>> good morning. it's 4:30. i'm marla tellez. >> i'm laura garcia-cannon. lots to get to. let's check the forecast. it was pretty cold as we walked out the door. >> yeah. we're going to see a rare occasion today where we're going to go from near record lows to near record highs all in one 24-hour period. you're going to want to dress for two parts. grab the jacket, the heavy coat as temperatures will be close to the freezing mark just about everywhere. you can see san francisco cold this morning, 45 degrees there. we're going to warm into the 70s. more rain on the way as well. first, mike has an area that might slow you down. >> it's in the north bay. it may slow you down. there is an accident southbound 101. highway 12, what we're talking about with. how far north is this, well, it's sebastopol north. we have lots of friends up there and we have the connector

blocked. sounds like there is a pickup that went off the road. we're not getting a lot of detail on injuries so right now know that there is at least one lane of the off ramp blocked, maybe both. we'll see if the chp gives us an idea when it will be open. >> 4:32 now. occupy protesters heading back to downtown oakland. >> this time to protest a controversial stay away order and gang injunctions. christie smith is live where the protesters will hold a rally. good morning. >> reporter: good morning. this is a group that is opposed to gang injunctions and recently stay away orders aimed at occupy oakland demonstrators. they say they feel it's unfair and arbitrary so they are planning a number of events at the courthouse here at seventh and washington including a rally at 10:00 this morning. they say the open gang

injunctions are less restrictive, they believe they are based on intelligence and predictions than facts about someone's criminal behavior. stay away orders given to about a dozen people arrested at occupy protests they say are a problem because those people haven't even been convicted yet. this comes as the oakland city attorney's office is saying that they are seeking damages against an elk grove man for vandalism at city hall during a november occupy demonstration. and they say they are promising to review other vandalism cases tied to occupy demonstrations here in oakland. and trying to seek restitution when they can. live in oakland, christie smith, "today in the bay." >> tonight berkeley residents will get a chance to question the police chief how the department handled the recent murder of an elderly homeowner. 67-year-old peter sekur died on his property last month. the police response to a call

for help was delayed because officers were tied up with an occupy protest. the first call from his wife went to a non-emergency line, then 15 minutes later to 911. police arrested 23-year-old daniel dewitt near the scene. tonight's meeting begins at 7:30, it's going to be held at the north break community church. >> oakland residents home there will be more jobs in the city. >> robbery, burglaries and things, they have money, they have something to do, you know, as far as work. stay out of trouble. >> the city leaders unveiled plans after the council approved $3.5 million toward redeveloping the area. mayor kwan says it could generate up to 32,000 jobs for the city. oakland's three sport teams are all being courted to move away. leaders hope the complex will keep them in town.

san francisco woman is recovering from a stroke after a crew came to her rescue. tatiana found her mother on the floor yesterday. about the same time a crew member from the tv show alcatraz knocked on the door trying to get local residents to move their car. the crew member and a police officer with him jumped in to help. >> i think it was pretty lucky. if my mom had a chance to have a crisis, today would be a good day. because they are right there on my door step. >> paramedics on the set of the show helped out until ambulances arrived. >> the men who hit a baseball fan with his car outside at&t park will go to jail. andrew vargas pleaded guilty for hitting 9-year-old ryan white as he and his family left a giants game. vargas will perform community service and pay restitution. he was sentenced to a year in

county jail but is expected to be released soon with credit for time served. >> san jose's finances will be reviewed by state adders. after nbc's investigative unit -- the audit will focus on the finances and the pension obligation. the audit should take four months to complete but the pension reform measure will be on the june ballot. >> it's 4:36. more than 100 teachers and staff of alameda school district will get layoff notices. the school district approved the notices this week. they have to determine how many jobs they will cut. the school board is looking at other ideas including a parcel tax and cutting music and art classes. >> one of the biggest food banks is struggling to stretch its budget. second harvest food bank says high fuel and food prices are

forcing fewer deliveries to shelters. most of the popular items have seen double digit increases in costs. the organization is asking for your donations to help feed the 250,000 people it reaches out to every month. >> an unusual sighting in the water near crissy field has ship captains on alert. a gray whale was spotted and caught on tape by one of our photographers. look beyond the orange ball. did you see it, the spout of water, then the whale breaching. gray whales are susceptible to colliding with vessels. a marine official says a boat approached one yesterday. >> an inflatable boat charged down onto them and came in very, very close and actually caused them to change direction several

