projections. bob, good morning. >> reporter: good morning to you, marla. in a few hours a group of bay area lawmakers will come here to san jose city hall to request an audit of the city's finances and pension obligations. you'll be looking at a letter there signed by the seven state senators and assemblymen requesting the review of the past three fiscal years and all projections for pension estimates during that time. their colleagues in sacramento decide on wednesday whether to approve this request. this comes after nbc bay area's unit found that mayor chuck reed inflated the estimate of future pension costs by hundreds of millions, allegedly to strengthen his argument in negotiations with unions and workers that the city needs to cut back on pensions. incidentally, tomorrow the city council will meet to consider a measure going before the voters in june, if approved, would reduce pensions and force employees to contribute more.

>> the union city woman accused of killing her former classmate is expected to return to court. 27-year-o 27-year-old faces charges in the killing of michelle le. prosecutors say esteban killed le in a jealous rage. >> opening statements begin today in the trial of a man accused of killing a musician during a drive-by shooting. christopher manseenis is one of 4 accused of gunning down dewey tucker. tucker was driving when police say the men mistook him for a rival gang member. two other men tied to the shooting will be tried in april. a third man will be tried in june. >> three men accused of a triple murder after a tattoo party will

be in court. the three are expected to be arraigned in connection with the shooting deaths of three people. the men allegedly shot at a green ford explorer outside of a tattoo parlor. seven people were hit. three were killed. >> police are still trying to figure out how a santa rosa teen consumed enough ghb to kill her during a slumber paefrmt seven months after she died police don't know where the lethal dose of the drug came from according to the press democrat. she and her friends apparently thought they were drinking vodka but may have ingested a household cleaner that looked like vodka. police say they are still following leads but do not think this is a criminal case. >> thousands of college students want legislators to hear their voices when they hold a rally at the state capitol. marianne favro joins us with more on the upcoming rally. good morning. >> reporter: good morning. at 6:00 this morning more than

40 students here at evergreen college will head to sacramento. some of the students already are arriving this morning, they will be joined by hundreds of other students from throughout colleges throughout the bay area, including students from uc santa cruz. they say they also plan to head to sacramento today to protest drastic cuts to classes. more than 200 students protested blocking entrances to the university and forcing most classes to be canceled. students at uc-berkeley also held a protest thursday and many of those students say they, too, plan to head to the state capitol this morning as well as students at san jose city college and also some students from san francisco. the students are going to be asking for two things, they want to restore funding to higher education but also asking for the 1% to help pay to make college accessible for all students. i'll tell you more about it when they come here with the bus coming up in a live report in about a half hour.

but in the meantime, back to you. >> thanks. 5:05 now. the music world is mourning the death of a guitar legend. san francisco native ronnie montrose died saturday after a battle with prostate cancer. he was 64 years old. in 1973, he formed the band that bore his name. he performed with some of rock's biggest stars. >> police looking for help as they step up patrols. people near a park complained about young people drinking and doing drugs near the entrance. if you see suspicious activity call burlingame police. >> major league baseball is disputing claims that the a's planned move to san jose is dead. the commissioner's office says quote nothing's changed. the committee has been beating, we were very surprised by the new york daily news story. no determinations have been made at all regarding the the a's

situation. on saturday the new york daily news reported that the mlb would block the move to san who sigh because commissioner bud selig could not get enough owners to revoke the rights. the a's general manager says the daily news story is just speculation. >> want to check the forecast now. no speculating. christina has the details. >> yeah. speculating we have a little bit of everything this week. good morning to you. we're starting out the work week with a nice dry beautiful monday. then things change tuesday. we get some showers just in time for tomorrow morning's rush. so, mike and i will be here to guide you through the showers tomorrow. right now you might have to fight through some fog on the way to work, especially over our local bridges. we're looking pretty clear inland, waiting on the fog to creep in which will likely happen through the next few hours. the visibility not too bad except for over the golden gate bridge and the marin county coastline.

throughout noon today, up to 60 degrees inland. 63 by the bay and 55 at the coast. so, it will be about 5 to 8 degrees cooler than yesterday with highs overall probably about 50% more cloud cover as we head through this afternoon. a few high clouds. tomorrow morning we get showers early, so we'll be here to guide you through those. i'll continue this futurecast, tell you when the showers clear. more importantly when the 70s return. first we'll check your drive. >> folks, we'll take you out to the highway 4, christina talking about potential for fog off the delta. we don't see problems for highway 4 or across the bridge but watching that. highway 4 at the limit all the way through pittsburg and concord and 680. we'll go south, then check your westbound commute. 14 minutes out of the altamont pass. no accidents to the dublin interchange. clear drive here for 680 through

sunol. and the castro valley y and the approach to the bay bridge. the incident at 13th cleared off of the reports as well as off of the roadway. and the east shore moving smoothly. a look at the san mateo. both directions westbound moving smoothly over the water a. clear view. no winds, at least not here. >> we like calm. >> parents needing to keep tabs on their teen driver can get some help thanks to an app on their phone. aaa developed on board to pinpoint where the teen is driving. parents can set limits on speed and curfew and they are notified if those are not obeyed. parents love it. >> he has not had a single accident, hasn't had a speeding ticket, any kind of violation so we feel it's helped in that way.

