and certainly a chilly one. you can leave the umbrella at home for the morning. but hour-by-hour for temperatures, it's going to be quite cool all the way for lunchtime. high temperatures today, mid to upper 50s. cool outside, we'll talk more about chances of rain for tomorrow's forecast in a few moments. now for a check of your monday commute. >> we're easing into this week. a lot calmer than we ended last week. i'll show you the bay bridge map here. a wind advisory in place for chp. sustained winds, not a big deal. just crossing over the bay bridges, we'll get a look at the san mateo bridge, as well. the sign lit up talking about high winds possible. the high-rise section of the san mateo bridge. we haven't heard any problems over the course of this morning. the volume's picking up and we'll see as more reports come in. sad to report a south bay mother desperate this morning for information about her missing daughter.

a weekend search failing to turn up any sign of the morgan hill teenager. live right now from morgan hill where the girl failed to show up for classes on friday. good morning. >> reporter: good morning, john. well, no doubt everybody is hoping that sierra lamar just walks into class this morning. that would be a case solved, if you will. no one has seen her since she left home for school on friday. so searchers spent the last three days looking for the missing teenager over around her house. her mother says sierra left at 6:00 a.m. on friday morning to catch the bus for school. they live in a remote unincorporated part of morgan hill. investigators worry they may have lost some valuable time if, in fact, this was an abduction. sierra's mother says a school did not notify her that sierra wasn't in class all day until friday evening. that's when she called 911. deputies say sierra has no history of running away and never showed signs of intending to do so. and sierra's cell phone is

apparently dead so they can't track it. meanwhile, a worried mother waits. >> we gave each other a big hug good-bye and said we loved each other. and she's been in a great mood -- >> around the lamar home, it's not rare to see school children waiting for a bus in the early morning hours when it's dark. the home is about two or three miles from the high school. i did speak to a sheriff's dispatcher just before 4:00 this morning. she did not know if, in fact, there would be a search underway today. and if so, to what extent that search would be. we're live in morgan hill, today in the bay. 6:03 right now. today, san francisco sheriff faces sentencing and his job hangs in the balance. he's pleading guilty to one misdemeanor count of false imprisonment. in exchange, prosecutors are dropping domestic abuse charges

they say stem from a new year's day argument that left his wife's arm bruised. he's expected to be sentenced to three years' probation, domestic abuse classes, 100 hours of community service and a $400 fine. mayor ed lee is deciding whether he should remove him from office. he insists so far he's not stepping down. a total of five people arrested during an occupy cal protest expected to be arraigned in court today. accused of resisting arrest and battery on a police officer for their part of a november 9th protest. occupiers, well, they deny the charges and blame campus bliss police for provoking the confrontation by using excessive force. video shows officers using batons to remove protesters and their tents. investigators are trying to figure out what caused a single-engine plane bound for san jose to crash. search teams found the plane on saturday about 100 miles southeast of san jose in rough

and snowy terrain. it took office from arizona on wednesday. the faa has not released the name of the pilot, but the plane was registered to an aircraft sales firm in san jose. some good news, berkeley's main public library will be back open this morning after a weekend fire. the library was shut down on saturday when flames were spotted in one of the library's bathrooms. we're also happy to report nobody was hurt. crews spent sunday morning just mopping up all the water damage there caused by the sprinkler system. the president of france is talking about a shooting that killed three children at a jewish school. >> president sarkozy is calling the shooting barbaric saying in part, i call upon everyone in bereavement, solidarity withe t victims, i call on caution and trust to find this killer. the shooting suspect opening fire in southern france this

morning. so far, three children and one rabbi have died. this includes two brothers and their father. five more are hurt. the gunman took off on a motorcycle and this is at least the third deadly shooting in which the suspect used a motorcycle within the past week in southern france. well, the fighting in syria has reached the nation's capital of damascus. syrian security forces clashing today with gunmen in an upscale neighborhood of the capital. this is one of the most serious confrontations in the tightly controlled city center in the country's yearlong uprising. today, the u.s. soldier accused of killing 16 afghan civilians will meet with his lawyer for their first face-to-face meeting today. the seattle-based defense attorney arriving at ft. levinworth prison. they're calling today's meeting a privileged visit.

