getting busy. >> it is. and with that below freezing temperatures throughout, the chance for ice if there is sprinkle, so keep that in mind for the north bay. over the bay looking at the bay bridge toll plaza. cash lanes backing up. we are hearing a wind advisory for the bay bridge and the san mateo bridge. oakland a look at 880 fast coliseum, the accident has cleared to the top of the screen. we see the volume, the roads are not clear. that's getting crowded. >> sure s. thank you, mike. >> we start off with breaking news out of ohio. police right now on the scene of a school shooting near cleveland. reports believe four students have been wounded. this is a look at local nbc affiliate wkyc reporting two gunmen now in custody. marla tellez is working on the story. she will be coming up in a few moments in about ten minutes with all of the details. >> some parents thankful to have their children.

a crucial portion of san francisco's sheriff ross mirkarimi's domestic violence trial begins today. a judge is expected to rule on what evidence to allow. christie smith joins us live from san francisco. the legal fight over a video. good morning. >> reporter: good morning. that judge has also said that san francisco sheriff ross mirkarimi doesn't necessarily have to appear at this hearing today. what's happening is that attorneys on both sides will present motions in this case. a little bit later this morning. after friday prosecutors went public. the defense is looking to exclude video from the sheriff's domestic violence trial. prosecutors showed a photo of lopez explaining that they argue her husband allegedly inflicted during an argument. during the video lopez apparently describes how he became upset and grabbed her but the defense argues that lopez was not necessarily talking as a

crime victim but might one day in a custody battle over their son. they are trying to include statements by neighbors who filmed that incident and her response to it. the case continues this morning in san francisco at 10:00 a.m. reporting live, christie smith, "today in the bay." >> new this morning a scary start to the day for people living at an oakland apartment complex. firefighters banging on the doors at the manor on schuyler street. an electrical cord and heater sparked a fire in a bedroom at 3:30 this morning. at first it was tough for firefighters to find out where the fire was because it was not visible from out on the street. working smoke detectors did step tine help alert tenants. one woman was taken to the hospital as a precaution for breathing problems. >> san jose firefighters also busy overnight.

they were called to a two-alarm fire near 7th and keys street. they found flames leaping from a shedding used to score scrap metal and furniture. firefighters were able to quickly put this out. some nearby buildings were damaged by the thick smoke. nobody was injured. firefighters right now trying to figure out what caused the fire. >> 6:04. the bay area's largest city is facing its 11th straight year in the red. now city leaders are hoping that residents will be open to another sales tax hike rate. bob redell joins us with some of the options. good morning. >> reporter: good morning to you. this is certainly one of the larger topics of discussion during tomorrow's city council meeting here at san jose city hall. what's going son mayor chuck reed wants the city to poll its residents to see how open they are to the possibility of a quarter to half cent increase in

the sales tax. the idea to help put a dent in the deficit. if they were to raise it that would bring in an extra 35 to $70 million a year. enough to put a dent in the budget deficit. if there is enough support to try to put this on the november ballot. the argument against the new sales tax that the city needs to cut employee expenses first which the mayor says he is trying to do with his pension measure that goes before voters in june. any new tax could be a hard sell. the sales tax is supposed to go up in july by 1/8 cent. and the governor, governor brown, is pushing for a half cent sales tax dreen help with the budget deficit that the state is reeling in. this will be topic "a" tomorrow during the city council meeting at san jose city hall. >> this morning a hell's angel gang member accused of killing a

fellow angel is in jail. police found steve ruiz at day's inn after four months on the run. they say an unidentified woman booked a room and ruiz likely snuck in the back. ruiz surrendered after police called his room and told him the hotel was surrounded. >> the guy come crawling up the hall and went past my door that i could still see his feet. they took him. then there's another lady that they told to crawl down the hallway as well. >> ruiz was also wanted for killing steven townsend during the funeral of a fellow member of the hell's angels. >> the drunk driver who shut down muni service during a morning commute struck a deal with prosecutors. scott mitchell pleading no contest to dui charges from the january 19th incident. police say his blood alcohol level was twice the legal limit when he drove his car into a

tunnel at church and da bow streets. mitchell will serve three years probation and do community service plus must attend dui classes. >> convicted serial killer wesley shermantine says he knows where more bodies are buried. this weekend shermantine gave an interview with the stockton registered. he apologized for taking years to reveal the locations of the victims' bodies. he said there are more buried in modesto and ripon. shermantine and his now dead partner lorn her zok have been linked to a 15-year murder spree beginning in 1985. >> we've been talking about gas prices approaching $5 a gallon coming this spring. this morning that ugly reality hit us hard. it arrived in hayward, the 76

