this is "today in the bay." >> good morning to you. it's 4:30, friday, i'm marla tellez in for jon kelley. >> happy friday. i'm laura garcia-cannon. lots to get to. let's check the forecast with meteorologist christina loren. >> yeah, we made it, ladies. we have done it, made it to friday. we have a gorgeous forecast for today. temperatures in the 80s in some cities. this morning it's cold, you need the jacket. grab that jacket on the way out the door but something you can peel off by about 10:00, 11:00, temperatures soaring once the sun comes out. things start to change, but let's get to traffic. we give mike a day off. we have problems in the berkeley area, i-80 eastbound, reports of a spilled load. the truck lost its oil in the road so you want to give yourself extra time. the word is you can get around this area.

i-80 eastbound at the central avenue off ramp but give yourself time. you might be slowed 10 to 15 minutes. we'll keep this up to date for you throughout the morning. no accidents across the greater bay area. you can see the golden gate bridge very, very light here over the golden gate. that's friday light. hopefully it will stay like that. back to you. >> thank you, christina. it's 4:32. a man shot has died marking the city's sixth homicide of the year. after 7:00 last night police responded to reports of a shooting on the 5100 block of monterey highway. when they arrived they found a man suffering from several gunshot wounds. no one has been arrested. >> one man in custody but this morning san jose police are looking for two others in a brutal attack that the victim claims was a hate crime. amelia was arrested when three

men caught by surveillance cameras surrounding a car and hitting the man with a bottle. they were calling him a terrorist and other racial slurs. prosecutors say without audio there is not enough evidence to add a hate crime enhancement. >> i believe it was a hate crime, i was called racial slurs while i was being beaten. i think that constitutes a hate crime. >> fingerprints led them to the man. >> a high-priced store opens for business. >> after years of debate because of traffic concerns and location disputes between other local malls christie smith is live in walnut creek where the doors to neiman-marcus will open later this morning. good morning. >> reporter: good morning. this is not a bad assignment at all, the opening of a neiman-marcus store. even though they are all fancy this one is really extra fancy. kind of looks like a museum

outside when you round the corner, it's really bright. very, very modern. we're less than six hours from the opening and i already see workers inside this morning. this 85,000 square foot store here in downtown walnut creek and the only neiman-marcus store to be opening this year. luxury on top of luxury including $25 lobster rolls to eat and a chanel boutique. lots of art inside. there was a fund-raiser opening gala last night. this wasn't without controversy. there was a battle between two shopping mall giants and public outcry over the size of store, valet parking, traffic that ended at the ballot box. three years later here we are opening day. a lot of people happy about the fact that tax revenues are estimated at about $600,000 a year, the doors swing open at 10:00 this morning. reporting live in walnut creek,

christie smith, "today in the bay." >> thank you very much. as many as 50 people had to spend the night away from their home in berkeley after a massive fire left an apartment building in danger of collapse. investigators say the fire started with a hot water heater in the closet on the ground floor. all three floors containing six apartments were gutted. residents in four surrounding buildings also had to evacuate. they have to stay out until crews can shore up the walls of the building. that is expected to happen today. >> tempers flared at a meeting focused on the beating of a man. demanding why police didn't respond immediately when they were called. peter called the nonemergency line to report a man trespassing. his wife called 911 to say the man was beating her husband with a flower pot. he died from the injuries. police didn't get to the house until 14 minutes after the first

call. they say if he conveyed an emergency situation officers would have responded. while the incident was tragic he believes the call was handled correctly. >> we looked at the call, the dispatches, the timelines, the messaging, and we've done a review of what other agencies do and how they prioritize calls to see if we're doing something outside of the norm and to this point we haven't found anything. >> police arrested a 23-year-old daniel dewitt after the attack. his family says he has a history of mental illness. >> a union city optometrist accused of shooting an officer is scheduled to enter a plea. dennis bagwell will appear at the hall of justice to answer to charges of attempted murder and assault with a firearm. police say bagwell shot robert siplick outside of his home february 7. documents reveal that bagwell was obsessed with seplick's wife

who was a student of his. >> there is a battle in mountain view over the smoking ban. the bay area news group reports more than 1,000 people signed a petition to overturn the recently passed ordinance that prohibits smoking within 25 feet of patios or doors of work places and restaurants. organizers say that will force people to go into the street or dark parking lots to smoke, which could be dangerous. the new laws take effect in may. >> the environmental protection agencies trying to figure out what to do about a toxic mess. divers have been surveying the super fund site this week where tests show high levels of a dangerous chemical ddt. a company contaminated the channel in the 1940s. most was cleaned up in the 90s but recent tests showed it's still there. epa is trying to determine the source. a community meeting is scheduled for march 19. >> the aclu is trying to

