is "today in the bay." good tuesday morning to you and thanks so much for joining us. it's 5:00 right now, i'm laura garcia-cannon. >> good morning, everybody, i'm john kelly. let's get to it and check in with meteorologist christina loren, you said the rain is coming. >> the showers are just now starting to develop. the entire peninsula at this point getting the steady rainfall and it will continue to come down as we head through the next few hours. the activity will continuously ramp up and you see the heavy pocket of rain that developed over oakland, county on slick driving through there. although it spring break for some kids and you man on that lighter-than-normal commute you still want to give yourself plenty of time, right, mike? >> exactly right. the golden gate bridge, some of the lighter green hit and the roadways are slick. and further south we saw the

rain hitting san mateo so watch out there. a live look at the bay bridge, the earlier wind advisory has been conditionsed from the bay bridge but the camera trembles and wet roads and gusty winds could be a factor. smooth drive as you said for now. new this morning firefighters still on the scene of a one alarm fire at a strip mall in san lorenzo, the roof caught fire before 2:00 this morning at the cash for gold store on hesperian boulevard near hasscienda, the fire may he started accidentally by someone trying to steal copper wiring. >> i've seen a few cases come down where there have been people trying to -- for abandoned buildings and other businesses, yes, it's not uncommon. >> pg&e cut off power to the building but expects to turn it on at 9:30 this morning. so far no word on how extensive the damage is or when that shop

will be able to reopen. it was one week ago yesterday when tragedy just gripped an oakland college campus. the shooting rampage at oikos university last monday left seven students dead and another three injured. stephanie truong is live for us. >> reporter: no word on when the boardedup doors will reopen, but banners are hanging saying in memoriam. the school has been hosting daily concerts since friday in honor of the seven victims. ♪ this is yesterday. jennifer zhang performed a song for lydia sims who she considered a big sister.

the noon concerts are open to the public and they'll continue through the end of april. the school is also trying to help fund raise for the victims' families. oikosuniversity.org lists donation information for the foundation that has a wells fargo account. family and friends have also set up individual accounts. right now, in fact, the tibetan association of northern california is trying to collect money for funeral expenses of two of the victims whose families live overseas in india. in the meantime as for the suspect in the shootings, one goh has been charged with seven counts of murder and three counts of attempted murder. his next court date is april 30th when he may enter a plea. live at oikos university in oakland, stephanie truong "today in the bay." prosecutors have until 4:30 to file charges or by law the minor must be let go.

police say they need more time to investigate sunday morning's deadly crash in conconsidered. officers say a father and his daughter were on their bikes when the teen lost control of the suv and ran them down. 41-year-old solomon nuri died on impact. his 9-year-old daughter odessa died at the hospital. her 12-year-old sister suffered minor injuries. also this morning a gang member on trial for killing a father and two sons will be back on that stand today. 25-year-old edwin ramos accused of shooting 48-year-old tony bologna and his sons in a case of mistaken identity in 2008. yesterday ramos telling the jury he was driving his car when his passengers spotted the bolognas car. ramos said the shooter is also a gang member who is now in hiding. ramos is expected to face cross-examination later on today. it is 5:04 right now.

new this morning, suicide bombers in afghanistan strike at government offices killing more than a dozen people. we'll following the latest developments from the newsroom. >> good morning. in all officials say 15 people are dead after militants target afghan and nato security forces in southern and western afghanistan. one of the attacks happened just outside police headquarters in the helmand province. at least four officers were killed. five more wounded. a group of suicide bombers blew up a truck outside a district province in the herad province. today is the deadline for syria to withdraw its troops from towns and halt the 13-month crackdown on pro-democracy demonstrators but activists do not see any signs of a cease-fire as military attacks are reported in towns across the country. a u.n.-brokered plan called for a cease-fire after the u.n.