station on west eighth street and arbor avenue. on the other side, the cheapest we found still low $4, $3.99 at the 7-11 in martinez and at the beacon in pittsburg. you got to pay cash. >> crazy. 6:08. colder throughout morning. let's check in with meteorologist christina loren. >> some cities in the mid-20s. good morning. the good news is the shower activity that we had earlier is really pushing south and subsiding at this point. you don't have to worry about fighting through showers on the way to work on a monday morning. temperatures are cold, though. you'll need to warm up your vehicle. look how cold it is in the north bay. 26 degrees in napa, at 30 in santa rosa. holding on to the 30s even on the peninsula. so it's one of those days you'll probably be wearing that jacket

every time you walk outside if you want to stay warm. only at 50 degrees inland as you break for lunch. 51 by the bay and 53 degrees by the coast. so, it all works out like this. an area of low pressure sidling down the coastline dragging a front through the area. tomorrow we'll see a few more clouds and a little bit warmer weather, then we've got a major storm on the way for wednesday. major when we put it in perspective. we haven't had that many storms so far so we could see maybe 3/4 inch of rain on the south bay floor. we'll talk about when that arrives coming up. first 6:09 let's talk about your drive. >> we'll take you to the peninsula, coming out of san francisco you got southbound 280, the speed sensor, the 52 registers where there are reports of a disabled bus which might be blocking a lane. we had details but they cheered from the report. it doesn't sound like anything big is going on.

>> we have breaking news out of ohio. about 30 miles outside of cleveland deputies say a gunman opened fire on a high school campus. marla tellez is live in our newsroom with all of the latest information. nothing short of a terrifying situation. >> the scene is chaotic. this is happening now in ohio 30 miles east of cleveland. we do have live pictures to show you coming from the scene. this is from the local nbc affiliate, wkyc. you can see the reporter on scene seems to be interviewing a parent, we've seen a lot of parents talked to. we can tell you according to the local nbc affiliate at least one shooter is in custody. we heard reports that two people have been detained but we're waiting to get confirmation there. officials say at this point a gunman opened fire at chardon

high school inside the cafeteria. this happened about 7:30 this morning. this is eastern time. wkyc is reporting at least four students are injured, and the students are in lockdown mode right now. but what they are doing, the parents aring allowed in the school at a time to find their child and then they can bring them home. so it's a process that's unfolding now at chardon high school in ohio. in the meantime, schools in the area are also on lockdown as a precaution. again, i can tell you at least four students have been injured in this high school shooting that happened in ohio. one gun man is said to be in custody. of course we'll continue to stay on this breaking news out of ohio to bring you the latest. >> thank you, marla. what a freaky situation. >> we'll continue to monitor that as it develops. 6:14. want to get you out the door, start your monday morning. a little colder. >> and we have fog developing

right now. let's take a live look at san francisco where we have wind in this particular shot. but from half moon bay down through pacifica that fog is starting to roll in. and that will likely become a factor through the next couple of hours we expect a little bit of fog formation. we have an area of low pressure pulling out of the area. and that's what's driving the winds. throughout the day today we could see a spotty shower later on this afternoon. we're not going to rule that out. but very slight, about 10% to 20% chance of rain throughout this afternoon. a better chance later this week. i'll time that storm out. we'll talk about what's happening. grab your jacket. 26 degrees, 42 in san francisco. 37 in san mateo. in the 30s even in oakland. so you'll probably need the jacket all day long. temperatures struggling to break out of the mid-50s at the coast today. a little area of low pressure scurrying the coastline dragging a cold front. as it continues to move into

southern california we start to see the showers wind down. a little post front precipitation is possible later on this afternoon but more so we'll see the cool conditions. sun and clouds and breezy throughout the hills as we head throughout this afternoon. another system right on its heels is slated to bring us our first showers by about 5:00 a.m. wednesday. take a look. we're talking about with steady rain throughout the day wednesday, potentially measuring 3/4 inch here in the south bay so we need this moisture. old man winter has been on hiatus until now. so he's coming back and we're welcoming all of that moisture. 58 in fremont, 57 in san jose. there's that rain chance wednesday into the first part of thursday. we'll clear out quickly. friday into the weekend we warm you back up. 66 saturday, 68 degrees, couple cities touching on the 70s at the end of the upcoming weekend. let's check your drive. >> we'll take you out to livermore, see it jamming up out of the altamont pass off of the merge, and then smoothing out.

