i'm happy about that. good morning, everybody. i'm john kelly. check in with rob mayeda to find out, has spring really sprung? >> it has. our morning temperatures aren't that bad. not too chilly if you head outdoors, you don't need a thick coat and for now, you don't need an umbrella either. look at sunnyvale and navado. as you move up from the north bay, the rain on the north coast, that's going to head our way through the afternoon, it'll drop into the north bay, but for now, no fog, no wind, no rain, no excuses from the weather department. >> oh, yeah, you've got to get to work on time. let me see if i can help folks out. no. things are moving pretty smoothly on the maps. look at the south bay, you have to get to work on time. let me check that. we do have to point out a couple of things. there's a minor injury accident. and around the matilda off-ramp. that's near the interchange with

101. and also westbound, we have that new express lane opening. we'll have a live report coming up and i'll show you more of your major commute spots, they are developing, it's traffic tuesday. >> it sure is. almost every day. thank you very much. it's 6:02 right now. he can keep his freedom, but will he keep his job? we should learn today whether ross mirkarimi will face an ethics probe. today in the bay is live at city hall where the mayor is expected to weigh in today. good morning. >> reporter: good morning to you. all eyes on san francisco's city hall. mayor ed lee is expected to make some sort of statement today about this domestic violence case. and his intentions for sheriff ross mirkarimi. so all along mirkarimi has said he wants to keep his job as sheriff despite all of the turmoil around it. he was sentenced just yesterday to probation and fined and he has to go through counseling after he pleaded guilty to the

altercation between he and his wife on new year's day. she showed a bruise on her arm and a tape and was tearful as she explained what happened to a neighbor. mayor lead has said he was considering his options under the city charter which would allow him to suspend mirk rarim. but after the sentencing, mirkarimi offered an apology. >> i deeply and humbly apologize for the behavior and the pain it caused to my wife and son, to my colleagues, to the san francisco sheriff's department, and to the people of san francisco. >> so here's what could happen. mayor lee could prompt a hearing by the ethics commission that would make a recommendation to the board of supervisors. 9 out of 11 would have to agree on this for mirkarimi to be removed from office. reporting live in san francisco, christie smith, "today in the bay." we do have new clues, but still no sign of a missing

morgan hill teenager and investigators are reviewing sierra lamar's cell phone records and her computer files for any possible clues about her sudden disappearance. the high school sophomore was seen last friday heading for school. her cell phone was found in a field not too far from where she lived. detectives have interviewed her friends at the high school and at washington high in freemt whe fremont where she attended last year. friends posted pictures at local businesses hoping someone will recognize her. >> she would never run away. she wouldn't feel safe being alone. she loved being with friends and a lot of people. so it's just very out of character for her. >> investigators right now contacting registered sex offenders in the south santa clara county to find out where they were when lamar vanished. walnut creek police are looking for a man who appears to be stalking a13-year-old girl. the girl was approached by a man offering a ride near crest avenue last wednesday.

she ran home. but the next day, the girl says the same man showed up near walnut creek intermediate school where she goes to school. police say the man is in his 60s with gray hair, high cheekbones and tan skin. he was driving a faded red older model sedan with a disabled placard hanging from the rearview mirror. cal state trustees getting an update on the budget forecast. it comes on the heels of a hearing yesterday outlining plans to restrict the number of admissions in the fall of 2013. they say as many as 25,000 qualified students could be rejected unless funding is restored through the governor's proposed tax hikes on the november ballot. the trustees also announcing once again, no new applicants will be admitted to cal state schools next spring. and putting the burden of education funding on the wealthy, occupy education demonstrators rallying today

