in addition to that, we're headed toward a warm-up. i've got your full forecast. and overnight hours mean overnight construction. highway 4 here, a little bit of slowing, we'll show you what else is going on and an update on those wires that were down earlier this morning. and we'll give you a live look outside at san francisco. kind of looks like a scene out of the movie twilight. i've never seen the movie, but that's what i guess it would look like. it's tuesday, april 17th. this is "today in the bay." good morning, everybody, thank you very much for joining us, the time is 5:00 on the nose, i'm john kelley. >> this morning, new clues in the search for a morgan hill teenager now missing for more than a month. bob redell is live in san jose this morning where crime lab results are giving deputies new leads in this case. bob, good morning. >> yeah, good morning to you, marla. and we have learned this new evidence could include a

fingerprint, dna, or hair fiber, but that's as specific as the sheriff's office is getting with us. they just tell us they do have new information, new leads into the disappearance of sierra lamar. as you recall, she's the 15-year-old morgan hill girl who has been missing for just over a month now. this information came from crime lab analysis of items found in the search for her, it's not clear if it was from her clothes, the cell phone, or the used condoms and empty box of handcuffs. these were all items found in different areas from her home in morgan hill since she disappeared march 16th. this week, investigators are also continuing their searches of local bodies of water near her home using side scan sonar and divers if necessary. yesterday, a huge crowd of sierra's family and friends marked the one month since her disappearance by releasing hundreds of balloons, all of them pink, that's her favorite color, each one carrying handwritten messages of hope and prayers for her return.

>> it's really hard. >> i hope all those messages are going to bring her back to us. >> there'll be another volunteer search being run by the foundation tomorrow morning, being run out of burnett elementary. you want to show up between 8:00 and 1:00, prove you're 18 years of age. reporting live in san jose, bob redell, "today in the bay." new this morning, south bay driver dead after being strapped inside his pickup truck by flames. the chp says the truck burst into flames after running off the road on northbound 680 of south of capital expressway in san jose. officers say the truck and the grass surrounding it were both on fire when they arrived on that scene just after 12:30. the coroner was called to the scene just a few minutes later. this morning, one man is

dead, another is in the hospital after shooting near oakland's mills college. the 19-year-old driver of a red camaro crashed near the corner of buell street monday afternoon. he and his 21-year-old passenger had been shot. the passenger died at the scene. witnesses say at least eight to ten shots were fired at the car about 4:30. a tan mid-sized car was seen leaving that scene. also today, a $5,000 reward now being offered to find the man who beat up and sexually assaulted a woman near oakland's lake merritt. the woman was grabbed on lake shore boulevard. christie smith has a look at the search for the suspect. good morning, christie. >> reporter: good morning to you, john. that's right, already a $5,000 reward being offered for information to help catch this guy. a woman tells police that she was walking near lake merritt right about where we are when a man stopped his car, forced her

into that car and then sexually assaulted her. this was about 3:00 in the morning sunday. a 34-year-old woman who tells police she just left a friend's home and was walking back home near our lady of lourdes church. the driver told her to get in, she didn't, he stopped, grabbed her, and forced her in and drove off. >> he physically beat her in the car, and then drove her to an undisclosed area of oakland where he sexually assaulted her. >> police say he then pushed that woman back out of the car, she was treated at a hospital and released. so far, unfortunately, not much of a description to share with you. the man is believed to be in his 20s driving a dark four-door sedan. i do have calls into oakland police this morning to see if they're working on a sketch. reporting live in oakland, christie smith, "today in the bay." 5:04. and this morning, a 17-year-old girl has been released from

custody after refusing to appear in court with the man accused of raping her. a sacramento judge ordered her to jail a week ago after she refused to show up at two court appearances involving her alleged attacker. prosecutors told the judge the victim's appearance was necessary to protect the public from an alleged serial rapist. but the girl's attorney says the whole ordeal is necessary. >> i do believe it should not have happened in the first place. i do believe that there were less extreme measures to obtain her statement. >> the judge has apologized for his ruling. meanwhile, the girl has been released to a secret location with a gps monitoring device to keep track of her whereabouts. the defendant is facing three counts of rape and sexual assault. it is 5:05 right now. a high-profile advocate for missing children will be at the state capital testifying on two death penalty proposals. mark klaas' 12-year-old daughter

was kidnapped and murdered. and he will testify on a senate amendment that would transfer death sentences from the supreme court to appeals court. we are learning more about the sailors lost at sea over the weekend. the low-speed chase overboard during a race on saturday. the coast guard rescued three people, but five others are still missing and presumed dead. and the victims were remembered with a moment of silence at monday night's giants game. alexis bush was ball girl when barry bonds broke the home run record. alan kahill was a fixture at the san francisco yacht club in belvedere. >> known as irish alan. always had a quick wit, good sense of humor. you could hear him down the docks. laughing, joking away.

