>> good morning to you. thanks for joining us. 6:00 now. i'm laura garcia-cannon. >> and i'm marla tellez. in for jon kelley. we want to get straight to the forecast including our top story, did you feel it, there was a 4.0 earthquake in the east bay, this is all happening near richmond and the el cerrito area. >> we're getting reports from people in the bay area, south of san ramon, from the sunset district. you had a friend? >> jenny says she felt it in sebastopol. >> we have reports across our facebook page. over 25 reports came in over the past 15 minutes, as far south as half moon bay, palo alto, reports of picture frames knocked off the wall. as you know, if the you've been in california, a 4.0 is a pretty good size shaker. it was located one mile north of el cerrito, at 5:33 this morning. we haven't had reports of major

after shocks yet but i have heard a report of at least one at this point. we're going to keep you updated. keep this in mind. grab your jacket. we'll see sunshine and the 70s. mike's got a look at what you can expect on the drive. >> the drive is okay but it's the ride that we're worried about. like you said, it's a 4.0 and that's not the biggest number we've seen but seems like this one was felt in a wider radius by a lot more people than typically report this. b.a.r.t. system, a standard check. they hold the train and run their system check as far as the computer and reports of problems on the rails. the system, the spokesperson tells us, no problems. they restored service for all of the trains. because they did have to pause the trains for safety sake while they did that, 5 to 10-minute delays for the system. but you should be okay for the morning train. a look at the roadways, no problems reported as a result of this. we'll look at the san mateo bridge over the water. there was a disabled truck on

92, westbound in your commute direction. that has cleared from the roadway but we did see slowing across that flat section for a few minutes. you're okay getting across the bay area bridges. watch for the heavy fog across the golden gate bridge. >> busy morning. thank you. it's also going to get loud and noisy in sacramento today as thousands of college students from across the state will hold a rally at the capitol building steps. marianne favro joins us live from the evergreen valley college where students are gathering with a list of demands. good morning. >> reporter: they certainly are. good morning to you. you can see the students are already lining up to get on the bus, they have two buses out here. and they are expecting more than 50 students will be heading to sacramento today for the occupy education rally. we spoke with one of the student organizers about her personal reasons for wanting to attend this protest. >> i've been at this college for way too long and i'm ready to get out. but the fact is education is too

expensive so it's something that when we invest in education, students can get out of college faster and get into the work world and therefore stimulate this economy. it's something that is critical, education is very important. >> reporter: the student body funded this trip so students you see do not have to pay, they just had to get up early and head to sacramento. others from colleges throughout the bay area will be attending. about 10,000 students total are expected to be at the rally in sacramento today, fighting for -- restore cuts and asking the 1% to do more to make college more affordable for all students. reporting live, marianne favro, nbc bay area news. >> 6:04 now. lawmakers are looking for answers about san jose's true pension obligations. today they will ask for an audit

to get to the bottom about the city's bottom line. bob redell has more on the investigation into questionable projections. bob, good morning. >> reporter: good morning to you. yes, in a couple of hours lawmakers will come to san jose city hall to announce they are seeking this request for an audit of the city's finances the past three fiscal years and what their projected pension estimates were. you're looking at the letter signed by seven state senators and assemblymen requesting the review. their colleagues in sacramento will decide on wednesday whether or not to approve this request. this comes after nbc bay area investigative unit found that mayor chuck reed inflated the pension costs by hundreds of millions allegedly to strengthen his argument in negotiations that the city needs to cut back on their pension. whatever is learned from this audit, if it shapes new pension reform laws. >> i think the way they go about

making projections ought to be transparent. we should have an open process and so we can see what liabilities of the city are. there are serious liabilities and we ought the find out what the true facts are. >> reporter: tomorrow the city council here in san jose will meet to consider modifying a ballot measure, a pension reform ballot measure going before voters in june that if approved will reduce pensions and force employees of the state to contribute more. bob redell, "today in the bay." >> 6:06. the union city woman accused of killing her former classmate is expected to return to court. 27-year-old giz sellelhas hearings in oakland. she is charged with murdering michelle le in a jealous rage. police arrested esteban in september. >> the oakland teen accused of