bales at not been charged in the shootings yet. but charges are expected within the week. money for hospital patients, not executive pay. today the hospital is holding meetings to address complaints tax revenue is going to serve people not pay salaries. some employees supporting a ballot initiative that specifies exactly how hospitals spend those tax dollars. the hospital insisting public funds are not used to pay executives or hospital workers. el camino hospital will hold meetings tonight at the mountain view and los gatos locations. the company is holding a conference call as we speak to announce what it will do with all its extra cash. some $98 billion. this is from tech reporter scott mcgrew gave us about ten minutes ago saying apple is to pay $2.65 a share, and repurchase $10 billion in shares over the next

three years. he is on the phone with apple right now. scott will bring us an update a little later in the newscast. four adults now facing charges after allegedly buying alcohol for minors. martinez police making the arrest during a decoy operation on friday night. they say one of the adults charged was only 20 years old and used fake i.d.s to buy the alcohol. a store clerk has also been cited. i want to check in with rob mayeda with christi-- >> you're going to be burning calories just trying to stay warm this morning. we're in the low 30s right now out towards fairfield, 32 degrees, lots of 30s in the north bay, eastbou bay, and sou bay. 40 in san jose and oakland now down to 38 degrees. it's chilly outside. not much wind. there's a little bit of good news this morning. and we're not seeing rain on the radar just yet.

we've got clouds here, a little bit of rain offshore, and later today into tomorrow morning around this time, i think we're going to see more rain showing up in the forecast. today with some overcast skies, not a warm afternoon. upper 50s around san jose, closer to 60 in pleasanton. still mid 50s on the coast. we move into spring, but showers springing back in the forecast. for tomorrow morning and wednesday we warm up a little bit and a few more north bay showers on thursday and a little more rain as we head toward the weekend. so the weather behaving pretty well today, so far this morning, mike, how's it looking so far if the commute? >> looks like everybody agreed they'll behave themselves, as well. for the most part. but a slower behavior westbound 580. out of the pass, we have the wind advisory that chp issued coming off the hill and that's some reason for slowing, but that kicked in early this morning, and now we're seeing slowing through the heart of livermore. we've seen both of these

sections build steadily over the last 15 minutes. 19 to 20-minute drive coming out of 580 to the dublin interchange. highway 4, 15 miles per hour for this drive, but no problems through bay point or pittsburgh. a live look at 880 past the coliseum shows you the volume of traffic picking up a tad bit. just a little slowing around the high street curve but all the way to the toll plaza, we're okay. toll plaza starting to back up a tad bit and we'll show you that coming up. back to you. 6:10 right now. people in the east bay will have a chance to weigh in on a cleanup. the environmental protection agency is trying to remove the chemical ddt from the site. a chemical company contaminated the area back in the 1940s. tonight, the community will hold a meeting to discuss the epa's cleanup plan. that will be held at the richmond community foundation at 5:30. it is 6:10 right now. despite the recent rains, one

good morning, everyone. a nice picturesque shot of san francisco. and rob mayeda telling us maybe dodging the rain drops, it's still going to be chilly out there. make sure you wrap up nice and tight. it is 6:13. >> and the thing around here, we were getting a big chill. but other parts of the country,

looking and feeling more like our golden state. at the georgia marathon, for example, temperatures soared into the 70s. the same could be said for runners in new york, seeing temperatures more typical of june than mid-march. the windy city, meantime, being described as balmy with people playing on the beach, playing volleyball during five 80-degree days in a row. all records, 35 degrees above average. >> it's pretty unusual to have to debate whether or not you're going to turn on the air-conditioning in march in chicago. >> that's crazy. the jet stream has been pushing its way north into canada keeping cold air in the arctic ushering in some of that warm gulf air through most of the country. >> that is wild to see. but right here in the bay area despite the recent rain, the north bay still facing drought-like conditions. the unusually warm weather season has dried up grasslands in marin county. ranchers say they've lost nearly half of their fields, which are usually used to feed their