break from the heater over the course of the weekend. hopefully you had a chance to do that. great news when it comes to your pg&e bill, not just for february but that's a good looking bill but this month looking mild as we have the 70s back in the forecast as of this upcoming weekend. good monday morning to you. thanks for waking up with us. you can see we do have fog. you want to give yourself plenty of time this morning to reach your destination. this live picture of the golden gate bridge shows you where the fog is the thickest over the open water bridges. one of the reasons why we have that dense fog is because we don't have a lot of wind. calm winds, clear skies, make way to dense fog. so, this morning, overall not bad. the situation will likely get worse. temperatures this morning are on the cold side. 46 in san jose. not bad there but you are at 37 degrees in santa rosa. rain on the way as of tonight. starting about 11:00 p.m. and then that front will slide to

the south throughout the overnight hours pushing this out in time for your morning drive. we meet back tomorrow we'll track showers on the radar. nonetheless, not anything too heavy. we'll see these showers come through. they will probably get the roadways slick. overall we're not expecting major flooding as we'll likely pick up .1 inch at best from this next round. however, that means more snow in the sierra nevada. we'll talk about how much. today, 60 at noon, 56 by the bay. and 55 degrees at the coast. temperatures really don't fluctuate that much until tomorrow. we'll drop to 56 degrees, then right back up to 64 wednesday, 70 by thursday, holding on to the 70s as we kick off the upcoming weekend. a time change ahead as well. let's check your drive with mike. >> right, spring forward. we'll hold off for that. you'll stay on time. for the south bay, look at these speed sensors, the northbound commute close to the limit.

no problems along the peninsula. up to the north bay, we do have an issue. there is an accident with bodega avenue. that will be an issue for local commuters. if you are on 101 through the area, no major problems right now. petaluma all the way to novato. we had an accident that has cleared and we haven't seen slowing there. a little blip at the 37/101 interchange. likely slowing for the interchange as they should. down to the approach to the city where we have a fog advisory for the golden gate bridge. that's the only issue. lower visibility. thick fog below 300 feet. no problems for the commute. across the bay bridge an easy drive. a light volume here. we see that the low clouds are blocking our view of the oakland area and berkeley but we see the east shore freeway. 880 shows a smooth flow past the coliseum. back to you.

>> 5:16. worries about the conflict between iran and israel affecting the markets. for details on that and the rest of the news before the bell we turn to jackie deangelis. good morning. >> good morning. the futures are lower, coming off the mixed week for the markets, investors point to ongoing concerns over greece's debt crisis, also china lowering its gdp forecast raise concerns that the second largest economy is slowing down. asian and european markets are in the red. oil prices slightly lower below $106 a barrel despite the shutdown of part of a pipeline near chicago. much of the focus on friday's jobs report. we'll get data on the services sector and factory orders. we saw the dow slip 2 points to 12,977, the nasdaq lost 12 to close at 2976. gm is expected to announce that it will start offering pickup

trucks that run on natural gas and gasoline by the end of the year. tomorrow chrysler will announce it's going to build the first production of its bi fuel truck in june. there are only 400 public natural gas stations in the united states. apple hits a milestone passing more than 25 billion downloads from its app store. the app store opened in july 2008 there were 800 apps, now more than half a billion out there. apple had been running a contest for the occasion. the person who broke the 25 billion mark would win a $10,000 itunes gift card. not bad. back over to you. >> all amazing stats. thanks. >> oakland needs your help finding pieces of a historic downtown fountain. thieves pried open the bronze sections early last month. the pieces look like basins and weigh about 200 pounds each. police are searching scrap metal

yards to see if they were sold as scrap. they are worth about $5,000. >> a peninsula city is without a police department this morning. millbrae police handed over control to the san mateo sheriff's department this weekend. the move is expected to save the city about $1.7 million this year. no officers were laid off, the department's 18 employees now work for the sheriff's office. >> 5:19. san rafael could become the latest bay area city to go green. city leaders will neat talk about banning plastic bags and home containers, modeled on marin county. under the plan, customers have to pay a nickel for a paper bag. >> 5:19. coming up a bay area court house trying to help the parents of young children. we'll tell you how. >> the ivy league schools that could now be cheaper to attend for high school seniors than state schools. >> an apple announcement. we'll take a look.

