i don't know if we have the oakland camera available. there we go. northbound 880, thank you, as we had a disabled vehicle at the 98th avenue off ramp. that's not affected traffic so i'll consider that a non-issue. even at this time with the time change, good number of cars on 880. always the key. >> good news for the economy, people are working. thank you, mike. this morning a third challenge to stop prosecutors from showing a video and sheriff mirkarimi's domestic violence trial. christie smith is live in san francisco with the newest defense tactic. good morning. >> reporter: a couple of things, jury selection continues after the jury pool was expanded but the state of a video that is the key to the prosecution's case, well, it's still up in the air after attorneys for san francisco sheriff ross mirkarimi, they are still fighting to have it kept away from jurors. a panel rejected a claim that

mirkarimi's wife made the video with a neighbor who she thought apparently was a lawyer, the argument there that it should be kept out due to attorney-client privilege. the video show as bruise on her arm and accuses mirkarimi causing it. he has denied any assault and lopez has said she was not abused and refused to testify. his attorneys claim that an unavailable witness would violate his right to question his accuser a. ways to go in this. there are 144 potential jurors still to question. reporting live in san francisco, christie smith, "today in the bay." >> thank you very much. the fallout beginning in afghanistan after a u.s. soldier goes on a deadly shooting rampage, killing 16 civilians, most of them women and children. the afghan people questioning whether single soldier could be

responsible for sunday's shooting and protests are expected. afghan president hamid karzai calls it an act of terrorism he says will never be forgotten. >> president obama and defense secretary leon panetta called to express condolences. coming up we'll go live to washington for the latest reaction, national and international, on this subject. >> 5:04. a mystery at a park. police are trying to figure out the identity of a man found at the shoreline. a hiker on the park's san francisco bay trail called 911 to report the discovery last night. the body was on the rocks next to the trail about a quarter mile away from the staging area on a west witten avenue. there are no signs of foul play. >> the search continues for a fourth body from a fishing boat accident. four men fishing in the channel were reported missing saturday. three bodies have been found. they were found floating near a

capsized boat. none of them were wearing life vests. the coast guard was prevented pulling a fourth body from the water. they will try today. >> livermore police looking for a man they say tried to abduct a 4-year-old boy from a daycare. police released this sketch of the would be kidnapper. he walked into the livermore valley tennis club and told a child care worker he was there to pick up his son. when asked for his i.d. he left. the mother said no one else was authorized to pick up her son. >> a major crash actually i should say a major cash infusion will move b.a.r.t. to the south bay down the track. stephanie chuang joins us live from the san jose area with the historic ceremony set for a few hours from now. good morning. >> reporter: good morning. we keep hearing about south bay commuters getting b.a.r.t. in their area and the project creating at least 1600 jobs.

this morning in a few hours like we said t project is going to get real money, $100 million check that will be presented here at city hall. it's coming from the federal transit administration. the first payment of its $900 million commitment to the project. construction on the first phase is under way, the 10-mile stretch from fremont to south fremont, warm spring, down to barry es sta. commuters say they are counting down the days. >> a very good thing for people going to san francisco from here. >> we never go in the city because it's such a pain to get up there and drive, do we not drive. where are we going to park, take the train. so it would be nice to like be able to have a really easy access to the city. >> reporter: the rest of the funding for the $2.3 billion extension project is from state and local money including a sales tax. $1 billion from that. the groundbreaking at the berryessa station is set for

april 12. congress members will be here, they have been huge supporters of the project. they will be at the check signing ceremony at 10:00 this morning. live at san jose city hall, stephanie chuang, "today in the bay." >> thank you. 5:07 now. the b.a.r.t. extension could not come at a better time. more americans are using public transit. the american public transportation association says people took 200 million more rides on public transit in 2011 than they did in 2010. some of the increase is a result of more people working. 60% of transit rides are by commuters. the group says americans took a total of 10.4 billion rides, that's a billion more than in 2000 and it's the second most since 1957. >> 5:07. state emergency leaders taking steps to ensure you know what to do in the event of a tsunami. several areas of marin county are vulnerable. among them wouldn't bonita and

even sections of san rafael. the topic, fresh in the minds of emergency leaders after a devastating tsunami in japan one year ago. it was so powerful the tsunami traveled all the way to the santa cruz harbor where eight-foot waves ripped away boats and destroyed docks. only two of the 23 docks damaged have actually been repaired. >> thieves put a damper on the start of baseball season. thieves broke into an equipment shed over the weekend taking $3,000 of equipment. any one with information is asked to call petaluma police. >> hopefully make that spring forward effect nicer. meteorologist christina loren is joining us in the nbc bay area weather center saying today is going to be nice. >> today is going to be nice. something you associate with spring, high pollen levels. we're not talking about a lot of allergy problems this week but