livestock out there. the board of supervisors will be considering declaring an emergency which would provide some federal aid to the ranchers. >> all right. what are we in store for today and the rest of the workweek. rob mayeda is filling in for christina this morning. >> not bad this morning, but still picking up the pieces from last week and counting the rainfall totals. it's tough to talk about drought. we had 20 inches of rain come down in the santa cruz mountains. doesn't that stop a drought from happening? well, yeah, we did get an incredible amount of rain. more rain fell at scott creek than we see typically in an entire year in oakland. that's how much rain came down in the mountains. but the rainfall average to date, we barely came up even in places like santa rosa and san francisco, locations that had almost 4 or 5 inches of rain. this tells you how dry the year's been despite all the rain we had last week. still, 50% of average from the golden gate northward and 30% of average around san jose. you can see here offshore, we have a little bit of light rain

lurking nearby. i think we'll see more of this as we head into tonight, more clouds during the day today, which will keep our temperatures down, as well. you can see the future cast, overcast skies heading into the afternoon. and by tonight, especially on the coast and for the north bay, we'll get extra lift to that moisture bringing out light rain. hour-by-hour, your forecast, winter coat mode this morning and you don't need to lose the jacket today. we're talking highs in the mid-50s out there and with that filtered sunshine, it may feel cool. at least we don't have gusty winds like yesterday. our next chance of rain coming in tonight into tomorrow. you can see it there. by the way, spring arrives coming up tonight at 10:14. thursday comes our better chance for bay area wide showers, and the weekend, looks like cooling temperatures. so no 70s and 80s like they were looking in chicago. we were lucky to get to the upper 60s around here on wednesday, mike. >> chicago gets a lot more snow than we get here.

we're looking over here to what little snow we do get. and still have that road to the peak to the summit closed right now. not a big issue. plenty of other roads for your morning commute. a little slowing shows up right here. highway 87 coming in the northbound commute direction, that's the cue, the sign of more traffic. 101 along the peninsula, no problems now. 280 -- just off of 280, we do have a water main that has broken over there that will affect you at monta rosa, and i don't think it'll affect sharon heights. a wind advisory for the dunn barton bridge and the san mateo bridge. not worried about the volume just yet on the peninsula. we'll take you up across the golden gate bridge where we'll look at a nice, smooth flow. the driving's just fine. but for folks taking the vallejo ferry, you'll need a bus bridge for the 7:00 in or 8:30 out of the city. a quick look at the bay bridge

toll plaza, looks like the metering lights were turned on. >> thank you very much. a california couple targeting gun show laws in alameda county are saying they are, in fact, unconstitutional. today they'll have their day in court. christie smith live with exactly what's at stake. >> reporter: good morning, john. well, a number of bay area counties like alameda county have laws on the books that don't allow the sale or possession of guns on government property, which basically bans gun shows at places that some would consider the most desirable place to have them, like fairgrounds. this is video from near the cal palace. now a couple from glenn county is asking a federal appeals court in san francisco to take another look at their request to strike down those laws as unconstitutional. they're specifically challenging alameda county's ordinance which has outlawed gun shows since 1999. the couple says the fact they

can't have gun shows where they want to has affected their lives tremendously. the decision could determine the fate of gun show regulations in california and a number of other western states and some believe this could end up all the way at the u.s. supreme court. the ninth circuit court of appeals panel in california is expected to take this up at 2:30 this afternoon. reporting live in san francisco, christie smith, today in the bay. 6:19 right now. a deadly weekend on three california slopes. northeast of fresno, says a 30-year-old snowboarder is dead after falling head first on to an open ski area sunday. at the sierra at tahoe resort, a 54-year-old skier killed after falling into a deep hole created by an underflow of water. and at kirkwood, a skier was taken to the hospital after being injured in a small avalanche. the extent of that skier's injury is unknown. a warning this morning for people in one peninsula city