outside oakland state building this afternoon in support of the so-called millionaire's tax. they are calling on groups to abandon the other proposed tax plans and back and increase tax on high-income earners. governor brown has already joined forces with the california federation of teachers in support of this initiative. it would raise the tax rate on the wealthy for an additional two years. 6:06 right now, more occupy protesters will be arraigned in court this morning. three demonstrators face charges of resisting arrest and blocking a sidewalk. it happened during an occupy cal protest last november. four others arraigned yesterday and were ordered to stay 100 yards from uc property except to attend class or go to work. several more protesters will appear in court tomorrow. well, new toll lanes open this morning in the south bay which means solo drivers may have to pay up while car poolers cover up. >> hey, good morning. you know, typically it takes as long as 20 minutes to get through the 880 to westbound here in malpedas. unless, of course, if you're in the car pool lane which is where we are right now. and you can't really see the car pool lane unless you have two people in the car. starting today solo drivers can get on, as well. this is now being converted to an express toll lane, very much like what we see -- this is a 4-mile stretch between dixon landing and 880 and westbound 237 eastbound 337. to turn on, you do have to pay, it'll cost anywhere from 30 cents to $6, an average around $3 based on the amount of congestion and it will be deducted from your fasttrack transponder. but chp has a warning for us this morning. once you're in this express toll lane, don't try to leave until you get to the end of it.

the biggest thing we don't want people crossing the double yellow lines. once you get in this lane, you need to be in the lane until you can exit at the proper place. >> is that different than the car pool lane rules? >> it is. typically you can move in and out of them without any problems but with this toll lane, you have to stay in the lane once you're in the lane. >> now, let's say you're a legitimate car pooler you've got more than two people in your car and you have a fasttrack transponder, you don't want to pay to use the toll way because you can use it for free since you have two people in the car. in order to prevent it from being charged, they tell us put it back into your mylar bag and that'll prevent the signal from deducting. if you don't have a mylar bag, you can ask fasttrack to send you one. >> all right, bob, thank you very much. hopefully he'll get nice hot tea

with a limb honttle honey. first day of spring, checking in with rob. >> not too bad. we were thinking we'd have rain by this time, but so far, so dry. from santa rosa down to santa cruz, not much in the way of wind. we do have clouds this morning, which actually have helped to bring our temperatures up. no 30s on the map, feels like spring outside this morning, 40s and 50s, in fact 51 in navado. a bit more of a mild start right now. the radar is dry. even the north bay, we're still dry. heading up to the north coast and now trying to spill into the northern half of mendocino county. it mainly looks like a golden gate bridge northward type of event with scattered showers south of santa rosa, rainy to the north of santa rosa today. tomorrow we'll see an even drier day of temperatures climbing up and thursday maybe a better chance of seeing a few light rain showers. around the bay area today, should be in the mid-60s for

parts of the south bay. looking pretty good with variable high clouds at times. temperatures cooling off a little bit as you head up, upper 50s around wine country, 55 degrees, 58 san francisco with mid and high-level clouds for the afternoon. mainly some north bay showers for today, tomorrow, looks like temperatures could climb a few more degrees. thursday, maybe a few showers, then for the weekend, that's when things turn cooler, and we're going to talk about more bay area snow this weekend and temperatures cooling mid-50s there by sunday. mike? >> first day of spring, shaping up spring-like, but we see what you have in the future. this is the present. highway 4 westbound starting to bog down. speeds around 13 miles for that l street sensor. eking down a tad. so the volume starting to pick up for highway 4 and you'll see some slowing in concorde shortly. all the way through livermore, that 54 mark, so things are still moving smoothly over toward that dublin interchange

welcome back, everyone, on this tuesday morning. that is a live look off of san francisco's coast at the rock. also known as alcatraz. we can tell you the weather right now, a mild start to the day on this first day of spring. not exactly going to be hot, but it's comfortable, enjoy it, it's 6:14. a controversial case in florida has practical prosecutors opening an investigation into the shooting death of an unarmed teenager. today in the bay following the latest overnight developments in our newsroom with the latest. good morning. >> 17-year-old trevon martin was shot and killed last month, but only now is the justice department looking into his death. the official investigation by the department's civil rights division, the u.s. attorneys office and the fbi getting underway today. the boy's parents and community members in the town of sanford demanding justice after officials say martin was gunned down by a neighborhood watch volunteer. while walking home and even though he was not armed, that

volunteer seen right here has not been arrested and tells authorities he was acting in self-defense. martin's parents say their son was racially profiled. well, france's interior minister say surveillance cameras show the gunman in yesterday's school shootings was wearing a video camera and may have filmed the attack. as investigators continue the search for the suspect today they're watching the internet to see if any of those clips are posted online. also, today's schools across france pausing for a moment of silence to honor the three children and rabbi that were shot and killed. a little bit of wind over the weekend, but nothing compared to what new zealand is up against today. the wind strong enough to blow cars and trucks off the road, rip roofs off homes and leave thousands without power. no surprise, all planes are grounded at local airports, all flights canceled. but so far, no reports of any injuries. >> glad to hear that. thank you very much.