he was quite the character, but very, very good sailor. >> 43-year-old mark cassan grew up in belvedere. and 25-year-old jordan fram was weeks away from graduating in marin county. while a community mourns, crews are looking into how to remove the boat stuck on the rocks. u.s. fish and wildlife says it's an area where birds nest and seals are. police are on the look out for a serial burglar who dresses in combat boots to commit his crimes. the combat boot bandit may be responsible for a spree of break-ins on woodward avenue and laurel lane. he has looted at least four homes so far. $46,000 worth of jewelry and electronics has been stolen. the burglar also made off with a bicycle. a beautiful start to your workweek. let's see if it's going to continue. meteorologist christina loren.

what's going on? >> yes, we've got a really good-looking forecast. good morning to you. you want to dress for the two parts of the day, like you did yesterday. and be aware we have fog out there developing. and even though san francisco reporting ten miles or better for now, likely watching these numbers fall in the morning hours. down to 1/2 mile visibility. and as we head throughout the morning, temperatures are going to stay on the comfortable side, 65 degrees by noon inland, 67 degrees at 4:00 p.m. by the bay and right by the water, right by that pacific ocean, temperatures are still going to be on the mild side. get out there, enjoy the sunshine, and you're going to get the most sunshine between the hours of about 10:00 and 2:00. high pressure really kicks into high gear as we head through thursday and friday, even saturday, offshore flow. as you know, that's the warming trend for us. all those winds warm as they pump from land to sea. and for us, we're talking about the potential for 90 degree weather. i'll let you know exactly when and when we might get a little more rain. that's in the seven-day forecast, as well. 5:08 first. let's get you to work on time

with a good note with mike. >> a better note for these folks working overnight. highway 4, that construction crew, roadwork clearing out there and that has reopened the eastbound direction passing by. and no more heading into antioch. that 54 over on the right side of your screen is the westbound direction already starting to show a little bit of a slow down for that morning commute. we'll watch it as that develops. northbound 680, construction zone there, approaching 24, but no slowing past the scene. crews should start moving from there in about half an hour. expect a little bit of commotion, not a lot, though. things are still pretty mild throughout the east bay. easy approach the bay bridge. highway 24 at 580, new reports of debris or maybe a stall in the area. i'll follow up with chp and see what they say. a nice easy drive westbound with those taillights away to the peninsula shot. >> thank you, mike. 5:09, san francisco is honoring the last handful of survivors of the great 1906

welcome back, everyone on this tuesday morning. that building is the hp pavilion, and that's where the san jose sharks played their home games last night, no home cooking as the sharks lose by a final of 4-3 in their stanley cup quest. the blues take a 2-1 lead in that series game. thursday, 5:13 right now. new this morning, one of nasa's oldest spacecrafts is now in the air heading off on its final mission. the shuttle discovery left kennedy space center for the last time this morning. take a look at this. it's atop a modified 747 jumbo jet for flight to virginia. crew members who took part in the last space flight are reflecting. >> she served well 39 missions,

365 days on orbit, and the fact that discovery's going to the smithsonian and people will get to see her forever is a good thing. the discovery will make a low-flying loop around washington, d.c. before landing later this morning. it will be on permanent display in a hangar at a smithsonian institution's national air and space museum. well, how about this, scott mcgrew says the courtroom fight between oracle and google is like taking your vitamins, right? >> right, because nobody wants to do it but it's actually good for you. we have to talk about this massive brawl between two of silicon valley's giants, even though the fight of patents is kind of boring. at issue is whether google used programming language to run its cell phones. in a way, this court case is a bit like a public divorce case. on the surface, it's kind of routine, but the potential for someone to say something really awful on the witness stand has all of us watching. for now, the only damning thing

we saw in court was an e-mail between google executives that seemed to indicate they knew they were using someone else's property. how are we doing on the sun deal is what google ceo eric schmidt asks. is it time to develop a non-java solution to avoid dealing with them? by which he means oracle. talk to the electronic arts melee off several employees. it's a bit like the movie industry, it uses one team while hiring another for a future project. so ea, both firing and hiring, apparently. shares of apple have been dragging on the market. jackie is at cnbc world headquarters. jackie, apple, who would've thought that? >> the futures are a touch higher after a mixed close for the markets on monday, we saw the blue chips advancing, pushing the dow higher on the back of a better than expected report on retail sales. but as you mentioned, apple took

