those hov lanes could be a little more crowded on your way to work. that story coming up. >> a live look outside. city by the bay, san francisco. it's the first day of march, this is "today in the bay." >> good morning to you. thanks for joining us. it's 5:00 now. i'm laura garcia-cannon. >> good morning everyone. i'm jon kelley. time to check win meteorologist christina loren. it is day one of march but sounds like day two of the winter like feeling weather. >> last day as well. we're going to see conditions greatly improved by about noon today. but we still got to get through the showers and the bitter cold this morning. 41 in san jose, and temperatures will continue to drop off as we head through the next hour. we do have light showers rolling through the north bay. that's it for the time being. we'll let you know when the activity will ramp up, when showers will clear, how much we received so far and what you can

expect for the all important weekend. let's check on the accident with mike. >> you're talking about the one over by the bay bridge. northbound 880, transitioning to eastbound eighty. up to berkeley we had a deadly accident about 3:00 this morning. it does sound like the investigation has completed and all lanes and activity are clearing from the area so. no more distraction for drivers, unfortunately we did have that deadly accident there and we're following this. i'll let you know if there are more details to report. as far as the traffic, we have a live look, you see a light volume. that's why things weren't held up that much. just the fast track lanes, the cash lanes as well as the hov lanes at the bottom and sparsely populated. we're talking hov and bob is out with the cool kids cruising around and bob, you see there are some changes with the trendy hov stuff and stickers. what's up? >> reporter: yeah, good morning. starting today, march 1, hov lanes will be open up to a new

class of solo drivers, namely, people who have one of these -- looking at the new green clean air vehicle stickers being issued by the state air resources board, for people who have near zero emission cars. not zero but near zero. right now only two that qualify, the 2012 toyota prius plug-in hybrid and the 2012 chevy volt. this program is not to be confused with the white sticker program that's for fully electric or hydrogen or natural gas vehicles and not to be confused with the yellow sticker program with hybrids that ended last summer. when that program started many complained because it dumped 85,000 new solo drivers into the hov lanes, the air resources board has learned this time around, with the green sticker program they are only issuing 40,000 stickers, this program

does expire at the start of 2015 but could be extended like the yellow sticker program back when it was up and running. you wouldn't be surprised to hear, there's a good chance people are going to take advantage of this. especially when you look at the gas prices. i want to throw these numbers up. you can see in the bay area we're averaging around $4.30, close to $4.40 in san francisco for a gallon of gas, an increase of almost 20 cents over the past seven days. on northbound 880, going through fremont, a smooth flow this early. bob redell, "today in the bay." >> nice traffic update there. thank you, bob. cal train riders finding out if they have to pay more for their next trip. there is a proposal to increase one-way cash fares. the increase aimed at getting

more people to switch to the clipper card system which keep payers at their current rate. >> the board will vote on a plan to fund a popular fee bike storage program in san francisco. warm planet stores at the fourth and king street station, however, the service is so popular it's gotten out of control that the center can't afford it. caltrain expected to allocate as much as $10,000 a month to help fund the program. >> police looking for help in nabbing a bank robber. this man entered the the bank of the west on california boulevard yesterday just after 9:00. the the teller handed over the cash and the suspect ran away. police do not think the man was armed. >> police looking for a man who harassed a teen girl in newark. it happened at parking lot at the shopping center on tuesday afternoon. the man approached the 15-year-old and tried to talk to her. she felt uneasy so she ran away but he followed her until she

went in a store. anybody who happened to see this incident should call newark police. >> investigators will get back to the scene of a south bay fire trying to determine the cause. this is an update to breaking news yesterday. the home's shake single roof fed the flames. all of the tenants did manage to get out safely. >> another deadly day for u.s. troops in afghanistan. marla tellez is in our newsroom with the latest overnight developments. good morning. >> good morning. a u.s. official says two more nato troops were shot dead by afghan gun men in the southern part of that country early this morning. this happened outside of kandahar, one of the gun man believed to be an afghan soldier. this is the latest 18 series of attacks following protests over the accidental burning of the koran. in the last weeks six nato