21 minutes, slower speeds where it's yellow below 40s into the 30s. looking at that pretty much all the way toward the dublin interchange for livermore, pleasanton, and 680. we're looking further south. 680 moves nicely through sunol without delays, 880 out of fremont the same passing mission boulevard. northbound the volume is picking up but not enough to bring the speeds down. that's a great south bay flow and the peninsula isn't a problem. toward the maze and the approach. no metering lights but we're looking for those to get turned on because of the volume approaching the toll plaza. the cash lanes showing a backup. the fast track a good advantage. the feeder roads looking nice. the east shore freeway we have slowing because of a new incident. a stall or traffic hazard in the fast lane approaching the merge off of that richmond bridge. we track this, and a live look out there shows you the volume past the coliseum should start slowing through san leandro.

the idea of raising sales business taxes again. bob redell joins us live with the latest attempt to solve the city's chronic budget deficit. good morning. >> reporter: good morning. if you live here and pay for anything in san jose you're going to pay $8.25 on your sales tax. city hall thinks what if we raise that to 8.50 or 8.75. a huge dent in the city's budget deficit. and that's going to be the topic of discussion at the city council meeting tomorrow night. mayor chuck reed wants the city to poll its residents to see how open they are to this possibility of a tax increase to see if there is support. if there is, then the city would perhaps try to put this on the ballot in november. any new tax could be a hard sell considering that the sales tax is already going to rise by 1/8

>> we don't know that it's gang related at this point. on its face it appears to be just a bar brawl gone bad. we know there was a physical fight. at one point one of the persons in one of the groups produced handgun and hit three people. >> police have not made arrests. >> a judge is expected to start deciding what evidence will be allowed in the domestic violence trial of san francisco sheriff ross mirkarimi. christie smith is live in san francisco. among the evidence we understand is a video. >> reporter: yeah, that's one of the key things. that san francisco judge spent the weekend getting up to speed on the case as he just got it handed to him friday. one of the things he's going to consider is what evident might be allowed including a photo of sheriff ross mirkarimi, showing what appears to abbruise. mirkarimi is charged with misdemeanor domestic violence

and after an alleged fight with his wife. prosecutors show add photo of a video that a neighbor shot of mirkarimi's wife. prosecutors say that during the video she describes that he got mad at her and grabbed her arm, causing a bruise. the defense wants this video excluded because they say that lopez was talking as someone preparing for a possible custody fight and not necessarily as a recent victim. the defense wants statements by the neighbor who filmed it as hearsay. since then lopez has said this whole thing in her opinion is politically motivated. that squ also decided that mirkarimi doesn't have to be here for the hearing that starts at 10:00 this morning. christie smith, "today in the bay." >> a group of teens in trouble facing criminal charges for a dangerous vandalism spree. five boys admitting launching river rocks at homes and cars

while driving through livermore neighborhoods. one rock slammed into a wall next to an emtpty baby ace crib. witnesses recognized the vehicle and stepped up and reported this. >> a decision is expected whether sante fe state will toughen add min standards. auk talking about eliminating preferred treatment of santa clara ap pli can'ts. right now they have to neat minimum requirements to be accepted. the university says state budget cuts are making it impossible to continue that policy. they will announce today what they decide. >> 6:36 now. we check in again with meteorologist christina loren who is reminding us sure, we're a few weeks from sbring. >> old man winter is back from his vacation and going to bring very cold conditions, not just this morning, tomorrow morning

as well and a potent winter storm on the way for wednesday. a live look outside. a gorgeous sunrise over the way bridge. we do have some clouds overhead, some inland cities with mostly clear sky. we had showers roll through the bay area. at this point no fog to report but we could see some of that develop. as we head through the next couple of shower hours, watching the fog in and out. cool conditions, something you have to deal with. 26 degrees, very kald start. 40 degrees right now in san jose. so it's going to take a while even with the sun coming out early for all of the cold air to mix out. holding on to low 50s. at 4:00 p.m. as you make your way home, 54 degrees. 51 by the bay and at the coast 53. so overall staying cool. i'll let you know when you're breaking out the umbrella and how many tas you need to use

that. first let's talk to mike about your drive. >> we'll consider that the countdown to clean wiper blades as well. cleared that up a little bit. the stall that was there, that ripples back now, some folks off of the richmond bridge, just a little now and looking at a slower drive, highway 4 all the way down to the racetrack. more slowing around emeryville and the berkeley curve. there is an issue for highway 4, westbound t slow through antioch, pretty early flowing there and continuing over toward 242, before and after you join up with that freeway you have slowing in your commute direction out to the walnut creek interchange. we'll show you ka nol, the taillights streaming so good volume of traffic. we don't see any major slowing