>> let's check the forecast. >> pretty nice so far. we have 40s and 50s outside, unlike the 30s we had yesterday morning, in fact, some places almost 20 degrees warmer at this hour, and the same time yesterday, we're talking the north bay valleys, napa over toward santa rosa, close to 50 this morning. san mateo down into san jose, gilroy, 46, isn't that bad to start off your morning. mostly cloudy skies, showers to the far north bay or the north, north bay this morning. and then as we go through the afternoon, north of santa rosa, we'll see rain, but the south bay, san francisco south really looks dry. tomorrow, a little bit warmer and the wettest part of your seven-day forecast, not so good in terms of the timing. it does look like it's going to roll in for the weekend. you will see these stories play out on probably the nightly news tonight with dallas and houston getting blasted by severe thunderstorms and unfortunately some tornado-producing super cells likely out toward arkansas

today, so flight delays likely into the south this morning. heading over to the pacific northwest, this is where the real action is off to the north. northern california sitting on the boundary here of where the rain is right now. the north bay is dry, but on the north coast, this is where the light rain is flying. this should start to drop to the south as we go to the afternoon, but the south bay, probably not going to get this far south today. we will see numbers in the low to mid-60s around the south bay. tri-valley locations looking good, mainly cloudy skies, filtered sunshine and turning cooler northward up toward the north bay. it'll be these locations, up to santa rosa, mendocino counties. very likely again on thursday. so spring has sprung, we'll see the temperatures climbing up tomorrow. may see some 70s starting to show up on the maps as we go into wednesday. thursday, a few more showers, that system might be a little stronger, we might see something out of that. but it's saturday and sunday with the main event rain and bay area snow again. maybe as low as 3,000 feet again this weekend.

mike? >> all right, weekend snow angels once again. rob, we're looking over here. i wanted to show the slow down we have all the way through the altamont pass. so we have a 21-minute drive registering on our sensors and continuing to slow. the volume of build. we show a smooth drive south through 680 and 880 coming down through fremont moving nicely, as well. we got this into the newsroom. there's a fire reported in the triangle area off of 880, curly is the street name. we'll get more details as we speak. we'll follow that, but the freeways are moving smoothly past that scene. we have a couple of accidents and incidents to report around matilda. it's just affecting your drive. there's flashing lights and crews there right now. also heading over there, off of southbound 880 to westbound 237 as bob has been reporting, that's where the express lane opens and you'll take your way

illinois is home to several moderate republicans in the chicago area. santorum is ineligible for 10 of today's 54 delegates because he filed his paperwork too late. >> or even a narrow win by romney will certainly seed a lot of doubts about the strength of his candidacy. nbc's latest tally has romney way ahead in the delegate count, 443 to 184 over santorum. the time now is 6:20. coming up, a big night for a former warrior turns into an ugly one for the team's owner. see how chris mullen came in to rescue this. apple sells an astonishing number of ipads in three days. we'll go over the numbers coming up.

everyone seems to get out okay and the fire department was able to put it out. there's still smoke coming out of the union, but the fire department assures me that's just residual smoke. they don't have an idea of what was burning or caused this to burn, but it definitely was enough they had to evacuate the entire section of this complex. it looks like there's maybe around 8 to 10 units that had to be evacuated. a lot of firefighters are -- right now, this fire is out, everyone's out okay, no one was hurt. reporting live here in san jose, "today in the bay." >> thank you very much for that one. we'll keep you posted. we're also keeping you posted when it comes to that forecast. want to check in with rob mayeda. >> dry forecast around the bay area for your morning commute right now. and it's mild outside. don't need a parka this morning,

just a light jacket or long sleeves, 40s and 50s outside right now. and notice the radar picture still dry around the bay area. in fact, we've got to go north of santa rosa to find the rain. you're seeing it there in eureka eventually this afternoon, slowly working its way to the south. i think the afternoon commute north of the golden gate will probably start to see a little bit of light rain. >> we're talking about the traffic building, the weather's okay, but the fire we talked about, i want to give folks a shout out, that is not affecting any of your major commute routes. we're looking over here to the east bay, we want to show things jamming up. highway 4 slams down, down toward summerville. and we're seeing the slowing, pittsburgh and bay point below 60, the volume shifting over toward the left. also, westbound 580 shows that volume jamming up, heading over toward that dublin interchange and continuing to build. this could slow down even more for that commute. it is 6:32 right now.