killing his adoptive parents is expected to enter his plea. 15-year-old moses kamin will be tried as an adult on two counts of murder. robert cayman and susan poff were found dead in their car january 27. investigators say troubles at school and the teen's recent suspension may have sparked the killings. >> an alleged child molester arrested may have more victims. police are looking to see if kyle vote abused other victims. a 36-year-old was arrested on suspicion of having sex with a girl starting when she was five years old. any one who has information on the case is asked to contact south san francisco police. >> 6:07 a. fire in san francisco's bay view district has been investigated as possible arson. it began at an empty home on oak dale avenue satdaay night, then spread to neighboring homes. 30 people in all were displaced. neighbors say they saw a ball of

fire, then smoke filling their homes. one woman says if it wasn't for a man walking by at the time, people may have died. the battalion chief says fires in abandoned buildings are dangerous because they can burn for a long time. >> reports of an after shock after the earthquake this morning close to el cerrito, a 4.0, an after shock. 2.0. >> 2.0, and this earthquake was felt as far north, we have reports now as novato and as for south as palo alto. 5:they 3 this morning. and if you have not chimed in on our facebook page, we have 70 comments over the past 15 to 30 minutes. you can tell just from the size of that response that a lot of people felt this. we'd like to hear from you if you have not reported your earthquake experience. of course you can read what

pleaded not guilty on battery charges stemming from an argument with his wife on new year's eve. the trial is expected to last two weeks. >> right now a beautiful live look outside overlooking city by the bay this morning. it's coming off a gorgeous weekend. want to get the details of what is in store for this week. >> you know, something we haven't seen for sometime, that thick fog is back over the bay area. good morning to you. as a result of the low cloud cover, it's going to be a little cooler today. overall by 5 to 8 degrees but we're still looking towards another gorgeous afternoon with temperatures about 5 degrees above the seasonal averages for this time of year. and yes, still two weeks of winter left before we usher in spring. that will be on the 20th of this month. and the time change is on the 10th. so we're close to kicking off daylight savings. 43 in oakland, and you're 46 in san jose.

so definitely cool enough out there for a jacket. and we're going to see winds pick up throughout the day. if you live in the wind prone areas across the bay, make sure you're ready. wind advisory goes up as of noon today and lasts overnight above 1,000 feet in the east bay and the north bay. a quick shot of rain tomorrow morning, nothing heavy but enough moisture coming through northern california potentially bring in six inches of snow to the sierra nevada above 6,000 feet. your seven-day tells the story. at 56 degrees, a sharp decrease in your temperature as of tomorrow. we're going to warm you up about 10 degrees come wednesday, a little fog, lots of sunshine wednesday afternoon. plenty of sun on thursday. full on sunshine for friday, 73 degrees. and we hold on to the low 70s for the upcoming weekend. always thinking about the weekend. mike's here to help you.

>> we're going to take to you the south bay, a couple of accidents. 17 and 85, minor accident. sounds like things are out of lanes. 880 over through downtown as well, approaching 87, another accident reported there. but again, no slowing shows up here. a little blip for northbound 87, capitol to curtner. volume heading into downtown, look for slowing for the 101 over the next 15 to 20 minutes. lower bay shore moves smoothly. 101 nice drive, then menlo park no. problems for 280. the traffic moves but some might have been woken up. reports that folk desire feel the quake as far south as there a. possible delay for the b.a.r.t. system. every time there is a quake they have to stop the system to do a system check. last we heard no major delays, maybe five, 10 minutes. plan on that so far. we'll look at the bay bridge toll plaza where we have a nice

flow of traffic. we should see metering lights turn on. we have good steady volume down the east shore freeway, 18 or 19 minutes off the carquinez bridge. but that's going to slow as the volume continues to build. look to the maps, i'll show you what else we have. slowing past the merge around the racetrack, that should add 30 seconds or so. every second counts so that's why we point out the blips of yellow. the livermore valley we have now slowing at the dublin interchange speeds into the 50s and 40s where you see the yellow. could cause problems out of the altamont pass. that could make things lighter for the next few minutes. >> thank you, mike. 6:18. republican presidential candidates are campaigning hard the day before super tuesday, depending on what happens tomorrow california could play a big role in selecting the nominee. 11 states are getting ready to cast votes tomorrow. mitt romney and rick santorum are neck and neck in ohio. key battle ground state.