service members have been killed. >> after drifting at sea since monday the "costa allegra" has reached shore. more than 1,000 had been without power and proper food since the ship lost power after a fire broke out in the engine room. the allegra is a sister ship of the infamous "costa concordia." >> another emotional day in chardon, ohio, as the community comes together for a unity walk to school today. students and locals plan to march about a mile to chardon high three days after five students were shot in the cafeteria by accused gun man t.j. lane. three died. the school reopens with grief counselors on hand though classes officially resume tomorrow. prosecutors must officially file charge es against tj lane by the end of the day. they are asking a judge that he

be tried as an adult. >> lawyers in the domestic violence case against sheriff ross mirkarimi will wade through the jury pool. 100 filled out questionnaires. including eric mahr. the potential jurors are expected back in court on monday. no court action is expected in the case today. the judge will hold a private hearing to determine if mirkarimi's ex-girlfriend can testify. she filed a police report saying he abused her during their relationship. that has not gone to trial. >> accused killer joseph nasoheading back to court. he waived his right to a speedy trial saying he needs more time to prepare a motion to dismiss. the 78-year-old representing himself in his murder case, nasoaccused of killing four northern california women between 1977 and 1994.

prosecutors say they will seek the death penalty. >> a retrial in the 1999 murder of former raider fred balitnikov's daughter on the stand. a jury convicted the defendant of strangling her but the verdict was thrown out in 2009 over misconduct by prosecutors. in court yesterday ali testified that he killed her in a fight, then tried to make her death look like a sex crime to throw off police. >> california's bullet train no longer speeding towards its groundbreaking. the obama administration backing off of a deadline to get the project started this september. that gives the authority more time to prepare for the construction of the $100 billion project. it was feared missing the september deadline would mean a loss of federal funding but the administration clarified requirements saying as long as progress is being made to getting the project underway the funding will be there.

>> where is the weather. christina? >> so far this weekend we've got beach-like weather. so if you wanted to hit the sierra nevada, we've got ideal conditions there and ideal conditions at our local beaches here in the bay area with a big time warm-up on the way. this morning we still have showers around. the bulk of the moisture sits to our north right now. moving south of ft. bragg, all of that moisture is slated to move to the south of the golden gate bridge. before noon. then throughout the remainder of the day temperatures will climb just a touch from yesterday's highs and high pressure will build in. that means the warm-up is on, it's going to kick the jet stream. for us we're going to see a gorgeous weekend so. a dramatic difference between what we'll see today and what we expect on friday. bright and mild, the mid to upper 60s, so if opportunity

warmth, if you want to wear short sleeves, you can do so. make sure you've got the winter wardrobe ready. only breaking into the mid-50s in the warmest cities across the bay so you need that jacket all day. you can get rid of the umbrella afternoon. i'll let you know when we get another round of rain, we'll tell you how warm it's expected to be in your city. a lot of moisture out there, i bet there are problems on the roads. >> you know, we're warning folks about with continued slippery conditions. watch those speeds. in the north bay we have a separate issue involving a big rig, it is eastbound 80. you see the sign on our map. out of fairfield through vacaville opposite your main commute but a big rig off the road and took some trees down, so there are no injuries put a lot of activity. there is slowing in the area.

>> some pretty impressive cell phone video sent in by a viewer. check it out. a fire hydrant bursts in campbell. the intersection near hamilton avenue flooded yesterday afternoon while fire crews worked to turn it off. the leak was eventually capped and things appear back to normal this morning. >> drivers heading out on interstate 80 and highway 50 this morning need to get chains on tires as snow continues to fall. this is what it looked like in masser county last night. you can see the winds gusting up to 30 miles per hour making driving dangerous in some of the areas. more snow expected all over the

area. >> good news for skiers and snowboarders. you want to check the forecast now, christine has a look at it. >> a good looking forecast for the weekend, a couple of more cold days before we hit the 70s again. i'm talking about maybe 76, 78 degrees in the cities across the bay come sunday. san jose, about 76 on sunday for us. so comfortable conditions. this morning it's cold and we have showers on the way. we have a little shower activity only up in the north bay, that action will ramp up as we head through the next few hours. we should get a dry break, and it will stay cold today but we'll lose the rain chance. you can breathe in the clean air courtesy of showers coming through. you can see at 8:00 a.m. a few spotty showers across the greater bay area. but as we transition through the second half of the day, starting at about with 11:00 a.m., all of the showers turning. and by 2:00 a dry bay area. cool all day, 54 in fremont.