help take the difficulty out of court appearances for parents. a drop-in daycare center will open its doors at contra costa county's justice center in pittsburg. parents can drop off kids up to 12 years old for free while they are in court. volunteers from the nonprofit group kid dango will run the center and provide snacks, toys and games for the kids. >> wow. may now be cheaper to send your kid to a prestigious school than a state college. according to a news group, harvard, yale and princeton now thousands of dollars cheaper than state schools for middle income students. tuition costs have doubled at uc and csu schools. many of the pricey private schools have better packages which reduce tuition costs. >> business and tech, harvard grap and yelp ceo smiling this morning on this the first full

day of trading for his company. scott mcgrew joins us. >> good morning. the second most important day for a publicly traded company is the second day. yelp ipo'd friday. there in the middle ringing the opening bell. reminds me of vince. yelp jumped 64% in its surprisingly high initial price of $15. so, will more investors pile in today? that's the question. we'll see when the markets open at 6:30. the other stock worth watching is news corp., the publisher of all of the newspapers in england. the worse the news is for some, the higher news corp. stock goes. why, because investors hate the newspaper business. they think the murdochs may be considering dumping the business and they are happy about that. news corp. makes most of its money from tv like the fox network. looking ahead this week,

wednesday, apple holds an event expected to unveil the ipad 3, this will be the second major announcement fronted by apple ceo tim cook. as far as judging how apple is doing without its founder steve jobs, this is not the event to do that. unless apple announces something absolutely flabbergasting the ipad 3 is going to be a better tablet, better screen, faster, the ipad when it was introduced was a game changer but the ipad 2 just thinner and had a camera. that's not to say the 3 won't be great and everybody won't want it. it's not the game changing technology that we'd like to see out of apple at some point to say yes, we have this enormous future plan. >> we're getting spoiled. >> the anticipation. >> still to come, a homicide suspect in court nearly 30 years after his alleged crime.

as we head throughout this afternoon. it's cold out there, we'll see more clouds to start. then the rain moves in as we head through tonight. i'll time those out as they move on shore as this is proving to be a light system but it's going to bring more snow to tahoe and rain to the bay area. we're talking about that first. let's see if there is anything that might slow you down on singo de march. >> we do have a fog advisory for the golden gate bridge. very low visibility there. we're looking here off the water for highway 4, visibility okay there from what we understand from chp. highway 4 kicked off, this happened about 5:20 so that's 10 to 15 minutes earlier that we see that amount of slowing. also livermore so westbound commute into the area that kicked off early. that may mean early slowdowns. we'll track it west toward the water. >> thank you. 5:30. two developments unfold in the

domestic violence trial of san francisco's sheriff. among them a start of jury selection. christie smith joins us live with what else is on the agenda. >> reporter: good morning. a number of new developments today including a name being called to testify that you might not expect. that is former "san francisco chronicle" editor phil gronstine may be called as a witness. and both sides in this case are saying that he could actually be a benefit for their case. according to the chronicle after phone records show that bronstine talked to a key witness, a san francisco sheriff's neighbor before she went to police, that's the reason he may be called. and also after she shot a video showing a bruise on her arm. lopez has since denied that her husband abused her and mirkarimi pleaded not guilty to misdemeanor domestic violence

charges, also today a decision expected on that video from an appeals court, whether it will be allowed. and attorneys will question potential jurors starting with a very large pool they did of nearly 200 people. the stril trial is expected to about two weeks. reporting live, christie smith, "today in the bay." >> san francisco police are looking for possible victims of an alleged child molester. kyle was arrested on suspicion of having sex with a girl over an eight-year period. any one who may have information in the case is asked to contact south san francisco police. >> 5:32. the oakland teen accused of killing his adoptive parents is expected to enter his plea. 15-year-old moses kamin will be tried on two counts of murder. bob cayman and susan poff were

found dead in their car on january 27th. investigators say frustration over the teen's recent suspension from school may have led to the killings. >> bay area man accused of killing a high school classmate 27 years ago will be in court this afternoon. steven carlson is expected to enter a plea. he was arrested in august accused of willing 14-year-old tina, a freshman in pleasanton and a classmate. she was last seen april 5, 1984. the body was later found along side 680. she had been stabbed multiple times. >> san francisco police trying to sort things out after what is described as a riot outside a mission district bar. officers arrived at 16th about 2:00 sunday morning after reports a large group was involved in a fight. no word on how many were arrested. the news comes as the city gets ready to issue the results of an economic study on how night life

affects san francisco's bottom line. the results will be released at noon. the city commissioned the study after a series of violent crimes outside and around nightclubs. >> bob redell joins us with new demands of the audit of city finances. good morning. >> reporter: good morning. a little later around 8:00 there will be a news conference outside city hall where legislators will be asking for an audit of the past three fiscal years of the city of san jose and about their pension projections during this time. this is in part in response to an nbc bay area investigative unit report that found that chuck reed had overinflated the pension projections for 2015, perhaps in attempt to gain leverage in negotiations with unions and such. assembly man jim bell, thanks for getting up early for us. assuming you get audit request approved what would you like to see come out of this?

