business inventories. the the dow rose 37 on monday closing at 12,959. the nasdaq slipping 4 to 2983. retailers hope to see more green on st. patrick's day. 54% of americans man to celebrate the holiday and will spend up to $35. spending on clothes, a third to bars or restaurants and 30% making a special dinner at home. sears is trying to use technology to win back lost shoppers. the retailer has a new loyalty program that offers customers freebies in return for sharing personal shopping data. the "wall street journal" says people who check in at the maul with their smart phone are greeted by a sears employee, and they can pull up web reviews or guide you to stuff you were

and the observe administration very concerned. president obama has threatened to take the chinese to the world trade organization, something that's rarely done, and could spark a trade war. rare serth critical to the american economy. there is a rare earth mine in california in southern california. here is some video that the company shot from a helicopter. the the mine is called project phoenix and its ceo tells me the phrase rare earth is a bit of a misnomer. rare serth everywhere but in really small quantities so it's unusual to find it concentrated. when you do that's where you put your mind. unfortunately those are almost entirely in china. something like 95% of all rare earth comes out of china but we need it here. >> okay. thank you, scott.

area bridge. another viz rye for the richmond/san rafael bridge. we have fruitvale an accident there. the car has gone off of the roadway. but now the crew is on the scene. weed that car fire in oakland as well. christie smith is there. >> a lot going on. thank you, mike. 5:29. san francisco sheriff ross mirkarimi's criminal case is over but his future employment remains in doubt. mirkarimi pleaded guilty to a misdemeanor charge in exchange for having three charges dropped and agreed to a sentence of three years probation, 100 hours of community service, 52 weeks of domestic violence glasses. mayor ed lee says the guilty plea has him reviewing his options. >> there has been distractions to be candid, but i think now i

apartment complex in oakland. christie smith is there right now, has all of the latest details. >> good morning. the damage looks a lot bigger. residents are walking around in robes and blankets, staring at their apartment building where near the lake merit area, adams street, this mainly affected the front side of the building, at least six cars burned including one cab. on the front side you can see two apartment units are pretty badly damaged as well. i did speak with a neighbor who shot some neighbor off of her eye phonement she saw flames pouring out of the bottom front of the building. they have an investigator here but one that it is cars burn. it could have spread to the other. i spoke with one woman who ran

out to see her far boat burning. firefighters say main concern was making sure everyone was out. this is a high density area with quite a few apartment buildings. the red cross is out here. they are saying that five units were affected. 18 adults and 6 to 8 children. firefighters tell me they will be on scene maybe an hour or so but at this point the good news at least no injuries. that's the latest, live in oakland, tob. >> sadly, a trip to hawaii turned tragic for a bay area woman. sanchez shing died after he was swept out in the ocean crossing a rain super bowlen stream. hikers say heavy rains mate their path unstable and dangerous. >> it's making the ocean

good morning. what will the voters in alabama and mississippi say today, their primaries are going to be a key part of this presidential race. what we're seeing is mitt romney doing better than expected, he had challenges before in other states with the conservative base. evangelical voters but he's running pretty strong with newt gingrich, both of them near the top, depending on the poll. in fact, they are in most major polls within striking distance of each other. rick santorum who had that southern evangelical vote for some time doesn't seem to be doing as well at least in these two states according to the polling we've seen before election day. both of them, all of them, have been in alabama and mississippi campaigning, gingrich and santorum yesterday talking about gas prices. that's something that the voters say they want to hear more about. all of the candidates have been there talking about grits and

gravy. voters tell us they want to here more about the economy. which is the most electable. that has been in the last few months. mitt romney against president obama. the president's popularity numbers have slipped down to 41% in one major poll. analysts think that's because of gas prices. >> tracie potts, thank you. >> 5:43. we're getting new details of the american soldier accused of that deadly shooting rampage in afghanistan. the 38-year-old staff sergeant was involved in a 2010 vehicle rollover accident. he was later given a clean bill of health. the reports say he has not shone behavior problems since. he also has been deployed three times in iraq. the sergeant is accused of killing 16 afghan civilians. the shootings sparked outrage including here in the bay area.

as we head home, going to be rough but not as rough as the evening. we expect a lot of rain so ponding on your local highways and it doesn't het up until 3:00 a.m. wednesday. on thursday morning, a little bit of a break. but then late thursday another strong storm moves in. bringing periods of rain. it works like this. we've got one front on the way with several behind. the first cold front moves in, on the warm sigh. that's why it's so mild. as we head throughout the day. the second system moves in throughout tomorrow. and that means it may takens wet. your outlook tells the story. back on the seven-day forecast, showering all week long. the longest stretch of wet weather that we had all weekend long. saturday and sunday when we get