a bite out of the nasdaq, the stock has fallen for five straight days losing nearly 10% after hitting an intraday high of 644 a week ago. apple accounts for 12% of the nasdaq index, and there are reports that mac and ipad sales may be disappointing. apple's going to report earnings next week. the asian markets were lower overnight, european markets were higher. and we get information on housing and industrial production. all reported earnings already actually ahead of the opening bell. the numbers looking good at this point. we saw the dow rise 71 points to 12,921, the nasdaq losing 22 yesterday to 2988. and cnbc has learned that delta airlines' board has signed on a plan to buy the conocophillips refinery. the deal could be worth between $100 million and $125 million. it's configured to make jet

flew. jpmorgan would be involved buying and shipping crude oil and paying for it to be refined into jet fuel. and the u.s. postal service's biggest union is critical of the agency's restructuring plan. the national association of letter carriers saying that the postal service will only be profitable if it starts to act like a regular business. the union urging the agency to raise stamp prices again and expand mail service. the postal service has proposed closing thousands of post offices and stopping saturday delivery to try to save some cash. of course, it faces $5 billion in losses due to a drop in mail volume and high pension and health care costs. scott, back over to you. >> all right, jackie. and john and march low, if that happens, stamp prices go up, big effect on netflix, san jose's largest user of the post office. >> oh, interesting tidbit. okay. thank you, scott. well, jackie just touched on this, tax day attracting protests in the area.

postal workers facing possible layoffs, that protest is scheduled for 3:30 outside the main post office on 7th street. and at 3:00, the civic center post office in oakland to thank californians for paying their taxes. the group will also demand corporations and wealthy residents pay more. now, similar events will also be held in san francisco. okay. if you're, you know, dragging your feet to file those tax returns, you can file a six-month extension. that's the good news. but make sure you make that request by midnight tonight. beware that filing for an extension does not spare you from actually paying that tax bill today. and if you fail to pay, you will incur interest charges and fees in addition to what you already owe. good news on tax day. >> yes, it is. >> sarcastically. nice weather in store for all of the procrastinators out there this morning. >> yeah. you guys procrastinating this year? >> no. >> i make it an annual ritual. >> you and me in that boat together. that's right.

north, that's going to bring in a little bit more cloud cover as we head through the second half of our day. high pressure still in control. temperatures just about as warm as they were yesterday as we head through the second half of your week, especially starting wednesday, thursday, friday. temperatures back in the 80s. the warmest conditions that we've had so far this year. 85 degrees friday, great beach day. 84 on saturday, and then sunday, for the second half of the day, we're going to start to see more clouds roll in. so your temperatures as a result will cool to 74 degrees. if you want the sunshine, if you want the warmth. if you want the tan, looking at saturday as a better day for outdoor activities. and i want the tan, back to you, mike. >> i just want the weekend. all right, we're going over here to the south bay where we have a nice travel in the northbound commute direction for want of anything. you do want slowing there southbound 87. blips going on, but those should sort themselves out south. as you head toward the summit, construction, blocks lane in either direction. we know about that. drainage projects going on for

i'm in for laura garcia-cannon. >> and i'm john kelley. this morning, thousands of dollars being offered to help find a sexual assault suspect accused of beating up his victim to silence her cries for help. live in oakland this morning. and christie, we're hearing this happened steps away from a church? >> yeah, a church and also lake merritt which is really a popular area even at this hour for runners, joggers, people who exercise. a woman tells police that she was out here right about where we're standing and that a man came up to her and basically forced her into his car, drove her away and then sexually assaulted her. this happened about 3:00 in the morning sunday, and oakland police are now putting out a warning to the public to be extra careful. don't be distracted by cell phones, headphones, that sort of thing. 34-year-old woman tells police she was walking from a friend's house. again, 3:00 a.m. sunday morning near our lady of lourdes church

veteran tried to lift his daughters into a storm cellar in fargo, north dakota, but there was no time. his 8-year-old daughter heather is critically injured. now, fargo is just 14 miles away from the town of woodward which was hit by a monster twister just after midnight sunday killing six people. forecasters say about 75 tornadoes touched down in four great plain states over the weekend. and today, a woman facing numerous charges including driving under the influence of drugs after allegedly running down an elderly bicyclist. officers say 23-year-old jenna rubio hit the bicyclist on monday morning. the 77-year-old victim was wearing a helmet, but he still suffered major head trauma and internal injuries. the charges against rubio include driving under the influence of marijuana and prescription drugs.

