. this year facebook will probably not make a cent in profit.

in fact, it will probably take a loss and get a tax refund. that sounds kind of insane, but facebook offered shares to its employees this year at very low prices and those shares will be worth much more when facebook goes public. facebook will get to declare the difference between those two prices as a loss. it gets to say, look, we sold these shares at 6 cents to employees, now they're worth say $40. we lost $39.94 in that process. we're going to call that a loss. if they do that, that would be perfectly legal. it's done all the time, but it would also mean that facebook does not pay taxes. again, this would be a loophole that would close under the presidents plan, laura, if he can push it through congress. >> it is so interesting to see how to all plays out legally as well. 5:36 right now. san jose earthquakes have one more hurd toll clear before they can start construction on a new stadium. neighbors. >> reporter: and the san jose city's planning commission. good morning, laura. tonight the commission will decide whether or not to allow the san jose earthquakes soccer team to build its new 18,000-seat, $60 million stadium next to its training facility here on coleman across from norm mineta international. in december the planning department gave the quakes the go-ahead but then a resident who lives nearby appealed citing concerns over the stadium's bright lights an noise from the games. neighbors don't think the team has adequately addressed those concerns. the team says it can't afford to dome the stadium as some have suggested. >> a variety of things, including designing the stadium with its open end towards the actual airport, banning loud noisemakers like vuvuzelas and also air horns, also not having concerts at the venue at least to start. all of those things together will mitigate the sound impact of the stadium. >> reporter: we did invite neighbors to come out and speak with us this morning.

michigan is getting pretty tight. we have a look at how the debates will play in two important primaries. >> good morning. let's start with michigan. our brand-new nbc poll from this morning shows the two top candidates there, rick santorum and mitt romney, almost neck-and-neck which is interesting because of course this is romney's home state. but he has not been able to open up a big lead there. he a's ahead by two points which is within our margin of error which means this is a statistical tie. not so in arizona where the debate happens tonight. romney's got a 16-point lead over rick santorum so tonight expect the two to try to make their points to win these two states. rick santorum who has been surging in michigan, not so in arizona. then there's gingrich who's far behind, he's focusing on energy and gas prices. ron paul who by the way has got a new attack ad against santorum

that questions is this dude serious? talking about how much money they've been spending here in washington. >> got to love politics. thank you, tracie. breaking news right now out of argentina. a train cash has left hundreds injured. marla tellez has all of the updated information. >> reporter: good morning. the associated press is reporting almost 400 people are hur. these are mainly morning commuters. we are still waiting for the latest video from the scene in argentina. in the meantime, according to argentina's transportation secretary, a train just pack with people slammed into the end of the line at a very busy station in buenos aires. officials say the commuter train simply came in too fast and hit the barrier at the end of the platform. again, about 350 people said to be hurt. so far though no deaths have been reported. of course we will continue to watch this story and bring you the latest in our next hour, in the 6:00 hour.

today, temperatures are going to be on the climb as these winds pick up. right now they're still nice and calm for the greater bay area but starting to pick up in the north bay. sustained wind speed at 6 miles per hour. 5 miles per hour nav tato. for us, talking about the warmest day we've had in months. warmest of the year so far -- 78, almost 80 degrees in morgan hilda. 75 in evergreen. 72 in danville. 73 degrees in walnut creek staying nice and mild right at the coast. 66 degrees at half moon bay. you could hit the beach today. you could wear a tank top in the middle of winter. 76 degrees by tomorrow. staying just about as warm. we'll get plenty of sunshine but start to drop off on friday. take a look at the drop-off between thursday and saturday, almost a 15-degree difference. you will notice the clang so enjoy the sunshine while it lasts and the warmth because things cool down as of this weekend. we get a few showers late sunday, into monday.

that will mostly be up in the north bay but i think everywhere will get a little bit of a sprinkle as we wake up monday morning. >> we'll zip right back to the city. heading into or through the city -- just off the central freeway we still have issues for power and for signals along the area. duboce is closed from elgin over to mission. that's just from 101 basically and duboce all the way up to market. use van ness. just avoid duboce at mission, that's the major intersection affected by the power outage. highway 4 looking all right with typical build coming over towards summersville, 17 miles per hour. construction will go on overnight tonight starting at 10:00. friday as well. they are recon figuring one of those off-ramps and that's an issue through pittsburg.

livermore, 17 minutes toward the dublin interchange with a tad bit of slowing approaching hopyard. jumping down to the south bay, northbound, no major delays or problems for speed sensors. just construction through palo alto, oregon expressway off to the side. this morning patriots quarterback tom brady is back in the bay area. unfortunately, it is with a very heavy heart. his long-time mentor and former coach tom martinez has passed away. martinez suffered a heart attack just yesterday. his health had been in decline recently due to complications from diabetes. he was in need of a kidney transplant and brady had actually helped promote the search for a donor. martinez leaves behind a storied history in community college sports. he won championships in football, women's basketball, and softball at the college of san mateo winning 1,400 games. >> absolutely he was a legend. and we will never forget the contributions he made here. >> it's a very saturday for us

all. tom martinez was really the incarnation of bulldog athletics. >> very, very sad. martinez had served as brady's mentor since the patriots' quarterback was just 13 years old. brady considered him to be a father figure. tom martinez was 66 years old. sadly, yesterday was his birthday. it is 5:49 right now. a new report shows young women who suffer from heart attacks are more likely to die in the hospital than men of the same age. researchers say it is because women under the age of 45 are less likely to show the common symptoms of a heart attack. many show up with no chest pain leading to a delay in treatment. that delay makes it more likely for women to die. health organizations argue there are other symptoms doctors should look for, including shortness of breath an pain in other areas of the body. 5:50 right now. more tough times could be on the horizon for the state's community colleges. revenue from student fees

code. the law says infractions -- should be witnessed by officers or at the very least should be authenticated by a person, not a computer. suit was filed against the city of victorville in southern california. attempts to reach the company for comment so far unsuccessful. a san francisco federal court judge will preside over a series of class action lawsuits against facebook. claimants say facebook tracked, collected and stored their personal information, including their internet browsing history, when they were not logged on to the site. the suits will be consolidated under the title "facebook internet tracking litigation." it accuses facebook of violating the federal wiretap laws. no word on whether the court will actually hear the arguments. you know it is a big day when you have a tease talking about cory hart referencing sunglasses at night. that means scott mcgrew's going to be here right now. >> listen to that. ♪ i wear my sunglasses at