hay, that rain we've been missing, boy, does it move in. as we head through tomorrow all the way through this weekend, the pattern changes. you'll have opportunities to get outdoors, but they will be limited. we're talking heavy downpours at times. it's cold enough for a jacket in livermore. 38 there. 38 in concord and 39 degrees in fairfield this morning. as we head throughout your afternoon temperatures will be on the mild side because we're starting out in the 40s in san jose. about 52 by 8:00. 61 by noon and 64 degrees at 4:00 p.m. because of that time change the sun is not going to come up until 7:30. that means it will be dark. weed that sunlight last week, just last week and people had an easy time getting to work. you want to give yourself extra time, more dangerous when you don't have all of the sun light. >> that's a good note for folks, there will be the sun rise hitting folks but not usually the ones it does hit so be prepared. if you travel about 7:30 or after that's when you see the

sun change. like christina's talking about. that will be an issue for the evening as well. looking to the maps where we had the disabled vehicle around 98, that is reportedly off the charts now, clear from the incident report. to the middle of the screen i'm going to circle this area eastbound 580, a lot of wood debris on the road. that has cleared. without any traffic breaks and without incidents. heading away from the bay bridge. antioch area, not showing any slowdown with the 60 on the right. but we're watching for that to change. we'll see if the time change has an influence on the start for the commute as well. we'll look at the south bay with san jose, 280 moving toward us with the headlights under the 880/17 interchange. i'll give you a better look coming up. >> mike, thank you. it's 5:10 now. it's a big deal here in the bay area t film festival rolling up the red carpet. wrapping up last night making

the final day of the festival a festive one. filling the theater in san jose to catch the most popular films of this two-week event. organizers say it was nothing short of a huge hit featuring more than 250 screenings and total of 26 parties, none of which i was able to attend. i'm jealous. >> and you were on the invitation list for sure. the niners may land a future hall of fame receiver. randy moss is hoping for a comeback. the niners appear to be listening. coach jim harbaugh will throw the ball because of league restrictions. san francisco is trying to lock in alex sbhith a contract extension f. they do not sign him many say the niners could be in the mix for a hot new free agent peyton manning. many have already talked to the broncos and cardinals and plan to make a decision this week.

but it's quiet today with the federal budget statement out this afternoon. the fed is going to meet tomorrow but is expected to leave interest rates at historic lows. we saw the dow rise on friday to close at 12,922, the nasdaq up 17 to 2988. toyota's prius d goes on sale today. it starts at $19,000 and expected to be a shot in the arm. toyota is targeting annual sales of 220,000 vehicles, those hybrids that is. back over to you. >> getting ugly at the pump. thanks. >> 5:19. here is a strange and unusual story, berkeley's police chief issuing an apology after sending an officer to a reporter in the middle of the night. he was upset about a story the reporter had written so he sent an officer to the reporter's house before 1:00 a.m. on friday

demanding changes. the reporter said he was startled and felt intimidated so made the changes. the chief now admitting he was wrong. >> obviously a very significant error of judgment. and i put doug in an awkward position. i shouldn't have done that. what i'm doing is i'm completely falling on my sword because i'm simply in the wrong. >> the story had to do with the response to last month's beating death in the berkeley hills. the report said mehan apologized for a delayed response to the crime scene, the chief says he had apologized for a delay in offering an explanation but not for a delay responding to the crime scene. >> b.a.r.t. is looking at lowering fares for weekend passenger, thinking about slashing fares as much as 50% during off-peak hours on saturdays and sundays to attract more passengers. b.a.r.t.'s director says the lower fares won't mean a net loss.

other data that show the economy is recovering. on friday the labor department said america added more than 200,000 jobs. california measuring a different month said the state lost job and the unemployment rate fell, remember, though, jobs loss are added are the important number, unemployment rate is a statistical guess. some asked if the person on the other end has a job or is looking for a job, that's why you sometimes hear the unemployment rate referred to as the household survey. mexican billian nair carlos flim will launch ora tv. it will feature content from larry king. when i think of hipsters watching a new internet channel, i'm not sure i think of larry king as the one they are going to see. it launches today. we'll see how it goes. >> with all due respect to mr. king and the suspenders i agree with you, scott. >> i'm not going to touch that one. 5:26.

flowing cash. good morning. >> reporter: good morning, jon. a pretty big celebration, we've got the federal transit administration cutting a $100 million check to the b.a.r.t. project out of the $900 million commitment in what is called the largest funding milestone for a project ever. that's in its history. construction crews have begun work on the first phase of this extension project. a 10-mile stretch. two stations planned going from warm springs to milpitas and then to barry es is a. >> the family put their stake in here and they voted twice for the -- to make this happen. they put their faith in it so it should be as we say here, should be getting their return on their

investment. >> the project will cost $2.3 billion paid for by federal and state funds and 1.2 billion from local dollars. the project will add six miles ending in santa clara. more news, it's supposed to create 1600 jobs and two huge supporters of this project will be here for the check signing ceremony at 10:00 this morning. stephanie chuang, "today in the bay." >> 5:33. paypal is mourning the loss after top executive. 39-year-old eric salvatira was killed. he was paypal's vice president of online payment service. he was hit by a northbound train in men who park. why he was on the track is not known. two more people died on cal train tracks in san leandro in recent days. a woman was hit friday afternoon near washington avenue, and a