estimates more than 9,000 people have been killed in the one-year uprising against al assad. north korea announcing tld it will be ready to launch its controversial long-range rocket as planned. it said all preparations will be made by the end of today. a top government official telling foreign journalists in pyongyang that everything is on track for a launch between april 12th and 16th. the international community is condemning the planned launch, of course. the major concern here is a secret nuclear test. john, though, north korea insifinsift insists it's launching a weather rocket. world famous artist thomas kinkade died in his sleep that according to the painter's girlfriend. amy pinto telling the "mercury news" that he died peacefully last friday morning. pinto said the two had been dating the past 18 months about

six months after the painter's wife filed for legal separation. his autopsy was performed on monday but it could take weeks for the actual cause of death to be determined. a nine-year fight to unionize sonoma county's biggest hospital is set to end today. the national union of health care workers said it's reached a contract agreement with santa rosa memorial hospital. the contract includes wage increases and improved retirement benefits and job security projections for 700 hospital employees. it is 5:07. more delays for california's voter approved high speed rail project. a state congressional committee launching an investigation in to possible conflicts of interest on the multibillion project. the leader ordering the authority to come up with documents and ro records of past communication. it will check for conflict of interest regarding rail officials and contractors. the current estimates that is

$68 billion. let's check the forecast with christina loren. how we looking? >> we've got showers on the radar this morning. the first wave is right now moving through. we'll get a little bit of a break later on with spotty on-and-off showers. but take a look at what could slow you down this morning. we've got showers coming down almost over the entire peninsula. i wanted to zoom in over the heavier pockets and time out the system and show you where the showers are headed. half moon bay is getting rainfall. and it's on its way to palo alto in 55 minutes. we'll see some pretty heavy rainfall. you want to keep it in mind. travel cautiously. and another pocket situated over berkeley on its way to walnut creek in 57 minutes. we'll track the showers all morning long. you can see spotty activity throughout the day today, highs only ending up in the low 60s, even the warmer cities across

the bay. and i in san jose. 63 for fremont and 57 degrees in stark contrast from yesterday. we'll get breaks in the rain in the forecast every day this week. i'll leapt you know when you can get outdoors. want this to check your drive with mike. >> we'll look at the south bay where the rain hasn't hit here. a smooth drive so far, the northbound route. but i do want to call out since last night we've had the accident scene at wright avenue and north shoreline boulevard. it sounds like a deadly accident happened overnight. we're still getting more details and bob redell is headed to the scene to fill us in on the rest. but so far know that the intersection north of central expressway could be an issue. a light volume on surface streets. 101 itself coming through palo alto getting the rain in the next hour as christina said. right now it's moving smoothly past highway 84 and continuing up towards san mateo. the bridge might get a gust or two of wind on the high-rise and

welcome back, everyone. and a good tuesday morning to you. rain going to come down in the morning commute as we take a live look outside 880 in oakland. we're minutes away from checking in with christina loren with a look at the forecast. 5:13 right now. and speaking of forecasts, weather warning for you hipsters out there, you might want to leave the tank tops and the cutoff jeans at home this weekend because it will be a little chilly at the coachella music festival, storm systems could bring showers and high winds and low temperatures to the town of indio this weekend. people typically, you know, camp out there in the sweltering desert heat to check out acts like the black keys and radiohead and snoop dogg, but the forecast this time around showing gusty winds and cooler temperatures not exactly tankini weather. christina loren, it's a little bit different this year around. you won't see as much skin.

>> i grew up there, you'll still see skin. >> that's part of the attraction, right? >> indeed it is. we've got the same storm system that will bring the cooler weather impacting us. we'll show you where the showers are coming down, hard to see from this live picture of the bay bridge but your roadway is slick across the board. and let's take you live with the radar and show you the heaviest rain. it's the coast that's seeing the heavy showers. your temperatures are nice and mild. but take a look at all this rain that just developed, a really heavy pocket here about to slam 280, i wanted to time that out for you. the yellow and orange embedded in the green, that's rain coming down at a pretty substantial rate about half of an inch per hour that's on its way to menlo park, 44 minutes away from redwood city and 37 minutes away from emerald lakes. it will slow you down especially if you are headed from san jose up to san francisco, give yourself plenty of extra time. we had another pretty good

