lights. a live look out there and see whatever lights across bay. just a steady flow of headlights into the city and out of the city the bay bridge. no backup and no metering lights at the toll plaza yet. we should see those turn order in about 20 minutes. according to schedule. typical flow this morning. >> we will continue to check with you. 6:0 the 2. san francisco sheriff ross mirkarimi's suspension officially begins today. mayor ed lee relieved him of his duties yesterday and set the process in motion to permanently remove him from office. christie smith has more. >> reporter: good morning. both sides really digging in here. mayor ed lee had given some indication that this might happen. but today he is expected to file the official paperwork to suspend sheriff ross mirkarimi from his job. saying he did not resign and so now i must act. early monday he had given mirkarimi 24 hours to step down. mirkarimi did not do that.

is on he said he has taken ful responsibility for his actions. and that the sheriff's department continues to function right and well. he pleaded guilty last week to misdemeanor charge of false imprisonment for an incident with his wife on new year's eve day. lee said he's trying to remove him for official misconduct. >> sheriff mirkarimi's actions and confession of guilt all in the lower standards of decency in good faith rightly required of all public officials. i have asked the city attorney to prepare the appropriate documents and notify the board of supervisors and ethics commission. >> now lee went on to name hennessy as the interim sheriff and last ran the department of emergency management after working in the sheriff's department. she has 35 years of experience. what's next n? the ethics commission will hold a hearing on this. then give a recommendation to the board of supervisors and it would take nine out of 11 supervisors to go ahead and

remove him from office. ross mirkarimi, for his part, he isn't shying away from this probe at all. saying that he would like to tell his side of the story for the first time. reporting live in san francisco, christie smith, today in the bay. 6:04. longtime prosecutor accused of sexual assault is taking his own dice court. deputy district attorney michael will file suit against contra costa county and martinez police today. he says that they maliciously investigated and prosecuted him after he was accused of assault in 2008. he p he was accused of raping a former co-worker but the charges were dropped. he's currently on paid administration i have leave. this morning a world turned upside downpour the family of a missing morgan hill teenager. today marking day five since sierra lamar disappeared. mob has seen anything from her. bob redell live in morgan hill now where friends and family held a candlelight vigil. good morning. >> reporter: good morning to you, jon. in the days since sierra failed

to catch her school bus at this intersection here down the street from her home, deputies with the sheriff's office had been interviewing her classmates and registered sex off enders here in morgan hill p and fremont where she used to live. while her family has been praying for her safe return. >> if you can hear me p. how much i love you and want you back. i want you back. i love you and i just want you back. >> reporter: that was the voice of sierra's mother, marlene, at a candlelight vigil held last tonight at a local church in much morgan hill. a large crowd of her friends and people from the community gathered to offer their support. sierra is 15 years old. last seen around 6:00 friday morning and supposed to be headed to high school where she is a sophomore but for whatever reason, never made it there. >> we are not going to give up until she comes home.

i just -- things aren't the same without her. >> have to get home before saturday because you have a hair appointment. we can't wait for you to come home, sierra. we love you. >> the sheriff's office tells us that steve lamar, sierra's biological father, is a registered sex offender but that he's not a person of interest. that he has been cooperating fully with the investigation into his daughter's disappearance. investigators don't know if she was abducted or ran away. though her family stlas were no problems to speak of at home and concerning the fact that her cell phone was found on the side of a road just under a mile away from where she lived. reporting live here in morgan hill, bob redell, today in the bay. >> gilroy police this morning still looking for some kind of help finding a gilroy woman missing since a murder/suicide in their home. investigators believe 27-year-old gutierrez, iraq war

very ran, shot his mother, martha, last week, before killing his 11-year-old sister and then himself. they say evidence found inside of his car, outside the home indicate a violent struggle and gunfire. several searches have failed to turn up any sign of the 52-year-old woman's body. they are hoping someone saw a the 2004 ford mustang and could k help them narrow down the search area. it is 6:07 now. the most vulnerable becoming the most impacted by budget cuts. that's the focus of a meeting tonight in alameda county. lawmakers say the realignment of state funded programs to county responsibility is straightening financing wilma chance says if the state makes more cuts to programs such as adult day health care, the county will not be able to make up the difference. tonight's budget hearing starts at 6:00 at the alameda boys and girls club in alameda. >> it is 6:07 now. authorities looking for a suspected thief who they say