times. >> under the marine mammal protection act boats must stay at least 100 yards from whales. >> keep your distance though it's spectacular. pretty cold when you head out the door. i forgot my gloves. >> we'll have to get you a new pair immediately. it's cold out there. cold enough for frost. take a look at this. the reason why it's so cold, it's because it's so clear. typically this time of year we have a fair amount of cloud cover that actually keeps us warm serving as a blanket trapping in warmth. but with the clear sky all of that warmth radiates back out into the atmosphere and this morning it is so clear out there with pretty good air quality you can visible see the craters that make up what they call the man in the moon. as we head throughout the morning it's on the chilly side. we're looking towards a pretty nice afternoon. we're going from near-record cold this morning to near-record

warmth. 39 in concord, 38 in livermore. and overall looking like this will go down as one of the warmest decembers ever in the bay area and one of the warmest winters on record probably for the entire nation. temperatures will be on the climb as of noon. talking about the mid-60s at noon. 67 in san jose, comfortable conditions in the heat of the day, 3:00 p.m., 71 in morgan hill. yeah, 67 in pleasanton and 67 degrees in san francisco so. overall warming you up by about 10 degrees from yesterday. we'll have the full forecast coming up. >> we'll go back up to the north bay where we have the accident southbound 101 and highway 12. it does turn out there are no injuries to the driver of the vehicle that flipped because that driver's not at the scene. the vehicle might have been there a while. it may have been an overnight joy ride. we have the car back on wheels, the ramp is open to southbound

report on jobs. employers may have added 216,000 jobs. invest terse point to an article suggesting that the fed may be thinking about new measures to boost the economy even though fed chairman bernanke didn't mention that in his congressional testimony. a lot of focus is still on europe as the deadline for creditors to sign on to a greek bond swap. we'll get data on new filings for unemployment. we saw the dow rise to 12,837. the nasdaq adding 25 to close at 2935. justice department is warning apple and five publishers it may sue claiming they coloaded to hike prices. "the wall street journal" says the publishers say their prices have boosted competition. publishers set the price of a book and apple takes a 30% cut. forbes is out with its annual billionaires list. a record 1,266 members.

meteorologist christina loren, what can you tell us? >> you know it's cold but this afternoon we're going to see the 70s, so it's that clear sky that makes for the extreme stretch of temperatures between now and what we expect in the heat of the day. what's so interesting is that this spring is looking rather active. all of next week starting tuesday we've got shower chances. and i'm talking about really good shower chances starting at 60% tuesday, a winter storm rolls through, late winter. of course we don't officially kick off spring until the 20th. 38 degrees in san mateo. high pressure moves in. for today it's going to drive the winds offshore. for us that means we're going to warm up throughout the day right when the sun comes out. it's going to be cold. so make sure you grab that jacket on the way out the front door. 72 in san jose later today. about 67 in danville, across the bay, touching on the 60s, upper 60s in san francisco, almost

uniform temperatures because of that offshore flow. don't forget the time change. this is the time change where we lose an hour. daylight saving time begins and that means we're not going to have as much sunlight to drive to work in in the morning so you want to keep that in mind especially if you take the little ones to school, it will be darker and that means more dangerous conditions. as we head throughout the next few days, temperatures warm up into friday. and then we drop off to 66 on saturday with a few more clouds. the action starts on sunday especially in the north bay. the system riding to the north, going to bring stray showers. by monday take a look at the cooldown as the cold front comes through, 58 degrees. that's it. then the action ramps up tuesday into wednesday. we could pick up 1 to 2 inches of rain in the north bay, and in the cities that get the most rain. this is looking like a significant system. we're running that deficit. we need the rain. back to you guys.

a group of undocumented students going the extra mile to support the dream act literally. they are walk from san francisco to washington, d.c. the four students from different states will kick off the walk today at uc-berkeley trying to rally support for the dream act to allow undocunted immigrants going to college or joining the military. the event will be at sather gate on the berkeley campus at 10:00 a.m. the students start their walk of 3,000 miles this weekend. they hope to reach washington, d.c. on the eve of the november election. >> some big names in tech are pledging support for the dream act. the wife of the late steve jobs has teamed up with palm pilot inventor jeff hawkins, mark leslie and andrew grove. they are all donating generously to nonprofits that help dream act students. california has its own dream act
