i'm laura garcia-cannon. 5:00. >> yes, exactly it is. good morning. i'm jon kelley. thank you for joining us. let's check in with meteorologist christina loren to find out how we follow that tough act yesterday for today's weather. >> repeat performance. that's the good news. more of the same for one more day, only caveat is we're going to have to deal with gusty winds especially the higher elevations. wind advisory until 6:00 p.m. for elevations above 1,000 feet. and as we head throughout day we're talking upper 70s, a couple of low 80s. then things start to change. i'll take you through the forecast. let's check your drive with mike. >> you heard the wind advisory, the east bay hills, that means you. 680 through the diablo range, construction, though, road crews cleared from the rudier off ramp and in fact the crews stretching between sycamore valley road and al costa. that's great news. the flow of traffic not

interrupted. we may see slowing, then off so i'll check but not a problem. >> thank you. there is a problem as concern is growing for a family of four missing after a fire destroyed their sunnyvale home. the home is on duncardine way. bob joins us live at the scene. what do you know about the family? >> reporter: no one has seen them. i spoke to the neighbor. he doesn't know them that well, they moved in maybe a year, year and a half ago. a family of four, mother, father, boy and girl, possibly 3 and 7, somewhere in that age range. why the people here are so concerned is because no one saw any one escape from this home. when the fire started around 1:00, when the fire department arrived the fire engulfed the home. the home has been destroyed. neighbors are concerned and so is the fire department, you see there are still two cars in the

driveway. they are not sure if there is a third they own and no one knows if they are out of town. this is ski week after all. >> no. i have no idea. i suspect they are going to find bodies. sorry. i am too. it's really pretty tragic. that's my guess. >> reporter: the fire department will know for sure once the sun comes up. that's when they will go in and do a physical search of the home to see what is inside once they have the daylight shining through where the roof used to be. this was a two-alarm fire, it started around 1:00 this morning. the fire department is not sure what caused it. it was one challenge in fighting the fire on top of the normal challenge they encounter, that was power lines down in the backyard, live power lines so they had to get pg&e to turn those off before they could fight the fire from the back.

the fire department said this fire was fully engulfed by the time they arrived. reporting live, bob redell, "today in the bay." >> breaking news out of oakland. police on the scene of a shooting, christie smith is there right now with all of the details. what can you tell us? >> reporter: good morning to you, jon. i just got an update from the sergeant on scene. he says that they don't have a lot of information but what they do know is that they got a call of shots fired in the neighborhood here at 32nd and addleline. this is west oakland. when they arrived they found one person in that red car you see across the street, shot one or more times. at this point what they tell me the person was conscious, taken to the hospital. don't know how the person is doing right now. when we arrived police were going door to door trying to get information from neighbors. they don't know if the shooter was on foot or in a car.

they are trying to get that information from neighbors, and the intersection will be closed for sometime here at 32nd and adeli adeline. christie smith, "today in the bay." >> police are looking for help in finding a hit-and-run driver. 28-year-old patrick joseph gregoire is wanted for leaving the scene. he slammed into a car. in his car they found a loaded handgun and marijuana. any one with information should call police. >> a teacher accused of sexually assaulting a student is expected back in court. peter could enter a plea, he is accused of having a sexual relationship with a 16-year-old student. investigators say that the james logan high school began that relationship last march. >> the family of giants fan

bryan stow are not giving up in their effort to sue the los angeles dodgers for stowe's beating. the family claims the team is responsible for the attack because it laid off hundreds of security guards. because the team filed for bankruptcy the lawsuit was placed on hold. the team is using its financial troubles to delay stowe's demand for a jury trial. the dodgers want the suit dismissed saying it couldn't be proved that security staffing is responsible for the beating. the bankruptcy court will decide if the stowe trial can proceed. stowe continues to recover from that brutal beating. he's at a rehab facility. brian is working hard at physical therapy, having a tough time with short-term memory but continues to make small steps. >> it's 5:06. new this morning the violent protests in afghanistan over the burning of religious material left two u.s. troops dead.

marla tellez has the latest. good morning. >> good morning. military sources say two nato service members were shot and killed in afghanistan by a frustrated afghan soldier. this is amidst the demonstrations against the alleged burning of korans by u.s. forces at begram air force base. yesterday at least seven people were killed in similar protests. the taliban is claiming responsibility for this attack, the u.s. embassy in kabul remains on lockdown for a second day in a row. also new this morning at least 50 people are dead, more than 200 squired in a series of attacks across iraq. 11 cities have been targeted by suspected militants but most of the deaths happened in baghdad. the main target, police officers. on sunday a suicide car bomber

killed 19 people at a police academy in baghdad. it happened almost two years ago, the final report on the deadly west virginia mine explosion is expected to be released. the blast killed 29 miners and previous reports conclude that the company that owned the mind is negligent because officials let explosive methane and coal dust build up inside mine. the families will be handed the report today, a little later this morning in west virginia. they hope to get some sort of closure. >> 5:07. one city f you get caught puffing on a significant brett in public places you could get read the cough up cash. morgan hills working on an ordinance to prohibit smoking in outdoor areas including parks, public events and within 20 feet of any building entry. the fines top out at $500.

leaders hope to have the ordinance drafted by next month. >> the u.s. coast guard has a message one being delivered this morning. for the first time the annual state of the state address. the commander is set to speak at coast guard island. the speech will focus on the need for new ships to replace the aging fleet. a bigger budget to pay for it is necessary for notnal security. >> you may feel it's warmer as you head out the door. not needing that thick heavy co. >> it does feel good. and ski week. bob redell brought up a good point, a lot of kids off enjoying the gorgeous weather. not great skiing but getting them outside will be easier with weather in the 70s. 45 in livermore. 51 in san francisco. in oakland, 45 degrees.

