kelley. let's get to the weekend forecast with meteorologist christina loren. >> we're sharing that friday enthusiasm with you this morning. good morning to you. grab your jacket, grab your sunglasses and you'll probably need the sun screen later on today with a high uv index we're going to see sunshine and your temperatures will creep up from the 30s and 40s into the 70s just about everywhere. i'll take through the forecast, tell you when the rain comes back in the mix. we have a lot of rain on the way but first, let's talk about what's happening on the roads. we don't have problems to report, no major accidents, that's been the case about all morning long so we're starting this friday off light and right. throughout the morning we expect that congestion to stack up with the usual hot spots. things are looking friday light. we don't have flight delays. the earlier incident 101 in the morguen hill area has cleared. back to you two. >> thank you, christina. union city optometrist is

accused of shooting an off-duty federal officer, scheduled to enter his plea. stephanie chuang is live where dennis bagwell will answer to charges of attempted murder. good morning. >> reporter: good morning, laura. dennis bagwell accused of trying to kill a federal agent in front of his newark home. this is that bizarre love triangle story we heard a few weeks ago. i think he is due here at 9:00 this morning. we became nearly obsessed with the victim's wife, which also say that the victim, 61-year-old u.s. customs and border correction agent robert suplik confronted bagwell before the shooting, told him to leave the couple alone after they spotted bagwell lurking in the bushes. bagwell met the wife, iryna smith, when he taught her at union city's optical school. he was to enter a plea but he

got a new public defender. and she needed more time with the case. thomas and the families of both men have been tight-lipped, not speaking with the media. we were here february 10 when they last met in the courtroom. we're not sure if they will be here when bagwell is set to appear. stephanie chuang, "today in the bay." >> a man shot on 0 san jose highway shas died. police responded to reports of a shooting on the 1500 block of monterey highway. they found a man suffering from gunshot wounds. he died several hours later. no one has been arrested. >> san jose police are looking for two more suspects in a brutal beating that the victim says was a late crime. emilio somayor is facing charges. the video from the parking lot shows the assault.

police say fingerprints led them to romayor. without audio, not enough. >> the case against sheriff ross mirkarimi takes another step forward today. an appeals court judge will hear arguments on an appeal from mirkarimi's wife. they want a videotape kept out of evidence. it shows bruises on lopez's arm. prosecutors say it was caused by mirkarimi. also decide if a uc violence expert will be allowed to testify. >> 6:04. former deputy sheriff is under arrest. donald atkinson was arrested yesterday. the retired sheriff's deputy is accused of keeping $20,000 meant for the families of four

officers shot and killed by a fugitive in 2009. atkinson is also accused of stealing $100,000 from an elderly person. >> investigators say they know what started that two alarm fire that destroyed an apartment building. a preliminary report says it was sparked by a hot water heater. as many as 50 people were forced to find another mace. the damaged three-story building is in danger of collapse and surrounding buildings. everyone in the sixth you night apartment building did make it out safely. >> there is a battle brewing over the new smoking ban.

more than 1,000 people have signed a feet overthe turn the ordinance. it prohibits smoking twn 25 feet of stores and restaurants. the ban will force people to go into street or dark parking lots which could be dangerous. the new rules take effect in may. >> occupy protesters getting support from the aclu. it's filed courts to overturn stayaway orders. employers say the -- >> 6:06. a high-priced store priced a high-priced battle. that battle is over. christie smith is live in walnut creek where the doors to neiman-marcus will open. tough assignment, my dear. >> reporter: yeah.

