get you as you cross one of our open water bridges, you don't want to lose control of your vehicle. make sure you're alert. in addition to the winds we have very, very wet conditions now in the south bay. i went out to the parking lot here, completely soaked. so the combination the strong winds and the showers, one of those mornings leave early. the 70s back in the forecast. i'll talk about when they return. first, mike, you're going to come in clutch this morning. what's going on? >> right now thank goodness not a lot. we had early morning accidents, and gusty winds like at the san mateo bridge. look at the camera shaking. that's what christina is talking about. hold onto your steering wheel. maintain control because the gusts can whack your car to the side and take you over in your lane. a smooth drive so far. 92, and the golden gate bridge is like the only bridge that does not have a weather advisory but we have sheen on the roadways.

>> thank you. leaders will meet to put the finishing touches on a pension reform measure. how much more should public employees pay? bob joins us live outside of san jose city hall where the question is raised how big this budget gap is. good morning. >> reporter: good morning to you, laura. that's one reason why they are expecting a full house in chambers when the council meets at 1:30 this afternoon because they are going to be finalizing the language for the pension reform ballot insure. that wording is expected, is due to the rush to voters by friday so it can get on the ballot for june 5. mayor chuck reed has been arcing that the city needs to cut back on what it contributes for employee retirement plans because it cost so much. right now san jose pays almost $250 million a year in pension. so after much back and forth with employees and the union the council is expected to approve language that would give

employees a choice. join a lower cost plan with lesser benefits or stay in the current plan and contribute more. new employees would be forced into a lower cost plan and pay after the cost. it would make it more difficult to collect disability retirement benefits and if they wanted benefit increases that would require voter approval. assuming the city council approves this it doesn't become law until the voters give it a thumbs up on june 5. >> 6:03. construction is set to begin on the new 49ers stadium. santa clara city council is expected to handle a few legalities at its meeting but yesterday a judge ended a last-ditch effort by opponents to stop construction. he ruled that residents cannot vote on the project a second time. construction is set to begin this spring. >> 6:03. jury selection continues for the trial of sheriff ross mirkarimi. though the trial could still be

moved out of the city, christie smith is live with all of the details. good morning. >> reporter: good morning to you. well, a number of developments in this case. one of them, a boost for the prosecution, a judge ruled that sheriff ross mirkarimi's ex-girlfriend can testify to what she says was abuse that happened during their relationship. now there is a question over where this domestic violence trial will take place because the sheriff's attorney is saying there has been so much pretrial publicity it would be hard to get a fair and impartial jury in the city. the judge hasn't decided whether it will be moved out of san francisco. another possible hitch around video of mirkarimi's wife eliana lopez crying and pointing to a bruise she says happened in an incident with her husband. a neighbor videotaped this but

she said there is no abuse and that this is actually a political persecution of her husband. her attorney, though, is trying to get that video thrown out on appeal which could delay the start of the trial. the girlfriend said mirkarimi grabbed her arm too and they had a rocky relationship, that thir fights were often about underwear left at his house and they thought about lopez he met in south america. jury selection continues. so far 54 potential jurors have been released. they have 130 more to go. everything gets under way at 9:00 this morning. reporting live in san francisco, christie smith, "today in the bay." >> 6:05. a man is dead, two children injured after a shooting on 86th and bancroft avenue last night. police say someone shot the driver of a bentley who then crossed the median and slammed into another car head on. two adults and two children in

the other car were injured. the wounded driver died. >> a san jose group wants to know what happened the night police shot a man to death in his bedroom. police say 47-year-old threatened them with a gun. the coalition for justice and accountability sent a letter to chuck reid your honoring him to make sure there is no delay into the investigation of the death. the coalition claims in the past similar investigations have taken up to a year and they say that's unreasonable. police say the gun he point thard way is the same one that was used to kill a woman two months earlier. >> dozens are facing trespassing charges this morning. they were excited last night after occupying the state capitol rotunda and refusing to leave it was part of a rally by

students demanding funding for education be restored. >> what would you say to those who say this is not an effective way to accomplish your goals? >> i would like to see what their alternatives are because i think this is pretty effective. >> they are learning how to make politics work. because there are so many people that are not being -- their needs are not met. >> 68 people were removed and cited for trespassing. the governor sent a message that his june initiative raising taxes will address their demands. >> 6:07. a report on the uc davis pepper spray incident is delayed. one of the officers is seeking a court order to bar the release of the report back in november officers sprayed dozens of occupy protesters. the report follows an investigation by a private firm. it was supposed to be released on uc davis today. the investigation into the officers' action is ongoing.