>> right now we're considering a lot of legislation in sacramento to reform pensions, and tighten up the fiscal accountability on pensions, and i think this audit will help us. it's a problem that's occurring all over the state of california, not just in san jose. so we need to look at san jose's books, find out if there's any things we can do to improve it and change state laws as necessary. that's what we hope to do. >> you are trying to help the city. is there part of this with what happened with the mayor? >> i think the way they go about making projections ought to be transparent. we ought to have an open process and established so we can truly see what the liabilities of the city are. there are serious liabilities and we ought to find out what the true facts are. >> reporter: you sim pa thoois thiz with a leader who he is in the position of trying to balance the budget and you have employees who want their benefits. >> i served on the city council

for 14 years and chaired the finance committee and i definitely sympathize with the mayor. we had crisis when i was on the council. it's a tough job but we need to get the laws straightened out. >> reporter: thank you for being up bright and early with us. we'll have a news conference at 8:00 on the steps of city hall. reporting live in san jose, bob redell, "today in the bay." >> thank you. did you feel it at 5:36, we're getting reports of an earthquake in the east bay, it happened, struck moments ago two miles east of richmond. the usgs is not recording a magnitude but we're getting word of a quake that shook up the east bay moments ago. we'll bring you the latest once we learn more. >> students from college campuses will hold a rally in front of the state capitol

building. an update on the students demands, marianne, good morning. >> reporter: good morning. at 6:00 this morning about 50 students here from evergreen college will get on a bus and head to sacramento for an occupy education rally. you can see many of them are gathering and grabbing breakfast. we spoke with one of the organizers about the goal of the rally. >> we're asking the state to invest in education, overall it's an investment in themselves and i think that's something that our government needs to realize and really deal with is that education is something that cannot be cut and it's something that is so crucial to our economy and it's something that is an overall investment in the state's future. >> reporter: the student body funded this trip so all of the students here do not have to pay to go to sacramento. they wanted to give them an incentive to get up early to do this protest. and one of the things they are asking mor for is to restore

cuts to higher education, also asking for the 1% to help fund education for all people especially those who can't afford it. other students are also going to be going including hundreds from uc santa cruz and uc-berkeley and some high school students in san francisco. reporting live at evergreen college, marianne favro, "today in the bay." >> thank you. talking about the earthquake near el cerrito. we have reports it was 4.3. you have more information? >> yeah, one mile north of el cerri cerrito, 4.3, no reports of damage yet. but as you know, those will slowly trickle in the there are reports. we'll let you know as we get that information throughout the morning. i'll have a map ready. right to your weather forecast now, grab your jacket, leave your umbrella at home. but temperatures are cold and we've got an area of low pressure that's going to bring us showers through tonight.

the area of slp going to bring a weak front through the area that's going to kick up the winds which are still rather calm but those winds will be gusty. starting at about noon today. there is a wind advisory through tonight for your higher elindications, the east bay hills and the north bay mountains. the timing of the showers, at 5:00 a.m. the front arrives between 2:00 and 5:00. you'll get shower activity between 2 and 3, the front will slide to the south between 3 and 4 along the peninsula, then will end up over the south bay at 5:00 a.m. tomorrow. you might have to fight through some showers on the way to work toe tomorrow. not the case today. we have fog out there but it's not too bad. mostly in the north bay down along the open water bridges. we wanted to let you know about that work, 5:33, one mile north of el cerrito. a pretty good sized shaker. we'll have more information as

a light volume now at the limit from the bay bridge toll plaza down to milpitas. >> fire in the bay view district is being investigated as possible arson. the fire began at an empty home on oak dale avenue saturday night, then spread. 30 people in all were displaced by the flames. neighbors saw -- say they saw a ball of fire and then smoke filling their homes. one woman says if it wasn't for a man walking by people may have died. the katalion chief says fires in abandoned buildings is dangerous because the fire can burn for hours before anybody notices. >> the story about the bees for the giants coming up in a bit. but also police want you to know they are searching for a serial tire slasher.

police say most cars had more than one tire slashed. any one with information should call palo alto police. >> we're learning giants fan bryan stow left the medical center. he had been moved to a distant facility with an aggressive physical therapy program. so far the family has not said where the facility is, only that it's a long drive from stow's hometown. stow was left with severe brain damage from a beating after the opening day game against the giants last year. >> you plan to build a new stadium, faces what could be its final hurtle. a judge will hear whether the financing should be approved before construction begins. opponents say the $850 million construction loan is too risky. council members insist that residents will not have to should ter the burden of repaying the loan. if a judge decides no voter approval is needed construction