man was hit saturday afternoon near central avenue. >> still no sign of a former marine from san bruno who disappeared 10 days ago. 27-year-old joseph mchenry told friends he was going camping and rock climbing. his car was found wednesday near the sharp park golf course. some of his gear was discovered on thursday, but at this point investigators aren't saying exactly what was found or where. searchers scouring the beaches and cliffs again over the weekend but nothing new turned up. >> attorneys for san francisco sheriff ross mirkarimi are offering a new argument to keep a video out of evidence. it's the latest tactic in the sheriff's domestic abuse trial. christie smith is live in san francisco where jury selection should resume today. good morning. >> reporter: good morning. the prosecution certainly seemed to have a victory on their hands when a court said they would be allowed to show a video of san francisco sheriff ross mirkarimi's wife. but now there is an entirely new

legal challenge coming out on this on the grounds that he actually wouldn't be allowed to question her in court over this. attorneys for the san francisco sheriff filed a new motion arguing that statements made by eliana lopez should not be alloweded because he can't cross-examine a videotape and lopez has said she does not want to testify in this. on the video that she made with a neighbor lopez shows a bruise from an alleged incident with her husband on new year's eve day. this is the third challenge to that video and mirkarimi and his wife have both since come forward and said there was no abuse. jury selection as you said continues today, the pool was expanded, there are now 144 potential jurors to get through. reporting live in san francisco, christie smith, "today in the bay." >> apple letting people know the new ipad may be in stores friday but it may take a while to get your own. scott mcgrew is in the newsroom

with the new delivery delay. >> good morning. jon, if you decide you want one of those new ipads and buy it on line it may take as much as three weeks to get it. all orders for friday delivery sold out. now as you point out apple does plan to have the new ipad in stores but if past history holds those, too, will sell quickly. in many ways this is one of the least new apple devices, it's mostly a faster chip and better screen. but demand appears high. you might think companies are glad when their products sell out but they are not because it represents a lost opportunity. apple factories cannot pump these out fast enough. you have choke points as well. how many ipads you can get on a plane and how many planes that apple can charter at one time. again, maybe as much as two to three weeks delay on the online delivery. >> in demand. scott, thanks. 5:36. your local county recorder's office may be packed with

protesters today. the occupy movement is joining forces with a group of homeowners to target 20 county offices throughout california including the recorder's office in san francisco. the protest is on illegal foreclosures and demanding independent audits of foreclosu foreclosures, they want the attorney general to put a hold on foreclosures until audits are complete. >> let's take a look at your monday weather forecast and toss it over to meteorologist christina loren. >> good morning, jon. good morning, marla and to you at home. it's cold but we're holding off on showers until tochblt we have a wet pattern that's going to last into this weekend. and we need the rain so that's the good news. however, we don't want to let you get caught off guard so clean out the the storm drains. we haven't had this rain all winter long. we're talking about with seven consecutive days with rain chance, upwards of 60% each day.

38 in livermore now, it's chilly in san jose in the 40s, as we head into your lunch time hour, noon today, 61 degrees, 55 by the bay. and at the coast 57 degrees. so overall temperatures running much cooler than where we were on friday, a beautiful couple days, thursday and friday, with temps in the 80s. everything changes, a series of storms on the way. that jet stream has taken a significant dip to the south. so that's going to usher in several pulses throughout the week. the storm systems are just lining up out there in the pacific. i'll time out the first one for you. and let you know when you might be able to get outdoors. you'll have limited opportunities but i have a pretty good handle on the timing. we'll talk about that. first i'll check your drive with mike inouye. >> we're worried about the timing of the morning commute because of that time change that kicked in yesterday. we're looking at a typical drive, a slow spot for antioch, highway 4 westbound right on schedule. but it doesn't appear to be quite as extensive.

>> welcome back. it's 5:41. a u.s. soldier held right now for a shooting rampage, a deadly one that left nine children, three women and four men dead in afghanistan. this of course a big blow to an already brittle u.s./afghan relationship. tracie potts live on capitol hill, she has the detail this is morning with reaction to what many are calling nothing short of a senseless act of violence. good morning. >> reporter: jon, good morning. now the concern is will afghanistan, will the taliban strike back. that's what we're hearing, calls for protest, demonstrations. the last time we saw that they turned violent against at least six americans there in afghanistan. this soldier apparently shot and killed nine children, three women, and four men and then wounded five others, then turned himself in the next morning. this happened 500 yards from a u.s. base.

president obama's call afghan president to apologize, saying this is not representative of u.s. soldiers. karzai said this was murder, it was intentional, it was an act of terrorism and that it won't be forgotten after those koran burnings last month, we saw the deadly reaction to that. now there is concern not only about the safety of americans there, the embassy telling people to keep travel plans to themselves, avoid large gatherings in afghanistan. but also there's concern about u.s. relations, already as you said on somewhat of a thin string and now this incident here in washington reaction, some lawmakers saying this is a situation that unfortunately sometimes happens in war. we need to push through it. also some say underscores why we need to get out. >> a hard to believe story, kind of crazy. a two-part question. what do we know about this soldier, and any idea at this point of his motive?