tried to run down a san mateo county sheriff's deputy. investigators say that this man is responsible for a series of locker break-ins at the fitness club. the club is located on alpine road just west of 280. a sheriff's deputy had to jump out of the way yesterday, this man sped away from the club. he was driving a tan or salmon colored four-door nissan maxima or toyota camry. some bay area passengers were left out in the cold in alaska. united plight 857 from san francisco was diverted to anchorage because of broken bathrooms. after landing in anchorage, passengers were stuck on the plane for more than five hours before they were eventually allowed to deplane. once off the plane, the 250 passengers were given vouchers for food and shelter. united brought in another plane the next day and passengers boarded but that plane also had problems. passengers took off two days

later on the third jet. 67 year old george kohler who vanished during a march 12 cycling trip to death valley national park. the is an plan man was last seen heading for his ten in the muskete strings campground near scty's castle, 180 miles northwest of las vegas. kohler's tent and bicycle were still there the next morning but he was nowhere to be found. crews con to serve for him with the help of dogs and a plane from a nearby air force base. the decision 2012 mitt romney needing a big time victory and guess what. hay has it. romney won 47% of the vote in illinois. for the record outspent rick santorum 7-1 there. exit polls showing super conservatives broke for santorum but those most concerned about the economy and beating president obama voted for romney. >> so many people are unemployed.

building. nbc news reporting he's 24-year-old mohammed mara. there are reports french intelligence have have been track thing guy for several years. he is a french national linked to al qaeda and wants revenge for palestinian children killed in the middle east. the officials say escaped from a prison in afghanistan in 2008. he's also wanted for the shooting death of three paratroopers. the victims of monday's shooting in toulouse were laid to rest in israel. 400 people, including france's foreign minister, gathered at the cemetery to pay their respects to that rabbi and his two children and the 7-year-old girl shot and killed before the start of school monday. they all held dual france/israeli citizenship. people waking up outside in mexico city after yesterday's major 7.4 magnitude earthquake. most of the damage done in central and southern mexico where some 800 homes were

conditions and commute tomorrow. overall looking good right now. just a bit of fog sneaking in from the delta. as we head throughout the day today we will stay mice and dry important the most part. 8:00 p.m. tonight, starting to get the first showers in the north bay. that front will slide to the south by 6:00 a.m. tomorrow. making for a wet commute. we are not expecting a lot of rain. whole thing blows out by 1:00 m.m. then we see a nice friday before the weekend rain arrives. we have a strong cold front along the way. area of low pressure that will track right over northern california and bay area. so we could pick up an additional two inches of rain. we need it. temperatures today are nice and mild. 71 for gilroy. rain today. none tomorrow. that's the setup. rain every other day. and then by monday, starting to get a nice dry pattern. tuesday, i think we will see very, very light showers. mostly in the north bay. but after that, high pressure sets up.

we are talking about a week of comfortable conditions. temperatures climbing into the 70s. dry pattern is going to resume as we head through next week. showers on the way tomorrow. check your drive with mike. >> you weren't kid when you said pattern. alternating there. looking over hooshgs, we have a slower pattern for northbound 101 but we have seen this come back up towards the 60. volume building. up find slow spots. a heartbeat as things slow. 87 showing slowing. earlier accident for 17 southbound at hamilton. clear from the roadway. much better here. we will look at -- outside and see how things are heading into the city. 101 along the pen lanes, not a problem. curving up to the city, smooth drive, good spacing between the cars. getting on to the lower deck of the bay bridge. month problems out of the city here. into the city the metering lights turned on. that's an issue, 880 crossing, slowing. we are seeing congestion start to build north of high street as well. taillights away from it.

southbound with headlights around from it. san mateo bridge. also towards cass traffic valley wide. accidenter with following here northbound at 238. head southbound. not really your main direction. still affecting the roadways. we will send it back to you. >> here is another one. new this morning, watery mess in emeryville. water main break flooded an area near hollis street. 59th street to palo alto blocked off. crews work to fix that problem. police got reports about the break around 1:30 this morning. most of the buildings in the area are under construction. crews cleaning up after another water main break in berkeley. burst at the intersection of 7th street and addison, 3:00. water bubbled up through several holes in the pavement sending a steady stream of water into the street. about 20 homes have been affected. one of the last remaining patches of open land in san jose being zoned for a mega-retail center. 45 acres of land on the northeast corner of highway 85.