>> welcome back. it's one of those realities early in the week. yeah, it's always pretty tough trying to get out of bed on monday. especially at this hour. and if you are feeling sleep deprived you are not alone. tracie potts is live in washington, d.c. she has a look at the new sleep study out there and tracie, we're curious here, are californians getting enough sleep? >> well, not all of them. i thought you were going to say you're not alone because tracie potts and the rest of the morning crew join in all of that. but i will tell you this. this study, it was cdc data that the university of pennsylvania analyzed. they found that californians, 17% of them say that they are having sleep disturbance on a regular basis. 19% say that they have daytime fatigue so people are tired during the day. because of the sleep that they are not getting at night. those numbers are less than what

we found nationally. a quarter with mild to extreme sleep problems. often women, more often african-americans when you break it down by group. lots of people having trouble falling asleep, staying asleep or found sleeping too much. then they have little energy or end up tired during the day. the national sleep foundation says we need 7 to 9 hours of sleep, that's for adults. a lot of people not getting that. it contributes, the report found, to chronic problems like diabetes and obesity, high blood pressure, interestingly in addition to where you live breaking this down by states, they also found that things like mental health, race, ethnicity and access to health insurance, medical care, have a lot to do with whether or not you're getting enough sleep. jon. >> wake up, buddy. >> sorry about that. tracie, thank you. >> 6:43. coming up, 15 minutes ever uninterrupted news including why

>> winter making a comeback. feeling it this morning a little bit. >> yeah. you are feeling it up in the north bay where last week we were shattering high temperature record this is morning. you broke a low temperature record in napa. 26 degrees. we had a weak disturbance come through the bay area earlier this morning. you can see what's left of that disturbance. a few high clouds out there, mid level clouds as well. that will be the case for today. a mix of sun and clouds. it will look warm later on come 3:00 p.m. you see all of that sunshine. boy, it is still going to be on

the cool side. temperatures ending up in the 50s for today. take a look at how cold it is right now. 26 degree napa. 42 in san francisco. and now you're at 38 degrees, now in the 30s in sunnyvale. oakland at 39 degrees for the past hour. you need that jacket all day long across the bay area. our micro climates really starting to kick in but not too much of a difference between your temperatures inland versus those at the coast. here is the reason. a little area of low pressure you see it falling apart but it did bring a weak disturbance, now racing into southern california. for us that's going to keep the cold air in place. a mix of sun and clouds and the breeze will continue to build throughout your hills. so watch out for that especially over the open water bridge, could get gusty from time to time as that system exits. tomorrow we'll see more clouds, it will stay on the cool side. temperatures a touch warmer as we kick off tuesday. take a look at what's headed our way on wednesday. we stop the clock right at

midnight. you can see santa rosa getting steady rain. between midnight and 5:00 a.m. the front slides to the south. we're talking about steady rain moving south of san francisco during if the heart of the morning rush hour. so mike and i will be here to guide you through. you want to plan on leaving early on wednesday. we're going to see showers pretty much all day long. we need the rain. maybe 3/4 inch here in san jose. so this is a juicy system. today's highs only in the 50s. 58 in san jose. 58 for gilroy. 56 in santa cruz. by wednesday the rain arrives, it clears quickly, though, late thursday, by friday we're left with cold air, 58. 56 by the bay. a mix of sun and clouds. may be a light shower friday into saturday. then the warm-up is on. up to 68 degrees by this sunday. so, climbing back up toward record highs as we head into the weekend. let's check your drive. >> pretty much right on schedule we have the slowing that shows up for the south bay. 101 from capital expressway all

the way up toward 880, into the 40s and 30s now. highway 87 a similar stretch from about curtner to downtown and back to capitol as well. northbound 85 shows 40s as you come over off of highway 17. though 61 registers in sarasota so things change after you get past that choke point. further out past this area, highway 4. we had shown you slowing off of bay point to 680 and 242. highway 4 we know that standard build. here we found there was a disabled vehicle and accident later. that was blocking one lane. all lanes are clear in the last few minutes. 242 down to the scene and walt nut creek interchange is clear. this burst is going to create drama over to lafayette and the bay bridge. right now the caldecott tunnel moves smoothly. the approach off the east shore freeway is slow. highway 4 down to san pablo and the merge.

