hall of justice mr. dennis bagwell will answer to charges of attempted murder. good morning. >> reporter: good morning. the last time dennis bagwell was here he was supposed to be here february 29 but did not appear. instead a judge granted the d.a.'s office request to bar him from practicing as an optician. he was recently teaching at union city's optical schools. inina was a student of his. her husband also 61 is the man bagwell alleged hi shot back in february in front of suplick's home. they described bagwell's relationship with the 38-year-old wife as an obsession. court records show that suplick confronted bagwell, telling him to leave the couple alone after he was spotted, quote, working in the bushes outside their home. again, he's to answer to charges

of attempted murder an assault with a deadly weapon. he has been behind bars on no bail expected back in court at 9:00 this morning. stephanie chuang, "today in the bay." >> police are investigating a rash of burglaries. officers responded to a reported break-in at a home on hillsborough boulevard on thursday morning. the thief went through an unlocked sliding door, made off with several items. a nearby home was also hit. it was also unlocked. so far no arrests. >> a former sheriff is under arrest for allegedly embezzling from a fun meant for slain police officers. donald atkinson was arrested. the retired deputy sheriff is accused of keeping $20,000 meant for the families of mark

doneagan and john hedge, killed in march 2009. atkinson is accused of stealing $100,000 from an elderly person. >> 5:03. san francisco police looking for victims of a man accused of secretly filming people in a city business. an employee found the camera hidden in a box. there were numerous men and women using the toilet. it captured the suspect setting up the camera. >> a bay area high school student arrested for assaulting a classmate with a stapler is telling his side of the story. 18-year-old sanchez says the whole thing could have been avoided if the intercom system at gavin newsom high school was working properly.

asilomar state beach is closed until it's safe for visitors. it was closed down after sewage overflowed. public works say the sewage flowed into tributaries that run into the beach. >> there is a battle brewing over the new smoking ban. more than 1,000 people have signed a petition to overturn the ordinance. the ban prohibits smoking within 25 feet of outdoor patios, windows are 0 work places or restaurants. it will force people into the streets or dark parking lots. the new rules take effect in may. >> the recent deal between nbc and the america's cup could mean scheduling changes. some august racing dates could be moved from san francisco to new york city. the boats are on the east coast,

later today, try 76 degrees on for size. what a gorgeous beach day. we're still in winter but not for long. the 20th of this month kicks off the first day of spring. so, it's going to start to warm up. temperatures average about 61 degrees this time of year in san jose. one thing that's dropped off are wind speeds. east-northeast at 5 miles per hour in fairfield, the strongest we have to report this morning. and temperatures today, so good for outdoor activities. 74 in san jose. a high around 70 in pittsburg, holding on to the 70s in san mateo. one more reminder daylight savings time, spring ahead, 2:00 a.m. the best bet is set that clock forward an hour on saturday night before you go to bed. that way you won't be late to church, you won't be late to work if you work on sunday. that way there won't be problems. as i said before our new sunrise will be about 7:30 a.m. the new sunset, 7:10 p.m.

we're getting data on the trade deficit and whole sale trade and lots of focus on europe. greece appears to have enough agree to its bond swap offer to secure another financial bail-out. today is also the three-year anniversary of when wall street hit the lows or when the current bull market rallied again depending how you look at. the dow rose 70 points thursday to close at 12,907. the nasdaq up 34 to 2970. bank of america reported hi struck a side deal with the government over its mortgage practices. boa was part of the settlement last month with the feds and states attorney generals. reports saying the company will make deeper cuts in mortgage balances potentially helping too 200,000 borrowers. move over keurig. starbucks will sell its own machine. the good news is you'll be able to buy it in time for the

holiday season. it could threaten green mountain coffee roasters makes the keurig brewer. it will supply its k-cups to green mountain as well. >> we could use one of those in the studio right now. >> i don't think we could make it fast enough. 5:19. occupy protesters getting support from the aclu. the civil rights group filed petitions asking alameda courts to overturn stay away orders for approximately 20 protesters. they say it violates the protesters rights. under the order protesters must stay 100 to 300 yards away from the plaza. >> city offices in concord will be closed, taking a furlough day. emergency services will not be affected. >> b.a.r.t. says its finances have improved enough that it should be able to avoid cuts this year. but don't expect to see fares fall.

