laura. the alameda county coroner has arrived on the scene of the accident. we've got new information. i just got off the phone with the chp and they are telling more details about the fatal accident, that a huge tree fell. was laying across the southbound lanes of highway 13, and then a car ran right into that. a second car also apparently ran into the first accident here. two people trapped inside one of the cars. one person killed. a second person taken away to the hospital. now, that tree covered all of the southbound lanes when it came crashing down around 4:20 this morning. firefighters were called out. also caltrans. they used chain saws to try to cut the tree away from the car. and they did, of course, try to get those two people out. one of them killed here at the scene. the car was just taken away on a flatbed truck. we're told at this point it looks like still drivers coming

on the southbound lanes are having to get off the freeway at park boulevard because that's where this accident is. but we're also hearing that neighbors are saying it was so loud, they heard the crash and then screaming coming from the accident scene. so they were the ones to call 911. we're also getting some new information, the chp estimating it will be reopening the southbound lanes in about 45 minutes. earlier they were saying it could take longer than that. but they do caution that one thing that could delay the reopening, they're not sure if there was a collision that led to the tree falling or if perhaps it was the ground that was saturated from all the rain. they want to go ahead and take a look at the ground around these trees and make sure that it's not unstable, of course, if it is, then that could delay the reopening. for now what they are telling us it's about 45 minutes. reporting live in oakland, christie smith, "today in the bay." >> that ground must be saturated out there as we have another tree down very close to where

christie is. >> this is also on highway 13. we're getting more information. christy smith is southbound 13 at park boulevard and five minutes until the freeway will reopen. and we saw the progress there. the deadly accident caused when a tree came down across the roadway. your alternate is eastbound 580 but in the last five minutes i got a report from chp of a tree down northbound 13 right around 35th. that is not far from where christie is, we'll helpfully get more information on that and maybe christie will have to head to the other side of the freeway. we'll see how it develops. be careful in the oakland hills. four trees reported down from yesterday and today. another tree was reported down on the santa cruz mountains affecting both sides of 17. one of your southbound lanes is affected by that tree. the northbound side sounds like folks are getting by and they've been able to trim the branches. one of the southbound lanes will be slow heading out of los gatos

because the tree is sticking out of t . >> and we are not getting any sort of a break from that aftermath. i think we'll probably see a couple more trees go down as the winds are still whipping especially through the higher elevations. the ground is saturated. we're getting light showers as we speak and we have heavy rain on the way as we head through tonight. let me show you what's headed our way. a lot more moisture. we'll take you through the forecast. lot to talk about in the weather department. give yourselves plenty of time this morning and be cautious on our local roadways. we'll have the full update coming up. let's get back to the top stories of the day. we are following developing news out of san jose where a three alarm house fire left a firefighter seriously injured. "today in the bay's" bob redell is on the scene, we're hearing at one point the injured firefighter was actually engulfed entirely in flames. >> reporter: yes, he was according to a fire captain. good morning, john, but he had

his protective gear on. we got an update on his condition, they said he suffered second-degree burns to his hands, it's not life threatening but it's very serious. the fire department escorted us into the apartment building on underwood drive that suffered the most damage. take a look at this new video. if you look up through what used to be the ceiling, you can see where the firefighter fell through. when they arrived at 3:45 this morning one of the priorities on the three alarm fire was to ventilate the fire and smoke out of the attic. to do that the firefighters climbed on top of the roof and cut a hole and that's when he fell through. he was in there for perhaps around 30 seconds before his colleagues were able to pull him off and rush him to valley med. fire department believes this fire was accidental caused by a lit candle. there were eight kids, nine adults, four units either destroyed or damaged. they are out okay. the people who live here tell us this morning they're very thankful for a young man who happened to be walking by their building when this fire started. >> i don't know him. he lives in the neighborhood.