i'll check it out and do it. it is early but we're already seeing people stop and do window shopping, take a look inside. this store big, bright, modern. and it's a good thing that it is pay day friday. if you've got the money to send they have eye watching shoes and and bags. this is the first neiman-marcus in the east bay, it is packed with luxury. you get hungry, they have lobster rolls, also local flavor with a walnut creek salad. lots of local artists. there was a battle to make this happen. between two shopping mall giants there was concern for people about parking, the traffic impact. and sadie by 1 thousand square feet it landed at the ballot box. the mayor thinks it's all worked out. >> when we finally realized what

two years. i did rescue, i mean i ran rescue, the business of rescue from home. and i will do it like that until we get another space when times are better. >> is it going to be harder to adopt out these dogs without a central gathering place? >> we benefitted so much from the visibility. tremendously. so many volunteers have come in. people walk in off the street and say i heard about rescue or i want to rescue dogs that i didn't know where to get one. that surprises me but nothing surprises me really. >> chosing down because of rent. >> yeah. it's 1500 a month. >> are you concerned that this is going to hurt your business. i mean -- >> the business of saving lives. it is a business, it's very much a business. we're a nonprofit organization. well, it will be harder to find new people to foster.

just about everywhere this morning. we're holding on to the 40s at the coast, even expecting oakland now at 40 degrees to drop in the upper 30s. over the next 15, 20 minutes. then once the sun comes up going to warm us up into the 70s. you wanted to hit the marina. look what you get to hit it with, 63 degrees by noon, sunshine and calm winds. we expect glassy conditions on the bay. we have a front on the way, change as of tomorrow. the clouds as we head through tomorrow, rain starts on sunday. you want to make outdoor plans you get better opportunities to get out, the better weather, on saturday. 72 for morgan hill. 80 in gilroy. we are still in winter. we are at the end of winter, the first day of spring less than two weeks away. 67 in pacifica. i want to remind you, monday it

let's turn to jackie and check in with those numbers. they kind of stayed flat, didn't they. >> that's right. good morning. the futures turned higher, they were a little bit better than expected so february non-farm pay rolls versus expectations of 213,000. the unemployment rate helped steady at 8.3%. a lot of focus still on europe. greece appears to have had enough agree to it's offer to secure another bailout. we'll be watching degrees as more information develops. today is the anniversary of when the current bull market rally began. we saw the dow rise 70 on thursday to 12,907 t nasdaq up they 4 to 2970. bank of america struck a deal over mortgage practices. doa was part of the settlement last month.

technology isn't in the clear just yet. the national oceanic and atmospheric association says the storm shook the earth magnetic field yesterday. hasn't affected anything so far but power disruption sometimes happens after the storm. >> b.a.r.t. says it has enough to avoid cuts but don't expect fares to fall. the board admits it's running a surplus but the agency needs the money to replace its fleet of ailing cars. many of them are almost 40 years old. it will take about $800 million for 25 years to replace the fleet. any surplus will be used for new cars and rail improvement. >> monterey county dealing with a situation, raw sewage on a beach. the beach was closed yesterday after 800 gallons of sewage overflowed from a manhole. public work employees say the

sewage flowed into a tributary that runs into the beach. it will remain closed until water samples show that the beach is safe. >> 6:24. the ront tv deal between nbc and the america's cup could mean changes for the race. some august racing dates could be moved in new york to help generate interest in yacht racing. they are looking to hold race days during fleet week. next year's america's cup will be the first time the race has been televised in the u.s. since 1992. >> it is 6:25. cal continues its push for a pac-12 title. the bears play colorado 18 semifinal showdown. last night cal beat stanford in the quarterfinals, likely securing a bid for the ncaa tournament. also dashed stanford's hopes. cal wins the tournament it is guaranteed a spot. >> still to come, a man accused

temperatures are going to climb. we're going to see sunshine just about all day long. the clouds increase and rain over the weekend. i'll take you through the forecast but we have a traffic alert in the richmond area. this is 580 westbound at canal boulevard on the off ramp but involving an overturned big rig. you can imagine the cleanup will last over a half hour, give yourself extra time. we'll continue to update you. we told you about another one, i-580 westbound approaching 680 where the two come together causing serious delays westbound 580 before you hit that 680 intersection. it's blocking the right lane in the dublin area. give yourself extra time. though it's friday light more people are hitting the highway so that could become a traffic alert. your weather and bring you updates. >> an up scale department store expected to bring millions in