>> 6:07. word that yahoo! could go through layoffs. >> it's the story we told before, hopefully not too many more times. new ceo, new direction, layoffs. "the wall street journal" says that scott thompson who joined yahoo! will cut potentially hundreds of thousands from the pay roll. analysts have said it needs to figure out what it is and what it's good at and do that. that would mean people outside the core competency would lose their jobs. no word from yahoo! this morning. zynga continues to grow. in a filing monday the company revealed it will buy the wilgd housing its new offices for $228 million, that's about a quarter of the cash it raised in its ipo. this building is 650 townsend theme flavors of the month including zdtv and saga and now

>> don't even bother doing your hair, ladies. you know why, because you saw what the wind was doing to stephanie's hair. it's not worth the effort. good morning to you. take the time that you were going to use to do your hair and leave it for the drive because we've got very dangerous conditions shaping up this morning. in addition to the showers that are coming to a close. especially in the south bay. we've got really, really strong winds picking up as the front starts to race into the sierra nevada, possibly bringing about another six inches of snow to elevations above 6,000 feet. a little more snow out of this system. but what's happening is it's racing off to the east. high pressure is moving in from the west. the two are working against each other. as a result take a look at how strong your winds are at this point. just about 15, 20 minutes ago we were talking about winds about half as strong as they are now. west-northwest at 25 miles per hour in oakland. 17 miles per hour sustained in

san francisco, and even right in san jose we're at 21 miles per hour. the winds are going to strengthen as we head throughout the day today. so your temperatures aren't going to be that warm. you need the jacket all day long. but something that will do you a favor make sure you don't put too much effort into your hair. all i can tell you. the wind is going to mess it up. the cold blast moves in. that's going to keep your temperatures in the 50s. breezy for the first part of the day, winds will relax substantially and then will warm you back up in the 70s. i want to point this out as you try to make plans for the day. winds at their strongest between 10:00 and 3:00, then subside a little bit as we head through the overnight hours. staying on the breezy side. the seven-day outlook back to 70 by thursday. let's check the drive with mike. >> we'll take you folks to the south bay, we have an easy drive in the northbound direction. no major accidents. however, this area, northbound 101, north of 680, over the last

few minutes are seeing the yellow pop on and off. that's the first time. the typical south bay commute. the winds can be an issue, even for san jose. looking here, the peninsula looks nice as well. dumbarton bridge, wind advisory called by chp and the san mateo bridge, 92 and the bay bridge. going to get hit as well all day long. talking about it picking up in the afternoon hours as well. highway 24 off of 580 an accident here. it's off to the shoulder. we should see more crowds off of the caldecott tunnel as well. but no slowing approaching the toll plaza. a backup, all of the metering lights on. starting at about 6:10, that's an early start. holding steady with the high winds might have been a reason. oakland, where the camera shakes, the southbound side picking up volume. >> thank you, mike. 6:18 now.

you can sound off on b.a.r.t.'s proposed fare hikes. they will hold hearings, the first is tonight in oakland. b.a.r.t.'s proposals include raising all fares 5 cent or only raising between east bay and san francisco by 10 cents or sticking with inflation-based increases for all fares. >> hundreds of dui convictions could be thrown out because of questionable breathalyzer readings. the problem is how san francisco police calibrated or didn't calibrate the machine. manufacturers for the devices require accuracy tests every ten days. the public defenders noticed test logs dating back to 2010 were exactly the same. they say examiners were writing down results without testing those devices. >> the polls are open now on this super tuesday. ten states are holding primaries or caucuses. 419 delegates are up for grabs.