i am so thankful to him. he was walking by i guess and he told me later i was talking to him that his little brother passed in a fire in 2004. and that -- so he just reacted right away. he knocked on the door of the lady of the apartment that was the one on fire and he ran upstairs and knocked on our doors and got us out. >> reporter: again, 17 people live in the four units are out okay. red cross just came by to pick them up and try to find them temporary housing. reporting live in san jose, bob redell, "today in the bay." this morning parents, teachers, and students will urge california lawmakers to not blow it when it comes to education funding. they are staging rallies and blowing bubbles to protest the pink slips that start going out today to thousands of teachers statewide. several bubble protests are planned at mckinley school in san francisco, glenview in oakland, lincoln elementary in

burling game. today is the state mandated deadline for schools to issue notices for positions that won't be funded next year. new this morning, laura, a south san francisco girl back home after police say her mother kidnapped her. here's the deal. police say 5-year-old jon joseph has found in southern california, police say paducah per reside was visez was visiti father when she stole the girl and took his car. fbi is looking for a gunman suspected in a string of violent gun robberies across the state. take a look at the surveillance photos. a ba the man robbed a bank in vacaville on monday, and investigators think he robbed several banks in southern california and has tried to rob a sacramento bank a few days ago. an elderly oakland woman is safe with her relatives this

morning of a she was involved in a violent home invasion robbery. the attack happened tuesday morning at a home near thorn hill drive and mountain boulevard. police say two men broke through the rear door and forced the 89-year-old resident into a bathroom before taking off with cash and jewelry. this just the latest in a string of home robberies and burglaries in montclair and oakland hills neighborhood. the oakland tribune are reporting that they or four are happening every day out there. police do not think multiple people are involved in the robberies. work crews are expected to be back at a home in san jose removing mountains of debris. crews started hauling junk off the home on claremont avenue in east san jose on tuesday. it was declared a public nuisance by the board of supervi supervisors. the crews still have not made their way to the backyard. bad weather delaying the opening of the new southbound

express lane. it will be delayed until tuesday. when it does open solo commuters will be able to drive in the carpool lanes in milpitas provided they pay a toll using their fastrak account. i want to check the forecast with christina loren, we are seeing so many trees down, the ground is saturated and more rain to come. >> more rain to come and more severe will be the wind we are expecting. already wind-battered trees weakened by the first storm, two more storms on the way. and it's the next storm that is really giving me a headache, because this storm is potent. it's packing a lot of moisture. we're going to see very gusty winds on friday. overall tomorrow looks like a complete washout. right now we actually have just a few light spotty showers streaming onshore. nothing heavy. but we're expecting aftermath and the winds start to pick up ahead of the next system. if you are headed over 17, you

tree down reported at 35th avenue over the last few minutes. before 6:00 reports of a large tree blocking the slow lane. vehicles reportedly swerving to get by that. no chp cruisers on scene yet and we don't know about how long it will take to clear. be careful before the split on 5 580. 580 will be your alternate. that will force you over to take 24 a little bit over towards the caldecott to rejoin with the freeway. it may be worth it at least right now. we'll see slowing, though, connecting the two for highway 24 that could be an issue if it doesn't clear by 7:00 for either or both incidents. we'll get a live look at the toll plaza, and it's a thursday, the volume steadily building throughout the east bay. typical spots. we'll show you those coming up, but the big focus is highway 13, the warren freeway. back to you. coming up on "today in the bay," rick santorum's campaign

lead for countrywide security in 2013. that's one year ahead of the current target date. karzai just making these statements after meeting with defense secretary leon panetta in kabul. he said in the meantime the international troops should pull back from the villages to the main bases. the panetta/karzai meeting comes as the suspect in sunday's deadly shooting rampage that killed 16 afghan civilians is flown out of afghanistan to kuwait today. the staff sergeant is to be tried in the u.s. it's mourning in belgium for the deadly bus crash. the memorial is growing outside of the schools where the children went. also above the tunnel in switzerland where the crash happened. belgium's prime minister says he is hoping all the victims will be identified by the end of the day. the cause of that accident

continues to be investigated. well, rod blagojevich, he's no longer a free man. the former illinois governor left his chicago home about 4:15 pacific time this morning to report to federal prison in colorado today. blagojevich was sentenced to 14 years after he was found guilty of corruption for trying to sell barack obama's senate seat after obama was elected president in 2008. the associated press is reporting right now blagojevich is on a regular flight to denver. he's not in first class, and he's actually said to be in good spirits. >> marla, thank you very much. interesting story there. but more interesting right now is the weather happening around here. a lot of rain causing saturated trees falling and one fatality and it will get worse you say. >> we'll get half of our average winter rainfall in the course of four days. take a look at the totals so far. san rafael picked up almost eight inches over the past 48 hours and that's metropolitan