even more important than that, surface streets, traveling through berkeley, water main break, addison. that will affect your traffic flow on addison and 7. if you are heading towards cal, and also emeryville, another one affecting hollis. one block. >> thanks for the update. >> 6:31. investigators this morning stepping up their search for 15-year-old sierra lamar. they are desperate for any clues. her mother makes an emotional plea for her daughter's return. bob redell live in morgan hill with what we do know so far. >> good morning. we do know that sierra lamar was supposed to catch a school bus at this intersection behind me on friday morning where you can see now her mom has posted a missing person's poster. looking for her. investigators are trying to find out why she never made it on that ride to high school where the 15-year-old is a sophomore. her family doesn't believe she ran away because they say there

are no problems at home. what is concern sing that her cell phone was found alongside a road less an mile from her house. investigators have ruled out her biological father, steve lamar. the sheriff's department tells us that even though he's a registered sex offender, he is not a person of interest and has been cooperating fully with their investigation. he along with sierra's sister and mother spoke last night at a candlelight vigil attended blarnlg crowd of sierra's friends. >> if i keep my faith i can go on. this just hard. i feel like -- it is hard for me to eat. i just feel guilty about doing anything. >> in the five to six days since sierra lamar disappeared, sheriffs have been interviewing her classmates and also registered sex offenders who live around morgan hill and free monday where sierra lamar used to live.

reporting live here in morgan hill, bob redell, today in the bay. >> if have you any information for detectives, they are, of course, anxious to hear from you. they have set up a special e-mail address. tips@sheriffs-sec.gov.org. we will put the e-mail address on our website. stern warning from san francisco's mayor. step down or else. but this morning, ross mirkarimi is facing the first day of his suspension, he says that he's not giving up. christie smith joins us live with what happens no. good morning. >> reporter: good morning to you. this is becoming a real battle here in san francisco with neither side giving an inch. and today mayor ed lee taking it up a moch. he is expected to filetle official paperwork to suspend a sheriff ross mirkarimi from his job. he asked him to resign. that didn't happen. and so the next step, file that

paperwork. then that will start an official ethics probe after mirkarimi pleaded guilty last week to misdemeanor charge of false imprisonment of his wife. before lee's announcement, very defiant mirkarimi spoke out saying he doesn't believe there was official misconduct. and he is digging in. >> i believe that i am still very able to be the sheriff in is an plan. and that it is just time -- at this time do i not plan to resign. >> lee has gone on to appoint vick write hennessy as the interim sheriff. she served as deputy chief in the sheriff's department and has 35 years of experience. so what's next in all of this? again, that ethics commission probe on whether to uphold the charges, then goes over to the board of supervisors.

nine out of 11 of them would have to agree for ross mirkarimi to be removed from his job. and for his part, mirkarimi was asked about what happened on new year's eve day. he didn't really answer reporters. he said he is not shying away from this. he looks forward to finally telling his side of the story. reporting live from san francisco, christie smith, today in the bay. city of oakland preparing this morning to honor four police officers who lost their lives in one of the city's darkest days. the keller avenue bridge will be dedicated to sergeants mark dunnigan, irvin romass, daniel fikay and officer john head. they died in march of 2009 during a shoot-out with cornered fugitive nixon. he was also killed in that incident. san francisco drivers can expect delays along the busy embarcadero this morning. part of the northbound lane between mission and howard streets will be closed. crews will be out repairing the sewer lines.

no word on when that lane will reopen. 6:35. looks like a clear day outside for us. >> good morning to you. it will be a nice day today. we are going to see temperatures in the 70s. something we haven't had for a while. and the thing is that if you want the rain we have that back in the forecast as of today. the next four days it works out like this. we are going to see nice conditions. dry conditions today. by tomorrow, we start to get showers and shave off ten degrees. same thing for friday. mice conditions on saturday. shave off ten degrees. get the rain showers. that's what is happening in the weather department. let's take you outdoors and show you what it looks like right now. friday, looking pretty good. that's when we will get the most significant rain. between today and tomorrow, looking okay for outdoor activities. tomorrow outdoors for the second half of the day. by friday take a look at that potent front that's going to bring maybe two additional inches of rain. even right here in the south bay that's possible. looking likely. up in the north bay.