the stall is cleared but at central it was the choke point as well. things are moving through the bay bridge toll plaza as a result of the traffic getting through after that. we do have slowing through berkeley and the berkeley curve. the span across the golden gate bridge looks nice. keep in mind we still have temperatures around freezing. may have been ice that formed. back to you guys. >> 6:50 now. an important phase in sheriff ross mirkarimi's trial starts today. a judge is expected to start deciding what evidence will be allowed. christie smith joins us live in san francisco with details. a key piece of video evidence. >> reporter: that's right. the judge has to consider a couple of key pieces of potential evidence including a statement made by a neighbor and also videotape shot by a neighbor of san francisco sheriff ross mirkarimi's wife ely anna lopez and whether they will be allowed.

mirkarimi is charged with three misdemeanors including domestic vie lan violence battery. it shows a bruise on her arm saying her husband had done something similar but the defense says she was speaking as someone concerned about a potential custody issue and not necessarily as a crime victim. and they describe the neighbor's statement as hearsay. lopez and mirkarimi have gone on to say any abuse is not true, that hearing starts at 10:00 but a judge has said that mirkarimi doesn't necessarily have to attend. reporti ining live, christie sm. >> a scary start for people at an oakland apartment complex. firefighters had to bang on doors at the apartment building on schuyler street. a heater sparked a blaze in a bedroom. that happened about 3:30 this

morning. firefighters actually had a tough time finding that fire because it wasn't visible from the street. working smoke detector desire help alert tenants. one woman had to be taken to the hospital as a precaution. >> the largest city in the bay area facing its 11th year in the red. city leaders hope ha residents will be hop to higher taxes. as bob reports it could be a tough sell. >> reporter: right now -- the topic of discussion tomorrow at san jose city hall during the city council meeting will be a possibility of a sales tax increase to help fight the budget deficit that's been plaguing san jose for years. mayor chuck reed wants the city to poll resident soos see how open they are to the possibility of a quarter cent to half cent increase in the sales tax. that would bring in an extra 35 to 70 million a year. if there is enough support for

that the city would possibly try to put this on the november ballot. the timing would not be ideal considering the fact that the sales tax is only going to rise in july to help pay for b.a.r.t. to san jose. you've got to consider that governor jerry brown is looking for a half cent increase in november to help with the state's budget deficit. there is also an argument against this from other city council members, saying that they should be cutting employee expenses first. which the mayor says he's trying to do with the pension measure that goes before the voters in june. reporting hive in san jose, bob redell, "today in the bay." >> we have an update to breaking news out of hoof ohio. marla tellez joins us in our newsroom with more. >> i finished watching a live press conference with local authorities including a member from the fbi, the fbi is now taking part. they say one person is in

custody in at least four students have been shot. those students were air lifted to local hospitals. unfortunately the extent of injuries is thot known at this time. we do have a live look at the scene. this is from our local nbc affiliate wkyc. you can see parents lined up outside this high school in chardon, ohio waiting to get reunited with students. officials say the gunman walked into the cafeteria about about 7:30 this morning, that was eastern time, and opened fire. we're just learning authorities say the gunman is a student at the high school. at this point they are working on a motive. the focus is reuniting parents with children. the local affiliate spoke with one of the students who is very shook up as you're about to hear. he says he did not go to school today and for that he's grateful. >> i think i'm very lucky because i would have been walking in the school.

i would have been walking in the school when this happened. >> again, one shooter is in custody. authorities say he is a student and at least four students shot in the cafeteria at chardon high school. this is all about 30 miles east of cleveland. i should also mention the school was originally put on lockdown, that lockdown has since been lifted. we are working to learn the status of the students now hospitalized with gunshot wounds. laura and jon. >> thank you. as a parent you don't want to think about that. can't imagine that. it's anything but smooth sailing for the america's cup yacht race in san francisco. the examiner reporting a lawsuit filed against race organizers and the city of san francisco over environmental approvals, could slow down preparation for the big event or delay construction deadlines. a group called waterfront watch and aaron pesingin filed the suit saying the race's environmental impact report is