san rafael. we take you to the higher elevations, ben lomond picked up almost six inches worth of rain. and i talked to people that live in the santa cruz mountains and they said it really poured. take it easy out there. and right now it's at the driest. this is the driest point of the day. as we progress throughout we're going to continuously see the showers stream onshore. your temperatures are nice and mild. but we're still on the warm side. the next system a cold one is going to usher in some very cold air and potentially drop our snow levels to 1,000 feet. so, we're getting a quick blast of winter. we were slated to see this go down as the driest winter on record for the bay area. that is not going to be the case. we head throughout this week, we'll have a lot more moisture on the way especially as we head through friday. that's the day you want to try to plan your indoor activities all day long. showers on the way. third storm moves in. let me time it out for you and show you how much moisture we're expecting. and the santa cruz mountains

have sheltered san jose from the rain. everything changes as of tomorrow. today, spotty showers. they continue throughout the day. we've stopped the clock on your futurecast at 9:00 p.m. and the heavier rain moves into the north bay and by 6:00 a.m. tomorrow the activity ramps up big time. rain all day long. light to moderate rain, but then the heaviest stuff comes in by about 10:00 p.m. take a look at the south bay just getting slammed. we could see 2 inches of rain come down over the course of maybe seven or eight hours in san jose. flooding definitely likely. take a look at what happens next. the cold air moves in. 5:00 p.m. saturday, the snow levels drop. really cold conditions. we're talking about 1,000-foot snow level. that means the foothills getting a dusting of the white stuff. so, it's going to get a little bit more active before finally calming down monday into tuesday. a few clouds wednesday. warming back up into the mid-60s. let's check your drive. a lot to talk about in that department with mike. most definitely, folks, we want to remind you that

southbound 13 is still closed at park boulevard. let me give you the live shots out there as they progress. the deadly accident on the southbound side because of the tree came down across the roadway and onto a car. we just got an update from chp. we'll bring you that information as soon as that finishes coming into the newsroom. we have, though, the cleanup that continues here as well. and we were originally looking at a 6:45 reopening. looks like they're well on that progress. there's a crew here. now, this is the southbound side at park boulevard. back to the maps, let's look to the northbound side now, just a couple miles away. the maps will show you what we're talking about as we're looking at northbound 13 at 35th. another tree reported there sticking out into the freeway. both sides of highway 13 having an issue for the short section of highway. 580 is a good alternate for you to stay completely clear and it should be completely cleared by 7:00. we're hoping that is the case. if it is then we should have relatively smooth traffic flow through the area. it's relatively light through the east bay and the south bay. pretty much not a problem for

flowing out of los gatos but we've got the second tree down or the third tree i guess now down over at summit road. just south of there, southbound 17 has one lane that is blocked as you're heading out of los gatos and in towards santa cruz. the rest of your southbound commute looking all right. this is 56 on highway 87 shows a little slowing there. expect that for 101 and the fire in san jose, bob redell continues to give us updates. there was a firefighter injured but it shouldn't affect your drive, but it affects a lot of lives. we'll send it back to you guys. we continue to follow breaking news, you mentioned the tree that went down on highway 17 this morning. we're just getting in details from the chp that said that tree fell, it was close to park boulevard, and a car hit it. three people got out of the car, moving to the side, but then a second car came along and hit one of those three people. one of which was killed. christie smith is live at the scene. we're now hearing reports of another tree that has gone down

person has been killed. >> christie smith is live at the scene of that fatality in oakland. what's the latest? >> reporter: good morning to you, laura. i can tell you that the alameda county coroner left the scene on southbound highway 13. the scene of this fatal accident. right now crews are out here trying to clear the roadway. and i spoke with the chp and they're giving us a clearer picture of exactly how this deadly accident happened after a tree fell across the southbound lanes around 4:20 this morning. they say a car carrying four people inside hit the tree that was across all of the lanes southbound. they all apparently got out of the car and then went to the shoulder. that's when another car, a truck, came up and hit the tree as well and that truck went airborne and killed the driver of the first car who was out of the vehicle. now, identi just asked the chp they think the southbound lanes right reopen and here's what