after several car break-ins. the burglars broke in to two cars on marlboro road. a home on the very same street was also ripped off about that time. police say there was a report of one other car burglary that morning. they are reminding people at this point to make sure to lock their vehicles and remove any valuable property. so far, there are no arrests. one bay area community is fighting back against plans to bring a big-box store in their community. we'll hear a special appeal tonight on plans for a walmart grocery store. critics say it'll eliminate higher paid jobs with better benefits. because the city expects a high turnout, tonight's meeting is at 7:00. the time now is 6:20. coming up, gm stopping production on the chevy volt. plus, how the group is using facebook and twitter during a

denver, portland, and orlando airports. the tsa says the pilot program will cut back on pat-downs. they'll not card people for age verification, however. instead, officers will decide who qualifies for those relaxed screenings. >> that sounds like a dangerous job to me. be careful, fellas and ladies. well, the red cross jumping right into the 21st century using facebook and twitter to track people in need. during the tornadoes in the southwest and midwest earlier this month, rolling out the new digital operation center. monitored twitter and facebook to see what people in the affected areas were saying about it. when somebody needed help, the red cross was there to offer advice and what they call digital hugs. >> as things are happening, they may not know what's happening around them because they're hunkered down in their basement. we can see them online and extend a hand and say, hey, here's how you can get help if you need it. and we're here for you. so here's our digital hug to you.

>> a digital hug. interesting. well, the red cross, the first humanitarian relief agency to actually use social media monitoring to offer help even as a disaster is occurring. 6:25 right now. sagging sales prompting a production halt for the chevy volt. general motors says it'll shut down assembly lines today and keep them shut down for five weeks just to reduce inventory. gm had expected to sell about 60,000 volts by this time, but so far, only 1,600 have sold. 1,300 workers will be out of work during that shutdown. well, we can tell you the most important company in the entire world will spend half of its massive war chest. scott mcgrew, $45 billion, yeah, a ton of money, but some are disappointed. >> they will spend $45 billion of the roughly $98 billion -- it's enormous, facebook may raise $10 billion in the ipo, talking about a cash number

4 1/2 times bigger than that, right? apple has announced it will pay $2.65 in dividends per share, this coming on a conference call on the telephone just a couple of seconds ago. then in 2013, apple will spend $10 billion in stock buybacks. fewer shares available and that drives up the share price. so a dividend and your share worth more, and that is a win-win. this still leaves apple, though, with nearly $50 billion in its savings account. and it's difficult to express such big numbers. but we'll put it this way. the apple that money -- the money that apple has left over after today's big announcement is big enough for it to buy hewlett-packard and then still have money in the bank. so why does apple have so much cash money? obviously from selling lots of stuff. but the hoarding mentality is inherited from steve jobs who saved apple from bankruptcy in the '90s. remember this? the cover of "wired" magazine in '97. the simple word "pray," this was not that long ago and much like a person who lived through the

great depression, mr. jobs was a saver. shares have been halted the dividend's going to come for the fourth quarter of this fiscal year, the stock buyback in 2013. keep in mind, all of these riches are aside from any organic growth you'll see in apple. all of this is aside from ipad, what, four and iphone 5. this is just in the stock itself. >> it's amazing how this company remains on so many levels in the news. >> absolutely. one of the most important companies in north america. >> thank you very much. 6:27 right now. still to come on today in the bay, a look at the top national and international stories, including what's happening today with the u.s. soldier accused of shooting in that shooting spree in afghanistan. plus, there is snow in parts of the bay area that closed roadways over the weekend. the latest details on when this road will reopen coming up. and the rain and snow, they both moved on, but it probably feels cold enough for some snow this morning around the bay