also allow sales for a profit. the proposal would create a nine-member board of medical marijuana enforcement which would be in charge of a medical marijuana fund based on state fees and state fines. get ready for mother nature to turn up the heat, meteorologist christina loren, tracking a nice forecast. >> and you know what? it's earth week. it's one of those weeks we encourage you to go ahead and bike to work if it's close enough to do so. and you're going to get weather that cooperates with your bike ride. downright perfect later on today. we do have some fog developing. however, san francisco still reporting ten miles of visibility. just because we have ten miles reported doesn't mean you're not going to encounter some thick patches of fog as you drive up the peninsula this morning from san jose. so keep that in mind, travel cautiously out there. as we head throughout the morning hours, we'll see that fog thicken up probably about before 9:00 a.m. and then between 10:00 and 2:00, the most sunshine for today. 4:00 p.m., more clouds rolling in, 67 degrees inland, 65 degrees by the bay and 60 at the

pretty steady here, but you'll see it kick up over the next hour. a wider view coming up. just about 5:37. a puzzling problem for north bay biologists. a higher than usual member of malnourished elephant seal pups are being rescued and brought to the marine mammal center. the center is treating 70 young seals. last year at this time, there were just 40. the spokesman says the young ones are just finished weaning. most know how to forage for food and get out into the water but some struggle and get stuck on the beaches. poor little guys. it is 5:37 right now. and remember back in the day what happened in vegas stays in vegas. >> it doesn't anymore? >> no, why hundreds of thousands of your tax dollars paid for a resort get away just ahead. plus, secret service scandal. why prostitutes may have had access to the president's top secret travel plans.

welcome back, everybody. we give you an illuminated look at san francisco. that is spectacular. it does feel like it's something out of one of those super hero movies. and it's going to be super hero-like weather all week long. christina loren will tell you about temperatures in the 80s and 90s. get out the suntan lotion, it is 5:40. well, this morning, congress is turning up the heat. in its investigation into a federal agency that threw a las vegas party on the taxpayer's dime. today lawmakers will learn more from the fired executive of the general services administration. the gsa. that executive says the gsa sent him a letter demanding reimbursement of almost $2,000 to pay for a party in his hotel room. congress is investigating if there was a reason to hold the 2010 conference which cost taxpayers $823,000. investigators are also looking into charges of bribery and kick backs. wasteful spending at the general services administration,

a government watch group is releasing its annual pork barrel spending book. live on capitol hill this morning with who is spending funds on unique and frequently very expensive home state projects. good morning, tracie. >> good morning. and the last pig book, citizens against government waste reported there were over 9,000 projects costing taxpayers $16.5 million. now they've got the new numbers coming out later this morning. the 2012 numbers. we didn't get a pig book last year because it's so convoluted the spending bills continuously put off, but from the 2010 book, we learned that california ranked number 40 out of 50. not too far up there when it comes to per capita spending on these pork projects. 728 of them totaling $635 million for california alone. now, this year we'll get a fresh look at that spending.

they will also give out their oinker awards. like millions spent on projects and research that really only benefit a few people or a small area. john? >> tracie potts, thank you very much. 5:42. we do have new details this morning as we bring you more fallout from the secret service prostitution scandal and colombia. it now appears there may have been just as many members of the military involved as secret service agents. for now, top security clearance has been taken away from those 11 secret service agents accused of hiring prostitutes while preparing for the president's trip to colombia last week. now we're learning that five but perhaps more than ten members of the navy, the army, and the marines may have been involved. >> anybody watched a spy movie knows, you know, you go in with the girls, you plant the bugs, you compromise the agent. what were these guys thinking?

>> we're embarrassed by what occurred in colombia. and we let the boss down because nobody's talking about what went on in colombia other than this incident. >> sources indicate there were two secret service supervisors, three snipers, and three members assigned to protect the president's motorcade who all had his minute-by-minute schedule. several congressional committees may hold hearings to investigate. most of australia's forces in afghanistan could be heading home very soon. australian prime minister gallard expects to pull most of her troops out by 2013. contributing to her decision to accelerate this withdrawal. she says australia's soldiers have nearly completed their mission to transfer responsibility of security to afghan forces. >> what would be the purpose? this is a war with an end. we have a strategy, a mission, and a time frame for achieving

it. we are serving a national interest in afghanistan. >> there are more than 1,500 australian troops in afghanistan. that is the largest force provided by any country outside of nato. happening now in norway, an anti-muslim fanatic who admitted to killing 77 people is taking the stand in his terrorist trial. brevik will have five days to explain why he set off a bomb before gunning down dozens at a youth camp. he claims he acted in self-defense to keep muslims from taking over the country. the court will use his testimony to decide if the 33-year-old is mentally competent. well, the attorney representing the man accused of killing trayvon martin now asking the judge handling this case to step down. a circuit judge has a conflict of interest because her husband works with the attorney who is providing legal commentary on this case for cnn.