they told me caltrans still has to do. >> have to clear the roadway, get the remaining debris up, if they open it right now, it's too slick from leaves and other things on the roadway, they'll probably have to bring a washer truck to wash the debris out. >> reporter: three people were taken to highland hospital here in oakland. the good news, they had nonlife threatening injuries. it's not raining right now, but it really is wet up here. the chp also telling us that another tree fell this morning in the northbound lane. i wanted to see if steve could swing the camera around this way. this is clark boulevard, and you can see where people are being directed off the freeway. they basically go around where we are and get back on the other side. it does look like they're moving the cones to one side, so maybe, maybe, they might be opening up one lane. but they're working hard out here to get it reopened. earlier they told us maybe 30 to 45 minutes, but we'll keep an eye on it for you and check back in when it does reopen. reporting live in oakland, christie smith, "today in the

bay." >> thank you very much, christy. let's turn to mike to find out how the other accident and others are affectening t enining commute. >> the full closure, we'll put it on the map. she's on highway 13 at park boulevard. we saw the situation is fluid. they may be reopening one lane but the other lane has remained closed as cleanup crews are still there. trying to clean the debris off the roadway because the leaves themself being wet are making it an extra slick roadway southbound. northbound the other tree that laura was talking about blocking at least one lane as you are approaching 35th avenue on the northbound side coming off of 580. both directions are affected by downed trees and that will be an issue for at least the next half hour to 45 minutes. looking at 580 eastbound as your alternate to get around the closure but 580 is just clearer this morning. yesterday saw a couple of trees down on the on ramp and rain sho soaked hills could be playing a factor.

we're looking at the bay bridge where a wind advisory has issued by the chp and the metering lights are on. and i'll warn folks about wind on the richmond bridge and slick conditions, and puddles and slick roadways around the bay. and we're considering it a break, the rain soaked hills and the rain could play a factor through the day and the weekend as well, right? >> we won't get much of a break. unfortunately we've got spotty showers streaming onshore right now and the activity will ramp heading throughout the day. today does not look as quite active as we're expecting tomorrow to be. my goodness, take a look at what is headed our way, especially down in the south bay. we've got 2 inches of rain over the course of an eight-hour period. flooding possible, low snow levels and thunderstorms and in addition to the rain already saturated soils, gusty winds on the way in excess of 50 miles per hour. we'll time everything out for you and let you know when the most treacherous driving conditions will take place and we'll help you get around the storms. when we finally clear out, you

"today in the bay's" bob redell is live on the scene. we understand at one point the firefighter was engulfed in flames? >> reporter: it was his protective outfit that saved him according to one of his colleagues, a fire captain we spoke to, earlier this morning. that firefighter is at valley med, at the burn center, is going to be okay, but he did suffer second-degree burns on his hand, so it's very serious. if you look up to the building to your right. this is the four-unit building that caught fire. when firefighters arrived at 3:45 this morning, one of the priorities was to get up on the roof, cut a hole so they could ventilate out the smoke and fire that was racing through the attic. they cut a hole. and then one woman standing on her front lawn saw what happened next. >> all we saw was his hand

coming like this, help me out. oh, my god, help him, help him! and they got him out and hauled him all the way to the end with another ladder coming up and they got him off the roof. what i hear is he's okay. so, thank god. >> reporter: and she heard correctly according, again, to the fire captain we spoke with. fire department believes this fire was accidental. caused by a lit candle that someone perhaps fell asleep next to. there are 17 people who live in these 4 units, 8 of them are children. within the past hour or so red cross arrived. they are now interviewing these people, trying to get them back to some sort of housing for the time being because these units right now are uninhabitable. reporting live in san jose, bob redell, "today in the bay." this morning teachers, parents and students urging california lawmakers not to blow it when it comes to education funding. and they're using that theme as they'll stage rallies and blow bubbles to protest the pink slips that begin going out today