we get a live look where the volume kicking in here, the metering lights are on. no big surprises, guys. >> thank you very much, mike. it's 6:31 right now. france is reeling this morning after another shooting by a gunman on a motorcycle. this time the targets were children at a jewish school. today in the bay has the latest development on this story and others. >> good morning. the gunman is still on the run. and now security's being tightened at all jewish schools across france. a man on a motorcycle pulled up to the school in france just before class was to begin and opened fire. so far, three children and one teacher have died. this includes two brothers, ages 3 and 6. and their 30-year-old father. he was a rabbi at the school. at least five more are hurt. the attack comes after three soldiers were shot and killed in two separate shootings in that same area within the past week. eight days after he's accused of shooting -- of a

shooting rampage that left 16 afghan villagers dead, army staff sergeant robert bales is expected to meet with his lawyer for the first time this morning. his defense attorney from seattle flew to kansas last night where the 38-year-old suspect is being held. prison officials calling the visit privileged. formal charges against bales are expected to be filed within the week. well, here's a first. the duchess of cambridge making her first public speaking engagement as a royal. today she was onhand for the inauguration of a hospice center in england. now kate middleton offering her apologies for her husband's absence saying the prince is expected to return from military duty in the islands later this week. no protection from the workplace drug testing, at least not for one union project in san francisco. the san francisco examiner

reporting a union plumber failed a drug test earlier this year and he was denied a job on a city public works project despite having a prescription for medical marijuana. the city's labor agreement specifically addressing a ban on substance abuse. one union leader says the policy flies right in the face of san francisco's values and is demanding the agreement be revisited. the issue will be discussed by a city labor committee some time next month. okay. the stock market has opened up. apple grabbing the spotlight out there. the company making a big-time decision this morning. what to do with all that extra cash. business and tech reporter scott mcgrew with the $1 billion dilemma. scott? >> yeah, $98 billion total cash, $45 billion of it apple will spend. apple up 2% this morning, or about $11.63. which is really when you think about it astounding. up 2%, we've had days where it was up 2% where nothing happened. here the company is going to

spend $45 billion in its cash hoard on both the stock buyback purchase program and a shares dividend, as well. so details. $2.65 a share as going out in the fourth quarter. the $10 billion stock purchase program starting in the beginning of next year and going for three years. now, laura, we got some news about employees. employees who have not yet vested will be able to participate. that's terrific news. tim cook doesn't get to. the other one is somebody asked this call just ended, what about dividend growth? could this number, $2.65 change? and yes, indeed, apple is prepared to change that number as time moves on. but again, apple paying a dividend technically for the second time in the company's history. they went into that malaise and

started to lose money and they ended it. this is good news for the whole economy. >> thank you very much for the details this morning. 6:35 right now. hey, you'll get a chance to head up to the snow without leaving the bay area. we checked in with the chp this morning, they confirmed mt. hamilton road will reopen at 9:00 a.m. it closed on saturday morning after the snow made it unsafe for drivers, but this is what it looked like for the few who made it through making little snow angels out there. things were pretty iced over pretty well. but you could see it from down in san jose. >> trying to make the most of it there. we're on the cusp of spring. >> tomorrow. >> and it's freezing out there. >> rob, what's going on, man? >> 24 degrees this morning. that doesn't feel like spring. otherwise, closer to the water, we're in the 30s and 40s this morning. so we've got patchy clouds, chilly start, but we're for the

most partum brel umbrella free. the winds have backed off a lot. there's good news for you. not too gusty outside. but the temperatures, you'll notice that this morning. even oakland, 38 degrees. so we're watching here the jet stream which dropped way to the south. you see all the snow that was flying this weekend in the sierra and also around mt. hamilton, diablo had a little snow too. we're going to see mild conditions today, mostly mid to upper 50s, but slowly but surely we'll see a little bit of light rain coming back in especially for the north bay as we head into early tomorrow. today, upper 50s around san jose, 58 in dublin, 67 in danville, close to 60 in pleasantton and high surf advisory has been dropped, 56 degrees in san francisco, more clouds later on this afternoon, yes, spring arrives, 10:14 tonight local time. we'll see a few showers for your tuesday, wednesday does look a little bit warmer, but get ready for more showers thursday and looks like, mike, more rain and