effects are there. slick conditions. we have this issue, it's not weather related but a deadly accident on northbound 880 around the transition as folks were heading up. we had activity on the shoulder but it's cleared up. crews are gone and no further flop necessary. an easy drive as we approach the bay bridge and the toll plaza. we're looking at a wider view. kalt caldecott tunnel no delays. out of the east bay, a smooth flow but eastbound 580 slowing through livermore, no incidents, we'll track that. you continue way further east, bring those chains to the sierra. you'll continue to need that. san jose moving but a blip as well but more folks hitting the road that might mean more slowing. we'll look at the golden gate bridge, easy drive between the city and the north bay.

i'll track this for early slowing. >> it's 5:18. fed chair ben bernanke will return to capitol hill to talk about the future of the economy. what he says could affect markets. for details on that and the rest of the news before the bell we turn to jackie deangelis. good morning. >> good morning to you. the futures are a touch higher after stocks posted modest losses yesterday. investors were surprised when ben bernanke didn't give hints in his congressional testimony that the sfed thinking about more steps to boost the economy. he is back on capitol hill today talking to a senate panel. asian markets fell but european markets are higher. data today in the u.s. on unemployment, personal income and spending, manufacturing and construction spending so look for those. we saw the dow fall 53 points wednesday to 12,952, but the dow had a great february rising for the fifth straight month. the nasdaq which touched 3,000 fell to 2966.

united and continental will take one of the last big steps toward completing a merger when they combine their computer system this is weekend. the move later saturday morning and affect systems that handle ticketing, and frequent-flyer miles. the flight schedule is lighter on saturdays but united is thinning out to ensure the switch will go smoothly. airtran is adopting southwest policy concerning overweight passengers. southwest bought airtran. starting today the passengers which southwest calls customers of size have to buy a second seat if they travel coach. airtran will apply the policy to any one who can't sit in the single sweet the arm rest lowered. >> we want to warn awe beachgoer information here today, love is in the air. it's mating season for harbor

>> oakland raiders kicker will spend the off season dealing with consequences of misdemeanor battery charges. a judge ordered the kicker to take 30 hours of anger management and substance abuse classes and perform 30 hours of community service. the sentence is part after plea agreement after his arrest for shoving a woman at a nightclub back in 2010. he was also ordered to stay away from the woman. >> bay area scientists need help for the search for alien life. they need help sorting through the signals from outer space. the institute has created a public search site to let volunteers track telescope data. the city needs hundreds if not thousands of volunteers to help

makers work. it's not just students but faculty, community members and others much like this day of action from back in november. this is video from san jose state. the issue again, the number one issue, the cost of education. they say they refuse to accept massive tuition hikes and outrageous student loan debts while banks and corporations make big profits. occupy cal is teaming up with other colleges and really this is going on up and down the state. happening for the next few days. here there will be a noon time rally, then at 12:45 they are marching to oakland city hall. and then this leads up to what they call the 99-mile march to sacramento. over potential cuts to education. that's on monday. the big push, they say, to see millionaires and banks pay more for education. reporting live at uc-berkeley, christie smith, "today in the

bay." >> after 26 long years of waiting the parents of a murdered woman bringing their daughter's body home. >> we just cried. that we're finally bringing her home. >> 16-year-old chevy wheeler vanished in 1985. she was a victim of the speed freak killers. this week her parents traveled to stockton to retrieve her remains. tonight they will hold a private memorial with their daughter's friends and family. afterwards they will bring her urn back to the new home in tennessee. >> we never gave up to find her, we looked and we looked and we wanted to find her so bad. >> convicted killer wesley shermantine directed investigators to where wheeler's body was buried. wheeler's parents say they are not buying it. >> it is 5:33 now.