to thousands of teachers statewide. several bubble protests planned today at mckinley school in san francisco, glenview elementary in oakland, lincoln elementary in burlingame is another one, today is the state mandated deadline for schools to issue the notices for positions that may not be funded the next school year, but the cuts won't become permanent until after may 15th. an effort to replenish funding for schools has prompted the governor to change his november ballot initiative. the governor is joining forces with the california federation of teachers in support of the so-called millionaires tax. both will now support efforts to raise the tax rate on high income earners for an additional two years. the governor has also agreed to reduce the proposed four-year sales tax increase from a half cent to a quarter of a percent. schools will have a choice this fall whether to skip the stuff called pink slime. the usda will announce the new policy -- that just looks gross -- this morning over the

controversial meat additive that is used in some schools, groshlgry stogroshlg grocery stores and restaurants. it prompted even mcdonald's to stop using the pink slime. the filler is a compressed parts of several beef cuts sprayed with ammonia to kill bacteria. sounds tasty. the usda says schools can continue to receive the leaner meat including those that have the pink slime or a more bulked-up fattier ground beef which is not treated. >> i think we're causing a lot of people to become vegetarians this morning. >> yeah. 6:36, oakland ready to cash in on pot clubs while other cities are kicking them out. the city set to hand out permits allowing four new pot clubs to set up shop including one in a vacant bank at 21st and broadway. the neighborhood response, however, is mixed. >> i just don't want to see the whole downtown solely based on cannabis, do you know what i'm saying? i want to see more coffee shops, clothing stores. >> i tend to think of crime being associated more with

illegal drug distribution. so, i don't think there would be a problem with having one right here. >> the four existing pot clubs in oakland generate more than $1.6 million for the city. not clear how the new clubs will be impacted by the recent federal crackdown on such operations. it is 6:37 right now. obviously we need all this rain that's coming but the rain is also causing a lot of problems. meteorologist christina loren is here to tell us to expect a lot more to come. >> a lot more to come down all at once. the busiest time frame looks to be friday night. so, that's when you want to try to stay off the highways if you can, especially through the higher elevations. this morning we still have some light spotty showers across the greater bay area. they're very light, kind of pesky showers. a lot of it is evaporating before it hits the ground, but the thick stuff, the heavy rain is on later on today. 55 degrees inland and the same for the bay and the coast. temperatures in the mid-50s. uniform conditions and that's because the cloud cover overhead.

60, though, by 4:00 p.m. you'll get a few breaking of sunshine in the south bay but elsewhere overcast conditions as the next storm moves in. for friday things start to change. this is going to be the juiciest of the three systems that we've been dealing with. this one will bring heavy rain through the south bay as of 11:00 p.m. friday night. it's not just the rain we're concerned about. take a look at your wind. this is your projected wind. we stop the clock on your futurecast at 10:00 p.m. friday. you look at the key. we're at the high end of this key with the pink. that's an indication of 50-mile-per-hour wind gusts from time to time even here in the south bay. with the heavy rain coming down and an already saturated soil. you want to keep it in mind. travel cautiously. we're expecting a lot more aftermath and if you are headed to tahoe make sure you have the chains because over the course of the next 24 hours, we could pick up an additional 2 feet and then the next 48 hours, an additional 6 feet above 7,000 feet, so, yeah, a lot more snow

we continue following breaking news in the east bay right now. a fatal crash in oakland likely the result of days of just continued rain. "today in the bay's" christie smith live on the scene where a tree fell right onto highway 13. christie, good morning. >> reporter: good morning to you, john. and caltrans have been working very hard to try to clear the lanes of southbound highway 13. i can tell you within the last 30 seconds literally, the left lane here has reopened. you can see they are still doing work in the right lane after this deadly accident. i did speak with the chp this morning. and they're giving us a clearer picture of what happened. a tree fell across the southbound lanes in the rain about 4:20 this morning.