whether the financing should be approved by voters before construction begins. opponents of the project say the $850 million construction loan is too risky for the city of santa clara. council members insist residents will not have to shoulder the burden of repaying the loan. if the judge decides no voter approval is needed construction is set to begin this summer. >> major league baseball disputing claims the a's move to san jose is dead. the commissioner's office says nothing's changed, the committee has been meeting, we were very surprised by the new york daily news story. no determinations have been made at all regarding the a's situation. on saturday, the new york daily news reported the mlb would block the a's move to san jose because commissioner bud selig could not get enough owners to vote to revoke the giants' territorial rights. a's general manager billy bean says the daily news story is just speculation. >> local review site yelp and

there. a look at sunol, a number of disabled vehicles. >> we're going to get updated. we have christie smith out in el cerri cerrito. that was the site of the first earthquake, 4.0 at about 5:33, then we had an aftershock. what do you know? >> reporter: good morning. the question is did you feel it this morning? the answer is absolutely. according to every single person that i spoke with this morning at the b.a.r.t. station. as you said, 4.0 earthquake, hit about 5:33. centered about a mile away from where we are near the golf course off arlington if you know the area a. 4.0 but every person we spoke with said it sure felt stronger. >> i felt the floor. i live in vallejo for one. all of a sudden i was getting ready to leave and the floor started trembling. i said oh, i was scared to go out the door. i'm scared of them.

>> at first it was a little shake and i was like okay, my dogs, did my dogs jump off the bed. and then it was like oh, you know. it shook, you know, side to side. it was -- it was as someone said aggressive. >> reporter: one woman told me she was scared to get on b.a.r.t. this morning worried about getting in the tube. i think as mike mentioned b.a.r.t. is saying they checked the trains and no damage. maybe a couple of minutes delays there. i have heard from a lot of my friends, though, on facebook and a lot saying that absolutely woke up their entire household. one woman, a friend saying it felt like a train rolled under her house. she lives in el sobrante. she is trying to go back to sleech. we were in san francisco, i know a lot of people felt it there. i think it's a good thing we didn't. that's the latest. reporting live in el cerrito.

are gathering. good morning. >> reporter: good morning. 40 students took off in two buses, headed to sacramento to march in the occupy education rally. and we talked with one of the organizers earlier this morning about the purpose of the rally. >> we're asking the state to invest in education. overall it's an investment in themselves. i think that's something that our government needs to realize and really deal with is that education is something that cannot be cut and it's something that is so crucial to our economy and it's something that is an overall investment in the state's future. >> reporter: the student body here raised money so that all of the students who are participating could go. they don't have to pay to get on the buses today. and they will be joined by hundreds of other college students from throughout bay area including uc-berkeley and uc santa cruz which both held protests last week. about 10,000 students total plan to participate in the rally in

sacramento. reporting live from evergreen college, marianne favro, "today in the bay." >> lots of people rally behind that. thank you. >> 6:36. let's check the forecast. meteorologist christina loren, still a nice forecast, not as warm, though. >> yeah. you know, it is not as warm and we're taking a look at that natural ac, the natural cool off the pacific. that is low cloud cover and fog, something we haven't had to deal with the past three days. we had a stellar weekend, sunshine, temperatures in the upper 70s and low 80s. as we head through today, we're talking more about the upper 60s and low 70s as a result of that fog coming in. mostly cloudy start for some areas across the bay especially at the coast. we'll see the sunshine later on today especially taf winds pick up. right now, though, still rather calm except for novato where the west wind at 8 miles per hour. up to 60 degrees by noon inland. 56 degrees as you break for lunch in san francisco and 55 in pacifica at noonl.

shower activity from santa rosa south to san francisco. that front will continue to slide to the south as we head throughout the morning hours. but the whole thing blows out of here by 6:00 a.m. in the south bay you'll get rain between 4:00 and 6:00. lots of cold conditions but good air quality and temperatures climbing as we head through the end of the week. so that's the good news. one day of cooler weather to get through. today not the case. 68 degrees in danville. 73 in san francisco. 68 in richmond and 68 in sonoma. speaking of which if you've been having withdrawals like myself you can catch the giants on our sister station, comcast sports net bay area tonight at 6:35. boy, i missed these guys. they will be back, 6:35. 81 degrees at 6:35 in scottsdale. they will hit 90 degrees. the boys have to play with the heat but i think they'll be okay. dramatic music. really dramatic music.