>> thank you. 5:29. union city optometrist accused of shooting an officer is scheduled to enter a plea. stephanie chuang is live where dennis bagwell will answer to charges of attempted murder. good morning. >> reporter: laura, good morning. dennis bagwell was 61 years old, he has a limp. the last time we saw him was on february 10 when he was assigned a new public defender. entering a plea has been postponed a couple of times. the last time he was supposed to be here was february 29. he didn't show. a judge granted the d.a. office's request to bar bagwell from practicing as an optician. he was teaching at union city's bay area optical schools where he met iryna smith, a student, a woman he became obsessed with according to court documents. her husband agent robert suplik also 61 is the man that bagwell

allegedly shot back in february in front of the couple's home. suplik did survive but was seriously hurt. suplik confronted bagwell before the shooting telling him to leave the couple alone after he was spotted lurking in the bushes outside their home. the families of both men have remained tight-lipped, very private in this. not sure if they will be here as he is expected to be back in court at 9:00. live at the hall of justice, stephanie chuang, "today in the bay." >> 5:31 a. man shot multiple times on a highway has died marking the city's sixth homicide of the year. last night police responded to reports of a shooting on the 500 block of monterey highway. when they arrived they found a man suffering from several gunshot wounds. he died several hours later. no one has been arrested. >> one man in custody but this morning san jose police are still looking for two others in a brutal attack that the victim

claims was a hate crime. emilio romayor was arrested friday when three men caught by surveillance cameras surrounding the man's car and hitting him. they were calling him a terrorist and other racial slurs. prosecutors say without audio there is no -- not enough evidence to add a hate crime enhancement. >> i firmly believe it was a hate crime, i was called racial slurs while i was beaten. i think that constitute as hate crime. >> fingerprints on the bottle led them to romayor. it appears there was a traffic dispute. >> the case against ross mirkarimi takes another step forward. an appeals court judge will hear arguments on an appeal from attorneys for mirkarimi's wife. they want a videotape kept out of evidence. it shows lopez displaying

bruises that prosecutors say were caused by mirkarimi. the hearing will decide if a domestic violence expert will be allowed to testify. >> as many as 50 people, many cal students, are spending the night away from homes in berkeley after a fire. this is an update to breaking news yesterday. the structure is charred down to its beams and in danger of collapse. fire investigators say the fire began with a hot water heater in a ground floor closet. all three floors went up in flames. people in surrounding buildings, this is west of people's park, they had to evacuate. one shot these videos. they have to stay out until crews can shore up the walls of the burned out building. >> hard to believe it's a year but sunday will mark the anniversary of the earthquake and tsunami. it washed away entire towns along japan's coast.

deal with afghanistan to transfer control of its main detention center in the country to afghan authorities. the two governments have been discussing a strategic partnership agreement for more than a year. it will be the framework for u.s. involvement in afghanistan beyond 2014. the issue how to handle the transfer of u.s. detention facilities has threatened to derail relationships between the two countries. >> new documents show the new york police department kept secret files on certain businesses simply because they were owned by second and third generation muslims. the associated press reports police secretly monitored mosques, groups and muslim-owned businesses in the northeast. michael bloomberg has suspended the department saying its efforts were legal and not based on reledgen. >> moments ago the labor department released its jobs report. tracie potts is live in washington, d.c. with a look at the unemployment rate. what it means for the overall

economic picture. good morning. >> reporter: 8.3% is the unemployment rate in this country, that was last month, it's the same this month. no change there. but we did create 227,000 new jobs last month. that's less than the month before. but the month before was huge. this is more than economists predicted, more than what they say is necessary to support a robust recovery. where were the jobs, professional and business, health care, leisure, hotels, amusement, things like that. and manufacturing as well. we saw a decrease in construction and retail jobs, a few thousand retail jobs as well. the other important things, revisions as there always are in december and january and increase of another 61 thousand dollars jobs. plus, the labor participation rate, to determine how many are really working or looking for work, that went up too.

so over all this is likely to be considered a pretty positive jobs report. not a month ago but a continuing of what we've seen the last few months. the number of jobs created over 200,000 for the last three months. >> at least it's maintaining. how do you think it's going to play out on the campaign tail. what are we going to hear? >> what's the spin spin. because it's left of january, are we starting to go back. but because it is much more than a necessary to support a robust recovery when the president goes to virginia today to talk about manufacturing jobs he's likely to highlight what the trend has been and probably point out as we saw, 13,000 new manufacturing jobs last month. >> tracie potts live from washington.