a car carrying four people they say hit it. all four got out and went to the shoulder of the road. then they say a truck crashed into the tree and flew into the air and killed the driver of the first car. again, who was outside of the vehicle. another person they say was trapped for a short time and the branches and debris on the side of the road. three people taken to highland hospital. the good news, if any, in this is that those three people had nonlife threatening injuries. they're not giving us an eta of when this right lane will reopen. they're out here. they're working hard trying to clear the leaves that are still out here, but the left lane as you can see, that has reopened. that's the latest from here, reporting live in oakland, christie smith, "today in the bay." >> okay, christie, thank you very much. keep talking about how saturated the ground is because the trees are coming down and we've got more rain coming our way. >> it's not just the rain. the ground is saturated. it's the wind. you need that force to topple a

tree and we have some really strong winds on the way. those winds, oh, we've got trees already that have just been battered over the past two days. with more gusty wind on the way. in fact, we're going to see the heaviest rain and the strongest wind on friday. take a look at some of the impressive totals of the past 48 hours. almost 8 inches of rain in san rafael. that is very significant. i do believe before all is said and done, we will be right back at average when it comes to our rainfall totals for this time of year up in the north bay where we've just been getting slammed for the past 48 hours. right now we're getting a little bit of a break, but take a look at what just developed offshore, half moon bay, a pretty good batch of rain. it will ramp up throughout the day today and through tomorrow. tomorrow night, oh, we have a lot of rain on the way. wait until i show you are futurecast. what is happening is the jet stream is taking a dip, a significant dip to the south, for us that's ushering in system after system. we've got two more to get through.

about. want to make sure you get to the latest update for the accident. one lane is open now southbound highway 13 at park boulevard. christie smith was out there. i don't know if we can still get her camera shot. we cannot. because she's had to move actually because they are clearing the roadway. one lane is open on the southbound side because of the deadly accident on park boulevard that we've been telling you about. tree came down and caused an accident or helped cause an accident that caused one death and three people injured and taken to the hospital. northbound 13 at 35th. the other tree down in the area has one lane open but the second lane sounds like it's closed. you can cross over at park boulevard and traffic flowing smoothly right now but the build is going on for the east bay. look at this, slowing down the eastshore freeway coming down the berkeley curve and the top of your screen around san pablo and richmond, typical build pattern for interstate 80, the eastshore freeway. as we move south, southbound 880 coming out of san leandro towards hayward, typical pattern

for the san mateo bridge, and an earlier accident at jackson had lanes tied up that caused more slowing and southbound 680 at bernal an accident there caused a slowing out of pleasanton heading into sunol, and there's a jam off the roadway. we are following developing news out of san jose where a three alarm apartment fire left a firefighter seriously hurt. "today in the bay's" bob redell is on the scene with the very latest on the firefighter's condition. good morning. >> reporter: good morning, laura. fortunately his injuries are not life threatening but they are situation, he is being treated for second-degree burns to his hand. if you were to look through the ceiling of this corner unit of this apartment building on underwood drive you would see where the firefighter fell through and was burned. when arrived at 3:45, one of the priorities was to ventilate the roof, that's when the firefighter fell through the attic that was fully engulfed in flames at the time we're told.

his colleagues were able to yank him out pretty fast, that quick action prevented serious injuries. the fire department believes it was accidental started by a candle, eight kids, nine adults who live in this building. the people who live here are very thank tlful for a young man that was walking by the building. >> his little brother passed in a fire in 2004. and that -- so he just reacted right away. he knocked on the door of the lady in the downstairs one, one on fire, and he ran upstairs and knocked on all our doors and got us out. >> reporter: there were four units in this building, some of them very severely damaged, others not so much, but the bottom line is they can't be lived in right now, that's why the red cross is here taking care of the 17 people that live here, finding another place to live in the meantime. reporting live, bob redell, "today in the bay." there are more possible victims coming forward after the arrest of a south bay nanny.

campbell police say they've received numerous phone calls about 41-year-old john walker, also known as mr. johnny. walker was charged with 14 counts of lewd acts with children yesterday. he did not enter a plea to charges he molested more than five children. walker will be back in court next week. 6:54. the fbi is looking for a gunman suspected in a string of violent bank robberies across the state. take a look at these surveillance photos of the man in the ski mask carrying an assault rifle. the man robbed a bank in vacaville on monday, he got away with an undisclosed amount of cash. investigators think he robbed banks in southern california and tried to rob a sacramento bank a few days ago. an elderly oakland woman safe with a relative this morning after a violent home invasion robbery. the attack happened tuesday morning at a home near thornhill drive and mountain boulevard. police say two men broke through the rear door and forced the 89-year-old resident into a bathroom before making off with cash and jewelry.