looking cell over berkeley. it's fallen apart. we saw lighter showers headed through lafayette, and stop the clock on your futurecast at noon. we'll get a little bit of a break. the heaviest wave is moving through until midmorning and by noon we'll get spotty, lighter activity and tonight another round moves through starting at midnight and making for another slow drive as you make up wednesday. we'll get a nice break for the second half your wednesday. you'll be able to get outdoors from time to time and another wave moves through on thursday, it's a colder system, and it will move through quickly but it will impact the outdoor conditions at at&t park as we head for the home opener. 61 in fremont. as we head through tomorrow holding on to the low 60s, on-and-off showers for thursday, rain on friday, but not all day. we'll take an in-depth look at the forecast for the giants coming up. a few showers early saturday. you'll be able to get outdoors by 10:00 a.m. and sunday great for outdoor activity you can hit

welcome back, everybody, tuesday morning, as we look live at san rafael. the traffic not too bad out there. going out the door, it's not too bad on the temperature but christina loren is warning you might want to take the umbrella. a new study finds president obama's landmark health care bill could result in an even larger ballooning budget

deficit. the study claims the health care overhaul would add more than $340 billion to the deficit over the next decade. administration officials dismiss the study saying it does not use conventional cost measurements. the study was directed by a republican member of the board that oversees medicare financing. the supreme court is currently considering the constitutionality of that law. president obama in florida pushing for a new tax proposal called the buffett rule named after billionaire warren buffett will have people that make over $1 million pay more in taxes. many wealthy taxpayers only pay 15% of their income. the new proposal would raise the tax up to 30%. the plan is not expected to pass through congress but senate democrats argue the new rule is needed for economic fairness. some breathing room for all you tax procrastinators, this year's federal and state deadline has been extended to

>> let's let looks because the rain will affect the speeds. north of the golden gate bridge, watch the off-ramps and another live look outside and show you oakland on the other side of the bay. the glowing lights here, the rain having passed through and more rain coming over as christina's maps showed you, so that will be a factor. a lot of spring break folks and it will affect surface street traffic. we're going to check in with bob redell right now because new this morning an extensive investigation is under way in mountain view after a car struck and killed a pedestrian. "today in the bay's" bob redell is live at the scene this morning. what does it look like right now? >> reporter: good morning to you, laura, we're off of central expressway on shoreline near wright avenue and you can see the mountain view police department is still working on the scene here doing their investigation. there was somebody, a body, that was located where that man is over there.

that person has since been removed. we don't know who that person was, whether it was a man or a woman. and we see a wrecker here, it looks like they are getting ready to tow a black pickup truck involved in this accident and it gives us an indication that maybe they are wrapping up this part of the investigation and that this road should be opening up sooner perhaps, sooner than within the next hour or so, although they won't give us information as far as an eta and mountain view police isn't telling exactly what the circumstances are surrounding the accident, all we know is somebody was killed and as we can see shoreline at wright avenue is still shut down. this is a major artery for people trying to get to and from their jobs here in mountain view, so it is an inconvenience. if you are planning today, use central expressway. reporting live here in mountain view, bob redell "today in the bay." san francisco police meeting with residents wiabout a recent

mass murder. bin look in jail right now facing five counts of murder. later on today, police chief will hold a town hall meeting to discuss public safety in the ingleside neighborhood. 5:33 in the morning right now. oikos university will be reaching out to the families of victims of last week's mass killing. the christian college will hold a memorial service. 41-year-old james hooker made headlines in february for abandoning his family and quitting his job to live with 18-year-old student jordan powers. hooker now facing charges of sexual misconduct with a different teenager 14 years ago. he has a hearing that starts today. powers says she ended that relationship following hooker's arrest on friday. the days of smoking in front of a movie theater may be over. san jose city council will decide today whether they should add more to the list of places where you can no longer light up. they'll consider a plan to ban smoking in outdoor dining areas and lines where people wait for services and in the common areas of apartment complexes. supporters say the goal is to reduce people's exposure to secondhand smoke. the vote on the proposed ban is set for this afternoon. it is 5:35 right now and those looking to attend san jose state university may soon face some new hurdles. the university president will