suicide rates, how long does it take you to get to work n what about mental health status? can people get enough sleepsome are they drinking too much? when they put all of that together they came up with thee rankings. 28 out of 50 is where the san francisco area actually ranks. and where you really stood out most of the things that they looked at were average. when you guys stood out was alcohol consumption. average 17 drinks per month. it was actually the highest of all the cities they studied. so san francisco not too stressed out. maybe because of the high alcohol consumption. maybe in spite of it. but when what we do know we will be able to compare it next we are. >> you talk about the balancing effect. okay, thank you very much. >> all right. 6:42. still to come 15 more minutes of uninterrupted news. we will tell what you investigators plan to do in the search for a missing morgan hill

morning. she was supposed to be heading to school where she is a sophomore. for whatever reason she never made it there. the sheriff's department tells us steve lamar, sierra's biological father is a registered sex offender, but he's not a person of interest. that he has been cooperating fully with the investigation and into his daughter's disappearance. investigators don't know if he was abducted or ran away. though her family says there were no problems at home. and adding to her concern is the fact that her cell phone was found on the side of the road. less than a mile from where she lived here in morgan hill. reporting live here in morgan hill, bob redell, today in the bay. >> san francisco sheriff ross mirkarimi's suspension officially begins today after mayor ed lee relieved him of his duties yesterday. and set the process in motion to permanently remove him from office. today in the bay's christie smith live in san francisco where the sheriff is not giving up without a fight. good morning, christie. >> reporter: good morning to you. both sides really digging in here in the fight to keep

heating up. today mayor ed lee expected to file the official paperwork to suspend sheriff ross mirkarimi from his job. mirkarimi refused to step down as sheriff. he pleaded guilty to a misdemeanor charge of false imprisonment of his wife on christmas eve. he was given 24 hours to resign. mirkarimi said he would fight. lee has the next move. >> sheriff mirkarimi's actions and connecticut fegss of guilt clearly fall the lower standards of decency and good faith and rightly required of all public officials. i have asked the city attorney to prepare the appropriate documents and notify the board of supervisors and ethics commission. >> reporter: vickie hennessy will be the interim sheriff. she has 35 years of experience. there will be an ethics probe and then goes to the board of supervisors. we will then have to decide whether or not to remove him from his job. reporting live in san francisco, christie smith, today in the

bay. a longtime prosecutor accused of sexual assault is taking his own case to court. deputy district attorney michael grisettel will file suit. accusing the police of malicious investigation. he was accused of raping a former co-worker in wait but the charges were dropped. he's currently on paid administration i have leave. new this morning, a watery mess in emeryville. water main break flooding an area near hollis street. 59th street, powell also blocked off. crews had to step up and work to fix this problem. police got reports about that break about 1:30 this morning. most of the buildings in the area are under construction. crews right now cleaning up after another break. this one in berkeley. one burst right there at the intersection of 7th street and addison around 3:00. water then bubbled through up through several holes in the pavement. sending that steady stream of water right out into the

streets. about 20 homes have been affected. people who live in oakland's montclair district say police need to do a better job patrolling their neighborhood. at a community meeting last might many expressed xern abo e about a rash of burglaries. an 79-year-old woman was attacked in her home and locked in her bathroom for hours while thieves ransacked her house. residents say the focus on oakland's more violent neighborhoods is leaving them vulnerable. >> we all know there is a lot more violence going on in different parts of the city. that doesn't mean you shouldn't have police presence in all areas of oakland. >> i think it is something we immediate to -- everybody has to be transparent about. if you are taking resources from one area to another you have to tell us. if you are not, then you need to tell us that. >> some people are taking security into their own hands by installing security cameras.

parents will rally in support of school principals. the school board removed seven principals earlier in month because of poor student performance. several top administrators were also stripped of some of their duties. parents are upset they were not told about the decision. they will attend tonight's school board meeting and protests. hayward city hall. a family cleared to move forward with a lawsuit against the dodgers. the family can proceed with a negligent suit once the team emerges from bankruptcy. that could happen sometime next month. the family sued the team and owner, frank mccourt, last year. they claim that the team did not provide adequate security at the march baseball game there. opening day. stowe was beaten in the parking lot after the ball game. they want at least $50 million for long-term care. man originally suspected of beating stowe is out of jail. police arrested ramirez last may and was eventually cleared.