snow on the way as we head toward the weekend. right now we're getting off to a great -- pleasant start i should say weather wise, but looking at highway 4 really jamming up over the last ten minutes, things have clamped down. over there at bay point as well as concord showed the volume of traffic picking up heading south toward walnut creek interchange. you're going to see some slowing just pass there as you're heading west through hercules. also the ferry into san francisco, 7:00 a.m., you will not shave the ferry, you'll be riding a bus. sounds like there's some mechanical issues and that may continue, look for updates from the ferry as the morning continues. the bay bridge has the metering lights on there. and a live look outside. shows you what things are like over at the coliseum. the volume really picking up, 880, holding close to 55, 60 for most of its route but expect to see some slowing developing,

good monday morning to you. 6:41 right now. big primary with a big twist. the republican candidates gearing up for tomorrow's vote in illinois. a state with more delegates than any other state except georgia. today in the bay's tracie potts live on capitol hill with a look at the loophole that makes this primary different from the rest. good morning, tracie. >> in illinois, they will cast ballots for president and delegates to nominate a president. but the popular vote doesn't necessarily dictate who those delegates are awarded to. illinois has 69 delegates up for grabs. but only 54 of them tomorrow, the rest to be decided next summer during the summer at a state convention. now, mitt romney, is the front-runner when it comes to delegates. he's coming in from momentum with a big win in puerto rico where he took all of their 20 delegates over the weekend. and he's up in the polls by as much as nine points, way more than the margin of error. but rick santorum thinks he has

well, coming off an unusual weekend in the bay area. a lot of hail coming down in the south bay. >> when the weather gets noisy. if it's wind, hail, or outside. we've had everything around the bay area. this morning, it's just the sound of the heaters cranking up in your cars. 32 degrees in fairfield, 40 san jose, 38 in oakland. so needless to say, i know it's the last full day of winter. it's living up to winter-like expectations, but spring-like weather's still going to be on hold around the bay area. starting off quite cool, at least not as much wind this morning, but we've got more clouds spilling in and eventually a chance of seeing some rain. right now, the radar's pretty dry. out on the coast, we did have a few light showers around monterey. as we watch the north coast later on this afternoon, i think

it's up towards areas north of tomales bay. and plan on a little bit of light rain. the jet stream marching off to the north a little bit today, but the clouds will continue to spill on in. so instead of a strong ridge of high pressure, we get this weak ridge of high pressure that's going to give us one mainly dry day today and later on tonight, starting to see light rain approaching the north bay coastline and tomorrow morning's commute, especially from the golden gate bridge northward, we will see light to moderate rain. not several inches of rain. talking enough to wet the ground, maybe 1/4 inch around the north bay and enough to wet the ground in the south bay. i think as we get toward tuesday afternoon. plan on increasing clouds, cool temperatures, upper 50s around san jose, over toward black hawk, you should see highs in the upper 50s today and mid-50s on the coast. high surf advisory has been dropped for your monday. so we spring into spring coming

up tonight, 10:14 and then more showers drop in for your tuesday, but wednesday, that's going to be the warmest day of the week as you head out to the coast and more showers drop in for thursday. so, mike, tomorrow morning's commute looks a little rainy, especially for the north bay. >> well, there's always tomorrow. we're looking at today right now for the slowing, rob, and folks in the south bay, you see capital expressway up past 680 and over toward 880. speed slowing from 40s, 50s into 40s as you're passing up to 880. 87 consistently shows slowing into downtown. that's a typical pattern for your south bay, exclamation point over here because of weekend snow, that should clear. but right now, you can't get there via the roadways. they've closed it off. smoother drive up the shore. no problems, we do have this water main break over at the park. more details came in. so i'll hand it off to john in a bit for an update on that. right now, the wind advisory for the bridge. we're watching for issues for the gusts of wind there, but