he represents george zimmerman who has pled not guilty for second-degree murder for shooting and killing an unarmed teenager. this morning, another strong quake in the south pacific. the u.s. geological survey says a magnitude 6.8 quake struck early this morning near the island of papau new guinea. no reports of any damage or injuries. earthquakes are common on the island, which is located on the ring of fire that stretches around the pacific rim. well, marla, late-night quake also rumbling down in south america overnight. the magnitude 6.7 quake striking central chile before midnight local time. the shaking was so strong, hundreds had to run from buildings in a state of panic. one man died of a heart attack during the quake but so far, there are no reports of any major damage there. authorities ordering evacuations along the coastline just as a

precaution. >> a great reminder that we here in the bay area have to be earthquake ready for when that big one hits. spring is in the air. christina loren. >> let's hope it never does. >> you can be happier with the peace of mind you do have that plan in place. >> thank you. >> so we really do encourage that. marla and i, john kelly, we are no strangers to earthquake. as you know, we have a nice-looking forecast. that's the reason we love california is because, yeah, we've got to deal with those earthquakes, but we get phenomenal weather conditions. and this week, one of those reasons why we love the state of california. you will be paid in sunshine and warmth. 54 degrees in concord, 54 in oakland. and comfortable 53 degrees in san francisco. we do have fog out there, slowly but surely developing. and right now your visibility looks pretty good everywhere right at the surface except for santa rosa where we do have deep pockets developing up there and that will be the case as we head through the next few hours. we'll keep watching your

visibilities. 63 degrees, though, by 1:00 p.m. in places like palo alto. it'll be a great day for outdoor activities. you'll get the most sunshine between about 10:00 and 2:00 today. so four hours of stellar conditions and more cloud cover as an area of low pressure brings in some more clouds. it's going to ride to our north. so high pressure still in control. we're still talking about the 70s for today. but the actual situation is we might see a stray shower arrive in the north bay later on today. rain cool there. we'll bring your temperature to about 65 degrees from the 70 i'm forecasting in santa rosa today. warming trend starts through wednesday. comfortable conditions in thursday, getting a little hot for some people around here, 85 degrees on friday. yeah, that means ac in your car, might want to get that kicking into high gear. let's check that drive, speaking of which, with mike. >> or get those windows down or something. get the air moving. looking over here, the cars are moving for the most part. but i'm watching right there.

westbound at the caldecott tunnel, in the center divide, no slowing shows up, there's 62, but we'll track that. meanwhile, a live look outside, showing how things are shaping up over south of there. northbound 880 past high street, the off ramp at high street is open from the northbound side, the southbound side, these folks, high street still closed for overnight roadwork. that'll continue until they tell me it's cleared. i'll let you know, but not a major problem. more congestion spots on the map. antioch down into the 20s and below where you see that red coming through the heart of antioch around a through l street. the south bay looks pretty nice. a smooth flow of traffic. northbound 101 shows a little bit of congestion starting right around 880. that'll build and look further north at the live shot from the golden gate bridge. a smooth drive out of the north bay or into the north bay. low clouds hovering around the deck, but you can still see across the bay. there may be thicker fog further north and things will change across the bay. back to you. >> thank you, mike. well, parents, children, and nurses will hold a march and

rally today to protest major service cuts at the hospital in hayward. they're fighting the planned closure of the in patient pediatrics unit at the hospital. the closure means families will have to drive to oakland, santa clara if their child needs to be hospitalized. the march and rally steps off at west tennyson road. also this morning, online bullying, the target of a new bill headed for the state senate making it easier for schools to punish students who harass others on social networking sites. it's already passed the state assembly. if it is, in fact, signed into law, schools could expel or suspend students for so-called burn pages, that attack students or fake online profiles that impersonate kids. we'll show you the

pretty good day and nice-looking week. here's a question, is apple's run over? shares in silicon valley's most important company have fallen 8% in the last week. business and tech reporter scott mcgrew joins us. that stock was on a tare. >> and it may be time for money to come off the table. profit taking. 4% fell yesterday alone. are there structural concerns? probably not. it's not as if anyone expects the iphone 5 to be a dud. ipod sales are declining and one of apple's best analyst says mac sales may be slowing but still sees apple as a $900 stock. now, apple has a big effect on the nasdaq and s&p 500. accounts for 12% of the nasdaq. you could have a fine trading day on lots of stocks, and if apple slumps, the nasdaq will too. this is a 9-year-old who makes a cardboard arcade in his dad's fix-it shop in east l.a.