fortunately police say emergency services were never a compromise. >> voters in sonoma will decide whether to raise sales tax. the council agreed to allow residents to decide to raise taxes to pay for public safety services. sonoma's sales tax is 8% so if voters approve the increase the sales tax would rise to 8.5%. that's 50 cents for every $100 spent. >> 6:24. former oakland occupiers getting praise and criticism this morning for taking citizen journalism to syria. scott mcgrew joins us. >> it's on youtube. you remember during the occupy oakland movement protesters were live streaming some of the action. one of the occupiers, a bartender from san francisco, decided to continue that journalism in syria. >> i have my -- my heart is beating as we're sitting this close. if year discovered we'll either

kelley. straight to the forecast with meteorologist christina loren. sort of a mixed bag. >> it's strange out there. the sun's coming out in san jose but the highways are slick because we got showers. the winds are moving in so quickly they are clearing out the cloud cover as the front races into southern california. so for us, we're looking toward the last of our showers right now. a little area of low pressure moving into the sierra nevada, dragging the front through southern california. as that frontal passage happens we're talking about major winds picking up. sustained at 25 miles per hour in oakland, 21 in san jose. and 28 miles per hour in novato. they will only get stronger throughout the day. i've got that forecast and what's to come for the all important weekend. we have another change on the horizon. 6:30 first. starting to get busy. >> right. we're looking at a combination of fathers. we're going to look at the san mateo bridge and we see the

camera, high winds, going to get worse over the morning and the afternoon. right here, highway 92 as well as pretty much every other bay area bridge has a wind advisory as you cross over the water. hold on and maybe slick road. the lighting is a little odd. we see some shine. means wet roads will be an issue. especially the off ramps. slow her down. >> you make the curves, take it easy. >> 6:31. some significant new details from the high profile case of san francisco sheriff ross mirkarimi, including another setback for the defense. christie smith is live in san francisco where mirkarimi's lawyers are demanding his domestic violence trial be moved out of san francisco. good morning. >> good morning to you, marla. a lot going on. a number of key developments. jury selection continues today. a judge has ruled that an

ex-girlfriend can testify against ross mirkarimi but where this trial might be taking place is still up in the air. that's because the san francisco sheriff's attorney has filed a motion to have the case moved out of san francisco because of all of the publicity the case received. a judge hasn't made a decision. so far the court has dismissed 54 potential jurors. opening statements were expected wednesday in this trial but his wife showing a bruise on her arm, that is an issue again, her attorneys want this whole thing thrown out on appeal and that could delay the start of the trial. the ex-girlfriend christina lopez is expected to testify. that's a win for the

prosecution. she says she had a rocky relationship and he was abusive including grabbing her arm. mirkarimi's attorney questions the timing of all of the new abuse claims. jury selection resumes at 9:00. the trial is expected to last about two to two and a half weeks. christie smith, "today in the bay." >> a deadly shooting in oakland causes a crash that put two children in the hospital. the driver of a bentley was shot, then crossed the median at 86 and bancroft avenues last night. he slammed into another car head on, injuring two adults, two children. the children are in the hospital. the wounded driver died. >> it is going to be a packed house at san jose city hall over pension reform. the council will take up the wording of the initiative.

between 15 and 30 miles per hour. and that means we could see some of the weak limbs come down as the winds stater some of our trees. so this is not something we're taking lightly, something i would classify as a wind event. it will be for a long period of time. the wind advisory isn't even in place. it doesn't go in place until moon. we set that in motion, you see the high end of the key. your pink and your red. as we head through 10:00 a.m. very gusty winds. you head through 4:00 p.m. then tonight t winds will relax but on the breezy sigh. in addition to the wind it's going to be cold. you'll likely need the jacket making your temperature 53 at noon, feel like 43 degrees. keep that jacket with you. bad day to spend time on your hair and hold onto your hat.

front-runner in the republican race for president. voters in ten states are set to head to the pole polls not counting wyoming. tracie potts is live in columbus, ohio this morning, home to one of the most competitive races in the country. good morning. >> reporter: good morning. ohio's the one to watch. it's going to tell us if mitt romney has the momentum and can gather enough states to become the presumptive nominee after today, after the super tuesday vote. the polls are neck and neck between rick santorum and mitt romney. both have been here, they were here yesterday, focusing very much on what's going on. we've seen people voting this morning at the polls which are now open in a number of states. the other state we're watching is georgia, newt gingrich there is hoping to claim the 76 delegates of georgia as his own. it is the biggest prize although he's got a pretty significant