we could find out today for what's next for ross mirkarimi. yesterday we learned his sentence in his domestic abuse case. today, he may learn if his job is in jeopardy. today in the bay's christie smith live at city hall where major ed lee is expected to make some kind of announcement today. christie, good morning. what's up? >> reporter: good morning, mike lee is expected to talk about this domestic violence case and the future for sheriff ross mirkarimi, even though mirkarimi has said he wants to keep his job as sheriff and doesn't want to step down despite pleading guilty to false imprisonment after an alleged new year's eve altercation with his wife. mirkarimi was sentenced yesterday to probation, counseling, and a $600 fine. now a tape showed his wife bruised and tearful after this alleged incident. mirkarimi met with lee after the sentencing for about 15 minutes yesterday. but when he left, he didn't say what it was all about. what could happen here is that

lee could start the process to remove mirkarimi from office but ultimately, it would be up to the board of supervisors. after the sentencing, mirkarimi said he's trying to regain the public's trust. >> and i'm going to devote myself to repair my relationship with my family, with the people of san francisco, and i'm committed to becoming a better public servant, one you can be proud of, someone who should not hide from their mistakes and demonstrate what it means to grow forward. >> mirkarimi said he's been in counseling for arrogance and anger-related issues. i do have calls into ed lee's office to see when the statement might be made as soon as i hear from them, i'll let you know. reporting live in san francisco, christie smith, "today in the bay." investigators are searching a morgan hill teenager's cell phone and her computer for any clues that may explain why she suddenly disappeared. 15-year-old sierra lamar was last seen friday morning leaving

her home. her cell phone was found in a field not too far from her house. detectives interviewed her friends at the high school and the high school where she attended her freshman year. investigators are contacting registered sex offenders in the south clara county area to see where they were when lamar vanished. tough new rules now a vote away for san francisco police. the board of supervisors wants the police department to follow state and local privacy laws when working with the feds on counterterrorism investigations. the board tentatively approved the plans last week despite complaints from the chief that it will "handcuff his officers." the board holding a final vote today. the chief wants the mayor to veto it if it passes. medical marijuana patients in the east bay may soon have more pot clubs at their disposal. the richmond city council will decide tonight whether to increase the number of clubs from four to six also decide

whether to ease restrictions on locations allowing them in commercial zones near residential neighborhoods. currently, they are confined to two areas in the hill top and pacific east mall areas. and berkeley city council will tackle the crime of sex trafficking at its next meeting tonight. they'll discuss creating a task force to fight the exploitation of children. the "the daily californian" reports that alleged underage girls are involved in prostitution at berkeley high school. 6:36 right now, rob mayeda is in, and sounds like you're seeing on that radar maybe rain in the north? >> yeah, to the far north bay right now, but it is slowly creeping to the south this morning right now, no rain in the bay area, it's pretty mild too. 40s and 50s outside, the clouds keeping our temperatures up overnight, the other thing we're watching will be wind gusts. right now, nothing, that's good news. not too breezy right now. and we'll see wildly different weather depending on where you are. north bay, you're going to see

quite a bit of rain. for areas north of santa rosa. to the south bay, though, mainly dry and mild. tomorrow, a little bit warmer and as we get toward the weekend, we're talking rainy conditions and much cooler temperatures. right now the rain is dry from santa rosa southward, all the way up to the north coast, that's where the rain is flying this morning around eureka. this should start to slide to the south later on this afternoon and with the jet stream just to the north, areas through the north bay have the best bet of seeing any rain today. mainly areas up northward. we're talking mid-60s south of san jose. and over toward the north bay, the highs in the mid-50s where the rain drops are most likely today and the same story for thursday. then for the weekend, here comes the cool-down and the rain and mountain snow. back to the bay area. we'll take folks out to the maze. we're looking at a nice, smooth approach for the most part. but one of your usual suspects, slowing because those metering lights are on. so the backup in effect all the way back as you're coming off of