>> welcome back. brace yourself for a spectacle. we're not talking about america's cup. here's what we're talking about. two tall ships as opposed to the short ships will dock this afternoon. both of those ships appeared in the pirates of the caribbean movies. kind of cool. organizers they like to show what life was like when pirates roamed the seas. this weekend the ships take part in what they call a simulated battle complete with canon fire and the good stuff they do. they will dock in redwood city through march 7. >> a little johnny depp.

>> 5:15. i want to check the forecast. good day to be out on the bay. >> yeah. great day to swab the deck. it's going to be nice out there wherever you're headed. temperatures comfortable, a little on the breezy side so not a great day for the flowing skirts. guys, hold onto your hats. 47 in san mateo. we're starting out mild. you might not even need that jacket if you are a tough guy and can handle 48 in san jose this morning. throughout the afternoon the sun is going to be up early as a result very little cloud cover this morning. we're going to warm up so quickly. temperatures on the climb courtesy of all of that sunshine and these winds that are starting to pump now out of the north at about 12 miles per hour in santa rosa, picking up in fairfield as well at 18 miles per hour. this is what we expect when it comes to winds. we stop the clock on future cast. 5:00 a.m., a little on the breezy side. we continue this into the 9:00

a.m. hour. and yeah, it starts to get windier. you can see the peak, the red, that's the areas we expect the strongest wind speeds. they will continue to maintain strong between about 25 miles per hour and 30 miles per hour sustained throughout your higher elevations. until about 6:00 p.m. tonight you can see clearly here. they start to drop off after that and we'll see comfortable conditions as we head throughout this evening and into tonight as we lose the winds. one thing the wind will do, kick up all of that pollen. if you are someone who suffers from allergies, we'll see high pollen levels with all of the winds in the area. 80 in morgan hill. 71 for dublin. 75 in san francisco. warmer in san francisco with offshore flow than some of the inland cities. we cool down, some showers on monday. if you're looking for outdoor activities this weekend your best day will be saturday. a few more clouds ond sunday and cooler, let's check your drive

>> welcome back. good morning. there is serious heat coming down on thieves. police arresting two 17-year-old boys this week for trying to sell 21 stolen bikes on the website. some of the owners saw the ads and then tipped off police. pictures of all of the bikes are now being posted on sfpd's mission district website in hopes of finding all of the bikes' owners. go ahead and check out mission station.org. >> it's 5:24 now. san jose earthquakes will soon have a new place to call home. the the planning commission has given the team a go ahead to build a new stadium.

neighbors asked the city to kill that plan because of potential noise and lights but the appeal was denied last night. the city has approved the permits for the $60 million facility. the earthquake plan to break ground this year. >> hewlett-packard a stock to watch. scott mcgrew joins us. >> it was a perfect storm, the problems, you had a ceo announce he was going to sell the company's pc line. you recall he is no longer ceo. the damage was done, and any competent ip manager wasn't going to buy them from hp. hp has changed its mind and its ceo, they changed that too. but temporarily that damage was done. add to that the popularity of ipads biting into pc sales and other worries and hp earnings fell more than 40%. new hp ceo is asking for patience. shares of tesla, a blogger

criticized the company saying if you let the battery run down to nothing and sit for a long time it will no longer charge and you'll be faced with a $30,000 repair bill. the company said technically that's true of all batteries and there were ways of preventing this. another blogger said yeah, if you drive a fer rory around with no motor oil you'll ruin your car. straight from the why didn't somebody think of this earlier file, a website and app for you called nanny in the clouds, the idea is parents of small children and young people who baby sit from time to time are probably on the same flight. hire somebody on the plane to help out. you can enter the flight number ahead of time and match wake-up a babysitter also planning to fly. ask the airline to sit you together. mike is applauding. i was telling you sometimes if i'm seated next to parents with small children i tell them, listen, i've been there.