fine but look at the bottom of the screen as you approach menlo park out of redwood city, slowing to the 50s. that may be an early kickoff to the peninsula drive. westbound here for the east shore freeways, slowing into berkeley. the big problem is around appian. still debris in lanes and a good amount of slowing off of the carquinez bridge. >> people around the bay say they felt it. did you? talking about a 4.0 magnitude quake that struck in el cerrito earlier. christie smith, that's where she is live with the latest. good morning. >> reporter: good morning to you. we were standing in san francisco at 5:33 this morning and i'm happy to say i did not feel the earthquake. but it seems like about everyone else did. i got lots of messages on my facebook page. it was centered about a mile from where we are, we're at the

el cerrito station, 4.0, but everyone we're speaking with this morning says that it felt a lot stronger than that. their beds were rocking. it was enough to wake them right up. >> felt this large shake, and i was shaking and so wow, this is an earthquake and i hope it doesn't get stronger. i mean, everything was rattling in my house. i felt maybe five seconds of fear. >> are you nervous? >> i am. >> reporter: she told us she was afraid to get on b.a.r.t. because she was going over to san francisco. b.a.r.t. as they do after earthquakes they checked everything out and gave it the okay although the trains may be a little bit delayed. reporting live in el cerrito, christie smith, "today in the bay." >> it's a $200 million discrepancy and this morning some lawmakers will demand answers about san jose's pension

obligation in the wake of an overstated estimate. bob redell is live with a call for a state audit of the city finances. >> reporter: the call will come in about an hour, a news conference outside of san jose city hall. at least one lawmaker making this request. you can look at the letter that his colleagues have signed. they signed this requesting an audit of the city's finances and pension obligations. their colleagues in sacramento will decide on wednesday whether to approve this request. nbc's unit presented a report that found that mayor chuck reed of san jose inflated the estimate of future pension costs by hundreds of millions, allegedly to strengthen his argument in negotiation with unions and workers. whatever is learned would help shape new pension reform laws. >> i think the way they go about

making projections should be transparent. we ought to have an open process so we can see what the liabilities of the city are. there are serious liabilities and we ought to find out what the facts are. >> reporter: incidentally, the city council in san jose will meet tomorrow to consider modifying a ballot measure going before voters in june, that would reduce pensions and force employees to contribute more. bob redell, "today in the bay." >> 6:52. thousands of college students will board buses heading to the state capitol. last week students staged demonstrations at several bay area schools including uc-berkeley, uc santa cruz and san jose state. they are upset about the rising cost of tuition as the state cuts funding for public universities. the rally is aimed at restoring funding and making college more

affordable. >> the woman accused of killing her former classmate is expected to return to court. esteban has a hearing on several motions, she is charged with murdering michelle le in a fit of rage. police arrested esteban in september a week before the nursing student's body was found four months after she disappeared. three men dead after a tattoo party. three men are expected to be arraigned. the men allegedly shot at a green ford explorer outside of a tattoo party in october. seven people were hit, three died. >> a bay area man accused of killing a high school classmate 27 years ago will be in court. steven carlson is expected to enter a plea today. he was arrested in august and accused of killing a 14-year-old. she was last seen april 5, 1984.

her body was later found along side interstate 680, stabbed more than 15 times. >> 6:53. former san francisco giants employee who admitted to stealing more than $2 million from the team is scheduled to be sentenced. robin o'connor pleaded guilty to a wire fraud charge. she embezzled $2.2 million from the giants between june of 2010 and 2011. she worked as a pay roll manager. she faces up to 20 years in prison. >> a game delay for the giants because of bees. the swarm appeared in right field yesterday sending a member of the arizona diamondbacks sprinting for cover. then they settled on a tv camera. the crew used cotton candy and lemonade to get rid of the swarm. things got under way, the giants

on today. >> a new facility opens to help take some of the dilty out of court appearances for parents. a drop-in day care will open its doors at the justice center in pittsburg. parents can drop off kids up to 12 years old for free while they are in court. volunteers from the nonprofit will run the center and provide snacks, toys and games for the children. >> residents and landscapers in burlingame may have to keep the rakes handy. the council is considering tougher restrictions on leaf blowers. the proposal would limit the use to tuesday, thursday and friday and weekends for residents. current law allows leaf blower use any day during certain hours. they will discuss the proposed restrictions tonight. >> chrysler is capitalizing on california by building a sales and marketing department that's specifically targets the golden state. the new california office is

developing special advertising for the state. the company is planning special limited edition cars for california. sales are sky rocketing here to more than 50,000 registrations in 2011 compared to the year before. >> figure week for politics. scott says you can find out who your neighbors want to win. >> this is not a totally new idea but i thought i would bring it up. the the federal election commission lets you look up donors. so plug in your zip code and see who your neighbors are donating to. sort by amount of the donation or even occupation. one thing that didn't surprise me is most of my neighbors are engineers regardless of what they support. yelp is down about 46 cents to 24.12 on its full day of trading. the markets, too, are lower. nasdaq is down about 5.