some of the reasons you've mentioned. romney's got the delegates, the momentum, and the polls right now. the latest polls showing him up on average by nine, the last one had him up by 15 percentage points over santorum. yesterday santorum made a comment that raised some eyebrows. he said and i quote, i don't care what the unemployment rate's going to be, doesn't matter to me. he went on to say it doesn't matter in terms of his campaign, but romney, as you can imagine jumped on that saying i do care, it bothers me, i want to get people back to work. unemployment a big issue in the midwest as santorum and romney both vie for this important midwestern state. 54 delegates at stake today, although santorum is ineligible for ten of them because he didn't get paperwork in on time. as the delegate count now stands, romney's got 443 to santorum's 184. laura? >> how does that happen.

an update now to breaking news we've been bringing you this morning in san jose where firefighters appear to be getting finally the upper hand on the fire at an apartment complex. our chopper flew up over the scene at curly drive near north 1st street. the two-alarm fire is still not contained this morning, but so far, the good news is that there are no reports of injuries. we'll keep tabs on that as firefighters are still out there. >> absolutely. 6:45 right now, let's find out what's happening outside, my man.

>> looks pretty good. right now, no worries about the weather impacting your morning commutes as the rain has certainly held off. in terms of rain today, i think it's going to hang up in the north bay. so rain north of santa row rosa, and our temperatures kind of mild and warming up more tomorrow. and you're going to think, oh, spring has finally arrived and you'll see the weekend forecast and realize we'll get a taste of winter this weekend. 40s and 50s outside right now. san jose not too bad, 46 in santa rosa, you can see the wind not too bad right now. they'll pick up a little bit toward the afternoon as we watch our next system drop on in. i do want to show you the system that used to impact the bay area this weekend as it moves across the southern plains and hits all that gulf moisture, severe weather outbreak today. dallas down towards houston and new orleans, we'll likely see issues with severe weather and flight delays heading off to the east and flight delays in the pacific northwest due to rain, wind, and snow. but the bay area commute is just fine. we're not seeing fog, no rain in the north bay yet. some of it, though, is up here

on the north coast that's starting to spill closer to mendocino county and lake counties that will continue to drop through the afternoon. but with the jet stream still off to the north, the north bay has the best of seeing showers. areas kind of mild. mid-60s today, maybe some low 70s tomorrow. 63 in san jose, 65 around gilroy. we should see low 60s for the afternoon, out toward the coast, cooler today, 50s around san rafael, and a chance of light-rain showers up there around the north bay. today, we're talking mainly just the north bay showers, warmer as we go into tomorrow, thursday, and maybe a better chance of seeing showers, san francisco northward, but it's still the weekend. we're going to drop those temperatures down, you're looking at rain, mountain snow, gusty winds again, as we get out of the weekend and staying cool early next week. mike? >> all right, rob. hey, folks, we're going to take you out to highway 4, we have still more build, more slowing, down close to 10 miles per hour here as you're passing by the "l" street sensor.

and then the yellow showing up for 242 and slowing now even for 680 down toward that 24 interchange. we have concorkoh concord with as well. watch that half an hour mark with more slowing through that area. speeds into the 50s and a little slowing as you're entering the tunnel. and, of course, we have the 20 plus minutes now coming off of the bridge to the slowing at emeryville. a standard build as those metering lights are on. a look at the san mateo bridge. no problems at the toll plaza, but 880 slow south of here, and at the 101 interchange getting more congested. a little more slowing starting to build just now, but likely another 45 minutes until we see a slowdown for that side. we're looking down to the south bay now where we have a nice flow. the off ramp has cleared with that accident, 85, 87, and 101 with your standard slowdown for a tuesday coming up in a northbound direction. the fire we're talking about

over on curly, it is still there active but not a major commute area. what is a commute issue also, we have a new lane opening up. this is one of your slow spots that we see building right now. and bob is out there talking about the new express lane. what's going on today? >> well, you can see the signs. and this is what used to be a car pool lane is now open to solo drivers if you have fasttrack, and you're willing to pay the price it's offering. based on the congestion. and right now, you can get in this express lane for $1.55, and go up as high as $6, vta says it'll average around $3. this is the bottleneck at 880 southbound and 237. so the express lane is around a 4-mile stretch to around 1st street and 237. and if you choose to take the express lane, vta tells you could be shaving several minutes off your commute.