announce his decision on changes and guaranteeing admission for local students. there are plans to only give preference to the locals. overcrowding and budget cuts are major reasons for the proposal and currently santa clara county high school and community college students are guaranteed a mission if they meet the requirements. talking about the rain coming down could spoil the commute for some but not if you're on tom p of it. >> it's hard to stay on top of it with so much coming down and some very interesting cells. you have light rain just about everywhere except for the peninsu peninsula, and light to moderate rain is moving into oakland. this is a slow moving system, we'll be dealing with the first wave of the more moderate rain, through midmorning and then we'll see the activity turn more spotty and widespread. by 1:00 p.m. we're talking about a little bit of a break. you'll be able to get outdoors

and you still have time to get objections outside in san jose inside before they get drenched because we are going to see pretty heavy downpours for the first part of the day and lightening up for the second half of the day and another wave moves through overnight. and we'll get a little bit of a break second half of wednesday. thursday kind of a washout. more rain on the way to the bay area. you see the yellow drifting into the north bay. this is another system altogether, a colder system and we are expecting thunderstorms out of this one as well. i'll show you the seven-day forecast on the next report and we'll pinpoint the showers and show you where they are headed minute by minute. let's check the drive with mike. >> christina you report the rain on the peninsula and then reports of an accident 101 at broadway. northbound side reports of a car going off of the roadway and hitting a pole but the back of the car hit the pole so it sounds like the car may have spun off the shoulder, may be slick conditions. this car is off the roadway.

golden gate bridge, you can see the sheen on the roadway, which is rain coming down. kind of scattered in parts. let's check in with christina. 5:40 right now. this morning we can tell you enrollment is up but funding is down for pre-k programs statewide. "today in the bay's" tracie potts is live in washington, d.c., with a look at the number numbers just released this morning. >> reporter: they came from the national institute for early education research. every year they take a look at what are states doing to get 3 and 4-year-olds into school so that they're ready for kindergarten. for california, 20% drop in the number of kids who are in those programs. take a look at the numbers. california is spending $746 million on 3 and 4-year-old pre-k programs about $4,900 per child but down over $500 from the year before. in terms of resources dedicated to this, california is in the top third ranking 13 out of the

39 states that actually have the programs. advocates say they are concerned about the money going away because there's danger in not getting these kids into school programs earlier than kindergarten. here's what the director had to say about it -- >> they don't behave well. they don't learn much. they don't get rewarded by the school. before you know it, they're on a path to high school dropout. that's a pathway to prison. >> reporter: now, besides the money, besides the number of kids, they also take a look at quality. things like are the teachers in these programs highly educated. do they have meals, do they have screenings. are the class sizes small enough for the younger children. only 12 of the 39 states with pre-k programs actually met those standards, john? >> all right, tracie potts from washington, d.c., thank you very much for the report. now to decision 2012. this morning republican candidate rick santorum is back on the presidential campaign trail. santorum's 3-year-old daughter

we're looking for a nice easy drive for 101 and 280 but they've been hit with rain. christina showed that coming through the area. we've got one accident to report northbound at broadway a car went off the roadway and hit a pole on the side of the road so there may have been slippage as a result of that as well because it sounds like the back of the car may have hit the pole and slid to the side. that may have been a factorer. a pretty smooth drive on your roadways. a look at the oakland and the east bay, picking up volume a little bit, the southbound looks more dramatic because the mist on the roadway makes the light bounce around, and that will be a factor even if it's not raining but it probably will be guys, back to you. a battle is being waged in southern california trying to wipe out a tiny little bug which could prove fatal to fruit trees. pesticide spraying continues in the san gabriel valley to save the $2 billion citrus industry. they are trying to kill an asian