way. bob redell is live at the scene. if anything what can you tell us where this family is at? >> reporter: that's the big question. good morning, jon. people here are scared about what the fire department might find inside this home here on duncardine way. there is a family of four who lives here who no one has heard from a. neighbor tells us it's a mom and dad and boy and girl, son and daughter, possibly 3 and 7 years old. you can see two cars are still in the driveway, the next door neighbor doesn't believe they own a third. one that they could have taken off in. he doesn't know if they are out of town, possibly for ski week. no one saw any one escape what seems to have been a fast-moving fire. by the time sunny veil fire arrived around 1:00 the house was fully involved. >> the front part of the house was pretty much engulfed and there wasn't any chance of getting in the house to alert

people or anything. so we went around the back. tried to preserve our own structure. >> reporter: the reason the fire department is waiting for daylight they need to see but they need a structural engineer to come out and make sure the house is okay for the fire department to go in. the house for the most part has been destroyed. some of the walls are missing. most of the roof or a good portion is gone. once the structural engineer gets the okay the fire department can go in at sun up to do a search for the family. hopefully they are not going to find them inside. that's what everyone is praying for. this was a two-alarm fire, still no word on the cause. that's something that the fire department is looking into. reporting live in sunnyvale, bob redell, "today in the bay." >> 5:33. this morning an armed suspect still on the loose after shooting at fisherman's wharf. a man was shot in the leg near the in and out burger. police tracked down two of the

three suspects believed responsible for that shooting but so far they have not found a weapon. >> the 23-year-old man accused of beating a berkeley hills owner to death expected to enter a plea in court today. daniel dewitt charged with killing peter sucor. there was a confrontation. dewitt reportedly said he was a psychic looking for his fiancee zoe. his parents telling reports outside court theirston is a paranoid schizophrenic and there is no such woman. >> a high school math teacher accused of sexually assaulting a teenage boy will be arraigned. marie johnson is accused of having sex with a 14-year-old boy who was a former student. police say the granada high school teacher started that through text messages and the

game words with friends. the alleged relationship started back in december 2010 and lasted six months. >> we're following developing news out of oakland this morning. police on the scene near add align. christie. >> reporter: good morning. right now oakland police are focusing attention on the red car that you see there with the doors open. this is where about 4:15 this morning they found a man in the car who was shot. somewhat of a mystery is exactly the details here because the car itself doesn't have a lot of bullet holes in it so they are trying to piece together what happened. again, they got the call at 32nd and adeline here in west oakland. they found the man in the car but no one else around. i asked the sergeant how many times he thought victim was hit. >> i do know that he was

with the two companies and the rest of the tech world that will allow to you opt out of some tracking on the internet. apple and google's ad division do their best to see where you have been to better advertise to you. connie harris is unveiling her own issues trying to beat the opportunity the punch on this one, demanding that company that have app store, apple, give smart phone users a better idea as to how their apps may take their private data without warning users. the classic p.m. of this is path, a social network that uploaded people's address books. it has discontinued the process. both of the obama and the harris plan were in motion before path got caught. they have become the poster child of what not to do to bring app developers back in line. >> interesting. thanks. it's 5:37.

patriots quarterback tom brady is in town to take part at a fund-raiser at his alma mater. he will participate in the fund a dream scholarship benefit, it's sold out to fund the high school's program. the administration made it difficult for some to afford the tuition. brady was scheduled to be in town for that event even before he heard the bad news that his long time mentor had died. a memorial service for tom martinez is planned for tomorrow at a menlo park church. martinez suffered a heart attack on tuesday, his 66th birthday. brady considered him a mentor, friend and a father figure. >> very sad there. it is 5:38. hopefully we can put sunshine back on it now. meteorologist christina loren is here to tell us about what's happening. >> we've got tons of sun in today's forecast and we do have pretty gusty winds starting to

pick up. in places like fairfield. look at what that sustained wind speed at 18 miles per hour is doing to your temperature. you're almost at 60 degree there is this morning. and 53 degrees in santa rosa, that's the other city getting a strong sustained wind speed. i think santa rosa will be one of those. throughout day clear and breezy conditions to start. we'll see warm and sunny conditions later on today. mostly sunny all day long. a few clouds increase later on but the big weather story aside from the record breaking warmth will be the gusty winds. sustained 15 to 30 miles per hour. we have changes ahead. much cooler for the weekend and the start of next week with a few showers as well so. enjoy the sunshine while it lasts. up to 70 degrees. at noon you'll be at 74 degrees at 4:00 p.m. cooler by the water, still a great day to enjoy lunch right by the bay.

thousands of ballots could be delayed, the reason, up to 11 mail processing centers in california are slated to be shut down. more than half of all voters in the state used absentee ballots. >> just in, president obama irk eyeing apology to afghanistan's president over the burning of korans. marla tellez in our newsroom with the president's statement. >> cnn is reporting president obama sent a letter to afghan president ma immediate karzai. he calls the act a quote inadvertent error. he goes on to say, quote, we will take the appropriate steps to avoid recurrence including holding accountable those responsible. the president's apology comes hours after two u.s. nato troops were shot and killed in eastern afghanistan by an afghan soldier who officials say blamed the americans for the protests that are now in their third day.

the air tuesday morning. last thursday a similar incident happened in another neighborhood. two women found the casings and called police. their home is down the street from where the shooting took place. >> it's terribly scary. you don't know what to do. you can't even have your children out in the street. >> that is not good. police comparing shell casings to see if they can -- if they came from the same gun. >> 5:49. vandals des straighted a church and police are calling it a hate crime. religious statues and walls were painted, the vandals painted two pentagrams and words including satan. a wooden cross was toppled. police are still looking for the vandals. oakland will review. the city approved budget cuts