overturn a judge's stay away order against 14 oakland demonstrators. the order requires them to stay between 100 and 300 yards away from the plaza. the orders are a condition of release for the protesters. civil rights group argue the restrictions are unconstitutional. >> a group of amtrak workers has filed a racial discrimination suit against their employer. 11 current and former employees from the oakland maintenance yard say they were denied promotions and training and forced to work in a hostile environment. >> in some instances people were hired off the street as new employees and given positions that my clients had been applying for for years. >> a spokesperson for amtrak says the company does not comment on pending litigation. >> the owners of san francisco's historic gold dust lounge now suing. the owners file add civil complaint accusing the landlord of deception, breach of contract

you're going to notice a cold start to the day when you head out, the clear skies, not a lot of cloud cover to keep us warm. 4:43. >> san francisco mayor ed lee wants to make sure his city stays tech savvy announcing a $5 million grant used to train or retrain 1700 workers for tech jobs. san francisco is home to zynga and twitter. the new program will ensure san francisco residents have the skills they need to qualify for future jobs. >> 4:44 now. we get the latest unemployment numbers in less than an hour. congress predicts they will stay flat with a modest number of new jobs. while we are seeing more jobs every month, president obama says they can do it better and faster. >> i keep hearing about an improvement in the job situation. he hasn't been able to do that yet. >> we want you to create jobs

here in america. if we're going to do that then we need to have not just a market for the jobs for the manufacturing goods in america, but we want to be an exporting giant. >> all of the candidates are focused on upcoming primaries in alabama and mississippi. the southern vote may determine who can capture the party's base. mitt romney is leading the latest alabama poll and just gotten endorsement from mississippi's governor. >> today marks a dubious anniversary in the stock market. it was three years ago today the dow jones hit its lowest at 6547 at the height of the recession. today it's nearly double that. most investors gained back what they lost in that slump, many are higher. a good reminder to have patience with that portfolio. >> let's see if the dow is poised to do better. we turn to jackie at cnbc.

good morning. >> good morning. futures are mixed as investors wait the monthly jobs report. expecting a month of solid hiring with employers to have added 213,000 jobs this month and the unemployment rate is expected to hold steady at 8.3%. we're going to get data on the trade deficit and lots of focus on europe still as greece appears to have had enough creditors agree to its bond swap offer. today is also the three-year anniversary of when wall street hit the bear market lows or when the current bull market began. we saw the dow rise thursday to 12,907. the nasdaq up to close at 2970. a side note to today's jobs numbers. wall street's work force rose last year. the findings came from new york city's department of labor. wall street companies hired 4900 people. officials were worried that the

securities industry would lose jobs after banks and brokers announced layoffs. wells fargo, georgia, new jersey and delaware and connecticut and new york and pennsylvania, the bank is going to start charging a $7 monthly fee in may and $5 for people who get online statements. wells started charging in 23 states last year. you can avoid the fee if you have at least 500 a month in direct deposit or keep a $1500 minimum balance. >> thank you very much. time to check the forecast. talking about the cool start. what a glorious finish in store. >> glorious finish. it's going to be the nicest at 4:00 p.m. as you make your way home from work getting ready to enjoy the weekend. things are going to change, we're going to drop you down by 10 degrees between today's highs and tomorrow, so if you want the sunshine and that beach beautiful weather you want to get out there. 44 in san jose, at 40 in sunnyvale and 48 degrees in san francisco. you can see from your futurecast

temperatures are going to sky rocket the minute the sun comes out. up to 71 at noon in san jose. 65 in fairfield. and 68 degrees in livermore. as you head throughout the afternoon we're talking about the warmest day we've had this year so far. 80 degrees in gilroy. in the upper 70s in place likes san jose, 77 degrees, 68 for san francisco. and 72 in santa rosa where temperatures are frigid this morning. as we head through the next 48 hours we have a cold front on the way. it's going to bring in more cloud cover. because our temperatures are going to end up so warm it's going to usher in colder air. it's only going to drop you into the 60s. we're going to hold on to comfortable conditions just about all week long temperaturewise. sunday we do have rain in the forecast, but it doesn't arrive until probably 2:00 to 4:00 in the north bay. that will slide to the south throughout the second half of sunday. and then we have a very wet pattern that starts to develop monday lasting pretty much flout the remainder of next week. we need the rain, we want that

moisture because it replenishes our water supply during the summer months. we're looking forward to the rain. but if you want the sunshine, you just got one more day to get out and enjoy it. back to you ladies. >> thank you. 4:48. sunday will mark the one-year anniversary of that deadly earthquake and tsunami that devastated japan. the the 9.0 earthquake lasted for six minutes and triggered a massive tsunami that washed away entire towns along japan's coast. the death toll from that disaster stands at almost 16,000. more than 3300 are still missing. the disaster was felt across the ocean, here in california and santa cruz a tsunami triggered by the quake sent boats crashing into each other and damaged docks. this morning local and federal officials will be at santa cruz harbor reviewing the progress of recovery efforts. >> as japan continues to recover from that disaster green technology from silicon valley companies poised to help. >> the earthquake and tsumani