none, we do see a little slowing showing up north of 92 on 101. the bridge shows a clear view and no problems, all the way through san rafael and into the city by the bay. i'll look on the other side of the bay, the bay bridge. we have the backup here, there's the east shore freeway. a clear view, but slowing in through emeryville and the toll plaza. back to you. >> thank you very much, mike. now we get to that water break you told us about. we updated earlier and told you now that we can let you know that it has been shut off. this was what it looked like this morning at sharon park drive near monta rosa drive. sending water just gushing right out on to the street. crews, well, they had a tough time shutting it off. >> the water and mud was so deep we couldn't shut the valves off, get it under control. i had to go out about 100 yards to the next set of valves and they were also under water. so we had to go way out 200, 300

yards to start shutting valves off. >> no homes have been affected and they should have the pipe fixed and back online in a couple of hours. 6:50 now. today a california couple will go to court to fight for their right to sell guns at local gun shows. their appeal could have an impact on laws across california and across the country. live this morning at the center of these legal arguments. good morning, christie. >> reporter: good morning, laura. well, gun shows have been outlawed here in pleasanton since 1998 and now a couple out of glenn county is challenging that law and laws similar to it as unconstitutional. the couple are from glenn county and they've been allowed to set up shop in santa clara county for gun shows. this is video from the cal palace, but counties like

alameda, san mateo, and marin don't allow the sale and possession of guns on government property which means you can't hold them in the most desirable places. the couple is asking the ninth circuit court of appeals to strike down these regulations and they're specifically targeting alameda county. the outcome could determine the fate of gun shows in california and other western states. the ninth circuit court of appeals panel is expected to hear this at 2:30 this afternoon in san francisco. reporting live in pleasanton, christie smith, today in the bay. a peninsula lawmaker trying to make sure pg & e has to pick up the tab for upgrading the pipeline. urging the california public utilities commission to reject pg & e's plan to charge rate payers 95% of the cost to upgrade the pipeline system. problems were, of course, exposed during the deadly san

bruno explosion back in 2010. san francisco sheriff returns to court in a few hours for sentencing in his domestic abuse case. he pled guilty to one count of false imprisonment in exchange for dropping three other charges. he's expected to be sentenced to three years' probation, 100 hours of community service, anger management classes, and a fine. still up in the air, whether san francisco mayor ed lee will file official misconduct charges, which could lead to mercarimi losing his job. a woman claims a man lured her to a secluded spot and raped her. officers say the woman was attacked early sunday morning aon broadway near 14th street. the woman says the man spoke in a low voice and carried a handgun. she was treated at a nearby hospital and so far police have not made any arrests. in the meantime, police have called off their search for a

missing gilroy woman whom that believe was a third victim in a tragic murder/suicide. police found no signs of martha gutierrez after looking in a rural area. the 52-year-old mother was last seen tuesday, a day before police say her son, an iraq war veteran, killed his 11-year-old sister then himself inside the family's gilroy apartment. police say they found evidence he killed his mother, as well, inside his car, but there's no sign of her body. and still no sign this morning of a missing teenager from morgan hill. live at the high school where the first bell is about to ring out there. damien, good morning. >> reporter: good morning, john. the victim, if she is, in fact, a victim, her picture is up on that wall by the locker behind me. i guess everybody is just hoping she does walk into her classroom when that bell rings for class this morning. because search crews have spent the last three days looking for her. investigators say if this was an

abduction, then they lost some valuable time by getting such a late start on this case because they were not notified until hours after her mom knew she was missing. she has no history of running away and there are no indications that's what happened. it is a possibility deputies have not ruled out completely. sierra catches the bus for school not far from her home. her mother tells nbc bay area, everything was normal when she left for school friday morning. she's upset the school didn't notify her of the absence until late friday. >> the school notified us she was not in attendance at 6:00 we received an e-mail. i wasn't happy when i was notified that late because i felt that we could've used that time to search sooner. >> the teenager's name, again, is sierra lamar, this is a rural part of unincorporated morgan hill and it's normal to see school children at bus stops in the dark in the area around