sales tax revenue opens for business. christie smith is live where the doors to neiman-marcus will open later this morning. good morning. >> reporter: good morning. looking around here, this is becoming quite the shopper's row. i wanted to point out. we've got the apple store here. next to that is tiffany and company. and now the new tenant moving in, opening up this morning, of course neiman-marcus. we spoke with the mayor of walnut creek who says this really seals the deal for walnut creek as a shopping destination for the region. the city has a really low 3% vacancy rate and the new niemann didn't come without a battle. two shopping mall giants went head-to-head. residents were concerned about parking and traffic. even the size. it landed at the balance hot box. now two years later it's set to open. >> this is a magnet store that will draw other stores and

really will cement walnut creek, one of the top 10 retail sections in the u.s. this will make not just walnut creek, it's good for the county as well. >> the store is 85,000 square feet, it's modern, bright, it's got local artists inside. even a walnut creek salad and cookie bar to give you local flavor. there's even public art outside the building. wind fins done by a local artist. and i wanted to show you these before we go. they have got the sparkly stuff up front. we've seen a lot of women with their coffee and little dogs to look at these. the doors open this morning at 10:00. christie smith, "today in the bay." >> a man who was shot on the south san jose highway died marking the city's sixth

homicide of the year. last night police responded to reports of a shooting on the 5100 block of monterey highway. when they arrived they found a man suffering from several gunshot wounds. no one was arrested. a union city optometrist accused of shooting a federal agent is set to enter a plea. stephanie is live outside the hall of justice where dennis bagwell will answer to charges of premedicated attempted murder. good morning. >> reporter: good morning. the 61-year-old was supposed to enter a plea twice before but it was postponed. that was about a month ago. dennis bagwell was teaching at bay area optical schools where he taught 38-year-old iryna smith. her husband, robert suplik, also 61, is the man that bagwell allegedly shot in february in front of the couple's home. court documents described

bagwell's relationship with the wife, with iryna smith, as a sort of obsession. court records show that suplik confronted him, telling him to leave the couple alone after he was spotted, quote, lurking in the pushes outside their home. for the last weeks bagwell has been behind bars on no bail. he is expected to be here in court at 9:00 this morning. stephanie chuang, "today in the bay." >> the case against san francisco sheriff ross mirkarimi takes another step forward. an appeals court judge will hear arguments on an appeal from attorneys for mirkarimi's wife, eliana lopez. they want a videotape kept out of evidence that shows bruises on lopez's arm. prosecutors say -- the hearing will decide if the domestic violence expert will be allowed to testify. >> a group of amtrak workers

not much changed. the unemployment rate stayed at 8.3%. presidential candidates hoping to use it to their own advantage. tracie potts is live in washington this morning. any indication how these numbers will affect the campaign? >> it's a good question, what is the spin, the fact we saw less job growth than january or more than is necessary for a robust recovery. here's what we know. 8.3% was and still is the unemployment rate. there were 227,000 jobs created last month according to the labor department. we had a huge january, 243, but this is more than what was predicted so the general thinking from economists in washington is that this is pretty good. also, revisions from the last two months added another 61,000 jobs. most of the job growth we saw was in these areas, professional and business jobs, leisure, like hospitality, hotels, health care and manufacturing went up about

13,000. there were hits in construction and retail. part of that you would imagine came because it was a month after these -- the holiday shopping season. the labor participation rate, how many people out there of working age are working or looking to work, that went up, too. economists like to see that. so over all moving forward, not where we need to be but definitely moving forward. on the campaign trail, president obama talking about manufacturing and so are some of his rifles. they think they can get these jobs going faster and better. >> thank you, tracie. coming up, 15 minutes of uninterrupted news including details on a hearing for a man accused of shooting a federal agency. a live report coming up. >> a beautiful live look outside. gorgeous bay bridge.