a peninsula special ed teacher accused of physically abusing her students is expected in court this morning. alexa will be arraigned on nine misdemeanor charges including child endangerment, accused of twisting a student's wrist and kicking a child in the stomach. she is on administrative leave. >> in the meantime t redwood city school district says it will discipline six employees for failing to report that alleged abuse. an internal investigation found the employees knew what was happening but did not report it as required by law. the assistant district attorney says those employees will not be charged. >> google's new privacy policy eternally changing now starting today the company is merging all the ways it tracks you across google from youtube to gmail. scott mcgrew is in the newsroom and says you can limit what information company collects. >> right.

a few minutes ago we talked about with at the top of the show the european union announced that google's privacy policy definitely breaks eu laws. google has gone ahead with this privacy policy change as of midnight so it's been effective for about six hours in california time. but the eu this morning saying it breaks eu law of what google is going to do about that we're not sure. to your original question, do you want to actually block google from knowing about you? there are some advantages to google tracking you. if you search on google, say about the band grateful dead t next time you're on youtube you're going to be seeing gradeful dead videos. there are those who find it creepy. the best way to defeat this is don't log in with your user name when you use services like google search or youtube. you see gmail here. you have to log in when you use gmail.

you. the key to this is that they can go in the hov lane like we are now on southbound 880 through fremont, by themselves. as solo drivers and that's because the california air board has initiate add program starting today if you have one of these here, i can put the video up, it's a green clean air vehicle sticker. you can go solo in the hov lanes. this is for vehicles that are near zero emissions. right now there are only two that apply. the 2012 chevy volt and the 2012 toyota prius plug-in hybrid. this is not to be confused with the white sticker program that's been out there. that's for true zero emissions that are fully electric or run on natural gas, not to be confused with the yellow sticker program. that was just for hybrids. at the time when that program was rolled out a lot of carpoolers complained that it was clogging up the hov lanes

good morning to you. it's cold out there this morning. grab a jacket and hey, surf's up out at pacifica. we have our live reporter allen out there this morning braving the cold to show you these very large breakers. up to 17 feet and high surf advisory in place. temperaturewise right now, it's a little too cool to go surfing. 49 in oakland and 48 degrees in novato. as we head throughout day we'll see that situation greatly improve after the front passes. that will be past noon. so if you want to hit the beach if you are someone who has the wet suit and you brave those waters you're going to have better conditions in terms of safety. and better conditions in terms of the rip currents. as you can see light showers pushing to the south of clear lake, a little more action through santa rosa, staying dry south of the golden gate bridge. high pressure will push it out of the way and the warm-up is

called it constructive and cordi cordial. john boehner, the republican leader on the house side said he was encouraged by the attitude and tone. they have been at odds over jobs, spending, energy, gas prices, the keystone pipeline. it looks like they at least have the spirit of cooperation to try to work some of this out on jobs, a republican bill to help small businesses and help them create jobs. the white house says it's similar to some ideas that the president has. one area they are far apart is up for a vote today, this mandate by the obama administration that employers including those affiliated with churches, would have to cover birth control in their health insurance plans. now, here on capitol hill today they are voting on an amendment that says that employers would be able to object on religious grounds but it looks like that's not going to pass. >> thank you very much. >> three california political groups are suing their ex-campaign treasurer for fraud.

the committees say kindy dirky is linked to thousands of dollars in missing funds. durkee is facing mail fraud charges. since her september arrest several nonprofit and political clients including dianne feinstein accused durkee of misappropriating millions from their accounts. >> the u.s. supreme court could have the final say on shocking images the government wants on significant raet packs. the judge ruled yesterday that forcing tobacco companies to put images of dead or diseased smokers on packs is unconstitutional. the fda approved nine graphic images including a graphic picture of an autopsy table. the manufacturers sued calling it a violation of free speech. the courts agree so far. >> starting today the department of agriculture is requiring detailed labels on 40 of the most popular cuts of beef and poultry. those will list calories,
