reports are that 38-year-old staff sergeant is a trained sniper. he may have recently suffered a head injury in a vehicle accident. >> we the american people who love and support our country are now being viewed as supporting war crimes. >> the massacre has sparked outrage in the bay area and around the world. it prompted a candlelight vigil at uc-berkeley organized by the afghan student association. >> everything i thought is we need change. what we're doing there is not helping. innocent people are dying day by day. >> the taliban has called for revenge. the secretary of defense says the u.s. must resist froosh change course in afghanistan in the wake of the shooting. >> san jose looking to bring life it's the downtown by making it easier for businesses to set up shop. stephanie chuang joins us live

from downtown san jose with more on the city council's plan. >> reporter: good morning. here's a number. at any time the vacancy vat 20 to 25%. it's trying to nax at tonight's meeting. one of the ordinances up for changes is making it easier for grocery stores to get liquor licenses. here where we're standing is where our fresh and easy is set to come but it's been very difficult for the businesses to come because the process needs to be stream lined. we spoke with the council member whose district encompasses downtown san jose. >> it's all about how we can make it easier for business, to be able to hire in the stixt we recognize we're making progress but we've got a long way to go. this is an important step to accelerate job growth. >> reporter: back here live, another ordinance up for discussion tonight is you see

these spaces in that picture. it's been reserved for retailers making it difficult for companies that want to use these as office space to do so. and with that vacancy rate, the council member saying it doesn't make sense so. they are going to try to make it that offices can use these spaces. more in the next half hour. >> deadly for a bay area woman. 58-year-old from sunnyvale was crossing a rain swollen stream on the island of kauai saturday when she was swept into the ocean. recent rain caused the river to wide. it made the path dangerous. >> there is no place for the rain to go so its making the ocean turbulent. people try to cross these twil hiking it can be very dangerous.

>> she was a teacher in hawaii for a group conference. she is the third person from the bay area to die while vacationing in hawaii in the past eight months. >> police need your help finding a pair of thieves. look at these surveillance images. it happened saturday night on contractor street. duo stole computers, printers and other electronics. you are asked to call livermore police. >> san francisco could be looking for a new sheriff as early as next week. ross mirkarimi pleaded guilty to a misdemeanor charge of false imprisonment. mayor ed lee now has the option of pursuing official misconduct charge. the sheriff is scheduled to be sentenced monday.

after that mayor lee says he will make a decision. >> there has been distractions to be candid, but i think now i have to focus on this charge because there's been a plea, an admission of guilt and therefore i've got to go forward with that assessment. >> under the plea deal mirkarimi will get three years probation, serve 100 hours of community service and attend 52 weeks of domestic violence classes and must publicly apologize to ivy madison and her family. >> people being arraigned for their part in a protest at uc-berkeley. the district attorney says four students and one professor will be charged. the charges stem from the november 9 protest when occupiers refused to remove their tents. urngs c berkeley used batons to remove them. the defendants accuse officers

of using excessive force. the d.a. would not comment on why only five were charged. >> amtrak is back to normal after a major crash. it took more than seven hours to repair the tracks. around 11:00 yesterday a train traveling from seattle to los angeles hit a truck on the tracks. the engine was damaged but no one on the train was hurt. the driver was taken to the hospital. no word on his condition. >> santa clara expected to 5 approval the 49ers project. the council holding a final vote on that budget, the financing plan and lease. last week a judge dismissed a suit demanding another vote on this project. construction on the stadium could begin this spring or early this summer and it should be ready for the 2014 season. >> 4:38.

good morning. she said the rain would come and it has. let's check it in and out with meteorologist christina loren. hi. >> yi, now that it has started it has begun, we going to see these showers just about every morning this week. this is what your drive looks like. the rain showers are confined to the north bay now. we're getting a steady mist or a drizzle in the south bay. it's enough to get your highways wet. if that wasn't dangerous enough with the split conditions we also have very gusty winds. so you want to take it easy in your high-profile vehicles. you can see where the bulk of the moisture is to our north. look at these reds and yellows. this is going to slide to the south so we're looking toward an active day. you need the umbrella giving you a healthy workout and blustery from time to time. we're still holding on to the 60s, though. mild temperaturewise.
